Good afternoon and welcome to our meeting for October 24, 2017. Regular meetings
are held on the second and fourth Tuesday at 3:00 p.m. Public hearings are held at
7:00 p.m. on the fourth Tuesday of each month. Deviations from this schedule will be
announced. The meetings are broadcast live on RVTV, Channel 3, and will be
rebroadcast on Thursday at 7:00 p.m. and on Saturday at 4:00 p.m. Board of

Recognition of Parks, Recreation and Tourism for receiving
the Virginia Municipal League 2017 Innovation Award for the
Explore Park Master Plan

This time has been set aside to recognize Roanoke County Parks, Recreation and
Tourism for receiving the Virginia Municipal League 2017 Innovation Award for the
Explore Park Master Plan.
BACKGROUND:
Roanoke County developed a master plan for Explore Park in 2015. The plan was
subsequently adopted by the Roanoke County Board of Supervisors in 2016.
Roanoke County submitted an award application for the Virginia Municipal League 2017
Innovation Award in recognition of the County's effort to develop a community based
plan that will foster economic growth. The Virginia Municipal League is a statewide,
nonprofit, nonpartisan association of city, town and county governments established in
1905 to improve and assist local governments through legislative advocacy, research,
education, and other services. The membership includes all 38 cities in the state, 160
towns and six counties.
DISCUSSION:
The Virginia Municipal League released the following information on October 11, 2017:

The Virginia Municipal League (VML) is pleased to announce Roanoke County is the
winner of its 2017 Innovation Award in Economic Development.
The panel of judges selected Roanoke County for its Explore Park Adventure Plan.
After significant community outreach, Roanoke County developed a master plan to spur
economic development through adventure- and recreation -based tourism on property it
acquired in 2013. In addition to a business plan and an environmental study, the plan
has maps, renderings, and conceptual placements of desired attractions. A phasing
report depicts a timeline for planning, design, and construction of amenities within the
park over the next 20 years. These efforts have already yielded positive returns for
Roanoke County with local and national businesses expressing interest in a request for
proposals to develop the property.
The annual statewide competition recognizes six projects that demonstrate problem -
solving, excellence in management, citizen participation, and service to citizens. VML
received nearly 70 entries for 2017. The awards were presented Monday, October 2nd
at the 2017 VML Annual Conference in Williamsburg.
FISCAL IMPACT:
There are no fiscal impacts for this issue.

ISSUE:
Resolution supporting an application for $1,082,240 of matched transportation funding
through the Virginia Department of Transportation (VDOT) Revenue Sharing Program.
BACKGROUND:
The VDOT Revenue Sharing Program annually provides Roanoke County the
opportunity to receive fifty percent (50%) State matching funds for construction and
improvements to primary and secondary roads in the State's highway system.
Beginning with this application cycle, the VDOT Revenue Sharing Program funding will
be allocated on a biennial basis. Applications in fall 2017 will be for fiscal years 2019
and 2020, with funding made available on July 1, 2018 and July 1, 2019, respectively.
The proposed allocation for the Commonwealth of Virginia is $100 million in both fiscal
years 2019 and 2020.
An application for Revenue Sharing program funding must be made by resolution of the
governing body. VDOT Revenue Sharing funding is anticipated to be allocated by the
Commonwealth Transportation Board, in June 2018, for fiscal year 2019 and fiscal year
2020.

DISCUSSION:
The attached Revenue Sharing project list includes two (2) project applications
requesting $1,082,240 in VDOT Revenue Sharing funds in fiscal years 2019 and 2020.
If the applications are approved, the County would be required to match state funding
with the same amount of local funding in both fiscal years.
The first project application is for Fallowater Lane Extension. The project is proposed to
construct an extension of Fallowater Lane, from Route 419 to Chevy Road. This
connection would provide appropriate access to future development anticipated for the
land designated as The Ridges in the draft 419 Town Center Plan. Project
administration phases would be accomplished by Roanoke County (Preliminary
Engineering + Construction) and VDOT (Right of Way).
The application requests a total of $502,240 in VDOT Revenue Sharing funds, split
evenly between fiscal years 2019 and 2020. If approved, the County has identified
previously appropriated economic development public-private partnership funds to
serve as the required project match.
The estimated cost of this project is $2,500,000. VDOT reallocated $1,495,521 in
Secondary Six -Year Plan Construction Formula funds to this project, following a
resolution approved by the Board of Supervisors on September 26, 2017. This figure is
lower than the preliminary estimate of $1,515,609 presented to the Board of
Supervisors due to final project close-out accounting associated with the reallocated
funds. The balance of the project is proposed to be funded from the requested Revenue
Sharing funds in the amount of $502,240, along with the same amount in County public
private partnership funds in fiscal years 2019 and 2020.
The second project application is for Starkey Road / Buck Mountain Road Intersection
Improvements. This project proposes to reconstruct a three way intersection into a
single lane roundabout at the intersection of Buck Mountain Road and Starkey Road.
VDOT would serve as the project administrator.
The application requests a total of $580,000 in VDOT Revenue Sharing funds, split
between fiscal year 2019 ($250,000) and fiscal year 2020 ($330,000). If approved, the
County has identified a previously appropriated rezoning proffer ($80,000) to support a
portion of the County match. The remaining County match ($500,000) required in fiscal
years 2019 and 2020 would be considered and prioritized as part of the development of
the next two Capital Improvement Programs. The total project cost is roughly estimated
at $3.2 million, with Regional Surface Transportation Program funding requested to
support the project at a later date.

This resolution authorizes the application for $1,082,240 in VDOT Revenue Sharing
funds. If both projects are approved at the requested amounts, the County would be
required to provide $1,082,240 in matching local funds in order to accept the VDOT
funding. The Board of Supervisors has previously approved appropriations totaling
$582,240 that are recommended to be applied to these two projects as detailed in the
"Discussion" section. The remaining funding ($500,000) would be considered and
prioritized as part of the development of the County's Capital Improvement Program.
STAFF RECOMMENDATION:
Staff recommends the Board of Supervisors adopt the resolution supporting an
application for $1,082,240 of matched transportation funding through the VDOT
Revenue Sharing Program for fiscal years 2019 and 2020.

RESOLUTION SUPPORTING AN APPLICATION FOR $1,082,240 OF
MATCHED TRANSPORTATION FUNDING THROUGH THE VIRGINIA
DEPARTMENT OF TRANSPORTATION FISCAL YEAR 2019 AND
FISCAL YEAR 2020 REVENUE SHARING PROGRAM
WHEREAS, the Board of Supervisors reviewed the projects identified in the
attached Roanoke County Revenue Sharing Program, Fiscal Year 2019 and Fiscal Year
2020 Project List, Designation of Funds; and
WHEREAS, the Board of Supervisors desires to submit an application for an
allocation of funds of up to $1,082,240 through the Virginia Department of
Transportation Fiscal Year 2019 and Fiscal Year 2020 Revenue Sharing Program; and
WHEREAS, $1,082,240 of these funds are requested to fund the projects
identified in the Roanoke County Revenue Sharing Program for fiscal year 2019 and
fiscal year 2020.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Board of Supervisors hereby supports this application for
allocation of $1,082,240 through the Virginia Department of Transportation
Fiscal Year 2019 and Fiscal Year 2020 Revenue Sharing Program.
2. If such funds are approved by the Commonwealth, the Board of
Supervisors will consider the required matching funding appropriation
during the fiscal year 2019 and fiscal year 2020 budget processes.

Resolution to petition the Federal Energy Regualtory Commission (FERC) for a formal
rehearing of their decision to certify the Mountain Valley Pipeline project.
BACKGROUND:
On October 13, 2017, the Federal Energy Regulatory Commission (FERC) formally
certified the Mountain Valley Pipeline project, subject to the terms and conditions
stipulated in their order.
DISCUSSION:
The certification of this project raises significant concerns for the adequate protection of
the environment of Roanoke County and the quality of life of Roanoke County citizens.
Staff finds that certain information germane to an appropriate and proper review of the
Mountain Valley Pipeline project has not been fully considered by FERC and as a
consequence, certification of the project is premature. This Resolution of the Board of
Supervisors seeks FERC's rehearing of the project certification and contends that
issues related to the mitigation of threats to local water resources, the preservation of
cultural assets, and the management of erosion and sediment impacts were not

sufficiently or appropriately addressed prior to certification.
Previously, Roanoke County sought and was granted federal status as an "Intervening
Party" in the FERC project certification process. Such status provides the County the
right to administratively seek redress of concerns related to the facts and or procedures
utilized by FERC in determining the certification eligibility of the Mountain Valley
Pipeline. Staff seeks Board approval to take the appropriate action to exercise the
County's right as an Intervening Party and seek a rehearing of the projects certification.
Additionally, to the extent participation of other jurisdictions and groups with similar
intervening party status bolster the effort to have critical and fundamental questions
answered and documented in the public record, staff seeks Board approval for their
inclusion in the County's rehearing petition.
FISCAL IMPACT:
The fiscal impact of this resolution cannot be precisely determined at this time and is
dependent on the documentation necessary for the legal filing of the rehearing petition
and any potential sharing of costs with other jurisdictions and groups who may wish to
jointly participate with Roanoke County in the petition. County funding for this effort will
be provided from existing budgetary appropriations.

Staff recommends approval of the attached resolution.

RESOLUTION DIRECTING THE COUNTY ADMINISTRATOR TO
UTILIZE ROANOKE COUNTY'S FEDERALLY GRANTED INTERVENOR
PARTY STATUS TO PETITION THE FEDERAL ENERGY
REGULATORY COMMISSION (FERC) FOR A FORMAL REHEARING
OF THEIR CERTIFICATION DECISION RELATED TO THE MOUNTAIN
VALLEY PIPELINE PROJECT
WHEREAS, on Friday, October 13, 2017, the Federal Energy Regulatory
Commission (FERC) issued a certification under Natural Gas Act section 7 for the
Mountain Valley Pipeline Project (MVP Project), subject to the terms and conditions
stipulated in the certification order; and
WHEREAS, FERC's issuance of a certificate for the MVP Project raises
significant concerns regarding the adequate protection of the environment of Roanoke
County and the quality of life of Roanoke County citizens, particularly those directly
impacted by the construction of the project; and
WHEREAS, the Roanoke County Board of Supervisors previously petitioned for
intervention and was granted "Party" status providing the County the right to
administratively seek redress of any concerns related to the facts and or process
utilized by the FERC in issuing a final decision on the MVP Project; and
WHEREAS, the Roanoke County Board of Supervisors finds that certain
information germane to an appropriate and proper review of the proposed MVP Project
has been dismissed, disregarded, or insufficiently evaluated by the FERC; the
consequence of which is the premature issuance of a certificate based on an
inadequate administrative record; and
WHEREAS, Roanoke County has repeatedly sought FERC's review and
discussion of plans for avoiding or mitigating likely impacts of the MVP Project on local
water resources, specifically those resources which provide potable water for a
significant number Roanoke County citizens; and
WHEREAS, Roanoke County has repeatedly sought FERC's review and
inventory of all historic and cultural assets impacted by the proposed MVP Project as
stipulated by Section 106 of the National Historic Preservation Act requiring
identification of such assets and defining the manner in which protection of those assets
shall be considered; and
WHEREAS, Roanoke County has repeatedly sought FERC's review and
discussion of plans to mitigate the potential erosion and sedimentation control impacts
from construction of the MVP Project on the County's natural waterways; and
WHEREAS, Roanoke County's concerns for water source protection, cultural
assets and impacts of erosion and sedimentation have not been adequately addressed
throughout the FERC process for consideration of the MVP Project; and
WHEREAS, the protection of Roanoke County citizens from the deleterious
impacts of the MVP Project cannot reasonably be expected absent a robust and
detailed review of those concerns noted; and
WHEREAS, such a robust and detailed review by FERC does not appear to be
forthcoming.
NOW THEREFORE IT BE RESOLVED, that the Roanoke County Board of
Supervisors does hereby direct the County Administrator, working in cooperation with
the County Attorney, to take the appropriate action necessary to exercise the County's
right as a party to the proceeding and to seek a rehearing by FERC of the certificate
issued for the MVP Project; and
BE IT FURTHER RESOLVED, that the County Administrator is directed to
additionally seek FERC endorsement of a stay of all actions related to the potential
future development of the MVP Project pending resolution of all outstanding petitions for
rehearing, the granting of all necessary federal and Commonwealth of Virginia permits
required for development and construction activity, and resolution of any judicial review
of those decisions; and
BE IT FURTHER RESOLVED, that the County Administrator may seek the
participation of other regionally affected jurisdictions and groups in this petition for
rehearing to the extent such parties have similar positions and interests and that such
participation bolsters the collective effort to have critical and fundamental questions
related to the MVP Project development answered and documented in the public
record; and
BE IT RESOLVED, that the County Administrator shall identify and utilize from
existing appropriations, those funds necessary to effectuate the actions described
above.

A Public Hearing and resolution of support from the Board of Supervisors is necessary
to submit a grant application for the Transportation Alternatives Set -Aside Program for
the Roanoke River Greenway crossing of the Blue Ridge Parkway along Highland
Road.
BACKGROUND:
The Roanoke River Greenway is a regional, 31 -mile bicycle and pedestrian trail
proposed through the Roanoke Valley, linking the Cities of Roanoke and Salem, the
Town of Vinton and Roanoke County. In 2007, the Roanoke Valley Greenway
Commission made the Roanoke River Greenway its number one priority in its update to
the Roanoke Valley Greenway Plan, which the local governments have all adopted into
their Comprehensive Plans. Greenways were strongly supported by Roanoke County
citizens during development of the Department of Parks, Recreation and Tourism
Comprehensive Master Plan for Parks completed in 2007. The residents of Roanoke
County identified greenways as a "high priority need" for facilities and amenities desired
in our community.
The Roanoke County Community Strategic Plan, adopted by the Board of Supervisors
in 2016, reaffirmed citizen desires for increased access to outdoor recreational

amenities. The proposed section of the Roanoke River Greenway is an implementation
strategy supported by citizens in the Explore Park Adventure Plan, adopted by the
Roanoke County Board of Supervisors in 2016, that provides the primary alternative
transportation link between Explore Park, the Blue Ridge Parkway and Virginia's Blue
Ridge. The proposed on -road alignment is supported in the Roanoke Valley/Blue Ridge
Parkway Trail Plan, approved in 2015 with a Finding of No Significant Impact (FONSI).
Roanoke County has secured funding for the design, right-of-way and construction of
the Roanoke River Greenway proposed between Roanoke City and the Blue Ridge
Parkway (UPC 91191). The approximate 2.5 -mile project has design plans (100%)
complete, environmental permitting is underway and right-of-way authorization is
expected in February 2018. Additionally, Roanoke County has secured Federal Lands
Access Program funding for the design, right-of-way and construction of the Roanoke
River Greenway proposed between the Blue Ridge Parkway and Explore Park (UPC
110155). The Roanoke Valley Resource Authority (RVRA) has agreed to provide
Roanoke County with permanent easements for the greenway across the former
Roanoke Regional Landfill and a trailhead at the corner of Highland Road and Rutrough
Road. Preliminary engineering for this project began in August 2017.
The proposed greenway will traverse federal land and follow along Highland Road
(Route 618), crossing underneath the Blue Ridge Parkway through an overpass owned
by VDOT. The proposed greenway will provide an 8-10 foot wide, paved shared use
path along the northern side of Highland Road between a proposed trailhead (UPC
91191) located west of the Blue Ridge Parkway on property owned by the Virginia
Recreational Facilities Authority (VRFA). The project will terminate at a proposed
trailhead east of the Blue Ridge Parkway (UPC 110155) on property owned by the
RVRA. Preliminary engineering and environmental reviews are already underway for
this project. Roanoke County is coordinating this greenway design with VDOT and the
Blue Ridge Parkway by evaluating two conceptual alignments along Highland Road. A
speed study is proposed on Highland Road in October 2017.
DISCUSSION:
Roanoke County Parks, Recreation and Tourism is requesting a resolution of support to
submit a grant application for an approximate 0.30 -mile section of the Roanoke River
Greenway proposed across the Blue Ridge Parkway along Highland Road on properties
owned by the National Park Service (NPS), the Virginia Department of Transportation
(VDOT), the Virginia Recreational Facilities Authority (VRFA), and the Roanoke Valley
Resource Authority (RVRA). Funding for the proposed project will complete a missing
link in the eastern section of the Roanoke River Greenway in Roanoke County that is
funded from Roanoke City to Explore Park.
The Transportation Alternatives Set -Aside Program provides eighty percent (80%)

Federal funding for a twenty percent (20%) percent local match for improvements to
non -motorized transportation that enhance the public's traveling experience, revitalize
communities and improve the quality of life. The program is administered through the
Virginia Department of Transportation (VDOT). The County's Parks, Recreation and
Tourism and Community Development Departments have reviewed this project and
both support the application for Transportation Alternatives Set -Aside Program grant
funding.
For the Transportation Alternatives Set -Aside Program Application to be eligible for
submission, the Roanoke County Board of Supervisors must hold a public hearing and
adopt a resolution supporting the project. The Roanoke Valley Transportation Planning
Organization is anticipated to endorse the project on October 26, 2017.
FISCAL IMPACT:
The total cost of the Roanoke River greenway crossing of the Blue Ridge Parkway
along Highland Road project is approximately $544,606 for preliminary engineering,
environmental permitting, right-of-way, and construction. Preliminary engineering and
environmental permitting for this project is underway and anticipated to be $53,000,
which is being funded through the Roanoke County Parks, Recreation and Tourism
Capital Maintenance Program.
The right-of-way and construction phases of this project are anticipated to be $491,606.
Roanoke County is requesting Transportation Alternatives Set -Aside Program funding
for this project in the amount of $366,606. Roanoke County Parks, Recreation and
Tourism is proposing to submit a Capital Improvement Program request in the amount
$125,000 to cover the local match required for this project. The County match for the
project will be considered as part of the development of the fiscal year 2019-2028
Capital Improvement Program that will be presented to the Board of Supervisors in
January 2018.
STAFF RECOMMENDATION:
Staff recommends approving the resolution of support for the fiscal year 2019/2020
Transportation Alternatives Set -Aside Program application for the Roanoke River
Greenway crossing of the Blue Ridge Parkway.

Greenway connection from Roanoke County property across National Park Service (NPS)
property and through the Highland Road tunnel into Explore Park. As stated in a 2013 letter
from Acting Blue Ridge Parkway Superintendent Monika Mayr to Ms. Webb: "The Blue Ridge
Parkway would support utilization of the Highland Road structure and crossing underneath the
motor road as the safest alternative at this location. Parkway management would like to continue
to work with you to help facilitate the greenway connection in that area..."
This project is a good example of how working collaboratively can produce mutually beneficial
solutions. In this case, greenway connections that will serve County residents and provide
Parkway visitors with a broader experience. The NPS staff appreciate the County's willingness
to work on a solution along Highland Road, underneath the historic Parkway motor road, that
protects the historic integrity of the Parkway while providing visitor access.
The NPS and Roanoke County have worked on greenway connections in this area for a number

RESOLUTION REQUESTING THE COMMONWEALTH
TRANSPORTATION BOARD FUND A TRANSPORTATION
ALTERNATIVES SET-ASIDE PROJECT FOR THE ROANOKE RIVER
GREENWAY CROSSING OF THE BLUE RIDGE PARKWAY IN
ROANOKE COUNTY, VIRGINIA
WHEREAS, in accordance with the Commonwealth Transportation Board
construction allocation procedures, it is necessary that a request by resolution be
received from the local government or state agency in order that the Virginia
Department of Transportation ("VDOT") establish a Transportation Alternatives Set -
Aside project to be administered by Roanoke County.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the Roanoke County Board of Supervisors requests that the
Commonwealth Transportation Board establish a project for the Roanoke River
Greenway crossing of the Blue Ridge Parkway along Highland Road.
2. That the Roanoke County Board of Supervisors hereby commits to
provide a minimum 20 percent (20%) matching contribution for this project and any
additional funds necessary to complete the project.
3. That the Roanoke County Board of Supervisors hereby agrees to enter
into a project administration agreement with VDOT and provide the necessary oversight
to ensure the project is developed in accordance with all state and federal requirements

for design, right of way acquisition, and construction of a federally funded transportation
project.
4. That the Roanoke County Board of Supervisors will be responsible for
maintenance and operating costs of any facility constructed with Transportation
Alternatives Set -Aside funds unless other arrangements have been made with VDOT.
5. That if the Roanoke County Board of Supervisors subsequently elects to
cancel this project, the Roanoke County Board of Supervisors hereby agrees to
reimburse VDOT for the total amount of costs expended by VDOT through the date
VDOT is notified of such cancellation. The Roanoke County Board of Supervisors also
agrees to repay any funds previously reimbursed that are later deemed ineligible for
such use by the Federal Highway Administration.
6. That the Roanoke County Board of Supervisors hereby grants authority for
the County Administrator, or his designee, to execute project agreements for any
approved Transportation Alternatives Set -Aside projects for fiscal year 2019 and fiscal
year 2020.

ISSUE:
Acceptance and appropriation of $234,316 in Revenue Sharing funds and authorization
for execution of project administration agreements for the Merriman Road Drainage
Project
BACKGROUND:
On October 14, 2014, the Roanoke County Board of Supervisors created the Merriman
Road Drainage Project, through application to the Virginia Department of Transportation
(VDOT) for Revenue Sharing funds. The initial cost estimate for the project was
$100,000. A copy of the fiscal year 2015-2016 Revenue Sharing program is attached
for reference.
The $100,000 original cost estimate was derived without the benefit of any survey or
completed design information. The original project scope envisioned modifying and
improving an existing open ditch drainage system.
Preliminary engineering in the fall of 2016 determined that modification to the existing
ditches would be inadequate to address drainage issues and alteration would likely
create a traffic safety hazard. A revised scope of work was developed which eliminated
the open ditch concept in favor of adding drainage pipe sections and associated
structures. As a result of this scope change, the estimated cost of construction

increased to approximately $325,000. Design plans are attached for reference.
In order to execute the project and accommodate the expanded project cost, County
and VDOT staff identified Revenue Sharing surplus funds from a completed project that
were available for transfer to the Merriman Road Drainage Project. Through an
administrative process VDOT allows some project fund transfers. The transfer permits
Roanoke County to retain and utilize unexpended State Revenue Sharing Funds
provided monies are moved to an existing, active County project.
DISCUSSION:
A fund transfer and appropriation of $234,316 is required to complete the Merriman
Road Drainage project. Unexpended funds from the Wildwood Road sight distance and
guardrail project serve as the source of additional appropriated funds.
The Wildwood Road project was constructed in 2015 without the guardrail portion of the
project being completed. Guardrail construction was eliminated from the project scope
due to the inability to acquire sufficient donation of right of way.
VDOT has authorized the transfer of funds from the Wildwood Road project to the
Merriman Road project and has amended all project administration agreements
accordingly. To finalize the Merriman Road project funding transfer, the Board of
Supervisors is requested to appropriate the noted additional funds to the Merriman
Road Drainage Project. The Board appropriation action is required since the Merriman
Road project is locally administered. The Board is also requested to authorize the
County Administrator to execute on behalf of the County the revised Merriman Road
project agreement with VDOT.
There have been no changes since the first reading on October 10, 2017.
FISCAL IMPACT:
There is no fiscal impact. No additional County funds will be required. Approval of this
action will appropriate reallocated funds provided by VDOT for construction of the
Merriman Road Drainage Project.

Enact an ordinance authorizing a public sanitary sewer easement at 6842 Walrond
Drive in the Hollins Magisterial District
BACKGROUND:
Tax parcels 027.10-02-06.00 (Yates Estate) and 027.10-02-07.00 (Creasy Estate)
border Walrond Park. Both of these parcels have had septic tank problems over the last
thirty-six (36) months. The Virginia Department of Health has ruled that tax parcel
027.10-02-06.00 needs to connect to public sewer and is not allowing any additional
repairs to the septic system on this parcel.
DISCUSSION:
The Western Virginia Water Authority (WVWA) has requested a public sanitary sewer
easement to connect to the eight (8) inch public sanitary sewer gravity line that runs
through Walrond Park. Staff from WVWA and Roanoke County reviewed connection
options for both parcels. The only two (2) options for sewer connections available were
either at Walrond Park or on Deer Branch Road. Due to both parcels being at a lower
elevation than the Deer Branch sewer line, the best option was to connect into Walrond
Park.

The sewer line extension will require a twenty (20) feet easement across Walrond Park.
The easement will traverse an open field and will not impact on Walrond Park or any of
the recreational amenities in the park.
The easement will allow tax parcel 027.10-02-06.00 to connect immediately to public
sewer and tax parcel 027.10-02-07.00 to connect in the future.
There have been no changes since the first reading on October 10, 2017.

There is no fiscal impact for the easement.

THIS EASEMENT AGREEMENT, made this day of
2017, by and between BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA a
political subdivision of the Commonwealth of Virginia (whether one or more, the "Grantor"); and
the WESTERN VIRGINIA WATER AUTHORITY, a water and sewer authority created
pursuant to Chapter 51 of Title 15.2 of the Code of Virginia (1950), as amended ("Grantee").
WITNESSETH:
That for and in consideration of the sum of One Dollar ($1.00), paid in hand at and with
the execution and delivery of this Easement Agreement, and other good and valuable
consideration, the receipt, adequacy and sufficiency of which is hereby acknowledged, the Grantor
does hereby GRANT and CONVEY with General Warranty and Modern English Covenants of
Title unto the Grantee, its successors and assigns, the following described easements, to -wit:
A new twenty foot (20') RIGHT and EASEMENT and a ten foot (10') temporary
construction easement, to construct, install, improve, operate, inspect, use,
maintain, repair or replace a sewer line or lines and communication infrastructure
including but not limited to fiber optics cable together with related improvements
including slope(s), if applicable (collectively, the "easement"), together with the
right of ingress and egress thereto from a public road, upon, over, under, and across
those tracts or parcels of land belonging to the Grantor, acquired by deed dated
January 15, 1975, and recorded in the Clerk's Office for Circuit Court of the City
of Roanoke, Virginia, as Deed Book 1011, Page Number 743, and designated on
the Land Records as Tax Map No. 027.10-02-19.00-0000 (the "Property"). The
location of said easement is generally described on the exhibit attached hereto as
"Exhibit A" and by this reference made a part hereof,] and more particularly
described as being centered over the constructed sewer line or lines.
The Grantee agrees to restore and repair any actual damage to Grantor's property which
may be directly caused by the construction, reconstruction, or maintenance of said project except as
hereinafter provided. The Grantor agrees that the Grantee will not be expected to restore the
Property to the identical original condition, but rather as near thereto as is practicable to the
condition at the time the easement was granted, and that the Grantor will cooperate with the
Grantee in effectuating such restoration.
It is expressly agreed between the parties hereto that the Grantee and its agents shall have
the right to inspect the easement herein granted and to cut, clear, and remove all undergrowth,
obstructions, or improvements lying within, upon, or adjacent to said easement, that in any way
endangers or interferes with the proper use of the same. The Grantor covenants that no building or
structure shall be erected upon or within the easement herein granted or placed in such location as
to render said easement inaccessible. In the event that this covenant is violated, the Grantee shall
not be obligated to repair, replace, or otherwise be responsible for such improvements if damaged
or removed.

ORDINANCE AUTHORIZING THE GRANTING OF A PUBLIC SANITARY

AUTHORITY ON PROPERTY OWNED BY THE ROANOKE COUNTY
BOARD OF SUPERVISORS LOCATED AT 6842 WALROND DRIVE (TAX
MAP NO. 027.10-02-19.00-0000), HOLLINS MAGISTERIAL DISTRICT
WHEREAS, the County operates Walrond Park located at 6842 Walrond Drive, in
the Hollins Magisterial District, as a regional public park; and
WHEREAS, the parcel identified as Roanoke County Tax Map No. 027.10-02-
19.00-0000 is located within Walrond Park; and
WHEREAS, The Western Virginia Water Authority has requested a twenty (20)
foot wide underground public sanitary sewer easement, across the parcel identified as
Tax Map No. 027.10-02-19.00-0000, equating to three thousand seven hundred nineteen
(3,719) square feet, for the purpose of providing public sewer services to two (2)
residences adjacent to Walrond Park (identified as tax parcels 027.10-02-06.00 and
027.10-02.07.00); and
WHEREAS, The Western Virginia Water Authority has also requested an
additional ten (10) foot temporary construction easement to install the sewer line; and
WHEREAS, the two (2) identified residences have failing septic systems and the
best option (due to the topography of the parcels) for sewer service would be to access
sewer services by a sewer line through Walrond Park; and
WHEREAS, the proposed public sanitary sewer easement has no negative effects
on Walrond Park or park amenities; and
WHEREAS, the Western Virginia Water Authority will compensate Roanoke

County $1.00 for the public sanitary sewer easement; and
WHEREAS, pursuant to the provisions of Section 18.04 of the Roanoke County
Charter, the disposition of interests in real estate can be authorized only by ordinance. A
first reading of this ordinance was held on October 10, 2017, and a second reading was
held on October 24, 2017.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:
1. That the granting of a twenty (20) foot wide underground public sanitary
sewer easement, across the parcel identified as Tax Map No. 027.10-02-19.00-0000,
equating to three thousand seven hundred nineteen (3,719) square feet, for the purpose
of providing public sewer services to two residences adjacent to Walrond Park, in the
Hollins Magisterial District, is hereby authorized and approved.
2. That the granting of an additional ten (10) foot construction easement
across the parcel identified as Tax Map No. 027.10-02-19.00-0000 is further authorized
and approved.
3. That the County Administrator, or any Assistant County Administrator, is
hereby authorized to execute such documents and take such actions as may be

ISSUE:
Request to accept and allocate funds in the amount of $19,395 to the Clerk of the
Circuit Court from the Commonwealth of Virginia
BACKGROUND:
Technology Trust Funds representing fees collected by the Roanoke County Circuit
Court Clerk's Office, have been received from the State in the amount of $19,395. In
accordance with State of Virginia Code Section 17.1-279 stated the Circuit Court Clerks
Office shall assess a $5.00 fee called Technology Trust Fund Fee. Each month, the
Clerk's Office can request the fees that were assessed the previous month. The code
section further states that four of every five dollar fee shall be allocated by the
Compensation Board from the trust fund for the purposes of obtaining and updating
office automation and information technology equipment including software and
conversion services; preserving, maintaining and enhancing court records, including but
not limited to the costs of repairs, maintenance, land records, consulting services,
service contracts, redaction of social security numbers from land records and system
replacement or upgrades and improving public access to court records.
DISCUSSION:
The funds received from the Commonwealth of Virginia have been earmarked for
maintenance needs for the Clerk of Circuit Court, specifically towards the twice yearly

maintenance bill from the Supreme Court for maintaining their records, equipment, etc.
FISCAL IMPACT:
All funds are provided by the Commonwealth of Virginia. No County matching funds are
required.
STAFF RECOMMENDATION:
Staff recommends accepting and allocating $19,395 to the Clerk of Circuit Court from
the Commonwealth of Virginia.

Resolution approving the donation of a Fire and Rescue

ISSUE:
Roanoke County Fire and Rescue proposes to donate an older, surplus ambulance to
Craig County, with whom the County has a mutual aid agreement.
BACKGROUND:
Roanoke County Fire and Rescue has several ambulances on order to replace current
older units. Once the new vehicles are delivered, the department will evaluate which of
the units being replaced is in the best condition to donate. In the past, these surplus
units have been sold on the County's Public Surplus site for an average of $8,500.
Roanoke County has a mutual aid agreement with Craig County and frequently
responds to their requests for assistance. By receiving an ambulance from Roanoke
County, Craig County's paid units will be better enabled to provide patient care,
particularly at times when Craig County's volunteer responders are unable to respond.
Further, inasmuch as the County is frequently called upon to assist with patient care in
Craig County, the donation of an ambulance will reduce the number of instances that
Roanoke County assistance is requested; County units will thus be more available to
assist the citizens of Roanoke County.
FISCAL IMPACT:
The estimated value of the ambulance is approximately $8,500.

I am requesting on behalf of the Craig County Board of Supervisors if Roanoke County Fire and
Rescue Department would consider donating a surplus ambulance to Craig County.
Currently the County has two ambulances serving the Craig County Emergency Services
Department. One is a Roanoke County donated 2002 ambulance which was used to start the new
County Department several years ago. This ambulance is now used as a spare ambulance and is in
poor condition.
The second ambulance is a new ambulance purchased via receipt of a state ambulance grant with a
75%-25% state/local match.
The County respectfully asks if you would consider recommending to the Roanoke County
Administrator and Roanoke County Board of Supervisors the donation of a surplus ambulance during
this year. Your donation of an ambulance to be used as a spare/backup to the frontline service
ambulance would be greatly appreciated.

is frequently called upon for assistance with patient care; and
WHEREAS, Craig County is in need of an ambulance and would willingly accept
the donation of a surplus ambulance from Roanoke County in "as is" condition; and
WHEREAS, Section 15.2-953(C) of the Code of Virginia provides that a locality
may make gifts and donations of personal property to another governmental entity within
the Commonwealth; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke

and settle a workers compensation case

The County Attorney's office has requested authorization to negotiate and reach a
settlement of a workers' compensation case. The Virginia Workers' Compensation
Commission has final jurisdiction to approve the settlement.
BACKGROUND:
This matter arises out of a 2015 compensable injury. The employee is unable to return
to pre -injury work status.
DISCUSSION:
This matter may be resolved through negotiation and settlement with the employee's
counsel. The requisite settlement documents will be submitted to the Virginia Workers'
Compensation Commission for legally -mandated final approval. Under the Code of
Virginia, records of the Workers' Compensation Commission are exempt from the
Freedom of Information Act.
FISCAL IMPACT:
Under the Virginia Workers' Compensation Act, an employer may responsible for five
hundred weeks of wage indemnity benefits and all related medical expenses for
compensable workplace injuries. A negotiated settlement of this matter is financially

advantageous for all parties and negates future expense to the County that would
otherwise be required during the remaining statutory period for which the County is
obligated.
STAFF RECOMMENDATION:
Staff recommends that the Board authorize the County Attorney to proceed with
negotiation and settlement of this matter.

Provide the Board of Supervisors an overview of County staff recommended
amendments to existing or implementation of new fees and charges for service in the
Community Development and Police Departments.
BACKGROUND:
The Board of Supervisors authorizes County staff to collect fees and charges for service
for various County services provided to the public. County staff reviews those fees and
on occasion will recommend amendments to or implementation of new fees and
charges. Amendments or new fees and charges can be based on cost recovery for the
County service provided, analysis of fee structures of comparative jurisdictions, or the
opportunity to provide enhanced services to the public. Community Development and
Police Department staff have recommendations for changes to existing or
implementation of new fees and charges for consideration by the Board of Supervisors.
DISCUSSION:
County staff will review the attached PowerPoint presentation at the work session.
Additionally, Attachment A provides details on all current County Community
Development fees and charges for service. The attachment highlights potential
amendments to existing fees and charges and potential new fees and charges for

consideration by the Board of Supervisors.
FISCAL IMPACT:
There is no fiscal impact associated with the receipt of the attached presentation. Any
decisions regarding County fees and charges would be taken up as part of future
ordinances presented to the Board of Supervisors for consideration.

Staff recommends the Board of Supervisors receive information regarding County fees
and charges for service.
