Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order a moment of silence was observed. The Pledge of Allegiance was recited by all present. Jacks, Chief Deputy Clerk to the Board IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Supervisor North asked to switch the order of the work session to review with the Board of Supervisors the Roanoke County Facilities Assessment with the work session to review with the Board of Supervisors fiscal year 2019-2020 projected General Government Fund operating budget revenues and review the County of Roanoke Fee Compendium. There were no objections. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS February 12, 2019 38 1. Resolution expressing the appreciation of the Board of Supervisors of Roanoke County to Barry W. Beckner, Fire Lieutenant, upon his retirement after more than twenty-nine (29) years of service (Stephen G. Simon, Chief of Fire and Rescue) The Clerk read the resolution. There was no discussion. RESOLUTION 021219-1 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO BARRY W. BECKNER, FIRE LIEUTENANT, UPON HIS RETIREMENT AFTER MORE THAN TWENTY-NINE (29) YEARS OF SERVICE WHEREAS, Lieutenant Beckner was employed by Roanoke County on September 28, 1989; and WHEREAS, Lieutenant Beckner retired on February 1, 2019, after twenty-nine (29) years and four (4) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, during Lieutenant Beckner tenure he has served as a Firefighter/EMT and Fire Lieutenant and has served with professionalism and dedication in providing services to the citizens of Roanoke County; and WHEREAS, Lieutenant Beckner always provided the outmost compassion when caring for any patient and would ease the patient’s pain with his outgoing personality; and WHEREAS, Lieutenant Beckner served as an Acting Fire Captain providing exceptional leadership to the men and women that he supervised while making competent decisions during emergency calls. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Lieutenant BARRY W. BECKNER for more than twenty-nine (29) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. Resolution expressing the appreciation of the Board of Supervisors of Roanoke County to William “Billy” E. Driver, Director of Real Estate Valuation, upon his retirement after more than thirty-four (34) years of service (Rebecca E. Owens, Assistant County Administrator) Mr. O’Donnell, County Administrator provided the overview of Mr. Driver’s tenure with Roanoke County. The Clerk read the proclamation. There was no discussion. RESOLUTION 021219-2 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO WILLIAM “BILLY” E. DRIVER, DIRECTOR OF REAL ESTATE VALUATION, UPON HIS RETIREMENT AFTER MORE THAN THIRTY-FOUR (34) YEARS OF SERVICE WHEREAS, Mr. Driver was employed by Roanoke County on June 25, 1984; and WHEREAS, Mr. Driver retired on February 1, 2019, after thirty-four (34) years and seven (7) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, during Mr. Driver’s tenure he has served as an Appraiser, a Senior Appraiser and Director of Real Estate Valuation and has served with professionalism and dedication in providing services to the citizens of Roanoke County; WHEREAS, Mr. Driver was hired as an appraiser when the Real Estate Department was in its infancy, then was promoted to director December 23, 2000; and WHEREAS, during the time Mr. Driver has been director of the department, he has maintained an excellent Coefficient of Dispersion (COD), which is a measurement the State of Virginia uses to ensure uniformity of the County of Roanoke’s assessments; and WHEREAS, Mr. Driver has guided the department through multiple software upgrades and changes without interruption to the annual assessment process; and WHEREAS, Mr. Driver, along with the entire Real Estate Valuation department, were instrumental in the recovery from the flood of 1985 by coordinating damage assessments between the Fire and Rescue department and Community Development; and WHEREAS, Mr. Driver is a member of the International Association or Assessing Officers (IAAO) and Virginia Association of Assessing Officers (VAAO). As a member of the VAAO he has held many posts including the presidency within the organization; and WHEREAS, Mr. Driver has been a team player and relayed that philosophy to his employees. During his time as director, Mr. Driver has taken part in numerous committees and events that has been beneficial to his department and to Roanoke County; and February 12, 2019 40 WHEREAS, Mr. Driver has promoted education within his department, not only by providing continuing education classes to current appraisers, he also encourages newer employees to gain the required education to obtain their license; and WHEREAS, Mr. Driver has been instrumental in improving procedures and programs that have proven beneficial to the department. Working with the GIS Department, he was vital in acquiring the GIS Secure Data and Pictometry sites. Both of these programs have improved the efficiency of the Real Estate Valuation department. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to WILLIAM E. DRIVER for more than thirty-four (34) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. Briefing by the Roanoke Regional Partnership (Beth Doughty, Executive Director of the Roanoke Regional Partnership) Briefing was given. IN RE: SECOND READING OF ORDINANCES 1. Ordinance accepting and appropriating funds in the amount of $1,752,213, granting signatory authority to the County Administrator or his designee to execute a project administration agreement with the Virginia Department of Transportation and extending Contract 2013-087 for engineering, design, right of way and construction management services for the Plantation Road Bicycle, Pedestrian and Streetscape Improvement Project, Phase II in an amount not to exceed $444,797.31 (David Henderson, County Engineer; Megan Cronise, Principal Planner) Mr. Henderson advised there have been no changes since the first reading on January 22, 2019. There was no discussion. February 12, 2019 41 ORDINANCE 021219-3 ACCEPTING AND APPROPRIATING FUNDS IN THE AMOUNT OF $1,752,213, GRANTING SIGNATORY AUTHORITY TO THE COUNTY ADMINISTRATOR OR HIS DESIGNEE TO EXECUTE A PROJECT ADMINISTRATION AGREEMENT WITH THE VIRGINIA DEPARTMENT OF TRANSPORTATION, AND EXTENDING CONTRACT 2013-087 FOR ENGINEERING, DESIGN, RIGHT OF WAY AND CONSTRUCTION MANAGEMENT SERVICES FOR THE PLANTATION ROAD BICYCLE, PEDESTRIAN AND STREETSCAPE IMPROVEMENT PROJECT, PHASE II IN AN AMOUNT NOT TO EXCEED $444,797.31 WHEREAS, Phase I of the Plantation Road Bicycle, Pedestrian and Streetscape Improvement Project was completed in the fall of 2018; and WHEREAS, during design of Phase I, the design firm, Whitman, Requardt and Associates (WRA) developed engineering plans to 90 percent completion for additional features that were not included in Phase I, and which are now included in Phase II; and WHEREAS, the County was awarded SMART SCALE grant funds in the amount of $1,752,213 for design and construction of Phase II; and WHEREAS, the project is locally administered, and certain agreements between the County of Roanoke and the Virginia Department of Transportation (VDOT) must be executed for this cooperative work to be accomplished; and WHEREAS, VDOT requires the local governing body to grant signatory authority to execute such agreements; and WHEREAS, the County desires to extend Contract 2013-087 with WRA to complete engineering design and provide right of way and construction services; and WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be appropriated by ordinance; and WHEREAS, the first reading of this ordinance was held on January 22, 2019, and the second reading was held on February 12, 2019. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia as follows: 1. That the sum of $1,752,213 is accepted and appropriated from the SMART SCALE program for the purpose of completing the Plantation Road Bicycle, Pedestrian and Streetscape Improvement Project, Phase II. 2. That the Board of Supervisors does hereby grant signatory authority to the County Administrator or his designee to execute a project administration agreement with VDOT for the Plantation Road Bicycle, Pedestrian and Streetscape Improvement Project, Phase II. 3. That the Board of Supervisors hereby authorizes the extension of the contract 2013-087 with WRA to complete engineering design and provide right of way February 12, 2019 42 and construction services for the Plantation Road Bicycle, Pedestrian and Streetscape Improvement Project, Phase II, in an amount not to exceed $444,797.31. 4. That this ordinance shall take effect upon its adoption. On motion of Supervisor Hooker to adopt the ordinance, seconded by Supervisor Radford and carried by the following roll call and recorded vote: AYES: Supervisors Assaid, Hooker, Radford, Peters, North NAYS: None IN RE: PUBLIC HEARING AND SECOND READING OF ORDINANCES 1. Ordinance enacting a new Section 13-14 of the Roanoke County Code, prohibiting the use of automobiles as sleeping quarters (Peter Lubeck, Senior Assistant County Attorney) Chairman North opened the public hearing with the following citizens to speak: Andy Williams of 8336 Strathmore in Bentley Park stated he has been a County resident all of his life. He was here about 15 years ago with his son who was 15 at the time and he addressed the Board about an issue with a road that needed improvement; which the County took care of with the Department of Motor Vehicles. His concern is as a property owner and neighbor and there are two of his neighbors here with him. We have a resident who is living her car 24/7 and we are not only concerned about her life, we are concerned about the neighborhood and the fact that her car is full so much that you cannot see out of the car and she lives in the car as he said 24/7 with a space heater during these cold nights. So, we have situation where we have someone whose life is in danger if that space heater caught fire, but we also have a neighborhood that we are very close to the woods, within 45 feet of where she sleeps in her car 24/7. We have a lot of concern, not only for her, but for our neighborhood. If that car would happen to catch fire and explode, we could have a major problem in the neighborhood, a fire hazard. This is the issue, and he would hope the ordinance would pass to prohibit sleeping in automobiles. ORDINANCE 021219-4 ENACTING SECTION 13-14 OF THE ROANOKE COUNTY CODE, PROHIBITING THE USE OF AUTOMOBILES AS SLEEPING QUARTERS WHEREAS, in the interest of public health, public safety, and the for the promotion of the general welfare, it is proposed that the Roanoke County Code be amended to prohibit the use of automobiles as sleeping quarters; and February 12, 2019 43 WHEREAS, the first reading of this ordinance was held on January 22, 2019, and the public hearing and second reading was held on February 12, 2019. NOW THEREFORE BE IT ORDAINED by the Roanoke County Board of Supervisors: 1. That Chapter 13, Article I of the Roanoke County Code be amended to enact a new Section 13-14 as follows: Sec. 13-14. – Automobiles as Sleeping Quarters. It shall be unlawful and a Class 4 misdemeanor for any person to use an automobile for sleeping quarters, in place of a residence, hotel or other similar accommodations, within the County. As used herein, “hotel” means any structure that is occupied or intended for occupancy by transients for dwelling, lodging or sleeping purposes. As used herein, “automobile” shall mean a vehicle that is powered by an internal combustion engine or motor and able to carry one or multiple people. It shall include all motor vehicles, excluding “recreational vehicle(s)” as defined in Section 30-28 of this Code. 2. That this ordinance shall be in full force and effect immediately. On motion of Supervisor North to adopt the ordinance, seconded by Supervisor Hooker and carried by the following roll call and recorded vote: AYES: Supervisors Assaid, Hooker, Radford, Peters, North NAYS: None 2. Ordinance authorizing the granting of a new public drainage easement to the Board of Supervisors of Roanoke County on property owned by Ms. Shirley Lee Manning, Tax Map No. 054.02- 04-20.00-0000, located at 4737 Little Bear Road, Catawba Magisterial District (Tarek Moneir, Acting Director of Development Services) Mr. Moneir advised no changes since the first reading that was held on January 22, 2019. He added that in response to a question from the last meeting, Ms. Manning has no issue with an additional easement for construction. Chairman North opened and closed the public hearing with no one to speak on this item. ORDINANCE 021219-5 AUTHORIZING THE GRANTING OF A NEW PUBLIC 20’ DRAINAGE EASEMENT TO THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, ON PROPERTY OWNED BY SHIRLEY L. MANNING (TAX MAP NO. 054.02-04- 20.00-0000), LOCATED AT 4737 LITTLE BEAR ROAD, FOR THE February 12, 2019 44 PURPOSE OF DRAINAGE IMPROVEMENTS, CATAWBA MAGISTERIAL DISTRICT WHEREAS, it appears that improvements to Glenvar High School have contributed to drainage problem on property belonging to Shirley Lee Manning (“Manning”), located at 4737 Little Bear Road (Tax Map No. 054.02-04-20.00-0000) in the Catawba Magisterial District; and WHEREAS, in order to assist Manning with correcting such drainage problems, the County has requested that Manning grant a new 20’ public drainage easement on her property; and WHEREAS, Manning has agreed to convey the new public drainage easement to the County; and WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition and conveyance of real estate interests be accomplished by ordinance; the first reading of this ordinance was held on January 22, 2019, and the second reading and public hearing was held on February 12, 2019. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the conveyance of a new public drainage easement by Manning to the Roanoke County Board of Supervisors, in the Catawba Magisterial District, located at 4737 Little Bear Road (Tax Map No. 054.02-04-20.00-0000), containing 8,424 square feet, and shown on the attached plat prepared by Frank B. Caldwell, dated December 11, 2018, is hereby authorized and approved. 2. That the County Administrator, or any Assistant County Administrators, either of whom may act, are authorized to execute, deliver and record the deeds, and any other documents on behalf of the County and to take all such further action as any of them may deem necessary or desirable in connection with this project. The form of the deed is hereby approved with such completions, omissions, insertions and changes as the County Administrator may approve, whose approval shall be evidenced conclusively by the execution and delivery thereof, all of which shall be approved as to form by the County Attorney. 3. That this ordinance shall be effective from and after the date of its adoption. On motion of Supervisor North to adopt the ordinance, seconded by Supervisor Peters and carried by the following roll call and recorded vote: AYES: Supervisors Assaid, Hooker, Radford, Peters, North NAYS: None IN RE: CONSENT AGENDA RESOLUTION 021219-6 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF February 12, 2019 45 SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM I- CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: That the certain section of the agenda of the Board of Supervisors for February 12, 2019, designated as Item I - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 2 inclusive, as follows: 1. Approval of minutes – October 23, 2018 2. Confirmation of appointments to the Building Code Board of Adjustments and Appeals/Fire Code Board (At-Large) On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor Hooker and carried by the following roll call and recorded vote: AYES: Supervisors Assaid, Hooker, Radford, Peters, North NAYS: None A-021219-6.a IN RE: CITIZENS’ COMMENTS AND COMMUNICATIONS Ms. Nancy Hans from the Prevention Council of Roanoke County stated on March 21, 2019, the Council will be 18 years old and one of the five (5) oldest coalitions in the State of Virginia. Over those 18 years, she is proud to say that the Council has directly brought $1.6 million into this County from a patchwork of federal grants and funding sources; benefitting the school system and community as a whole. Through long-standing local partnerships we have impacted the lives of an entire generation of students, parents, grandparents and families in Roanoke County. Today, she is asking for your support. Local support for our important local work. We have strong data-measured outcomes that has led to us for partnership opportunities with great institutions such as Virginia Tech University, Radford University and the Fralin Bio-Medical Research Institute, VTC. Our partnerships are strong because we realize many of the battles that our community faces are lost in isolation. It takes a team to attain victory. The Council’s mission is to foster the healthy development of Roanoke County youth and we are now impacting a second generation of young people. We identify risk factors that threaten our community and then intervene through education and collaborative partnerships before it is too late. It is only through this collaborative effort that we achieve opportunity and success. The opioid crisis landed in our backyard, in our valley, silently for 20 years before anyone recognized it. Sadly, we have lost and continue to lose a very significant part of a generation of young adults. The impact of this crisis of addiction is having on entire families is wide and deep. February 12, 2019 46 Prevention, education, reducing risk, shedding stigma and shame, strengthening families and increasing resources is key to how we will begin to not only turn our local statistics around, but more importantly help individuals and family’s access treatment and get well. The urgency of healing is now. It is our sincere hope to build upon the long-standing partnerships with Roanoke County. As you prepare this budgeting season, we ask that you consider a meaningful investment in our community through the Prevention Council. The increasing challenges of substance use are a threat to our community and we hold an unwavering commitment to support, educate and make a sustainably impact in Roanoke County. It is our firm belief that the investment in the health of our youth and the prevention of risk behaviors builds a sustainable, healthy community for generations to come. The packets that have been prepared for the Board have more details about what the Council has done over the past 18 years as well as why prevention and reducing risk is of utmost importance. The Council is always available to answer any questions. IN RE: REPORTS Supervisor Peters moved to receive and file the following reports. The motion was seconded by Supervisor Radford and carried by the following recorded vote: AYES: Supervisors Assaid, Hooker, Radford, Peters, North NAYS: None 1. Outstanding Debt Report IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Radford provided several pictures of the May 27, 2019 storm damage to Sugar Loaf Mountain Road. He just wanted to add to the commentary that was added in October. Supervisor North on our Transportation Planning Organization and SMARTSCALE, Roanoke County only passed the funding rating hurdle as far as projects for the VDOT SMARTSCALE Program for $1.6 million for sidewalks in the Hollins, Plantation Road, Williamson Road intersection towards Peters Creek Road on the North side, which is a good thing. Some other projects, one for Exits 140 and 141 on North and Southbound lanes on I81 were rated too low even though they had been vetted by the local Transportation Planning Organization with additional funding to improve scoring, but unfortunately that did not work. So, we are going to be using those funds for other projects. What is interesting is that two years ago, when SMARTSCALE considered these same projects, they got higher scores with no additional funding than February 12, 2019 47 they did this year, with additional funding. So, this tells him there is a problem with this part of the State, Central and Southwestern Virginia competing for SMARTSCALE projects and he has spoken to Delegate McNamara when in Richmond about possible legislation for next year to consider this summer to improve funding for this area of the State, especially our area with regards to SMARTSCALE projects. Unfortunately, since I81 funding this year is probably not going to incur until sometime next week after another study is done, it is sad we could not get one exit or two exits improved in our area. We also lobbied in Richmond for two County bills, one sponsored by Senator Suetterlein to help contain Children’s Services Costs and another sponsored by Delegate Head to exempt Roanoke County for after-school programs with mandated licensure and increased costs. This bill did pass the House that day 99-0, both bills are headed to the other legislative bodies for approvals. He did visit the Senate Subcommittee on Finance concerning I81 corridor improvement plans a couple of weeks ago and it was very enlightening as well. th At 4:00 p.m. Chairman North recessed to the 4 floor for work session and closed meeting. IN RE: WORK SESSIONS 1. Work session to review with the Board of Supervisors the Roanoke County Facilities Assessment (Rob Light, Director of General Services) Byron Dunlap, Cardno Principal, Project Manager explained their process. Supervisor Assaid inquired how many maintenance staff do we current have with Mr. Light responding seven Maintenance technicians and a Supervisor. Supervisor Assaid then asked if this gets approved would we need iPads for the technicians. Mr. Light responded in the negative stating the reason they don’t use iPads rights now is they do not function for everything staff needs. They will use laptops or phones. Supervisor Assaid then asked since this is Cloud based is there an annual fee with Mr. Light responding approximately $3,000, which has been budgeted in General Service. Supervisor Assaid then asked if there were any other fees that we did not know about to operate. Mr. Light responded in the negative. Supervisor Radford asked in going back to the Town of Christiansburg, do you do their stormwater facilities; with Mr. Dunlap responded they did not, but had discussed initially, and they indicated they have other means of tracking. Supervisor Radford asked if they saw the quantity of how many of those they had. Mr. Dunlap responded in the negative. February 12, 2019 48 Supervisor Radford then asked if they could do stormwater management, with Mr. Dunlap responding in the affirmative. Supervisor Radford then asked Tarek Moneir, Acting Director of Development Services, does Roanoke County own stormwater retention ponds with Mr. Moneir responding in the affirmative, stating over twenty-three (23) and the schools also own some. We do an annual assessment every year, but we cannot cover the private ponds. Supervisor North asked if their system allows an inflation factor as we move forward in time away from this year. Mr. Dunlap responded in the affirmative and can be adjusted. Supervisor North further stated he wanted to make sure he heard Mr. Dunlap correct. If it is a category 3, signifying that something is not needed right now, maybe downstream. The number that is in there is it the number three years down the road or is it today. Mr. Dunlap responded three years down the road and accounting for some inflation. Can the data be downloaded into Excel? So, once it is done and we do something with the data in Excel, is there any benefit or ability to take it back from Excel into the system to populate it. Mr. Dunlap responded that is one of the ways it could work, if you tracking a roof that needs repair and then you end up doing it in three years. This would be something you would track in the software so that when it is completed and that group gets updated to a new one so that when you regenerate the forecast in the future that is saying that it no longer needs to be done. Supervisor North stated he is being to see this is a pretty dynamic system. You don’t get a book; you get the software package; with Mr. Dunlap responding you get a book as well. Supervisor North then asked how many people will need to be trained initially. Mr. Light stated he thought there would be three or four (3 or 4) people. Supervisor Radford stated a couple of meetings ago, the Board was given a presentation about Citiworks and notice it had a capital asset management component. Did Mr. Light look at that one compared with Mr. Light responded in the affirmative, however, it does not give staff what they need. Do we have a subscription to RS Means with Mr. Light responding that the vendor does. It was the consensus of the Board to move forward and place this on the agenda at the next meeting for approval. The work session was held from 4:48 p.m. until 5:19 p.m. 2. Bever, Director of Management and Budget; Steve Elliott, Budget Manager) Mr. Bever, Ms. Gearheart and Mr. Elliott provided a PowerPoint presentation to the Board. There was no discussion. The work session was held from 4:16 p.m. until 4:47 p.m. February 12, 2019 49 3. There was no discussion. The work session was held from 5:21 p.m. until 5:40 p.m. IN RE: CLOSED MEETING At 3:39 p.m., Supervisor North moved to go into closed meeting following the work sessions pursuant to the Code of Virginia Section 2.2-3711 A.5. Discussion concerning prospective businesses or industries or the expansion of existing businesses or industries where no previous announcement has been made of the business’ or industries’ interest in locating or expanding its facilities in the community, namely to discuss contract negotiations with prospective vendors for Explore Park and Section 2.2-3711.A.19 Discussion of plans to protect public safety as it relates to terrorist activity or specific cybersecurity threats or vulnerabilities and briefings by staff members, legal counsel or law enforcement or emergency service officials concerning actions taken to respond to such matters or a related threat to public safety where discussion of reports or plans related to the security of any governmental facility, building or structure, or the safety of persons using such facility, building or structure, namely Roanoke County Schools The motion was seconded by Supervisor Peters and carried by the following recorded vote: AYES: Supervisors Assaid, Hooker, Radford, Peters, North NAYS: None The closed session was held from 5:50 p.m. until 8:17 p.m. IN RE: CERTIFICATION RESOLUTION At 8:18 p.m., Supervisor North moved to return to open session and adopt the certification resolution.
