IN RE: CALL TO ORDER Chairman McNamara called the meeting to order at 3:02 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Joseph McNamara, Vice-Chairman Richard C. Hyatt, Chief Financial Officer IN RE: OPENING CEREMONIES The invocation was given by Reverend Bill Booth, Vinton Baptist Church. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Mr. Mahoney added a closed meeting pursuant to Code of Virginia Section 2.2-3711 A (3) discussion regarding the disposition of the County’s interest in June 10, 2003 528 certain publicly held real estate, Well Lot, Block 31, Section 8, North Lakes. Mr. Hodge added Item I-7 to the consent agenda, request to accept Matisse Lane into the State Secondary System. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Introduction of Ms. Miki Sawada, intern from Japan who is participating in the International Internship Program – Professional Exchange Program. (Elmer Hodge, County Administrator) Mr. Hodge introduced Ms. Sawada and indicated that she will be working as an intern with Roanoke County for the next six months. He indicated that Ms. Sawada is a 1998 graduate of Chuo University in Tokyo where she received a B.A. in Law and has worked with international exchange programs. For the past five years, she has worked for a research institute in Tokyo. Ms. Sawada will be working with the Economic Development Department in further developing their website, and will also work with other area economic development organizations, the Roanoke Regional Alliance, and will visit with neighboring local governments. Ms. Sawada stated that it was nice meeting everyone, and she expressed her appreciation for the valuable opportunity that has been provided to her. She indicated that she enjoys living in Roanoke, and that this opportunity will provide her with valuable business and personal experiences. She stated that she will do her best to contribute to Roanoke County. June 10, 2003 529 The Board welcomed Ms. Sawada to Roanoke County, and Mr. Hodge presented Ms. Sawada with a Roanoke County lapel pin. 2. Resolution of congratulations to paramedic/firefighter William Chrimes for receiving the following national awards: Forestry Heroism Award and Firefighter Gold Medal R-061003-1 Chairman McNamara presented the resolution of congratulations to paramedic/firefighter Chrimes. Also present at the meeting were Rick Burch, Chief of Fire and Rescue; Captain Rodney Ferguson; Kenny Shelton, Roanoke City EMT/Firefighter; David Altizer, Paramedic/Firefighter; Lieutenant Eddie Chitwood and Captain Dennis Fisher. The Board members extended their congratulations to paramedic/firefighter Chrimes and thanked him for his service to the citizens of Roanoke County. Supervisor Flora moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None RESOLUTION 061003-1 OF CONGRATULATIONS TO WILLIAM R. CHRIMES, PARAMEDIC AND FIREFIGHTER FOR RECEIVING THE 2003 VETERANS OF FOREIGN WARS’ FIREFIGHTER GOLD MEDAL AWARD AND THE 2003 STIHL NATIONAL FORESTRY HEROISM AWARD June 10, 2003 530 WHEREAS, William R. Chrimes was employed by the Roanoke County Sheriff’s Office on March 22, 1999, as a paramedic and transferred to the Fire & Rescue Department as a firefighter and paramedic on January 2, 2001; and WHEREAS, Mr. Chrimes used vacation days during the 2002 summer to participate in a Virginia Department of Forestry program and was sent to Happy Camp, California to work with firefighters managing wildfires in Klamath National Forest; and WHEREAS, Mr. Chrimes demonstrated extraordinary courage when he helped to rescue two firefighters after their fire engine plunged more than 1,200 feet over an embankment; and WHEREAS, Mr. Chrimes is the recipient of two national awards honoring him for his brave, courageous and selfless actions while serving with the Virginia Forestry Department; and WHEREAS, on March 12, 2003, Mr. Chrimes was awarded the Veterans of Foreign War’s Firefighter Gold Medal Award for his heroic actions in saving the lives of the firefighters; and WHEREAS, on May 28, 2003, Mr. Chrimes was awarded the Stihl National Forestry Heroism Award, given each year to an individual who works with or devotes a significant portion of their time to the forestry industry and who exhibits acts of bravery and valor. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of WILLIAM Roanoke County, Virginia, does hereby extend its sincere congratulations to R. CHRIMES for receiving the Veterans of Foreign Wars’ Firefighter Gold Medal Award and the Stihl National Forestry Award; and FURTHER, the Board expresses their appreciation to Mr. Chrimes for his unselfish actions in assisting his fellow firefighters and for his outstanding service to the citizens of the County of Roanoke. On motion of Supervisor Flora to adopt the resolution, and carried by the following recorded vote: AYES Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None 3. Certificate of recognition to Betsy Graves, Hidden Valley Middle School, for receiving the Virginia PTA Reflections Award for Literature Chairman McNamara presented the certificate of recognition to Ms. Graves. Also present were Debbie and James Graves, parents; and Dr. B. J. Brewer, June 10, 2003 531 Principal. Ms. Graves read selected portions of her original story “Signs of Courage in Big Stone Gap, 1968" ©. IN RE: BRIEFINGS 1. Briefing by County Attorney on legislative trip to Washington, D.C. (Paul Mahoney, County Attorney) Mr. Mahoney reported that on June 3 he participated in a trip to Washington, DC for the purpose of representing Roanoke County as part of the Virginia West Coalition, a legislative coalition of area chambers of commerce, in attempting to have an impact on legislative matters at the federal and state levels. Mr. Mahoney recognized Joyce Waugh, Roanoke Regional Chamber of Commerce, for her instrumental role in building the Virginia West Coalition. Mr. Mahoney reported that a meeting was held with the Assistant to the Secretary of Transportation where the focus of discussions was on the re-authorization of the TEA-21 grant program, surface transportation (I-81), additional airport funding, and support for passenger rail service. Following this meeting, the group met with Congressman Virgil Goode, Congressman Bob Goodlatte, and Senator George Allen. He reported that in a meeting with the Assistant Secretary - Department of Labor, there was discussion regarding the re- authorization of the Workforce Investment Act (WIA). Mr. Mahoney expressed his appreciation to Lisa Link and Beth Doughty, Roanoke Regional Chamber of Commerce, for their efforts in organizing the trip. He stated that although no additional funding commitments were obtained, he felt it was June 10, 2003 532 important to be seen and heard by the legislators. IN RE: NEW BUSINESS 1. Request to approve memorandum of understanding and agreement between Roanoke County Schools and Parks, Recreation and Tourism to provide after school childcare programs in elementary schools. (Debbie Pitts, Assistant Director of Recreation) A-061003-2 Ms. Pitts stated that on February 25, 2003, members of the Parks, Recreation, & Tourism (PR&T) Department met with the Board in a work session to present an overview of the After School for Kids (ASK) Program operated by the department in Roanoke County elementary schools and to discuss the Roanoke County School Board’s invitation to accept proposals from qualified vendors to provide this service in the future. Ms. Pitts noted that the Recreation Division created and has operated the ASK program for 15 years and wished to continue providing the service. Staff submitted a proposal to the schools on March 14 and has been awarded the contract to provide the program at 8 elementary schools serving a total of 12 schools. The contract also allows for program expansion into the remaining schools with the exception of Fort Lewis, Bonsack, and Glenvar Elementary. These schools will host a pilot program offered by the Boys and Girls Clubs of America. Ms. Pitts indicated that the Memorandum of Understanding was included in the Board’s agenda packet as June 10, 2003 533 Attachment A and outlined the agreement between Roanoke County PR&T and Roanoke County schools. Ms. Pitts stated that PR&T is very pleased to have the opportunity to continue this partnership with the school system and to provide quality and affordable licensed childcare for Roanoke County families. She noted their long history of working together to provide facilities and services for citizens, and stated that the ASK program is just one aspect of that partnership. Mr. Pete Haislip, Director of PR&T, reviewed Attachment B outlining the support provided to the school system and highlighting the extent of the partnership. He indicated that the schools allow the County to utilize undeveloped property or property that they own and in return, they benefit through the maintenance of their fields by PR&T staff. He also noted that capital improvements to school-owned sites (through the 1992 bond program) totaled $462,521 and the PR&T matching grant program has funded 30 projects at school sites totaling $179,961 in grant funding. Supervisor Minnix expressed his appreciation to Mr. Haislip, Ms. Pitts, the PR&T staff, the School Board and their staff. He indicated that they have a long history of working together to the benefit of the schools and the County. Supervisor Church noted that when the work session was held several months ago with the School Board, there was some alarm. He indicated that it is beneficial to work with a local organization that can provide a service that is equal to or June 10, 2003 534 better than what can be obtained elsewhere. He noted that PR&T has a good program and he thanked the staff for their efforts. Supervisor Minnix moved to approve the staff recommendation, approval of the memorandum of understanding. The motion carried by the following recorded vote: AYES: Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None IN RE: FIRST READING OF ORDINANCES 1. First reading of an ordinance declaring three parcels of real estate to be surplus and donating same to Habitat for Humanity, namely property located at 5541 Stearnes Avenue, Cave Spring Magisterial District. (Gary Robertson, Utility Director) Mr. Robertson reported that staff had been asked to investigate the possibility of donating a surplus well lot to Habitat for Humanity. At the May 27, 2003 Board of Supervisors meeting, staff identified two potential surplus well lots that are suitable as buildable lots. It was recommended that the Stearnes Avenue well lot be presented to the Board of Supervisors for donation to Habitat for Humanity. Mr. Robertson stated that there has also been interest from County staff to assist in the construction of this home as a volunteer County project. Anne Marie Green, Director of General Services, has agreed to coordinate the project, if approved, and Geraldine Barber, Assistant Director of Finance, and Mr. Robertson have agreed to assist. June 10, 2003 535 Mr. Robertson stated that the Stearnes Avenue well lot consists of three small parcels that, when combined, will form a single parcel slightly less than 0.4 acres. The well lot is property that was acquired by Roanoke County when it assumed ownership of the Crescent Heights water system several years ago. The wells and concrete reservoir located on this property are no longer in use and are not considered suitable as a standby water supply for Roanoke County. The land value is presently assessed at $17,200. Mr. Robertson indicated that should the Board of Supervisors decide to approve the donation to Habitat for Humanity, a second reading and public hearing will be held on June 24, 2003. Prior to that meeting, staff will contact adjacent property owners to inform them of the plans for the property. Supervisor Minnix commented that he did not want the citizens in this area to be alarmed. He indicated that the home to be built on this lot will be comparable to the homes in the area, and that Roanoke County staff will be working on the construction of the home. Supervisor Minnix moved to approve the first reading and set the second reading and public hearing for June 24, 2003. First reading of an ordinance to authorize conveyance of a 0.118 acre parcel of land to the Commonwealth of Virginia in connection with improvements to Hardy Road for the Vinton Business Center, Vinton Magisterial District. (Paul Mahoney, County Attorney) Mr. Mahoney stated that in October 2002, numerous parcels of land were accepted as part of the Hardy Road widening project, in conjunction with the Town of Vinton, for improvements to the Vinton Business Center. He indicated that the initial plan of the County and the Town was to convey all the parcels at one time to the Virginia Department of Transportation (VDOT) for the road widening when the project commenced. The project has since been delayed due to funding difficulties at VDOT. In the interim, the attorney for the Clark’s, one of the property owners involved, has raised questions regarding possible title problems with respect to access from the Clark’s property to Hardy Road. Mr. Mahoney indicated that adoption of the proposed ordinance would convey the property to VDOT, thereby resolving the Clark’s access problem. There was no discussion on this matter. Supervisor Altizer moved to approve the first reading and set the second reading for June 24, 2003. The motion carried by the following recorded vote: AYES: Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None June 10, 2003 537 IN RE: SECOND READING OF ORDINANCES 1. Second reading of an ordinance authorizing the quitclaim and release of an existing 20 ft. waterline easement within the proposed right-of-way of Matisse Lane (Plat Book 19, Page 122), Cave Spring Magisterial District. (Arnold Covey, Director of Community Development) O-061003-3 Mr. Covey reported that there had been no change in this item since the first reading. There was no discussion on this matter. Supervisor Minnix moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None ORDINANCE 061003-3 AUTHORIZING QUIT-CLAIM AND RELEASE OF A 20’ WATER LINE EASEMENT CREATED ON PLAT OF SECTION NO. 5, THE GARDENS OF COTTON HILL, IN PLAT BOOK 19, PAGE 122, AND NOW WITHIN THE BOUNDARIES OF MATISSE LANE ADJACENT TO LOTS 1 AND 2, SECTION NO. 7, TULIPS IN THE GARDENS, PLAT BOOK 24, PAGE 169, IN THE CAVE SPRING MAGISTERIAL DISTRICT WHEREAS, in order for Matisse Lane to be accepted into the state secondary road system, the Virginia Department of Transportation (VDOT) requires that the right- of-way be free and clear of any third party rights or encumbrances; and, WHEREAS, VDOT requires quit-claim and release to the Commonwealth of 20' Virginia of all existing easements within the boundaries of Matisse Lane, namely a water line easement , shown and created as “20' W.L.E.” on ‘Plat of Subdivision for Strauss Construction Corporation Creating Hereon .5, SECTION NO THE GARDENS OF June 10, 2003 538 ,’dated August 21, 1996, and recorded in the Clerk’s Office of the Circuit COTTON HILL Court of Roanoke County, Virginia, in Plat Book 19, page 122; and, WHEREAS, Matisse Lane has since been extended for the development of Section No. 7, Tulips in the Gardens, Plat Book 24, page 169, and the subject water line easement now lies within the boundaries of Matisse Lane, adjacent to Lots 1 and 2 of Section No. 7; and, WHEREAS, it will serve the interests of the public to have the extension of Matisse Lane accepted into the state secondary road system and this release, subject to the issuance of a permit and other conditions, will not interfere with other public services and is acceptable to the affected Roanoke County departments. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Section 18.04 of the Roanoke County Charter, the acquisition and disposition of real estate can be authorized only by ordinance. A first reading of this ordinance was held on May 27, 2003, and the second reading was held on June 10, 2003; and, 2. That pursuant to the provisions of Section 16.01 of the Charter of Roanoke County, the interests in real estate to be released are hereby made available for other public uses by conveyance to the Commonwealth of Virginia for acceptance of Matisse Lane into the state secondary road system by the Virginia Department of Transportation (VDOT). 20' 3. That quit-claim and release to the Commonwealth of Virginia of the water line easement , shown and dedicated as “20' W.L.E.” on ‘Plat of Subdivision for Strauss Construction Corporation Creating Hereon .5, SECTION NO THE GARDENS OF ,’dated August 21, 1996, and recorded in the aforesaid Clerk’s Office in Plat COTTON HILL Book 19, page 122, within the boundaries of Matisse Lane and now lying adjacent to Lots 1 and 2, Section No. 7, Tulips in the Gardens, Plat Book 24, page 169, as shown on Exhibit A attached hereto, is hereby authorized subject to the following conditions: a. VDOT issuance of a permit for the water lines or pipes, and any related appurtenances or facilities. b. The facilities located within the 40-foot right-of-way for Matisse Lane, as shown on the above-referenced plats, may continue to occupy the street or highway in the existing condition and location. c. This release is for so long as the subject section of Matisse Lane is used as part of the public street or highway system. 4. That the subject easements are not vacated hereby and shall revert to the County in the event of abandonment of the street or highway. 5. That the County Administrator, or an Assistant County Administrator, is hereby authorized to execute such documents and take such further actions as may be necessary to accomplish this conveyance, all of which shall be on form approved by the County Attorney. June 10, 2003 539 6. That this ordinance shall be effective on and from the date of its adoption. On motion of Supervisor Minnix to adopt the ordinance, and carried by the following recorded vote: AYES Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None 2. Second reading of ordinance to increase the salaries of the members of the Board of Supervisors pursuant to Section 3.07 of the Roanoke County Charter and Section 15.2-1414.3 of the Code of Virginia. (Paul Mahoney, County Attorney) O-061003-4 Mr. Mahoney stated that there had been no change in this item since the first reading. Mr. Church requested verification of the amount of the salary increase. Mr. Mahoney reported that the increase totals $269.89 per year for each supervisor. Supervisor Minnix moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None ORDINANCE 061003-4 TO INCREASE THE SALARIES OF THE MEMBERS OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY PURSUANT TO SECTION 3.07 OF THE ROANOKE COUNTY CHARTER AND SECTION 15.2-1414.3 OF THE CODE OF VIRGINIA WHEREAS, Section 3.07 of the Charter of the County of Roanoke provides for the compensation of members of the Board of Supervisors and the procedure for increasing their salaries; and WHEREAS, Section 15.2-1414.3 of the 1950 Code of Virginia, as amended, establishes the annual salaries of members of boards of supervisors within certain June 10, 2003 540 population brackets; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has heretofore established the annual salaries of Board members at $13,494.50 by Ordinance 061102-5 and further has established the additional annual compensation for the chairman for the Board to be $1,800 and for the vice-chairman of the Board to be $1,200; and WHEREAS, this section provides that the maximum annual salaries therein provided may be adjusted in any year by an inflation factor not to exceed five (5%) percent; and WHEREAS, the first reading and public hearing on this ordinance was held on May 27, 2003; the second reading was held on June 10, 2003. NOW, THEREFORE, it is hereby ORDAINED by the Board of Supervisors of Roanoke County, Virginia, that the annual salaries of members of the Board of Supervisors of Roanoke County, Virginia, are hereby increased by an inflation factor of 2% pursuant to the provisions of Section 3.07 of the Roanoke County Charter and Section 15.2-1414.3 of the 1950 Code of Virginia, as amended. The new annual salaries shall be $13,764.39 for members of the Board. In addition, the chairman of the Board will receive an additional annual sum of $1,800 and the vice-chairman of the Board will receive an additional sum of $1,200. This ordinance shall take effect on July 1, 2003. On motion of Supervisor Minnix to adopt the ordinance, and carried by the following recorded vote: AYES Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None IN RE: APPOINTMENTS 1. Parks, Recreation and Tourism Advisory Commission (Appointed by District) Supervisor Flora nominated Deborah George, Hollins District, to serve an additional three-year term which will expire on June 30, 2006. Supervisor McNamara nominated Paul Bailey, Windsor Hills District, to serve an additional three-year term which will expire on June 30, 2006. 2. Roanoke Valley-Alleghany Regional Commission Supervisor McNamara nominated J. Lee Osborne to serve an additional June 10, 2003 541 three-year term which will expire on June 30, 2006. 3. Roanoke Valley Convention and Visitors Bureau Board of Directors It was the consensus of the Board to reappoint Elmer C. Hodge to an additional three-year term which will expire on June 30, 2006. IN RE: CONSENT AGENDA R-061003-5; R-061003-5.f Supervisor McNamara moved to adopt the consent resolution. The motion carried by the following recorded vote: AYES: Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None RESOLUTION 061003-5 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM I - CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the certain section of the agenda of the Board of Supervisors for June 10, 2003 designated as Item I - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 6, inclusive, as follows: 1. Approval of minutes – May 27, 2003 2. Confirmation of committee appointments to the Clean Valley Council, Library Board, and Parks, Recreation & Tourism Advisory Board 3. Request for appropriation of the 2003-2004 Roanoke Valley Regional School Fund 4. On motion of Supervisor McNamara to adopt the resolution, and carried by the following recorded vote: AYES Supervisors Flora, Church, Minnix, Altizer, McNamara NAYS: None RESOLUTION 061003-5.fREQUESTING ACCEPTANCE OF MATISSE LANE INTO THE VIRGINIA DEPARTMENT OF TRANSPORTATION SECONDARY SYSTEM WHEREAS, the street described on the attached Addition Form SR-5(A), fully incorporated herein by reference are shown on plats recorded in the Clerk’s Office of the Circuit Court of Roanoke County, and WHEREAS, the Resident Engineer for the Virginia Department of Transportation has advised this Board the streets meet the requirements established by the Subdivision Street Requirements of the Virginia Department of Transportation, WHEREAS, the County and the Virginia Department of Transportation have entered into an agreement on March 9, 1999 for comprehensive stormwater detention which applies to this request for addition, NOW, THEREFORE, BE IT RESOLVED, this Board requests the Virginia Department of Transportation to add the streets described on the attached Additions Form SR-5(A) to the secondary system of state highways, pursuant to §33.1-229, Code of Virginia, and the Department’s Subdivision Street Requirements, and BE IT FURTHER RESOLVED, this Board guarantees a clear and unrestricted right-of-way, as described, and any necessary easements for cuts, fills and drainage, and BE IT FURTHER RESOLVED, that a certified copy of this resolution be forwarded to the resident Engineer for the Virginia Department of Transportation. Update on the status of Phase 2 School capital request IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Flora: He congratulated the recent Roanoke County high school graduates. Supervisor Church: He stated that he has received a letter from Mr. Beamer regarding the Dantzler farm. He indicated that “enough is enough” and that he will be pushing for a resolution to this matter. He noted that he has visited the site, and he requested a meeting with Mr. Mahoney to determine what can be done regarding this situation. Supervisor McNamara: He stated that the County recently received an award from Perdue Pharma as part of a child intervention program to improve outcomes June 10, 2003 544 and steer children away from drug and underage alcohol abuse and usage. He indicated that he and Supervisor Flora attended the ceremony and accepted the Courage to Care award on behalf of the Board. The award was based on funding decisions made by the Board, as well as the decision to allow the Police Department to focus their time and efforts on addressing this problem. Supervisor McNamara stated that this award shows that Roanoke County cares about its youth. IN RE: CLOSED MEETING Supervisor McNamara moved to go into closed meeting following work sessions at 4:09 p.m. pursuant to Code of Virginia Section 2.2-3711 A (3) discussion regarding the disposition of the County’s interest in certain publicly held real estate, Well Lot, Block 31, Section 8, North Lakes. IN RE: SENIOR CITIZENS HALL OF FAME AWARDS AND RECEPTION Chairman McNamara presented the individual award to Ms. Alma Bailey for her volunteer service at Therapeutic Recreation Services of Roanoke County and Brandon Oaks Retirement Community. Ms. Bailey provides one-on-one support at Therapeutic Recreation Services to individuals with disabilities, and she is an active participant in the Brandon Oaks Retirement Community where she has served on the board of the Health Center Auxiliary. Two awards were presented for group projects that were completed at Camp Roanoke. The first award was presented by Chairman McNamara to Ted Susac, Jesse Williams, Bob Collins, Walt Woods, and Tony Clifford for their work on the log June 10, 2003 545 cabin project. The volunteers installed the interior walls, the floor, and the ceiling of the log cabin. In addition, they completed the electrical work and installed the decks, ramp, and steps. To date, the volunteers have donated 443 hours of service to this project. The second group award was presented to Ted Susac, Jesse Williams, Tony Clifford, Jack Russell, Bob Smith, John Kleven, and Greeley Wyatt for their work on the deck project. The deck was constructed outside the dining hall at Camp Roanoke and serves as a central gathering point at the camp. The architecture and quality of construction are outstanding, and the volunteers have contributed in excess of 750 hours to this project. Following the presentation of the awards, there was a reception honoring the recipients from 4:35 p.m. until 5:00 p.m. IN RE: WORK SESSIONS 1. Presentation from Northrop-Grumman for construction of a new public safety center under the Public Private Education Facilities Infrastructure Act of 2002 (PPEA). (Dan O’Donnell, Assistant County Administrator) The work session was held from 5:03 p.m. until 6:17 p.m. and was presented by Dan O’Donnell, Assistant County Administrator. Mr. O’Donnell advised that an unsolicited proposal has been received from Northrop-Grumman for construction of a new public safety center. He indicated that the current building has become a “maintenance challenge” and is problematic for June 10, 2003 546 the handling of E-911 systems due to inadequate electrical service, a worn out roof system, and generally poor building conditions. The PPEA process allows firms to submit unsolicited proposals to state and local agencies to construct, and possibly own, qualified governmental projects. Mr. O’Donnell stated that over the last several months, Northrop-Grumman has conducted a needs analysis and has prepared a Phase I unsolicited proposal. He noted that the Board has already approved the PPEA regulations necessary to allow the consideration of these proposals. The proposal is being presented to the Board at this time due to the fact that this is a significant project and the process is new. Staff plans to review the proposal in detail over the next two weeks and return it to the Board for further action. If the Board authorizes the proposal to move forward to the detailed design phase, advertisements will be placed to allow for submission of competitive bids. Mr. O’Donnell advised that the cost information for the proposal is proprietary in nature and will not be discussed publicly at the work session. Mr. Ron Miner, Southeast Region Business Development Manager for Northrop-Grumman, presented the Phase I proposal to the Board. The proposal consisted of three options: (1) Base package: includes a multi-story public safety communications center with technology and furnishings, information technology center, and an emergency operations center. The facility will contain multiple conference/briefing rooms, offices, kitchen/break rooms, and locker rooms. It will be a secure facility that is “hardened” and allows for multi-day backup. The facility will be self-sustaining for 72 hours. (2) Option One: includes the base package plus a multi- June 10, 2003 547 story police and fire administration building. The building is constructed to allow for expansion and will contain administrative offices, storage areas, and locker and break rooms. (3) Option Two: includes the base package, option one, and an upgrade to the radio infrastructure. It will provide a partial digitization of the radio system. The County is not able to switch to full digital signal until Roanoke City, who shares radio communications with the County, also switches to digital. This option would involve moving the microwave equipment at the Southview call center into a new shelter at the base of the tower. This would be connected by microwave to the new facility. Mr. Miner introduced the following individuals who will be participating in the project: Bruce Bower, Assistant Director for Public Safety and Transportation at Northrop-Grumman; John Thurston, DVA Architects; and Adam Joseph, J. P. Morgan Chase. Following discussion, there was a consensus of the Board to continue moving forward with this process. Staff is to review the proposal in detail and bring the matter back to the Board at the June 24 meeting for approval to continue. 2. Work session to discuss proposed amendments to Roanoke County Zoning Ordinance Section 30-93 Signs. (Janet Scheid, Chief Planner; David Holladay, Planner) The work session was held from 6:27 p.m. until 7:28 p.m. and was presented by Janet Scheid, Chief Planner, and David Holladay, Planner. Members of the Planning Commission present at the meeting included: Don Witt, Martha Hooker, June 10, 2003 548 Steve Azar, Al Thomason, and Todd Ross. Mr. Mahoney reported that at the May 27 meeting, the Board heard from Mr. Chip Dicks, counsel for the sign industry and Lamar Advertising. At that time, the Board requested a work session with the Planning Commission to discuss the goals of the sign ordinance and the process. Staff was also requested to work with representatives of the sign industry to address some of the issues that were discussed at the meeting. Mr. Mahoney indicated that he received suggested revisions to the sign ordinance from Mr. Dicks yesterday. He indicated that he has not had an opportunity to review these proposed revisions, nor has the Planning Commission received copies. Mr. Mahoney suggested that he work with Mr. Dicks during the coming week to discuss the proposed revisions based upon input received at tonight’s meeting from the Board and the Planning Commission. Mr. Hodge reported that there has been some question regarding Roanoke County staff not being objective in this matter. He indicated that this is not the case, and that he has been fully involved in this process with the Planning Commission. He assured the Board, Planning Commission, and representatives from the sign industry that this process has been objective and has involved a give and take between the parties. He requested that the Planning Commission brief the Board regarding the reasons why these revisions to the ordinance were undertaken. Don Witt stated that the goals of the Planning Commission are as follows: (1) Reduce the number of non-conforming billboards. (2) Maintain or reduce the June 10, 2003 549 number of billboards throughout the County. He indicated that there is no feasible way to buy back the billboards, and therefore they must be removed through attrition. Mr. Mahoney indicated that in drafting the ordinance, he structured the guidelines to assist in meeting the goals of the Planning Commission. Ms. Hooker reported that there has been a significant increase in the number of requests for billboard permits from out-of-town individuals wanting to set up billboards in Roanoke County. She indicated that this was a source of real concern for her. It was noted that there are 115 billboards in Roanoke County, of which approximately 70 are non-conforming. Mr. Covey, Director of Community Development, stated that conforming locations are in C-2, I-1 and I-2 zoning areas. Ms. Hooker indicated that in keeping with the visioning process and the community plan, agricultural areas are not appropriate for billboards in order to protect the scenic vistas of the area. Supervisor McNamara indicated that the Board needs to address the critical decision points submitted by Ms. Scheid. He stated that the Board must decide if they support the goals set forth by the Planning Commission. Supervisor Altizer voiced his support for adopting a cap on the number of billboards. He indicated that this would address the issue of preventing out-of-town companies applying for permits to build billboards. Supervisor Minnix questioned what the Planning Commission’s goals were for the sign industry in the next 20 years. Supervisor McNamara indicated that the Planning Commission has been fairly clear with their goals which includes decreasing June 10, 2003 550 the number of billboards. He indicated that the decrease will not be large, based on the way the ordinance is written because, on average, one billboard is destroyed every 10 years. He indicated that while the goal may be to decrease the number of billboards, implementing a cap will be doing almost the same thing as the Planning Commission’s current recommendation. He stated that this leaves the Board with the question of whether to allow tri-vision billboards. Mr. Mahoney advised that he did not want to suggest to the Board that Lamar Advertising represents the attitude of the entire sign industry. He stated that the ordinance deals with other parts of the industry that use on-premise signs and these businesses are not objecting to the revisions to the ordinance. He indicated that, within the billboard industry, Lamar Advertising is a significant player and one of the competitors of Lamar Advertising has requested tri-vision signs. The Planning Commission viewed this as a future technology that may be a positive change. Mr. Mahoney questioned whether Lamar Advertising may view this as competition and are thus attempting to use the Board to remove this provision from the ordinance. He indicated that Lamar Advertising has proposed eliminating tri-vision signs from the ordinance. He stated that staff has worked through most of the issues with the sign industry and it is now down to a narrow focus within the smaller component of the billboard industry, and some parts of the billboard industry want single face billboards, some prefer double face billboards, and others would like to use tri-vision billboards. He indicated that there are many facets and players within the sign industry. June 10, 2003 551 Supervisor Church indicated that he was not in favor of billboards but he questioned how the Board could arbitrarily declare that a sign which was previously conforming is now non-conforming due to a change in zoning. He stated that a “happy medium” needs to be found. Mr. Mahoney indicated that this is a fundamental concept of zoning and that localities change the zoning to reflect changing conditions. He stated that the government has often zoned or re-zoned property so that what was once permissible is now different. Supervisor Altizer questioned if the proposed ordinance had been in effect for the last 10 years, how many fewer signs would be in Roanoke County today? Mr. Witt indicated that there would be 10 less signs. Ms. Scheid further clarified that this number would depend on the type of signs involved. If 10 non-conforming signs were removed, 10 conforming signs could be installed resulting in no change in the total number of signs. If some conforming signs were lost, then the conforming sign would be lost, as well as a non-conforming sign. This situation would result in an overall reduction of one sign. Ms. Scheid stated that the majority of the situations, however, would result in no change in the total number of signs because the majority of the signs in Roanoke County are non-conforming. Supervisor Minnix questioned what the Planning Commission’s goals were for the sign industry. The Planning Commission members indicated that they would like to see fewer non-conforming signs. June 10, 2003 552 Mr. Al Thomason stated that there would be an outcry if there was a discussion of the potential harm to the parkway. He indicated that the land in Roanoke County is beautiful and the County must find a way to keep it that way. He stated that the proliferation of signage has to stop. Mr. Thomason reported that several options have been presented during the past year and they have not made any progress with the sign industry. He indicated that controls need to be implemented to prevent ruining the views in Roanoke County. Supervisor Minnix questioned if the sign industry would agree to an amortization schedule to phase out the non-conforming signs in Roanoke County. Mr. Dicks indicated that this would not be acceptable to the sign industry. Mr. Hodge encouraged the inclusion of the tri-vision signs in the ordinance. He indicated that these are acceptable in most locations throughout the state. Mr. Witt indicated that tri-vision signs will bring more income to the sign industry and this was the incentive the Planning Commission offered to the industry in exchange for the other changes in the ordinance. Mr. Hodge also indicated that Mr. Dicks has submitted a proposal requesting the use of front and back billboards. Supervisor Flora expressed reservations about the allowance of tri-vision signs and voiced concerns about the safety of the signs. Ms. Scheid reported that research has been conducted regarding the twirl times of the signs. Supervisor McNamara noted that placing a cap on the number of signs benefits the incumbents in the sign industry. He stated that the Board will not be June 10, 2003 553 supporting a free market environment if they implement a cap because they will be preventing other individuals from entering this industry. He noted that the other side of this issue is the value of commercially zoned land that will be reduced because the cap will prevent the landowner from placing a billboard on the site. He stated that no matter which decision the Board makes, someone will be adversely affected. Mr. Mahoney stated that placing a cap on the number of billboards will make the current non-conforming locations more valuable. In response to a question from Supervisor Minnix, Ms. Scheid reported that Botetourt County and the City of Salem do not allow any new billboards. She stated that the sign ordinance in Roanoke City is very restrictive. It was the consensus of the Board to send this matter back to the Planning Commission to resolve the remaining issues with the sign industry. Supervisors Altizer and Church urged the sign industry to take the opportunity during this last round of negotiations with the Planning Commission to bring forth new ideas from their side. 3. Work session to discuss the status of the following economic development projects: (Doug Chittum, Director of Economic Development): a. Ongoing infrastructure improvements to the Roanoke County Center for Research & Technology The work session was held from 7:38 p.m. until 8:09 p.m. and was presented by Doug Chittum. Mr. Chittum outlined the improvements that have been June 10, 2003 554 made to GlenMary Drive which attempt to provide a “parkway” feel to the road design. He reported that Novozymes is in the process of constructing a 6,000 square foot expansion to their facility. He also indicated that staff has been working with VDOT on signage at the entrance to the Center for Research and Technology (CRT), and he presented proposed signage designs which will be constructed using rock/stone and bronze. He indicated that a work session will be scheduled in the next several months to update the Board on the long-range plans at CRT. Aaron Hofberg, GIS Technician, presented a virtual demonstration of the topography at CRT from an aerial view. The new software, which was received from the state, allows staff to examine different grading layouts and perform cost analyses. b. Intersection improvements at Indian Grave Road and Route 220 The work session was held from 8:09 p.m. until 8:10 p.m. and was presented by Arnold Covey. He reported that on April 15, the Board authorized the County to enter into a contract with Allegheny Construction to build the 4-way intersection at Indian Grave Road subject to conditions. On April 22, the Board approved a resolution amending the Six-Year Secondary Construction Plan funds for the Buck Mountain Road project to the Indian Grave Road project. As of May 16, staff had obtained all necessary rights-of-way, easements and contributions necessary to move forward with the construction. Allegheny Construction has executed the contract and posted the necessary bonds with Roanoke County. The length of the contract is June 10, 2003 555 240 days. Mr. Covey indicated the pre-construction meeting was held today (June 10), and construction is ready to begin. c. Sims Automotive (Land Rover) development project in the Clearbrook overlay area The work session was held from 8:10 p.m. until 8:14 p.m. and was presented by Doug Chittum. He reported that the project is growing in scope and now consists of five dealerships and a service center. As the project scope continued to increase, the drainage needed to be connected to the federal government drainage system on the parkway. Staff has worked through the easement issues regarding drainage, and construction is ready to proceed when the weather improves. The site will consist of four 5,000 square foot buildings for the following dealerships: Mercedes, Volvo, Land Rover, and Jaguar. The fifth site is still being negotiated. d. Other miscellaneous projects The work session was held from 8:14 p.m. until 8:15 p.m. and was presented by Doug Chittum. Mr. Chittum reported that Fink’s has completed their site plan, Economic Development has performed an expedited approval, and the site plan has been reviewed by the Community Development Department and returned to Fink’s. At present, the project is waiting for VDOT to submit their comments. The closing was scheduled for Friday but had to be postponed pending receipt of the information from VDOT.
