Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order, a moment of silence was observed. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Radford called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman David F. Radford; Supervisors Martha B. Hooker, Paul M. Jacks, Chief Deputy Clerk to the Board IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Chairman Radford added a new Business Item, D.1 to Request to grant an additional holiday on Thursday, July 2, 2020. There were no objections. June 23, 2020 238 IN RE: BRIEFINGS 1. Briefing to the Board of Supervisors regarding removal, relocation, etc. of war memorials (Peter S. Lubeck, County Attorney) Mr. Lubeck provided the briefing. There was no discussion. IN RE: NEW BUSINESS 1. Request to grant an additional holiday on Thursday, July 2, 2020 (David F. Radford) Mr. Radford outlined the request, stating this was being observed for Juneteenth. There was no discussion. A-062320-1 Supervisor North moved to approve the staff recommendation to approve the minutes and Supervisor Hooker seconded the motion. Motion approved by the following vote: AYES: Supervisors Mahoney, Hooker, North, Peters, Radford NAYES: None 2. Resolution adopting the fiscal year 2020-2021 operating budget, the fiscal year 2020-2021 capital budget, and the fiscal year 2021- 2030 Capital Improvement Program for the County of Roanoke, Virginia and Roanoke County Public Schools (Laurie Gearheart, Director of Finance and Management Services) Ms. Gearheart outlined the request for resolution. Supervisor Mahoney commented as you go through the fee compendium, it is always a surprise to see in how many different areas local government is involved with transaction of business and different activities in our community. It is an eye- opener to see all the different fees and all the different areas where we do have some clear impact and regulatory authority. Supervisor Radford commented this has been an unusual budget year thanked the staff for it seems like a restart of three times; quite a task this year and hopefully it will calm down for next year. June 23, 2020 239 RESOLUTION 062320-2 ADOPTING THE FISCAL YEAR 2020- 2021 OPERATING BUDGET, THE FISCAL YEAR 2020-2021 CAPITAL BUDGET, AND FISCAL YEARS 2021-2030 CAPITAL IMPROVEMENT PROGRAM FOR ROANOKE COUNTY, VIRGINIA AND ROANOKE COUNTY PUBLIC SCHOOLS WHEREAS, Section 15.2-2503 of the 1950 Code of Virginia, as amended, provides that the governing body of the County shall prepare and approve an annual budget; and WHEREAS, said budget shall be prepared and approved for informative and fiscal planning purposes only; and WHEREAS, this budget contains a complete itemized and classified plan of all contemplated expenditures and all estimated revenues and borrowings for the ensuing fiscal year; and WHEREAS, a brief synopsis of said budget was published as required by the provisions of Section 15.2-2506 of the State Code, and the public hearings as required thereon were held on May 26, 2020 and June 9, 2020; and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia: 1. That there is hereby approved the annual operating budget for fiscal year 2020-2021 for Roanoke County, Virginia, and Roanoke County Public Schools as shown on the attached Schedules 1 and 2. 2. That there is hereby approved the capital budget for fiscal year 2020-2021 and Capital Improvement Program for fiscal years 2021-2030 for Roanoke County, Virginia, and Roanoke County Public Schools as shown on the attached Schedule 3. 3. That the preparation and approval of these budgets is for informative and fiscal planning purposes only. 4. That there is hereby approved a Fee Compendium which lists all fees and charges imposed by the County for providing specialized programs and services. The Fee Compendium provides details on the type of fee, authority to levy the fee, current fees, and proposed changes to the current fees. On motion of Supervisor Mahoney to adopt the resolution, seconded by Supervisor North and carried by the following recorded vote: AYES: Supervisors Mahoney, Hooker, North, Peters, Radford NAYS: None June 23, 2020 240 IN RE: REQUEST FOR PUBLIC HEARINGS AND FIRST READING OF REZONING ORDINANCES - CONSENT AGENDA 1. The petition of Wild Partners to obtain a special use permit in a C- 2S, High Intensity Commercial, District with special use permit to operate a car wash facility on approximately 1.152 acres, located at 4065 Electric Road, Cave Spring Magisterial District Supervisor Mahoney’s motion to approve the first reading and set the second reading and public hearing for July 28, 2020, was seconded by Supervisor Hooker and approved by the following vote: AYES: Supervisors Mahoney, Hooker, North, Peters, Radford NAYS: None IN RE: PUBLIC HEARING 1. Public hearing to receive citizen comments regarding a proposed amendment to the fiscal year 2019-2020 budget in order to appropriate Cares Act funds, in accordance with Code of Virginia Section 15.2-2507 (Laurie Gearheart, Director of Finance and Management Services) Ms. Gearheart outlined the request for the public hearing. Chairman Radford recessed the meeting from 3:22 p.m. until 3:32 p.m. to allow for citizen comments. Chairman Radford opened and closed the public hearing with no citizen comments. IN RE: SECOND READING OF ORDINANCES 1. Ordinance accepting and appropriating funds in the amount of $8,217,365 from the Commonwealth of Virginia for the locally- based allocation distributed as a component of the Coronavirus Aid, Relief, and Economic Security (CARES) Act of 2020 (Laurie Gearheart, Director of Finance and Management Services) Ms. Gearhart outlined the request for ordinance. There was no discussion. June 23, 2020 241 ORDINANCE 062320-3 ACCEPTING AND APPRORIATING FUNDS IN THE AMOUNT OF $8,217,365 FROM THE COMMONWEALTH OF VIRGINIA FOR THE LOCALITY-BASED ALLOCATION DISTRIBUTED AS A COMPONENT OF THE CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY (CARES) ACT OF 2020 WHEREAS, in response to the present Coronavirus pandemic, on March 17, 2020, the Board of Supervisors confirmed the County Administrator’s declaration of state of emergency effective March 16, 2020, subsequent to declarations of states of emergency by the President of the United States and the Governor of Virginia; and WHEREAS, following such declarations of emergency, the United States Congress passed the Coronavirus Aid, Relief, and Economic Security (CARES) Act, which established a $150 billion Coronavirus Relief Fund (CRF) to assist state, local, territorial and tribal governments with direct costs associated with the Coronavirus pandemic; and WHEREAS, Virginia’s allocation of these funds is $3.1 billion; and WHEREAS, on May 12, 2020, the Virginia Secretary of Finance notified the County that its allocation of funds made available through the CARES Act is $8,217,365; and WHEREAS, these funds may be used only for qualifying expenses; the CARES Act provides that payments from the CRF may only be used to cover costs that 1) are necessary expenditures incurred due to the public health emergency with respect to the Coronavirus disease; 2) were not accounted for in the budget most recently approved as of March 27, 2020 (the date of enactment of the CARES Act); and 3) were incurred during the period that begins on March 1, 2020, and ends on December 30, 2020. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $8,217,365, made available to the County through the Commonwealth of Virginia from the Coronavirus Aid, Relief, and Economic Security Act, is accepted. 2. The sum of $8,217,365 is hereby appropriated to the County’s Grant Fund, to be used for those purposes allowable under the Act. 3. That this ordinance shall take effect from and after the date of adoption. On motion of Supervisor Peters to adopt the ordinance, seconded by Supervisor Hooker and carried by the following recorded vote: AYES: Supervisors Mahoney, Hooker, North, Peters, Radford NAYS: None June 23, 2020 242 2. Ordinances to appropriate funds for: (a) Fiscal year 2020-2021 operations budget and approval of the Classification and Pay Plan for fiscal year 2020-2021 for the County of Roanoke, Virginia; Supervisor Hooker noted as she has discussed in the past, she is an employee with Roanoke County Public Schools and after consulting with the County Attorney and Commonwealth Attorney, they have advised her that is no conflict in her participation in this vote. ORDINANCE 062320-4 APPROPRIATING FUNDS FOR THE FISCAL YEAR 2020-2021 OPERATIONS BUDGET AND APPROVAL OF THE CLASSIFICATION AND PAY PLAN FOR FISCAL YEAR 2020-2021 FOR ROANOKE COUNTY, VIRGINIA WHEREAS, upon notice duly published in the newspaper, public hearings were held on May 26, 2020 and June 9, 2020, concerning the adoption of the annual budget for Roanoke County for fiscal year 2020-2021; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved said budget on June 23, 2020, pursuant to the provisions of Section 13.02 of the Roanoke County Charter and Chapter 25 of Title 15.2 of the 1950 Code of Virginia, as amended; and WHEREAS, the first reading of this appropriation ordinance was held on June 9, 2020, and the second reading of this ordinance was held on June 23, 2020, pursuant to the provisions of Section 18.04 of the Roanoke County Charter. That the County Administrator may authorize or delegate the authorization of the transfer of any unencumbered balance or portion thereof from one department to another. 3. That all funded outstanding operating encumbrances at June 30, 2020, are re- appropriated to the 2020-2021 fiscal year to the same department and account for which they are encumbered in the previous year. 4. That all General Government Fund unexpended appropriations and all General Government revenues collected in excess of appropriated revenues at the end of the 2019-2020 fiscal year not lapse but shall be re-appropriated and presented to the Board of Supervisors for allocation based on guidance provided in Section 10-1 through 4 of the County of Roanoke Comprehensive Financial Policy approved by the Board of Supervisors on December 17, 2019. 5. Account balances remaining in the Fee Class Fund collected by the Parks, Recreation and Tourism Department will be allocated to accounts as defined by the Fee Class Accounts Procedure. 6. These anticipated funds are appropriated to the Grants Fund for the various functions and purposes as provided therein, and said appropriation shall be acknowledged and allocated to the appropriate fund upon approval by the Board of Supervisors on the Consent Agenda. 8. That the Board of Supervisors approves the County of Roanoke Classification and Pay Plan. The Classification and Pay Plan included as part of this ordinance is effective July 1, 2020. The County Administrator shall implement the County Classification and Pay Plan pursuant to Board of Supervisors Resolution 082515-1. 9. This ordinance shall take effect July 1, 2020. That all funded outstanding capital encumbrances at June 30, 2020, are re- appropriated to the 2020-2021 fiscal year to the same account for which they are encumbered in the previous year. 4. That appropriations designated for capital projects will not lapse at the end of the fiscal year but shall remain appropriated until the completion of the project or until the Board of Supervisors, by appropriate action, changes or eliminates the appropriation. Upon completion of a capital project, staff is authorized to close out the project and transfer to the funding source any remaining balances. This section applies to appropriations for capital projects at June 30, 2020, and appropriations in the 2020- 2021 fiscal year budget. 5. That the Board of Supervisors anticipates receiving various grants, donations, and other miscellaneous revenues. These anticipated funds are appropriated to the Grants Fund for the various functions and purposes as provided therein, and said June 23, 2020 249 appropriation shall be acknowledged and allocated to the appropriate fund upon approval by the Board of Supervisors on the Consent Agenda. 6. She read a speech that was written by a man named Dennis Rogers. He wrote it for the new officers that were being sworn in to the Raleigh Police Department in December of 1998. It highlights what it means to be a police officer and why it is important for all of us to say thank you. “I don’t know why you people do what you do. My natural inclination is to mistrust anyone who wants to be a cop. The pay is lousy, the hours long the work varies from tedious to terrifying and most of the people you encounter are not generally having a good day. Often they take it out on you. But you do it anyway. You get up in the morning or the afternoon or in the middle of the night, depending on your shift and you offer to take the bullet that was June 23, 2020 256 meant for the rest of us. That’s what it means, you know, when you swear to protect and defend the public. You get to up the dangerous alleys, not us. You get to go into dark basements to look for prowlers, not me. You get to bust into that motel room, you get to shield the hostage with your own body or tackle a crazed person with a gun. And those are your good days. On the bad days, you’re the one who drapes the blanket over that tiny, shattered body left by the side of the road. The kids call you when Dad threatens to kill Mom. You’re the one who has to comfort an elderly woman who has been raped, a gay man who has been beaten senseless or the traumatized kid who has painfully learned that love can be just another four-letter word. And it is you, not any one of us, who has to stand there like a rock as they carry away the body of your partner. You want to blow somebody away, but you know if you pull that trigger, you will tarnish the badge and the honor that is your only defense against the evil that is waiting for you to screw up. Still, you labor through 26 weeks of rigorous training to take your place in the thin blue line and now that you have made it, you have every right to be proud of yourself. We expect a lot from you, but don’t bother to expect much from us in return. Don’t expect us to see the real man or woman behind the badge. Don’t expect us to be reasonable, when you right us a traffic ticket. Don’t expect us to be patient. You can on the other hand, expect us to make jokes about doughnuts and blue flu and to tell you to be arresting real criminal instead of picking on law-abiding citizens. But one day, I promise you, it will all be worth it. One day you will look into the eyes of a lost child. Maybe you’ll get to tell a family that Mom is going to be okay. One day you’ll give an old man back his dignity and sense of safety after some punk has knocked him down and stolen his pension. One day somebody will live because you stopped that drunken driver just in time. In the meantime, take care of yourself. We need you out there more than you will ever know and maybe, just maybe, one day we might even remember to say thank you.” There are incredible men and women out there that will stand in front of each of us and she just wanted to find a public place to acknowledge their sacrifice and their service to our community to keep us safe. IN RE: REPORTS Supervisor Mahoney asked when looking at the comparative statement of budgeted and actual revenues, is there anything in that report that gives staff some worry or heartburn. When he looks at some of the percentages, particularly with respect to some of revenues, real estate, personal property. He knows that we have extended some due dates, but is there anything there that gives you heartburn or are you all sleeping well at night. Mr. O’Donnell responded stating before Ms. Gearheart addresses with real numbers, in his last weekly report, he provided a brief summary indicating we are real close with revenue, but we are going to squeak by. Supervisor Mahoney stated he sees the percent of variance and it is 11 months through the year and knows it is an unusual year. June 23, 2020 257 Ms. Gearheart reiterated it is an unusual year, and staff is very closely monitoring revenues and expenditures. We are also giving regular updates to administration on how those are coming. We have been very pleased with how June has turned out. We are feeling really good about the real estate taxes. We are actually feeling really good about the sales tax revenue. We were pleasantly surprised with what posted for June. She is cautious about personal property taxes, however, we did extend that so we do feel like maybe some people will be taking advantage of that, however, it is in line. Overall, we are thinking that we are going to actually end the fiscal year okay. The departments have done a great job on the expenditure side. We do know we will have some overages in certain areas that we do not control that get billed outside of us for services that are provided for us, but we are hopeful. Supervisor Mahoney reiterated that some of the percentages look really look and he is pleasantly surprises by seeing some of those. Ms. Gearheart responded the State is seeing the same thing and have been on record stating even though they are going to be down, it is not near as bad as originally projected. Accounts Paid – May 31, 2020 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor North stated he first wanted to share with the public a reminder to participate in the Rt. 460 improvement study underway in Roanoke City and Roanoke , County; presentation and online survey through June 302020. Last November there was a public hearing and followed by one that was supposed to be in March and April and because of COVID-19 will now be a virtual survey. Some folks at home have gotten these cards in their mail (held up post card). It is a virtual presentation and survey that he encouraged everyone to look over, review the feedback from the meeting an survey so far and lean about what the recommendations are along the intersections on Rt. 460 to improve safety and fluidity. After doing so, just hit the button and submit it. If you don’t give us your input, we won’t be able to make sure that what VDOT is proposing will work. This is actually the second step in a multi-step process. The next step will be to file these projects by August 1, 2020, as Smart Scale applications and we will find out if the State of Virginia has enough money to effect these changes when they rule on what is priority in January of next year, but these are not earmarked to start before July 1, 2024, which is fiscal year 2025. We appreciate those folks involved along those right-of-ways and those folks who aren’t but use Rt. 460 to weigh in on it now because it is important. Supervisor Peters really appreciates Ms. Casey comments this afternoon, because he thinks she said it better than he could. He has said since his was an elected official that we can do a lot of great things. We can have a wonderful school system. We can have great parks. We can have all of this wonderful stuff, but if we don’t have a safe community, in his opinion, nothing else matters. He is very thankful for our police department. He rejects the emails asking to defund the police department because he still believes that without a safe environment; a safe community, nothing else matters. He asked the community to support him, our police department and everything they do every day to continue to keep us safe. Supervisor Mahoney stated he wants to echo what Mr. Peters and Ms. Casey said. If you look at what our responsibilities are, we boil it down to public health, public safety and public welfare and there is no way we are going to defund our police department. Secondly, some cautious optimism, he knows we will have a work session later this afternoon with respect to the CARES Act funding, but he is very happy that it appears as though we may be able to allocate up to $1 million in a Small Business Assistance Grant Program to help our local businesses and our community. He stated he thinks that is one way that we can try to get out of the economic disaster that we have been suffering under for the last three months. Supervisor Hooker stated she echoes appreciation for Ms. Casey and her remarks because we do truly appreciate our police officers and what they do for us on the regular. She also echoes Supervisor Mahoney’s comment to just in being pleased that it isn’t as bad as it could have been and that we are making headway. Supervisor Radford stated that he too rejects all the emails. We are not going to defund our police department. There is a thin line between chaos and civility and they help, that is why they are called the thin blue line. They help and keep that line there and that is very important in our society. IN RE: CLOSED MEETING At 3:52 p.m., Supervisor Radford moved to go into closed meeting following the work sessions pursuant to the Code of Virginia Section 2.2-3711 A.1 of the June 23, 2020 259 Code of Virginia in order to hold a routine performance evaluation for Peter S. Lubeck, County Attorney. IN RE: WORK SESSIONS 1. Work session to discuss the Amended and Restated Service Agreement for the Roanoke Valley Detention Commission (Richard L. Caywood, Assistant County Administrator) Mr. Caywood provided a PowerPoint presentation and review the proposed Amended and Restated Service Agreement. In attendance was Jim Guynn of Guynn, Waddell, Carrol and Lockaby who prepared the agreement to answer any questions.Supervisor Mahoney stated when we originally did this, he thought we had incurred some fairly substantial long-term debt, have we paid this off? Mr. Caywood responded in the affirmative. Supervisor Mahoney then commented that he is looking at Mr. Guynn and Mr. Lubeck, he understands judicial philosophy has changed, but judicial philosophy could change back to what it was 20 years ago. How easy would it be to reopen the facility to its full utilization similar to what was anticipated back in 1998? Mr. Guynn responded to a certain point it would be fine. As Mr. Caywood stated, you have to have a minimum number of people there and you can add to that, however when you get to the net pod that you are going to have to staff up. Mr. Caywood stated essentially what is going on now, there are two wings so to speak and one of them is closed. He indicated you would need significant capital to increase capacity. Other than staffing up, there are no barriers going back to an 81 bed facility. Supervisor Mahoney stated he would be concerned if we had to increase capacity, the commission would be looking to have to issue new debt and that would be scary because we just don’t know how Juvenile and Domestic Relation Court Judges would perceive that. Mr. O’Donnell stated during the current climate we do not anticipate this happened. Based on his knowledge from being on this Board for many years, he thinks this is the best option. June 23, 2020 260 Mr. Caywood stated in order for one female to be dropped off at the facility, there is going to be three shifts worth of staff there because that person could arrive at any time of day, but there are often periods of time where there are no females in the facility. It is a good thing to have this facility here locally. Another thing, most of the juveniles that are detained are not there very long. The typical stay is around two (2) weeks. Supervisor Mahoney advised he was comfortable with the revised agreement, he was trying to look forward thinking that if the capital improvements that were done 20 years ago are reaching a point where some refurbishing or reconstruction has to be done so that a new bond issue would have to be put forward with a lack of utilization for the jurisdictions to be willing to pay for that. He thinks we are always going to need it, he does not think it will ever go away, but he is pleasantly surprised the philosophy has changed so we are not incarcerating kids as much as we were 30 years ago. Mr. Caywood advised this would be brought back to the Board on July 14, 2020, with one reading. The work session was held from 4:07 p.m. until 4:35 p.m. 2. Work session to review with the Board of Supervisors the budget for the CARES Act funding (Rebecca Owens, Assistant County Administrator; Laurie Gearheart, Director of Finance and Management Services) Ms. Gearheart provided a PowerPoint presentation. Supervisor Hooker inquired if the Schools would be getting some of these funds with Ms. Gearheart advising in the affirmative. Mr. O’Donnell commented they also received funds themselves. Supervisor Mahoney asked if the money that comes to the Schools have to come to the County and then be appropriated to the Schools. Mr. O’Donnell stated it was just appropriated with Supervisor Mahoney stating under Virginia law it has to go through the local government. Supervisor Radford asked how do the schools receive their $1 million. Ms. Gearheart stated it would go directly to them. Ms. Owens advised it would need to come through at a later time, because they did not include in the budget just approved. Mr. O’Donnell outlined the addition of a new meeting room on the third floor, which the Board will use for work sessions and overflow.
