8/24/2021 - Regular - DRAFT August 24, 2021 513 Roanoke County Administration Center 5204 Bernard Drive Roanoke, Virginia 24018 The Board of Supervisors of Roanoke County, Virginia met this day at the Roanoke County Administration Center, this being the second regularly scheduled meeting of the month of August 2021. Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order, a moment of silence was observed. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Peters called the meeting to order at 3:00 p.m. The roll call was taken. MEMBERS PRESENT: Chairman P. Jason Peters; Supervisors Martha B. Hooker, Paul M. Mahoney, Phil C. North and David F. Radford MEMBERS ABSENT: None STAFF PRESENT: Daniel R. Lubeck, County Attorney; Amy Whittaker, Public Information Officer and Deborah C. Jacks, Chief Deputy Clerk to the Board IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS 1. Proclamation commemorating the 100th Anniversary of the Roanoke Valley Association of REALTORS (Jill Loope, Director of Economic Development) Joe Sutliff, Director of Economic and Governmental Affairs accepted the Proclamation on behalf of the Association. Proclamation was read and all supervisors offered their congratulations. August 24, 2021 514 IN RE: BRIEFINGS 1. Briefing to update the Board of Supervisors on the Virginia Department of Transportation (VDOT) project to repair a Route 220 slope failure at Crossbow Circle (Megan Cronise, Transportation Planning Administrator) Ms. Cronise provided a PowerPoint presentation and briefed the Board on this project. Supervisor Mahoney commented if this work was not being done, it would adversely affect the Yamamotos and the Akersons. Ms. Cronise responded in the affirmative and stated if the slope continues to fail and eroded. Mr. Mahoney stated his point is that it takes a surprisingly large amount of money to cure the problem, but if you don’t cure the problem there could be a landslide and possible damage to two homes of mud and direct into Rt. 220. Ms. Cronise responding in the affirmative stating a part of the North – With the State having a surplus and money raining down from feds. st Ray – difficult to come buy. Worked through district funding for 1 phase. Listen. Radford – how far up does the scar do to the Y and A’s Mahoney – when looking at page 5, is that a hiking trail. IN RE: NEW BUSINESS IN RE: REQUEST FOR PUBLIC HEARINGS AND FIRST READING OF REZONING ORDINANCES - CONSENT AGENDA IN RE: FIRST READING OF ORDINANCES 1. Ordinance amending Chapter 21 (Taxation), Article IX (Transient Occupancy Tax) of the Roanoke County Code (Peter S. Lubeck, County Attorney) Mr. Peter outlined the request for ordinance. Ordinance approving a lease with .com Properties, IV, LLC for 40 parking spaces of a lot located at 200 East Calhoun Street (Joyce Earl, Director of Social Services; Mary Beth Nash, Senior Assistant County Attorney) No changes from first reading. Statement of Treasurer’s Accountability per Investment and Portfolio Policy as of July 31, 2021 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Hooker – Roanoke County schools back in session. Hope and pray for in- person attendance. Attended VACO; Broadband – continue to work on universal, very important for our citizens. Zoning changes for higher heights in rural area. Also attending the Festival – Thanks to Ssuny Shah. Supervisor North – VACo Supervisor Radford – Would like to see prepare a letter to Congressman Cline. Repair of parkway. ARPA money. Prayers and peace to Mr. Mahoney on the passing of his dad. He attended the Festival of India; cultural heritage. We were a sponsor. They are part of our community. August 24, 2021 517 Supervisor Mahoney – Thank everyone for your kind comments and condolences. Glad to hear about the Festival. Supervisor Peters – Rt. 419 – Ms. Loope announced Chili’s and Popeyes. Carilion coming along quite nicely. IN RE: WORK SESSIONS 2. Work session with the Board of Supervisors on the potential regulation of running bamboo (Peter S. Lubeck, County Attorney) Mr. Lubeck provided a powerpoint presentation. Mr. Radford’s thought that the County did not want to get into cutting bamboo. Slide 9 – how do we address with the land that is owned by VDOT. – Education campaign and an ordinance. No civil penalties – softer approach. Can you do an ordinance without a civil penalty. – Needs to be aggressive. How do you invision and education campaign. Flyers North – What is going on around the State – Peters – seen both. Concerns not enough staff. Mahoney – has a citizen with this problem. He would not support and patron. Two problems, one practicial and philosophical. We have two code enforcement staff. We cannot keep up with what we have. Thought we were all republicans and believed in lesser government. We have more important issues. – Need an expert witness. Does not see us going down this pass. Peter – can also do civic action. Martha - does not want civil penalties; need education. The work session was held from 3:52 until 4:12 p.m. 1. Work session with the Roanoke County Board of Supervisors and the Towing Advisory Board (Richard L. Caywood, Assistant County Administrator; Rachel Lower, Senior Assistant County Attorney; Rick James, Chairman, County of Roanoke Towing Board) August 24, 2021 518 Ms. Lower started powerpoint presentation. Jason – had the conversation with Rachel and Richard, shared the concern. Did not feel like this Board wanted to get into the wees. Primary concerns and let staff take care of. Annual review with the Towing Board. – Resolution is very high level. Martha – when visitors visit the Roanoke Valley – McAffee’s Knob does not leave a bad taste in their mouth. st North – Peak leaf season October 1. Hope implementation can occur by that time. Jason – not sure Richard – factors considered in the development of recommendations. Rick James – Towing Advisory Board recommendations. Mr. Radford – Question – what about the other side. Peter – other tows are a private property. We do not have the authority to regulate in that area. Citizens will get confused. Jason – question last week – how many complaints with Roanoke City since they started – zero. Martha – McAfee’s Knob. Needs signage. Phil – what would the maximum be – see towing fee schedule Why not done by October – Richard – has to go through procurement process. North – Big sign must be up there. Richard – other options going on outside of this. Martha – not cool to go and be towed. Rachel – outlined last item Jason – thanks to the members of the Board, Mr. James, appreciate your service. Thinks this is the right time to do this. August 24, 2021 519 Mahoney – if we have 8 contracts, what do the police officers do – Dispatcher will go to the next one on the list. Sgt. Hoopes – provided as part of training onsite. Did not want to legislate into the weeds. We want to have a certain degree of flexability to craft what the towing community needs Vice Chair Charles Brown explained from the towing side. Do you want a contract that is detailed or flexability Richard – binders – Radford – Fee Schedule – Hanging Rock - Can we put an amount (maximum fee) Rachel – no. Martha – can we put a minimum. Richard – we look at every season, we will need to continue the dialog with VDOT. SPECIFICALLY, THE BOARD WILL CONSIDER THE ACQUISITION OF POTENTIAL PROPERTY FOR FIRE AND RESCUE PURPOSES Article II. 2.
