Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order, a moment of silence was observed. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Mahoney called the meeting to order at 3:01 p.m. The roll call was taken. MEMBERS PRESENT: Chairman P. Jason Peters; Supervisors Martha B. Hooker, Paul M. Resolution recognizing Paula Benke for her exemplary service to Roanoke County (Richard L. Caywood, County Administrator; Doug Blount, Assistant County Administrator Mr. Blount recognized Ms. Benke for her service; the resolution was read by the Chief Deputy Clerk of the Board. Each Supervisors offered their thanks. April 26, 2022 582 RESOLUTION 042622-1 RECOGNIZING PAULA BENKE FOR HER EXEMPLARY SERVICE TO ROANOKE COUNTY WHEREAS, In July, 2019, Paula Benke was hired as the Program Coordinator for County of Roanoke Transportation (CORTRAN) to manage the demand response transportation program for citizens with physical and mental disabilities and senior adults; and WHEREAS, Paula Benke was instrumental in designing a new CORTRAN transit program; and WHEREAS, Paula worked with a new service provider to enhance customer service and scheduling system for program participants; and WHEREAS, Paula goes above and beyond to ensure all riders’ needs are met; WHEREAS, Paula was successful in applying for two rounds of transit grants through the Department of Rail and Public Transportation; and WHEREAS, Paula also managed $450,000 in CARES Act funding for the Department of Social Services to aid citizens that were financially impacted by COVID- 19; and WHEREAS, Paula’s management of the CARES Act funding helped Roanoke County citizens with utility bills, car payments, child care expenses, medical bills and mortgage payments; and WHEREAS, Paula’s positive attitude and commitment to her programs make a difference every day in many of Roanoke County’s citizens’ lives. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to Paula Benke for her nearly three years of dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for continued success in the future. Recognition of Roanoke County by the Virginia Economic Developers Association (VEDA) for the 2022 Community and Economic Development Award (CEDA) for the Reimagine 419 Plan (Jill Loope, Director of Economic Development) Recognition was given. April 26, 2022 583 2. Resolution expressing appreciation to the City of Roanoke for their collaboration and partnership on the County's new Fire and Rescue Facility Project (Richard L. Caywood, County Administrator) Mr. Caywood outlined the resolution. Mayor Sherman Lea was in attendance to accept the resolution, which was read by the Chief Deputy Clerk to the Board. RESOLUTION 042622-2 EXPRESSING APPRECIATION TO THE CITY OF ROANOKE FOR THEIR COLLABORATION AND PARTNERSHIP ON THE COUNTY’S NEW FIRE AND RESCUE FACILITY PROJECT WHEREAS, in order to enhance services, and to reduce demands on other fire and rescue stations, Roanoke County staff identified a need for a new fire and rescue station to be built near the Bonsack area and within the Route 460 corridor; and WHEREAS, the addition of this new fire and rescue station is expected to replace services currently provided by Roanoke County and Roanoke City fire stations, and will improve response times to certain addresses; and WHEREAS, Roanoke County staff initiated a search for property to build upon, and ultimately decided that a 2.25-acre parcel located in the City of Roanoke would best serve the needs of the County in this endeavor; and WHEREAS, Roanoke County selected the 2.25-acre parcel located in the City of Roanoke due to (1) the limited availability of appropriate parcels in the Bonsack area and within the 460 corridor, (2) the need for signalized access to and from a fire and rescue facility, and (3) the costs associated with acquisition and construction; and WHEREAS, due to the existing zoning of the 2.25-acre parcel, it was necessary for the County of Roanoke to initiate a rezoning process in the City of Roanoke in order to build upon and use the parcel for fire and rescue purposes; and WHEREAS, the rezoning process included collaboration between staff of the City of Roanoke and the County of Roanoke, the City of Roanoke Planning Commission, the City of Roanoke Council, and the County of Roanoke Board of Supervisors; and WHEREAS, the County of Roanoke is proud of the regional partnership with the City of Roanoke, and is exceptionally proud of the enhanced fire and rescue services that will be available to both the citizens of the City of Roanoke and the County of Roanoke which resulted from the endeavors of both localities; and WHEREAS, the Board wishes to acknowledge this regional partnership with the City of Roanoke, express its respect, and convey to the City of Roanoke the Board’s appreciation for all that has been done to ensure that the County’s new fire and rescue facility project is a success; and April 26, 2022 584 NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of the County of Roanoke to the City of Roanoke for the collaboration and partnership on the County’s new fire and rescue facility project. The petition of Zye Reinhardt and Gaven Reinhardt to obtain a special use permit in an AR, Agricultural/Residential, District for a special events facility on approximately 42.08 acres, located at 2875 Timberview Road and the 2400 block of Loch Haven Drive, Catawba Magisterial District Supervisor Hooker’s motion to approve the first reading and set the second reading and public hearing for May 24, 2022 was seconded by Supervisor Radford and approved by the following vote: AYES: Supervisors Peters. Hooker, North, Radford, Mahoney NAYS: None IN RE: PUBLIC HEARING 1. Public hearing for citizen comments on the proposed fiscal year 2022-2023 Operating Budget and the proposed fiscal year 2023- 2032 Capital Improvement Program (Laurie Gearheart, Director of Finance and Management Services) Chairman Mahoney opened and closed the public hearing with no citizens to speak on this agenda item. IN RE: FIRST READING OF ORDINANCES 1. Ordinance amending Chapter 7 (Building Regulations), Article V (Fees), Sections 7-73 (Miscellaneous Fees) and 7-75 (Fee for Cross Connection Inspection) of the Roanoke County Code (Peter S. Lubeck, County Attorney) Mr. Lubeck outlined the changes. There was no discussion. Supervisor Radford’s motion to approve the first reading and set the second reading and public hearing for May 10, 2022 was seconded by Supervisor Hooker and approved by the following vote: AYES: Supervisors Peters. Ordinance increasing the technology fee assessed on transactions processed by the Roanoke County Departments of Planning and Zoning and Development Services (Peter S. Lubeck, County Attorney) April 26, 2022 586 Mr. Moneir outlined the changes. Supervisor Radford inquired if these fees will pay for the software update with Mr. Moneir advising in the negative. Mr. Radford stated he just wanted people that use this department to understand we are not recouping the costs; this is just trying to help offset a little. Supervisor North asked if we were increasing to 3% with Mr. Moneir advising we are increasing from 3% to 5%. There was no further discussion. Hooker, North, Radford, Mahoney NAYS: None Supervisor Hooker noted she was a retired employee of Roanoke County Schools. (d) Fiscal year 2022-2023 operations budget for Roanoke County Public Schools; and Supervisor North stated on page 160 of the packet, staff refers to General School Operating funds in the revenue category as well as expenditure category. He asked for confirmation that the number shown is comprised of the funding from the Commonwealth of Virginia as well as Roanoke County. Ms. Gearheart confirmed. He added the number presumes what we believe we are going to receive from the house budget bill that passed the general assembly at this time, correct. Ms. Gearheart confirmed. Supervisor North then stated we may have to entertain a revision to this, if and when the General Assembly adopts their budget, correct. Ms. Gearheart confirmed. There was no further discussion. Hooker, North, Radford, Mahoney NAYS: None April 26, 2022 588 (e) Fiscal year 2022-2023 capital budget for Roanoke County Public Schools (Laurie Gearheart, Director of Finance and Management Services) Supervisor Radford’s motion to approve the first reading and set the second reading and public hearing for May 10, 2022 was seconded by Supervisor North and approved by the following vote: AYES: Supervisors Peters. Hooker, North, Radford, Mahoney NAYS: None 5. Ordinance dissolving a lease with Blue Mountain Huts, LLC to provide camping accommodations in Explore Park (Doug Blount, Assistant County Administrator) Supervisor Mahoney as if this lease program was successful, with Mr. Blount responding affirmatively stating approximately $20,000 a year generated in revenue from camp site rentals. Supervisor Mahoney asked if staff anticipated in the future, next year, trying to administer and manage this in-house or does staff think we might try to go through another process to try and find a third-party, private vendor to manage and administer? Mr. Blount responded staff would like to bring in other partners to help with providing these types of services. He added it has been the goal of Explore Park to be an economic driver for small business. One of the things, we want to look at is not just primitive camping; we want RV camping at the park as well. We would like to find a vendor that can help provide both of these; it is extremely popular, especially with people that have travel trailers and recreational vehicles. Ordinance accepting and appropriating funds in the amount of $119,008 from the Virginia Department of Rail and Public Transportation for the CORTRAN Program (Paula Benke, CORTRAN Program Coordinator) April 26, 2022 589 Ms. Benke advised there were no changes since the first reading held on April 12, 2022. There was no discussion. ORDINANCE 042622-3 ACCEPTING AND APPROPRIATING FUNDS IN THE AMOUNT OF $119,008 FROM THE DEPARTMENT OF RAIL AND PUBLIC TRANSPORTATION FOR THE CORTRAN PROGRAM WHEREAS, the County of Roanoke Transportation (CORTRAN) program was established in 1985 in order to help County residents remain in their homes and independent with curb-to-curb transportation from their homes to destinations within Roanoke County, the City of Roanoke, the City of Salem, and the Town of Vinton; and WHEREAS, the CORTRAN program is currently structured so that Roanoke County residents are eligible to use the service if they are either 70 years of age or better, or if they have a disability; and WHEREAS, Roanoke County received $119,008 in FTA Section 5310 grant funding through the Department of Rail and Public Transportation for fiscal year 2022 to supplement County funds for the CORTRAN program; and WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be appropriated by ordinance; and WHEREAS, the first reading of this ordinance was held on April 12, 2022, and the second reading was held on April 26, 2022. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $119,008 is accepted and appropriated from the Department of Rail and Public Transportation for the purpose of the CORTRAN program. 2. That this ordinance shall take effect upon its adoption. Resolution authorizing the execution of an amended Memorandum of Understanding between Roanoke County and City of Roanoke for Therapeutic Recreation Services On motion of Supervisor Hooker to adopt the resolution, seconded by Supervisor Radford and carried by the following recorded vote: AYES: Supervisors Peters, Hooker, North, Radford, Mahoney NAYS: None A-042622-3.a RESOLUTION 042622-4.b EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO MICHAEL BRIZENDINE, PARKS MANAGER, UPON HIS RETIREMENT AFTER MORE THAN FORTY (40) YEARS OF SERVICE WHEREAS, Michael Brizendine was employed by Roanoke County on May 12, 1980; and WHEREAS, Mr. Brizendine retired on December 1, 2020, after forty (40) years and seven (7) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Mr. Brizendine through his employment with Roanoke County, has served as a Laborer, Grounds Maintenance Worker, Motor Equipment Operator, Parks Crew Leader, Parks Maintenance Foreman and Parks Manager within the Parks, April 26, 2022 591 Recreation and Tourism Department and has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Mr. Brizendine’s tenure with Roanoke County, directly worked with staff to execute the Parks mowing operation, repair and upkeep of the park amenities, assisted in managing the county wide agricultural program, worked with the Roanoke County Recreation Leagues and staff to manage the maintenance of the sports lighting systems and athletic complexes, managed the support for our County sponsored special events and tournaments, supported the construction and maintenance of our greenways, and assisted in managing the Parks response to Roanoke County Wide Emergencies and the Snow Removal Operation. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to MICHAEL BRIZENDINE for more than forty (40) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. Nimmo was employed by Roanoke County on October 6, 2014; and WHEREAS, Mr. Nimmo retired on September 1, 2021, after six (6) years and eleven (11) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Mr. Nimmo, through his employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Mr. Nimmo’s tenure with Roanoke County, he was a friendly public servant to the many children that lived on his routes. These children looked forward to seeing him each week, and Mr. Nimmo made sure to acknowledge them as he serviced their neighborhoods. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens April 26, 2022 592 of Roanoke County to WILBERT C. Accounts Paid – March 31, 2022 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor North thanked the City of Roanoke for approving the fire station; huge regional example. Also, he thanked Roanoke County staff and the team that worked to bring this to fruition; words cannot thank you on behalf of the citizens of that area on both sides of Rt. 460. He understands the anticipated opening is in 2024, we hope, assuming we can accomplish all the tasks. This is the halfway point and now you have to work the plan. Last Tuesday, he attended the local legislative wrap up, or more likely labeled, legislative update, as the work is not completed so therefore, it is not a total wrap-up. Local legislators mentioned several hopeful items among Catawba Hospital and the Transportation Museum were mentioned for local funding. Other topics shared with us were the proposed gas tax reduction for several months, State transportation funding surplus, grocery tax and how 37 of 50 states in the United States April 26, 2022 593 have no grocery tax, airport funding and cryptocurrency, which he does not know how that has to do with Roanoke County. In the end there is no State budget and there has not been one anticipated at the veto session tomorrow in Richmond. Next month, on May 18, 2022, from 4-6 p.m., at Bonsack Elementary, Supervisor Peters and he invite the public to come to the open house on the Rt. 460 Bonsack Community to discuss changes in that corridor as well as transportation proposals. He encourages all to attend and learn what the input was from last fall’s meeting. There are some interesting concepts that he has learned from staff. Lastly, he is proud to serve the citizens of the Hollins district and all of Roanoke County with the Board of Supervisors and colleagues to provide personal property tax reduction and relief that this Board approved unanimously at our last meeting. He thinks this is a huge step in the headwinds of inflation that are upon us and our taxpayers will be relieved when they get their bills that they aren’t as high as they could have been; congratulations Board. Supervisor Radford stated last week, he attended two (2) Roanoke County Plan summary meetings. One at Bent Mountain that was heavily attended by the citizens and thank you to coming and voicing their thoughts on how they would like to see that plan unfold in their area. We followed up the next night at Oak Grove Elementary. It was well represented by the staff at both meetings and we did get some comments back from the Oak Grove citizens; they are appreciative that we are going to take the Oak Grove Park behind Oak Grove Elementary and improve it with funds that were approved for the park. They are really enthused and excited about making that park something again; something they can use and share. Supervisor Peters stated it is good to be back, even though he was not at the last meeting, he fully supports the reduction in the personal property taxes. He is glad we were able to come up with that solution for our citizens because it was sticker shock and he can say personally; his wife bought a car last year that they tell me is worth $8,000 more than what it was valued at last year; another $362 for that one vehicle. He was glad we were able to make those adjustments. He is also glad the State allowed us to make those adjustments because when he brought it up he was not sure we would be allowed to do that. He is glad we were able to and glad it was passed. He wasn’t here last meeting, but he would have been part of that unanimous vote. Supervisor Hooker stated she also attended in the last couple of weeks a 200 Plan summary meeting and it was well attended and appreciated the input from our citizens. She expressed her appreciation, again, to our staff for all the incredible work, tirelessly, working to find a solution to how best handle this unexpected increase and how to get it back to the citizens. She does not think enough can be said for how much they worked to make it happen. We are so appreciative and it looks good on us, but we just passed the vote, but they did the heavy lifting ahead of time. She is very appreciative of that. Supervisor Mahoney advised on April 15, 2022, he was truly honored to attend the Police awards luncheon. Mr. Caywood, Mr. Blount, Ms. Owens were also in April 26, 2022 594 attendance. It is truly inspiring to listen to the stories of our Police officers and the things they have done that often times does not make the news media. The only time it makes the news media, if an officer makes a mistake. He thinks what Chief Hall has done in recognizing our officers for the good things they accomplish for our citizens. It was a very wonderful event and it was a good lunch, too. As Supervisor North indicated, several of us attended the Roanoke City Counsel meeting when they approved our land use request for the fire station and we thanked the Mayor and City Counsel for that. There is a lot of work to go forward, but we are on a path that hopefully will have that station up and running in a year or so and we will be in good shape to protect the citizens in that part of the County. He also attended the legislative wrap-up with Supervisor North, very frustrating, he thinks we are all stuck in a holding pattern until the General Assembly fulfills its duties and responsibilities. Finally, he attended a Go 200 Meeting at Cave Spring Elementary. He is a little jealous, because everybody is talking about what great turnout they have had, but he thinks there were three (3) citizens; it was sparsely attended. He just hopes our citizens understand what we are trying to accomplish with that initiative. Chairman Mahoney recessed to the fourth floor at 4:00 p.m. for work session. IN RE: WORK SESSIONS 1. Work session with the Board of Supervisors to provide Freedom of Information Act (FOIA) training (Peter S. Lubeck, County Attorney) Mr. Lubeck provided a PowerPoint presentation to provide the necessary training on the Freedom of Information Act (FOIA) in accordance with State code. Supervisor Mahoney inquired of any FOIA request had been presented for this subject with Mr. Lubeck responding in the negative.
