Audio and video recordings of this meeting will be held on file for a minimum of five (5) years in the office of the Clerk to the Board of Supervisors. IN RE: OPENING CEREMONIES Before the meeting was called to order, Amy Bordeaux of Fire Church of Christian Scientist provided an invocation. The Pledge of Allegiance was recited by all present. IN RE: CALL TO ORDER Chairman Hooker called the meeting to order at 3:01 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Martha B. Hooker; Supervisors Paul M. Mahoney, Phil C. North, P. Lubeck, County Attorney; Amy Whittaker, Public Information Officer and Deborah C. Jacks, Chief Deputy Clerk to the Board IN RE: NEW BUSINESS 1. Resolution of the Board of Supervisors of Roanoke County, Virginia declaring its intention to reimburse expenditures from the proceeds of a financing for costs associated with the new Career and Technical Education Center (CTE) and renovations to Glen Cove and W.E. Cundiff Elementary Schools (Laurie Gearheart, Director of Finance and Management Services) Ms. Gearheart outlined the request. August 22, 2023 292 Supervisor North stated when looking at the Board packet, there is an amount spent through June 30, 2023 of $4.3 million. Was that the land purchase with Ms. Gearheart responding in the affirmative clarify that was the grant they received. Supervisor Radford stated the current proposal has an opening by this Friday. Can you confirm that we are not obligating anything and if the proposal’s offer is under financed, will this affect us. Ms. Gearheart explained no it would not, we just would not use the resolution. There was no further discussion. RESOLUTION 082223-1 OF THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA, DECLARING ITS INTENTION TO REIMBURSE ITSELF FROM THE PROCEEDS OF ONE OR MORE FINANCINGS FOR CAPITAL PROJECTS FOR PUBLIC SCHOOL PURPOSES WHEREAS, the Board of Supervisors of the County of Roanoke, Virginia (the "County"), has determined that it may be necessary or desirable to advance money to pay the costs of certain capital projects for public school purposes, consisting primarily of costs associated with the design and construction to renovate W.E. Cundiff Elementary and Glen Cove Elementary Schools and the design and construction of a new Career and Technical Education Center (CTE) described in the County's capital improvement program, as it may be amended from time to time (the "Projects"). NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE COUNTY OF ROANOKE, VIRGINIA: 1. The Board of Supervisors adopts this Resolution as a declaration of official intent under Treasury Regulations Section 1.150-2. 2. The Board of Supervisors reasonably expects to reimburse advances made or to be made by the County or the Roanoke County School Board to pay the costs of the Projects from the proceeds of its debt or other financings (collectively, the "Bonds"). The maximum amount of debt or other financing expected to be issued in one or more series for the Projects is $121,560,000. 3. On the date each advance is made, it will be a capital expenditure (or would be with a proper election) under general federal income tax principles or will otherwise comply with the requirements of Treasury Regulations Section 1.150-2(d)(3). 4. The County reasonably expects to reimburse the advances made prior to the issuance of the Bonds to finance the Project from the proceeds of the Bonds and the adoption of this Resolution is consistent with the budgetary and financial circumstances of the County. 5. This resolution shall take effect immediately upon its adoption. On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor Radford and carried by the following recorded vote: August 22, 2023 293 AYES: Supervisors Peters, Mahoney, Radford, Radford, Hooker NAYS: None IN RE: FIRST READING OF ORDINANCES 1. Ordinance 1) accepting funds in the amount of $465,091 from the Virginia Department of Rail and Public Transportation and appropriating such funds to the County’s grant fund for operation of the CORTRAN program, and 2) reallocating $19,379 from the County’s general fund to the grant fund, for operation of the CORTRAN program (Paula Benke, CORTRAN Program Administrator) Ms. Benke outlined the request to accept and appropriate the funds. Supervisor asked if we can apply again next year with Ms. Benke responding in the affirmative. Supervisor Mahoney stated from the Board report we applied for more money than we actually received, based on our expenditures for the last two years, will that amount be sufficient to cover our costs or are we going to need more money. Ms. Benke responded they have been coming in under budget. There was no further discussion. Supervisor North’s motion to approve the first reading and set the second reading for September 12, 2023, was seconded by Supervisor Mahoney and approved by the following vote: AYES: Supervisors Peters, Mahoney, North, Radford Hooker NAYS: None 2. Ordinance 1) accepting $170,709 from the Virginia Department of Rail and Public Transportation and appropriating such funds to the County’s grant fund for fiscal years 2024 and 2025 for expanded shuttle service to the National Park Service’s McAfee Knob trailhead parking lot, and 2) reappropriating $42,677 of County funds from the general fund to the grant fund for expanded shuttle service to the McAfee Knob trailhead parking lot (Megan G. Cronise, Assistant Director of Planning) Ms. Cronise outlined the request to accept and appropriate the funds. August 22, 2023 294 Supervisor Mahoney stated you requested more money than received; are we going to have to tap into general funds; is the County at risk if to make up the difference if the ridership, usage and the cost increases. Ms. Cronise responded the strategy we have been using the last few years because we received quite a bit of funding from the CORTRAN program, the County budgets the full amount of the project and offset what they have in grant funds. The extra funding has been available to help with the McAfee Trailhead shuttle. Supervisor North asked if we could look into what is available from the Federal government; he left a brochure on Mr. Blount’s desk that was full of opportunities to ask for funds. Supervisor Hooker’s motion to approve the first reading and set the second reading for September 12, 2023, was seconded by Supervisor Radford and approved by the following vote: AYES: Supervisors Peters, Mahoney, North, Radford Hooker NAYS: None IN RE: PUBLIC HEARING AND SECOND READING OF ORDINANCES 1. On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor North and carried by the following recorded vote: August 22, 2023 297 AYES: Supervisors Peters, Mahoney, Radford, Radford, Hooker NAYS: None A-082223-2.d A-082223-2.e A-082223-2.f RESOLUTION 082223-2.g EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO GINGER WYNN, TECHNICAL ANALYST II, UPON HER RETIREMENT AFTER MORE THAN TWENTY-FIVE (25) YEARS OF SERVICE WHEREAS, Ginger Wynn was employed by Roanoke County on February 2, 1998; and WHEREAS, Ms. Wynn retired effective August 1, 2023, after twenty-five (25 years and six (6) months of devoted, faithful and expert service to Roanoke County; and WHEREAS, Ms. Wynn served as Computer Operator, Technology Support Technician, Technical Support Technician and Technical Analyst II during her employment in the Communication and Information Technology Department; and WHEREAS, Ms. Wynn, through her employment with Roanoke County, has been instrumental in improving the quality of life and providing services to the citizens of Roanoke County; and WHEREAS, throughout Ms. Wynn’s tenure with Roanoke County, she has performed crucial printing processes in the form of payrolls, Personal Property Tax and Real Estate billings for the County, the Roanoke County Public Schools, the Town of Vinton, and the Western Virginia Regional Jail. Ms. Wynn also managed the multi- million-dollar County Computer Inventory program without any discrepancies. She was instrumental in the development and refinement of the County Technical Contact program that solicited departmental volunteers to assist with both minor computer issues and with large program deployments. She was the department representative on the Employee Advisory Council. Most notably; she assisted thousands of users and vendors with troubles and access issues and has become known as “The Voice of the Information Technology Department”. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to GINGER WYNN for more than twenty-five (25) years of capable, loyal and dedicated service to Roanoke County; and FURTHER, the Board of Supervisors does express its best wishes for a happy and productive retirement. August 22, 2023 298 On motion of Supervisor Peters to adopt the resolution, seconded by Supervisor North and carried by the following recorded vote: AYES: Supervisors Peters, Mahoney, Radford, Radford, Hooker NAYS: None A-082223-2.h A-082223-2.i ORDINANCE 082223-2.j ADOPTING AMENDMENT TO 1988 MEMORANDUM OF AGREEMENT AMONG ROANOKE COUNTY, CITY OF ROANOKE AND THE CITY OF SALEM FOR OPERATION OF A REGIONAL FIRE TRAINING CENTER WHEREAS, in 1988, Roanoke County, City of Roanoke and City of Salem entered into a Memorandum of Agreement for construction, maintenance and operation of the Roanoke Valley Regional Fire-EMS Training Center; and WHEREAS, the Agreement will expire on 31 March 2024; and WHEREAS, in 2019, Roanoke County assumed all Fire-EMS responsibilities for the Town of Vinton; and WHEREAS, the agencies anticipate making significant changes to the terms and conditions of the 1988 Agreement; and WHEREAS, an extension of the Agreement in effect from 1 April 2024 through 30 June 2024 will allow the parties additional time to negotiate the terms of a new Agreement and further, will cause the new Agreement to align with the localities’ fiscal year; and WHEREAS, Section 15.2-1300 of the Code of Virginia, 1950, as amended, requires that inter-governmental agreements involving joint exercise of powers, privileges or authority be accomplished by ordinance; the first reading of this ordinance was held on July 25, 2023, and the second reading was held on August 22, 2023. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Amendment to the Agreement between the County, the City of Roanoke, and the City of Salem with regard to the Regional Fire Training Center, is hereby authorized and approved. 2. That the County Administrator, Deputy County Administrator, or Assistant County Administrator is authorized to execute the agreement and other related documents on behalf of the County, and to take all such further action as any of them may deem necessary or desirable in connection with this project. On motion of Supervisor Peters to adopt the ordinance, seconded by Supervisor North and carried by the following recorded vote: AYES: Supervisors Peters, Mahoney, North, Radford, Hooker NAYS: None ORDINANCE 082223-2.k ACCEPTING FUNDS IN THE AMOUNT OF $1,275,000 FROM THE CARBON REDUCTION PROGRAM, AND APPROPRIATING SUCH FUNDS TO THE COUNTY’S GRANT FUND FOR THE CONSTRUCTION OF THE ROANOKE RIVER GREENWAY THROUGH EXPLORE PARK (VDOT UPC 113567) WHEREAS, it is a priority to construct the Roanoke River Greenway through Roanoke County; and WHEREAS, the County was awarded Regional Surface Transportation Program (RSTP) grant funds, now named the Surface Transportation Block Grant (STBG), in the amount of $3,020,308 in 2018 for design and construction of the Roanoke River Greenway through Explore Park; and WHEREAS, the County was awarded Carbon Reduction Program (CRP) funding in the amount of $1,275,000 in April 2023 to satisfy a project deficit; and WHEREAS, the project is locally administered, and certain agreements between the County of Roanoke and the Virginia Department of Transportation (VDOT) must be executed for this cooperative work to be accomplished; and WHEREAS, Section 18.04 of the Roanoke County Charter provides that funds be appropriated by ordinance; and WHEREAS, the first reading of this ordinance was held on July 25, 2023, and the second reading was held on August 22, 2023. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia as follows: 1. That the sum of $1,275,000 is accepted from the CRP and appropriated to the County’s Grant Fund for the purpose of completing the Roanoke River Greenway through Explore Park. 2. That the Roanoke County Board of Supervisors hereby grants authority for the County Administrator, Deputy County Administrator or Assistant County Administrator to execute project agreements. 3. On motion of Supervisor Peters to adopt the ordinance, seconded by Supervisor North and carried by the following recorded vote: August 22, 2023 300 AYES: Supervisors Peters, Mahoney, North, Radford, Hooker NAYS: None ORDINANCE 082223-2.l AUTHORIZING THE ACQUISITION OF PERMANENT AND TEMPORARY EASEMENTS AT EXPLORE PARK ON PROPERTIES OWNED BY THE VIRGINIA RECREATIONAL FACILITIES AUTHORITY (ROANOKE COUNTY TAX MAP NUMBERS 080.00-05-24.00-0000, 080.00-05-26.00- 0000, 080.00-05-27.00-0000, 080.00-05-29.00-0000, 080.00-05- 30.00-0000, 080.00-05-31.00-0000, AND 080.00-05-32.00-0000) FOR DEVELOPMENT OF THE ROANOKE RIVER GREENWAY, VINTON MAGISTERIAL DISTRICT WHEREAS, the Roanoke River Greenway is a developing bicycle and pedestrian trail identified in the regionally approved 2018 Roanoke Valley Greenway Plan, adopted by Roanoke City, Roanoke County, Botetourt County, City of Salem and the Town of Vinton; WHEREAS, the 2007 Roanoke County Comprehensive Master Plan for Parks and Facilities identified the development of greenways and trails as a high priority desired by citizens in Roanoke County; WHEREAS, the 2016 Explore Park Adventure Plan adopted by the Roanoke County Board of Supervisors and the Virginia Recreational Facilities Authority (“VRFA”) support extension of the Roanoke River Greenway through Explore Park; WHEREAS, Roanoke County is overseeing the design and construction of the Roanoke River Greenway proposed through Explore Park; WHEREAS, easements are needed for the eastern section of the Roanoke River Greenway across portions of the VRFA’s seven (7) properties designated as Roanoke County Tax Map Numbers 080.00-05-24.00-0000, 080.00-05-26.00-0000, 080.00-05- 27.00-0000, 080.00-05-29.00-0000, 080.00-05-30.00-0000, 080.00-05-31.00-0000, 080.00-05-32.00-0000 and more particularly described on a plat titled “PLAT SHOWING TEMPORARY CONSTRUCTION EASEMENTS, PERMANENT DRAINAGE EASEMENTS & A PERMANENT GREENWAY EASEMENT ON THE PROPERTIES OF VIRGINIA RECREATIONAL FACILITIES AUTHORITY COUNTY OF ROANOKE, VIRGINIA” prepared by H & B Surveying and Mapping, LLC and dated May 31, 2023, which is attached hereto as “Exhibit A” (herein referred to as the “Plat”); WHEREAS, the VRFA has agreed to the conveyance of a permanent greenway easement over those parcels of land located in Roanoke County to Roanoke County for use as a public access trail, the location of which is shown on the Plat; WHEREAS, the VRFA has also agreed to the conveyance of certain other drainage and temporary construction easements to Roanoke County for construction and maintenance of the project, the location of which is shown on the Plat; and August 22, 2023 301 WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition and conveyance of real estate interests be accomplished by ordinance; the first reading of this ordinance was held on July 25, 2023, and the second reading was held on August 22, 2023. NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors of the County of Roanoke, Virginia, as follows: 1. Statement of Treasurer's Accountability per Investment and Portfolio Policy as of July 31, 2023 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Radford stated he wanted to update the Board and Roanoke County citizens an update on the School Board about the model policies regarding transgender. The new policy states, “Every day, throughout the Commonwealth of Virginia, educators and school leaders work to ensure that all students have an opportunity to receive a high-quality education. As a part of that work, educators strive to meet the individual needs of all students entrusted to their care, and teachers work to create educational environments where all students thrive. The Virginia Department of Education (the “Department”) recognizes that each child is a unique individual with distinctive abilities and characteristics that should be valued and respected. All students have the right to attend school in an environment free from discrimination, harassment, or bullying. The Department supports efforts to protect and encourage respect for all students. Thus, we have a collective responsibility to address topics such as the treatment of transgender students with necessary compassion and respect for all students.” Given that the State law requires local school board to adopt policies that are consistent with the model policies developed by the VDOE, this is what the current administration did and the School Board adopted that. Also, at the end of the meeting, the four school Board members, Mike Wray, Cheryl Facciani, Tim Greenway and Brent Hudson all spoke and thanked the speakers for exercising their first amendment right, speaking their mind and were able to do that. Some of the School Board members also spoke about the SRO’s and their deployment out into the elementary schools and how that has increased and they talked about the upcoming CTE and construction and August 22, 2023 303 remodeling of the two (2) elementary schools. This leads me onto another School Board topic. Proposals are due by August 25, 2023, this Friday, for the construction of the new CTE and the remodel and addition of two (2) elementary schools. Currently there is only one proposal that did not include solar option that he has talked about many times. It fulfills all of the other requirement. His hope is that there will be more proposals submitted that offer a solar option and owner financing. He also thanked the School Board for giving us our annual athletic passes for the year. We always like to see these sports, especially you need to go to Glenvar because they happen to have all of the winning teams. Supervisor North stated on August 16, 2023, Chairman Hooker, Eldon James, our rep in Richmond and he met with the Governor’s staff on potential funding for the CTE school. This was a very productive meeting and will lead to further discussion with our team. On August 17, 2023, he chaired the VACo Transportation Steering Committee; learned of changes to the Smart Scale funding for transportation. The risk of reducing the potential for 12 applications to 6 for funds for the region and only two (2) for Roanoke County directly is concerning, specially since the State as a $5.1 billion surplus. Tomorrow, we will tune into the governor’s update on the surplus and later meet with Delegate Austin, VACo and Commissioner Birch on funding to improve unpaved roadways in the Commonwealth. Regions 10 and 11, encompassing th 14 counties are set to meet September 6 and address this concern on secondary road fund. Supervisor Hooker stated they had a really good session at VACo; she sits on the Education Steering Committee and there was a very robust conversation. We talked a lot about construction and the funding formulas for getting those monies to the localities and really advocating for some changes to that funding formula. It was a good session, but we are not there yet. Chairman Hooker recessed to the third floor for work session at: 3:32 p.m. IN RE: WORK SESSION 1. Work session to discuss Reimagine Roanoke County's Administration Center with the Board of Supervisors (George Assaid, Capital Projects Administrator) Mr. Caywood provided an overview and turned the meeting over to George Assaid who went through a PowerPoint presentation, a copy of which is on file in the office of the Clerk to the Board of Supervisors. Supervisor Mahoney asked is much of the HVAC equipment in the mechanical room? Where they show mechanical and boiler, is it there? I guess the second question is this building is so old, is the newer HVAC equipment bigger or smaller in size so that you need a different configuration to accommodate that? Mr. Assaid responded the boiler room is the smaller room as you can see that it is here. We August 22, 2023 304 have one boiler in there, it's a large boiler. We can do redundant boilers. I think that's the direction we'd like to go and high efficiency boilers and go that direction. That is the mechanical room where it has everything from mostly electrical in the rest of it. Supervisor Radford then added to make the building more efficient with the equipment, we have got to make it less porous. If we spend money on replacing all the HVAC, we will have wasted our money. We have got to stop the leakage. That's the concept we use in our residential. You have to stop the leakage because you're just throwing good dollars at a bad situation. Mr. Assaid responded correct and in addition to not only that, we have pneumatic controls and we really need to get to where we have digital controls. And one of the things with this building, the VAV boxes that are above the ceiling, which is really just for cooling in this case, that we don't have heat in them, we don't have the heating coil. If we had a heating coil in it, we can control spaces better. The humidity level we can change, can be warmer, we can have varying controls for different spaces. We do not really have that now. We run heat around the perimeter and the air conditioning at the same time. That's really why the HVAC replacement is so important and why it's on the CIP. Next, Doug Blount, Assistant County Administrator, provided the Board with a print out of the Allstate building (a copy of which is on file in the office of the Clerk to the Board of Supervisors). Mr. Caywood stated the building is basically a cube farm, nice building with lots of parking. Supervisor Peters stated this building is our downtown, there is value to stay here. He notes this building is an embarrassment for customer facing and has not been well kept; what king of message is being sent. Supervisor Radford commented steel lasts forever; location is paramount. Supervisor North asked where will this fall in our CIP? Supervisor Peters stated we do not need to building all the fire stations, just need to maintain staffing. Mr. Caywood advised staff will work on a little more and flush out more ideas. We will see if we can fund short-term items and see how we lay out something more substantial and decide when we can roll into the CIP. It was the consensus of the Board to go with option 2, which is full renovations of the existing RCAC facility to include HVAC, plumbing, and electrical systems replacements, building envelope component replacement, new partition walls and doors, and improving site circulation and amenities.
