IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Chairman Minnix advised that Supervisor Nickens would be unable to attend the meeting and has requested that any action regarding the issuance of general obligation school bonds or support of improvements to Bent Mountain Road (Route 221) be postponed until the September 26, 1995 meeting. Supervisor Eddy added an Executive Session item regarding appointments to the Urban Partnership Board. IN RE: I PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS h Introduction of exchanqe visitors from OÞole. Poland and briefing of their activities while in the United States. Mr. Hodge introduced the members of the delegation from Opole, Poland: Leszek Pogan, Mayor, City of Opole; Andrzej Namyslo, Chairman, Opole City council; Grazyna Frister, Opole ci ty Administrator; and Zbigniew Bartkiewiez, Center for Local Democracy, Translator. Chairman Minnix presented them with honorary citizen certificates and a Roanoke County flag. - IN RE: NEW BUSINESS h ProÞosal to change refuse collection route I ~ ~ I .. I .~ September 12. 1995 w schedules. Director) (William Rand. General Services A-91295-1 Mr. Rand reported that approximately 23,100 households are now receiving automated collection service which was phased in beginning in 1988. with each phase staff attempted to allocate resources evenly throughout the County which resulted in an inefficient collection schedule with trucks and personnel spread through the County. The schedule also required tremendous drive time for foremen as well as those crews attempting to provide backup assistance. Mr. Rand advised that the proposed schedule would make better use of resources and only affect those homes receiving automated service. Backup capability and supervisory support will be increased by concentrating all vehicles in one collection area, and the number of backup vehicles is increased by one. Approximately 9,900 automated households will be affected by the change, but only 900 will move more than one day. Following discussion, it was the consensus of the Board that in addition to other education options, a letter should be sent to every household in Roanoke County regarding the changes so that they will be aware of them. In response to a question from Supervisor Johnson ,regarding maintenance of trucks on a possible second shift, Mr. Hodge advised they are still discussing this issue with the ~ ,.... 622 September 12, 1995 school administration. Relations Director) for video equiÞment for the (Anne Marie Green. Community A-91295-2 , Ms. Green reported that in the past it has been difficult for the audience and the media at Board meetings to see video tapes or the visual presentations made by the speakers at the podium. It is now possible to install three television monitors in the room along with a video player so that everyone at the meeting can view them. The cost for three monitors and related equipment is $3900, with funding available in the grant received from Booth Communications as part of the recent franchise agreement. (Timothv Gubala. Economic DeveloÞment Director) R-91295-3 Mr. Gubala advised that Rusco window Company has announced the location of its new manufacturing facility in Roanoke County. The County has committed to provide incentives to assist Rusco in the development of its site at Valley TechPark. Funds in the amount of $127,500 need to be donated to the Industrial Development Authority to assist this effort. The funds are for $120,000 toward site development costs and $7,500 for legal, surveying and recordation fees. In response to a question from Supervisor Minnix, Mr. Gubala advised that the company will employ a total of" 80 employees with 25 new positions over the next several years. Supervisor Kohinke moved to approve the funding. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Eddy, Minnix NAYS: None ABSENT: Supervisor Nickens RESOLUTION 91295-3 APPROVING REQUEST OF THE INDUSTRIAL DEVELOPMENT AUTHORITY OF ROANOKE COUNTY, VIRGINIA, FOR APPROPRIATION AND DONATION OF FUNDS ~ ,.... 624 September 12. 1995 WHEREAS, the Board of Supervisors of Roanoke County, Virginia, and the Industrial Development Authority of Roanoke County, Virginia, (IDA), desire to promote and encourage the economic development of Roanoke County, Virginia, and the Roanoke Valley by retaining employment opportunities within the Roanoke Valley, in order to provide for increased employment and corporate investment in the County; and WHEREAS, this increased employment and investment constitutes a valid public purpose for the expenditure of public funds; and WHEREAS, the County desires to support these economic development efforts of the IDA by donating public funds to the IDA in accordance with the provisions of Section 15.1-511.1 of the Code of Virginia. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $127,500 is hereby appropriated and donated to the Industrial Development Authority of Roanoke County and that this appropriation of public funds be made from the county' s unappropriated balance 2. That this appropriation and donation to the IDA is made for the following economic development purpose: a. To contribute $120,000 towards site development costs on an approximate 13 acre site in' Valley TechPark which is being donated to Rusco Windows of Roanoke, Inc. l þ I I ~ I I .~ September 12, 1995 625 b. Engineering & InsÞections Director) ~ ,.... 626 September 12, 1995 þ Mr. Covey advised that in 1993, Roanoke County retained from Norma Jean Sigmon a 20 foot water and sewer easement for the development of the County's south loop water transmission line. Strauss Construction purchased the property for a single family residential subdivision, and subdivided the property known as section 1. The 20 foot water and sanitary sewer easements lies within section 1 and is beneath Monet Drive. In order for Monet Drive to be accepted into the VDOT secondary road system, VDOT requires that the right-of-way be free and clear of any third party rights or encumbrances. The proposed ordinance would authorize the County to execute the necessary documents for quit- claim, release the easement within the boundaries of Monet Drive, I and would be effective for so long as the subject section of Monet Drive is used as part of the public street or highway system. Supervisor Kohinke moved to approve the first reading and set the second reading for September 26, 1995. In 1977 the original sewer line was replaced and a new 20 foot wide sewer easement was obtained. David N. and Tamera L. Monroe have requested that the Board of Supervisors vacate the portion of the 12 foot sanitary sewer line. easement so that they may build a garage~in their backyard. All costs associated with the vacation will be the responsibility of the petitioners. Supervisor Kohinke moved to adopt the ordinance. Slovensky conveyed to the Roanoke County Sanitation Department, (predecessor in title to the Board of Supervisors of Roanoke County, Virginia), a sewer line easement, twelve feet (12') in width, across a tract of land owned by Mr. Slovensky, in connection with the sewer system to serve Springlawn Subdivision; and, I l ~ I I .~ September 12, 1995 ~ WHEREAS, John A. Slovensky, subsequently subdivided and developed said tract of land into Springlawn Subdivision, as shown upon the plat dated February 19, 1960, made by T. P. Monroe, husband and wife, are the current owners of Lot 8, Block 1, Map of Springlawn; and, WHEREAS, the petitioners have requested that the Board of Supervisors of Roanoke County, Virginia, vacate the twelve foot (12') sanitary sewer easement located on said lot; and, WHEREAS, the vacation will be accomplished without cost to the County and meets the requirements of the utility Department. That pursuant to the provisions of section 16.01 of the Charter of Roanoke County, the subject real estate (easement) is hereby declared to be surplus and the nature of the interest in real estate renders it unavailable for other pUblic uses; and, 3. That the 12' sanitary sewer easement (Deed Book 647, page 476) across Lot 8, Block I, Map of Springlawn, in the II Cave Spring Magisterial District, owned by David ~. Monroe and Tamera L. Monroe, husband and wife, be, and hereby is, vacated; and, 4. GJ2 September 12, 1995 þ WHEREAS, Appalachian Power Company (APCO) requires a right of way for an overhead line or lines and related improvements across Vinyard Park II to provide electric service for irrigation of the soccer fields, as shown on APCO Drawing No. R-3134, dated July 5, 1995; and, WHEREAS, the proposed right of way will serve the interests of the pUblic and is necessary for the public health, safety, and welfare of citizens of the county of Roanoke. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. WHEREAS, by Ordinance No. 2308, adopted May 22, 1979, the County of Roanoke granted unto Booth American Company of Detroit, Michigan, doing business as Salem Cable TV, a franchise to operate a community antenna/cable television (CATV) system, which franchise ordinance requires the approval of the Board of Supervisors of the County of Roanoke to any transfer or sale of its franchise rights by Booth American Company; and WHEREAS, by Ordinance 102594-12, adopted October 25, 1994, the County of Roanoke granted unto Booth American Company of Detroit, Michigan, doing business as Salem Cable TV, an extension of the term of this franchise for a term of five (5) years; and WHEREAS, Booth American Company has formed Booth Communications of Virginia, Inc. as a wholly-owned subsidiary corporation for the purpose of owning and operating Salem Cable TV in the franchise area of Roanoke County; and WHEREAS, the first reading of this ordinance was held on August 22, 1995, and the second reading was held on September 12,1995. That the assignment of the cable television franchise granted to Booth American Company by Ordinance 102594- 12 and of the Cable Television Franchise Agreement dated October 28, 1994, to its wholly owned subsidiary, Booth Communications of Virginia, Inc. is approved. 2. The County Administrator is hereby authorized to execute such agreements, including a Guaranty of Performance, with Booth American Company to carry into effect this transfer all upon such form as shall be approved by the County Attorney. 3. This ordinance shall be in effect from and after I its enactment. School SuÞerintendent) II Dr. Gordon presented the report, and advised that the School Board has expressed support to move forward with the ~ ,.... 6J6 September 12, 1995 þ renovations to Cave Spring Junior High School. She indicated that she was aware that the Board of Supervisors would prefer recei ving the consultant's report on southwest County schools before making a decision, but that Cave Spring Junior High School will be used for at least five more years. School Board member Buck Mitchell advised that these renovation have been requested as far back as 1990. School Board Chairman Jerry Canada also requested that the Board adopt the resolution. Finance Director Diane Hyatt advised that in order to participate in the fall 1995 bond sale, a resolution must be adopted by September 18; otherwise the County will have to wait until the spring of 1996 to participate. II Ms. Mary Nasca, Cave Spring Junior High School PTA President, 5013 Upland Game Road, Roanoke, spoke in support of the issuance of the bonds. She explained that Cave Spring Junior High School will be the last school in the County to be air conditioned and receive upgraded electrical wiring. She described the overheated conditions that the students and teachers had to cope with during the school day. In response to questions from the supervisors, Ms. Hyatt advised that the costs will increase by $1 million if the County waits because of changes to the building code. Architect Ron Martin explained that the specifications are based on the 1990 building code and if the County waits, the 1993 building code will be used which is more restrictive. I l ~ I I .~ September 12, 1995 &J7 In response to questions from Supervisor Eddy, Mr. Mahoney advised that it was legal to lend the School Board funds if the Supervisors chose not to go forward with the literary loans, and Mr. Hodge advised that he would support lending the money from the County to the School Board for the renovations until the spring 1996 bond sale. Chairman Minnix announced that Supervisor Nickens had requested that this item be postponed to September 26 since he could not attend this meeting. Supervisor Eddy moved to postpone action until September 26, 1995. The motion was defeated by the following recorded vote: AYES: - Supervisors Eddy NAYS: Supervisors JOhnson, Kohinke, Minnix ABSENT: Supervisor Nickens Supervisors Eddy, Kohinke and Johnson advised that they could not support this issue at this time. Supervisor Minnix announced that he supported the renovations because it may take years to build a new high school and close the junior high school. Supervisor Minnix moved to adopt the resolution authorizing $2.5 million general obligation school bonds. Mr. Hodge advised that they are evaluating the various parcels and the number under consideration has been reduced from 45 to 30. Mr. Hodge emphasized that the process is voluntary and that the land will only be rezoned with the owner's agreement. 'SuÞervisor Eddy: (1) He asked about responses that have been received to the letter that Chairman Minnix wrote regarding the formation of a proposed Regional Council of Governments. Chairman Minnix has received only one response from Mayor Bowers , City of Roanoke. (2) He asked whether Roanoke County will consider the model BPOL ordinance recommended by VACo/VML. Mr. Mahoney advised that staff is meeting to review the model ordinance and that he will probably bring it to the Board in October. (3) He expressed appreciation to Congressman Goodlatte for his work ,on the cellular tower legislation, and asked if anyone had written to our legislators. Mr. Mahoney responded affirmatively, and said that he would provide copies of the letter. (4) He announced that an Organ and Tissue Donation Commission meeting is scheduled and complimented Mary Allen for getting the commission going. (5) He asked about the proposed work sessions on: (a) Vehicle Replacement Policy. Mr. Hodge advised that the work session will be held on October 10, 1995. (b) Policy for Athletic Fields. Mr. Mahoney is bringing a proposed ordinance to the Board on September 26, 1995. (6) He asked about the status of the debarment proceedings with Wayne Engineering. Mr. Mahoney advised that he is working on a solution and that he hopes to bring it back to the September 26, 1995 meeting. (7) He asked why it will take until next spring to replace Fire and Rescue Chief after Chief Tommy Fuqua's retirement. He reported that the study to improve Route 221 began in 1974. The first phase was improvement from the Roanoke City line to Route 419, and the second phase was improvement from Route 419 to Coleman Road. The third phase will be from Coleman Road to Old Mill Road. VDOT is recommending continued study of two corridors, one to the north which generally follows the existing road, and one to the south of the current road known as Corridor C. He advised there was pros and cons to either corridor and that staff recommended continued study of both corridors. Jeff EChols, Resident Engineer wi th VDOT, explained that a corridor as described in road improvements means a wide ~ ,.... 648 September 12, 1995 þ swath, not a single line.
