Roanoke, Virginia 24018 January 3, 1994 The Roanoke county Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the organizational meeting and the 3rd day of January, 1994. I IN RE: CALL TO ORDER Chairman Minnix calcled the meeting to order at 9: 05 a.m. The roll call was taken. KEHBERSC PRESENT: Chairman H. Odell "Fuzzy" Minnix, Vice Chairman Lee B. Eddy, Supervisors Edward G. KOhinke, Bob L. Johnson, Harry C. Nickens MEKBERS ABSENT: None STAFF PRESENT: Elmer C. Hodge, County Administrator; Paul M. Mahoney, County Attorney; Mary H. Allen, Clerk to the Board; John M. Chambliss, Assistant County Administrator, Don C. Myers, Assistant County Administrator, Anne Marie Green, Community Relations IN RE: OPENING CEREMONIES I The invocation was given by Supervisor Harry C. Nickens. The Pledge of Allegiance was recited by all present. IN RE: REQUEST TO ADD AGENDA ITEMS County Administrator Elmer Hodge added an Executive ~ "... 002· January 3, 1994 Session Item 2.1-344 A (5) Discussion of a Prospective Business, and advised that action may take place following the Executi ve Session. Supervisor Nickens asked about the Planning Retreat on January 7, 1994. Mr. Hodge advised that Explore Park will not be available and suggested using the Board of Supervisors Conference Room. IN RE: ORGANIZATION OF COUNTY BOARD ~ Electio" of Officers .L.. Chairman Supervisor Minnix nominated Supervisor Eddy to serve as Chairman. Supervisor Johnson nominated Supervisor Minnix to serve as Chairman. Supervisor Eddy was elected by the following recorded vote: AYES: Gupervisors Kohinke, Minnix, Eddy. NAYS: Supervisors Johnson, Nickens b. vice chairman Supervisor Eddy nominated Supervisor Kohinke to serve as vice Chairman. Supervisor Johnson nominated Supervisor Minnix to serve as Vice Chairman. Supervisor Kohinke was elected by the following recorded vote. AYES: Supervisors KOhinke, Minnix, Eddy. Rules of Order and Schedule for Board Meetinas in 1994. R-1394-1 Supervisor Nick~ns moved to adopt the prepared resolution amended to eliminate the November 8 meeting because it fell on I Election Day, and the April 5 meeting because it was during the school spring break. Mr. Hodge and Chairman Eddy will determine if additional meetings are necessary in those months. The motion carried by the following recorded vote: AYES: Sup~rvisors Johnson, KOhinke, Minnix, Nickens, Eddy. NAYS: None RESOLUTION 1394-1 ESTABLISHING A MEETING SCHEDULE FOR THE BOARD OF SUPERVISORS OF ROANOKE COUNTY FOR CALENDAR YEAR 1994 AND ADOPTING RULES OF PROCEDURE FOR SUCH MEETING BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That for calendar year 1994, the regular meetings of the Board of Supervisors of Roanoke County, Virginia, are set forth below with public hearings scheduled for 7:00 o'clock p.m. unless I otherwise advertised. That no second to motions shall be required in order to consider that motion; and b. That the chairman may make motions, participate in debate and vote on all matters considered by the Board. c. That no amendment or addition to the printed agenda be permitted unless approved by unanimous vote of all Board members present, unless requested by the County Administrator or the County Attorney as a matter requiring immediate attention. This provision applies to Main Motions and shall not apply to I privileged Motions, Subsidiary Motions, Incidental Motions, or Motions That Bring a Question Again Before the Board. On motion of Supervisor Nickens to adopt the resolution amended to eliminate the November 8 meeting because of Election Day, and eliminate April 5 meeting because of Spring Break, and carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Eddy, Nickens, Minnix NAYS: None IN RE: EXECUTIVE SESSION At 9: 15 a.m., Supervisor Johnson moved to go into Executive Session pursuant to the Code of Virginia 2.1-344 A (5) to discuss a prospective business where no previous announcement has I been made of the business' interest in locating in the County. The .s motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy ~ ,.. ~~6 a~ January 3, 1994 NAYS: None IN RE: CERTIFICATION RESOLUTION At 9:40 a.m., Supervisor Johnson moved to return to Open Session and adopt the certification Resolution. The motion was carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None RESOLUTION 1394-2 CEkTIFYING EXECUTIVE MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened an executive meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such executi ve meeting was conducted in conformity with virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting which this certification resolution applies, and 2. On motion of Supervisor Johnson to adopt the certification Resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Eddy, Nickens, Minnix NAYS: None IN RE: REQUEST FOR APPROPRIATION AND DONATION OF FtJHDS TO THE ROANOKE COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY Economic Development Director Timothy Gubala advised that I an economic development prospect has indicated an interest in relocating its warehousing and distribution facilities to Roanoke County. . The prospect has requested certain incentives, and the Industrial Development Authority will assist in the matter. The IDA would acquire 15 acres on Hollins Road from the Friendship Manor Apartment Village Corporation for $272,500. Mr. Gubala asked the Board to adopt a resolution appropriating the funds from the Unappropriated Balance and donating it to the IDA. Supervisors Eddy and Johnson advised they would abstain because of the possible appearance of conflict of interest. Supervisor Kohinke moved to adopt the resolution. The motion carried by the following recorded vote: I AYES: Supervisors Kohinke, Nickens, Minnix NAYS: None ABSTAIN: Supervisors Johnson, Eddy ~ ,.. 008 January 3, 1994 RESOLUTION 1394-3 APPROPRIATING AND DONATING PUBLIC FtJHDS TO THE ROANOKE COUNTY INDUSTRIAL DEVELOPMENT AUTHORITY WHEREAS, the Board of Supervisors of Roanoke County, Virginia, and the Industrial Development Authority of Roanoke County (IDA) desire to promote and encourage the economic development of Roanoke County, Virginia, and the Roanoke Valley by the recruitment of new industry for the Roanoke Valley, in order to provide for increased employment and corporate investment in the County; and WHEREAS, this increased employment and investment constitutes a valid public purpose for the expenditure of public funds; and WHEREAS, the County desires to support these economic development efforts of the IDA by donating public funds to the IDA in accordance with the provisions of § 15.1-511.1 of the Code of Virginia. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the sum of $272,500 is hereby appropriated and donated to the Industrial Development Authority of Roanoke County. That this appropriation of public funds is made from the County's unappropriated balance. 2. That this appropriation and donation to the IDA is made for the following economic development purpose: a. To acquire 15 acres of real estate on the west side of State Route 601, Hollins Road, from the Friendship Manor ~ þ I I ~ ~ 009 '3i J-~ ~, 1:9"94 Apartment Village Corporation. 3. That the appropriate officers or agents of the County are hereby authorized and directed to take such actions as may be necessary to accomplish the purposes of this resolution, and all actions taken by such officers and agents in connection with this transaction are hereby ratified and confirmed. 4. That this resolution shall take effect immediately.
