The Board of Supervisors of Roanoke County, Virginia, met
this day at the Roanoke County Administration Center, this being the
fourth Tuesday, and the second regularly scheduled meeting of the
month of January, 1994.

CALL TO ORDER
Chairman Eddy called the meeting to order at 3:05 p.m. The
roll call was taken.

Boy Scout Troop 224, Den 4, from Back Creek Elementary School and
recited by all present.

ITEMS
Mr. Mahoney added Item 8 to the Consent Agenda: Donation of
right-of-way to the Board of Supervisors of Roanoke County in
connection with extension of Spring Grove Drive.
Mr. Hodge added to the Executive Session Item 2.1-244 A: (3)
Consideration of disposition of public property. I
Chairman Eddy announced that due to the inclement weather,
the Planning Commission was unable to meet in January, and the evening
session has been cancelled because there were no advertised public
hearings.

PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS
Mr. Hodge expressed his appreciation to the staff and others
for their assistance during the recent bad weather.
Mr. Hodge announced that there will be an Appreciation
Reception to thank those involved in moving the County offices to the
new Roanoke County Administration Center. It will be held at the new
RCAC on the fourth floor at 4:30 p.m., February 8, 1994.

NEW BUSINESS
~ Reauest for AdoDtion of ProDosal to Strenathen Vehicle
Decal Enforcement. (Don C. Mvers. Assistant County

Mr. Myers advised that as requested at the January 11, 1994
meeting, the Board has been furnished with more information about a
proposal from Chief Cease to create a traffic unit with decal
enforcement as part of their responsibilities. He advised that since
decal enforcement is primarily the responsibility of the Commissioner
of Revenue, staff recommends adding one person to the Commissioner's
staff either now or during the budget process.
Captain Jack McCorkle and Lieutenant Stephen Turner from the
Police Department responded to questions from the Board members.
After discussion, Supervisor Nickens moved to authorize the
creation of a police traffic unit which will consist of four officers
and associated equipment with the understanding that the unit would
actually go into service at beginning of fiscal year July 1st; and
prior to that time, the Police Chief is authorized to recruit the
necessary people and get them started through the academy; and
authorization of a part-time clerk for monitoring so that the Board
can re-evaluate on a quarterly basis. The motion carried by the

Mr. Smi th advised that this is a proposal to change the
method of collecting bulk and brush to improve the efficiency and
decrease the number of staff required.
The proposal is to use two
knuckle boom trucks with collection to be made twice per month on a
call-in basis. He advised that rules will be established for
regulating the size of brush piles, the number of bulk items, and
scheduling of the pickups after a call is received.
After discussion, Supervisor Minnix moved to approve th~1
appropriation of $132,600 from the General Fund Balance. The motion

Mr. Myers advised that at the January 11, 1994 meeting, a
decision on this item was postponed, and the Board requested that
staff look at reducing expenses in the General Services area. One
opportunity for reducing expenses has been addressed by adopting thel

new method of collecting bulk and brush. He advised that the benefit
from other reductions will be felt in the next fiscal year, and the
request for $400,000 needs to be approved to supplement the budget for
the current year.

Mr. Mahoney advised that this is the third claim received
from Roanoke City with respect to the on-going dispute over the
interpretation of the 1979 water contract. He recommended that the
Board reject the claim as previously rejected in July, 1992, and
March, 1993, and allow Roanoke City to amend the pending lawsuit to
include the fiscal year 1992-93 amounts.
Mr. Mahoney advised it has been agreed to divide the pending
lawsuit into (1) a constitutional question;· and (2) a contract
int~rpretation question, and that a hearing on the constitution
question has been set for April 14, 1994.
Supervisor Johnson moved to deny the claim. The motion

~ Recommendations and ReDort on Phase I of the structural
Investiaation of the Roanoke County Courthouse.

Mr. Chambliss advised that in November, 1992, Sherertz
Franklin Crawford Shaffner, Inc. performed a structural study of the
County Courthouse because of cracks in the walls and some of the
internal partitions separating from the exterior walls.
It is the
opinion of the consultants that the structure is safe and can be
occupied with no danger to the public. I
After reviewing the study, staff recommends that the brick
soffits be corrected immediately, and monies for corrt::ctions to the
window wall and modifications of the wall coverings in the courtroom
and other public areas be considered in the 1994-95 fiscal year
budget.
Staff is requesting that $14,000 be appropriated from the
Courthouse Capital Reserve with $6,000 to cover the cost of the study
and $8,000 to correct the brick soffit problems. Staff does not feel
that a Phase II study by the consultants is needed at this time.
Mr. Chambliss advised that he will contact the Judicial
Committee for their approval of this appropriation.
Supervisor Nickens moved to approve the appropriation of
$14,000 to correct the brick soffits and pay for the study.

ORDINANCE 12594-6 FOR AUTHORIZATION TO ACQUIRE
NECESSARY EASEMENTS AND PROPERTY TO CONSTRUCT THE
SOUTH TRANSHISSION LINE AND THE STARKEY ROAD WATER
PROJECT
WHEREAS, location plans for the South Transmission Line
proj ect and the Starkey Road Water Line Proj ect have been completed
and the projects will require acquisition of easements across certain
properties; and,
WHEREAS, said easements are to be acquired to facilitate any
future construction of the water line project; and, I
WHEREAS, Section 18.04 of the Roanoke County Charter directs
that the acquisition of real estate be accomplished by ordinance; the
first reading of this ordinance was held on January 11, 1994, and the
second reading was held on January 25, 1994.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF

Virginia Department of Transportation meeting on February 3, 1994,
concerning the route for I-73. Mr. Hodge advised that Arnold Covey
will attend. Supervisor Nickens asked that staff contact the
Congressional delegation to strengthen position on I-66 and I-73, and
that efforts be coordinated. (2) He announced that there will be a
New Century Council presentation tonight at 7: 30 p. m. at Virginia
Western.

WORK SESSIONS
~ Jail Feasibility study
Sheriff Gerald Holt summarized the feasibility study made by
Hayes, Seay, Mattern, and Mattern, Inc. to renovate and add to the
Roanoke County/Salem Jail. The study determined that a total of 514
inmates could be housed in comp11ance with current minimum standards
at the current site and this could be accomplished through four phases
of construction and implementation.
He advised that in order to receive matching funds from the
Sate for any construction or renovations, an application must be II
completed and submitted to the state by March 1, 1994.
Sheriff Hol-:: introduced Sheriff E. B. Obenshain from the
City of Salem, Bob Cooper,
from the Virginia Department of
Corrections, and Dan Bolt, Project Programmer, and Warren Wertz,
Engineer, from HSM&M.
After discussion, it was the consensus of the Board for
Sheriff Holt to proceed with the preparation of the application for
funds in order to meet the state deadline of March, 1994, with the
decision on specific items to be delayed for two weeks until the
report could be reviewed fully by the Board Members.

Virginia has convened an executive meeting on this date pursuant to an
affirmative recorded vote and in accordance with the provisions of The
Virginia Freedom of Information Act; and
WHEREAS, section 2.1-344.1 of the Code of Virginia requires
a certification by the Board of supervisors of Roanoke county,
Virginia, that such executive meeting was conducted in conformity with
Virginia law.

EXDenditures for FY 1994-95
Brent Robertson, Budget Manager, updated the Board on the
status of the Fiscal Year 1994-95 budget process, focusing on the
projected revenues and the potential significant expenditure issues.
Mr. Hodge advised that the public hearings to set the real
c
estate, personal property and machinery and tools tax rates will be
held on February 22, 1994.
There was some discussion and Supervisor Eddy requested that
the fOllowing items be considered during the budget discussions: (1)
Capital Improvement Program;
(2) Vehicle Replacement Policy;
(3)
Health Insurance;
(4) Allocation to Camp Roanoke;
(5)
Fees for
recreation programs;
(6) Low band radio for tourism;
and ( 7 )
Recycling Program.

PUBLIC HEARING AND SECOND READING OF ORDINANCES
Chairman Eddy announced that due to the inclement weather,
the Planning Commission did not hold their January meeting, and the
public hearings for the following ordinances were never advertised.
He announced that second readings and public hearings will be held at
the February 22, 1994 meeting, and that CMH Homes, Inc., petitioner,
had withdrawn its request for a special use permit.
