Budaet Manaaer) R-3894-1 County Administrator Elmer Hodge advised that the public hearing was held on February 22 and it is necessary to approve the tax rates at this time to allow the Treasurer adequate time to print the bills. Supervisor Johnson moved to approve the resolution setting the tax rate at $1.13 per $100 of assessed valuation. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy I NAYS: None RESOLUTION 3894-1 SETTING THE TAX RATE ON REAL ESTATE SITUATE IN ROANOKE COUHTYFOR THE CALENDAR YEAR 1994 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the levy for the twelve-month period beginning January 1, 1994, and ending December 31, 1994, be, and hereby is, set for a tax rate of $1.13 per one hundred dollars of assessed valuation on all taxable real estate and mobile homes classified by §§ 58.1-3200, 58.1-3201, and 58.1-3506.B of the 1950 Code of Virginia, as amended, situate in Roanoke County. Supervisor Minnix moved to adopt the resolution setting the personal property tax rate at $3.50 per $100 of assessed I valuation and the machinery and tools tax rate at $3.00 per $100 of assessed valuation. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None RESOLUTION,3894-2 SETTING THE'TAX LEVY ON ALL CLASSES OF PERSONAL PROPERTY SITUATE IN ROANOKE COUNTY FOR THE CALENDAR YEAR 1994 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the levy for the twelve-month period beginning January 1, 1994, and ending December 31, 1994, be, and I hereby is, set for a tax rate of $3.50 per one hundred dollars of assessed valuation on all taxable, tangible personal property, excluding all those classes of household goods and personal ~ ,.. 124 March 8, 1994 effects as are defined in §§ 58.1-3504 and 58.1-3505 of the 1950 Code of Virginia, as amended, but including the property separately classified by §§ 58.1-3500, 58.1-3501, 58.1-3502, 58.1-3506 in the 1950 Code of Virginia, as amended, of public service corporations based upon the assessed value thereof fixed by the state Corporation Commission and duly certified. 2. That there be, and hereby is, established as a separate class of personal property in Roanoke County those items of personal property set forth in § 58.1-3506 of the 1950 Code of Virginia, as amended, and adopted by Ordinance No. 121592-11, and generally designated as Motor Vehicles for Disabled Veterans 3. That the levy for the twelve-month period beginning January 1, 1994, and ending December 31, 1994, be, and hereby is, set at fifty (SO%) nercent of the tax rate established in paragraph 1 for the taxable, tangible personal property as herein established as a separate classification for tax purposes and as more fully defined by § 58.1-3506 of the 1950 Code of Virginia, as amended, and generally designated as Motor Vehicles for Disabled Veterans. 4. That there be, and hereby is, established as a separate class of personal property in Roanoke County those 'items of personal property set forth in § 58.1-3507 of the 1950 Code of Virginia, as amended, and generally designated as machinery and tools. 5. On motion of Supervisor Minnix to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None L. Reauest for Funds County Facilities Administrator) for storm Related Damaae to (Elmer C. Hodae.. County A-3894-3 Mr. Hodge advised that he would prefer to absorb the expenses in the current budget at this time with the understanding that some departments may overrun their budget. The total expenses were: (1) storm related expenses from December and January - $68,663 including a police cruiser which was covered by insurance; (2) increased utility costs - $11,800; (3) requests for roof replacements at $148,000 and generators for fire and rescue facilities at $300,000 and (4) school weather related expenses of $26,700. Mr. Hodge advised that the roof replacements and generators would be included for consideration ~ ,.. 126 March 8, 1994 þ in the 1994-95 budget process. Supervisor Nickens moved to approve Alternative #3 to defer appropriation of funds until later in the budget year. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None ~ Reauest for Annroval of Aareement for the Purchase of Electricity from Annalachian Power Comnany. (Paul M. Mahoney.. County Attorney) R-3894-4 Mr. Mahoney reported that the Virginia Association of Counties and Virginia Municipal League appointed a committee and II hired lawyers and consultants to negotiate a new electricity agreement with Appalachian Power on behalf of all local governments served by APCO. Rates through December 31, 1993 increased 5%. From January 1, 1994 through June 30, 1995, rates will be revised downward to a 1.6% increase above rates in effect on June 30, 1993 and rates from July 1, 1995 through June 30, 1996 will reflect a 2.5% increase above the rates on June 30, 1993. The street light rates will also increase. The agreement has an addendum for electric service for the Spring Hollow Reservoir. Mr. Mahoney advised that he would like to clarify the rate differences he has identified and how the street light rate increase might affect the County's ability to approve new street I l 4 I I ~ March 8, 1994 m lights. Following discussion, Supervisor Nickens moved to approve the agreement and authorize Mr. Mahoney and Mr. Hodge to meet with VACo/VML and APCO to discuss differences identified in rates, as well as other storm-related issues. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None RESOLUTION 3894-4 APPROVING AND AUTHORIZING THE EXECUTION OF, AN AGREEMENT FOR THE PURCHASE OF ELECTRICITY FROM APPALACHIAN POWER COMPANY WHEREAS, Roanoke County and Appalachian Power Company desire to enter into a three year agreement commencing July 1, 1993 for the purchase of electricity for public purposes; and, WHEREAS, Roanoke County hàs benefitted from the professional assistance and expertise of the Virginia Municipal League and Virginia Association of Counties Steering Committee in negotiating ,an agreement for electricity with Appalachian Power Company for political subdivisions and public authorities in this service area; and, WHEREAS, the VML/VACo Steering Committee strongly recommends the agreement negotiated, since the rates negotiated by it result in significant savings for all participating locaîities; and, WHEREAS, this agreement establishes rates for general ~ ,.. 128 March 8, 1994 þ service, utility pumping and outdoor lighting/street lights. NOW THEREFORE, BE IT RESOLVED, BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA: 1) That the three year agreement commencing July 1, 1993 for the purchase of electricity from Appalachian Power Company is hereby approved and accepted. 2) That the County Administrator is hereby authorized to execute this agreement on behalf of the Board of Supervisors and Roanoke County, upon form approved by ,the County Attorney. On motion of Supervisor Nickens to approve agreement and authorize the County Attorney to meet with VACo/VML and APCO to discuss differences identified in rates, as well as storm- related issues, and carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None II IN RE: FIRST READING OF ORDINANCES .L. Ordinance Amendina and Reenactina sections of Article II.. Doas.. Cats.. and Other Animals.. of" Chanter 5.. Animals and Fowl of the Roanoke County Code to Reauire Licensure of cats.. to prohibit Unvaccinated Doas and Cats from Runnina at Larae.. to Limit the Number of Cats Der Dwellina unit.. to Provide for a Three Year License Tax for Doas and I l "'II1II 4 March R, 1994 m Cats.. to Increase the Board Fee for Imnounded Animals.. and to Define certain Acts Committed by Animals as Nuisances and Prescribina Penalties Therefore. (Josenh Obenshain.. Sr. Assistant County Attornev) Mr. Obenshain advised that this proposed ordinance would accomplish several changes to the County animal code. The primary amendments are: (1) require licensure of cats at the, same terms and fees as currently required for dogs; (2) add cats to the appropriate code sections and define animal nuisance; (3) create a three year animal license tax or fee; and (4) approve I the rate increase for animal shelter at the SPCA to $ 6. 00 per day. The following individuals spoke regarding the proposed ordinance: I 1. Mori Cochenar.. 3230 Woodland Drive.. S.W... asked for reconsideration of allowing two unneutered cats unless they are cat breeders, expressed support for the tiered licensing costs and suggested a public information campaign. 2. Gary K. Greer.. 3636 Bennett Snrinas Road.. expressed concern about the lack of animal control officers to handle dog complaints and felt the staff should resolve that problem first. Individual Board members expressed concern about port tons of the proposed ordinance, the possible increase in ~ ,.. 130 March 8, 1994 costs to add cats to the ordinance, and the lack of staff to handle the increased responsibilities. Several Board members offered suggestions to modify the ordinance, but there was no consensus on specific changes. Mr. Obenshain suggested that the Board members offer their suggestions before the second reading. Supervisor Johnson moved to approve the first reading of the ordinance and set the second reading for March 22, 1994. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens NAYS: Supervisor Eddy ~ Ordinance Vacatina a 15 foot Public utility Easement on Tax Parcel 94.02-2-21.19. Tract "A". located on Carriaae Hills Drive in the windsor Hills Maaisterial District. Unon the Petition of Keith and Diane Custer. (Arnold Covey. Director of Enaineerina , Insnections) Mr. Covey reported that Keith and Diane Custer are requesting vacation of the public utility easement because it would have no effect on any present or future public utilities at this location. Supervisor Eddy moved to approve the first reading of . . i the ord1nance and set the second read1ng for March 22, 1994. Ms. Brenda Duncan, 823 Clearwater expressed her concern that the County is not enforcing the current laws regarding Bingo Permits and was concerned that more organizations would move their bingo operations to the County. Supervisor Eddy moved to approve Item 3. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Eddy NAYS: Supervisor Nickens RESOLUTION 3894-5 APPROVING AND'CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM J - CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke I County, Virginia, as follows: 1. that the certain section of the agenda of the Board ~ ,.. 132 March 8, 1994 of Supervisors for March 8, 1994 designated as Item J - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 7, inclusive, as follows: 1. (2) He complimented the staff for their efforts during the recent ice storms. Sunervisor KOhinke: (1) He advised that the Catawba area will be getting automated refuse collection and there was a 50/50 acceptance of the program. Concerns included long driveways making it difficult to bring the cart to the road. He asked the staff to look at implementation in rural areas. (3) He asked about the joint meeting with Vinton. Mr. Hodge asked the Board members for dates that they would be available for the meeting. Sunervisors Nickens: (1) He announced that the Explore opening date has been extended to July 1, 1994, at 10 a.m. (2) He advised that he received a letter from APCO. He asked for an update from APCO on their plans to avoid problems from ice storms in the future. Mr. Hodge advised that APCO officials would like to attend a Board meeting in the future to present a video. (3) He advised that he read the Economic Development Activity Booklet and was pleased with the increased efforts to attract new business and industries. Sunervisor Eddy: (1) He announced that he and Mr . ~ ,.. 134 March 8, 1994 þ Hodge met with Botetourt County Chairman and County Administrator to discuss mutual issues. Secondary System Six Year Construction Plan and Revenue Sharina Pronosals The work session was presented by Arnold Covey, Director of Engineering & Inspections, and Jeff Echols and Scott Hodge from the Virginia Department of Transportation. They updated the Board on the following projects: (1) Countywide Items, (2) Rural Additions; (3) Roads scheduled to receive funding on the six Year Plan; (4) Projects dropped from the six Year Plan; (5) Gravel roads to Recommendations for additions to the receive funding; Six Year Plan; and (6) (7) I l ""I11III 4 March 8, 1994 as Recommendations for Revenue Sharing. Mr. Covey announced that a public hearing on the six Year Plan is scheduled for April 26, 1994. IN RE: RECESS At 6:20 p.m. Chairman Eddy declared a recess for dinner. Ordinance Authorizina the Temnorarv Relocation of the Pollina Place for the Hollins Votina Precinct from the Hollins Library to the North Roanoke Ba~tist Church (Paul Mahoney.. County Attorney) 0-3894-6 ~ ,... 136 March 8, 1994 There was no discussion and no citizens spoke on this ordinance. Supervisor Johnson moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None ORDINANCE 3894-6 AUTHORIZING THE TEMPORARY RELOCATION OF THE POLLING PLACE FOR THE HOLLINS VOTING PRECINCT FROM THE HOLLINS LIBRARY TO THE NORTH ROANOKE BAPTIST CHURCH PURSUANT TO S 24.2-306, 24.2-307, and 24.2-310 OF THE 19S0 CODE OF VIRGINIA, AS AMENDED WHEREAS, the Electoral Board of Roanoke County has recommended to the Board of Supervisors of Roanoke County the temporary relocation of the polling place for the Hollins Voting Precinct from the Hollins r.ibrary to the North Roanoke Baptist Church for the June 14 Democratic Primary election held within Roanoke County. NOW, THEREFORE, be it ordained by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the first reading on this ordinance was held on February 22, 1994; and the second reading and public hearing was held on March 8, 1994. 2. That the temporary relocation of the polling place for the Hollins Voting Precinct from the Hollins Library to the North Roanoke Baptist Church for the June 14 Democratic Primary election held wi thin Roanoke County is hereby authorized and approved. l þ I I ~ 4 Mareh R, 1994 13=7 3. That the County Administrator is hereby authorized to take such actions and to execute such documents as may be necessary to accomplish these purposes, all upon form approved by the County Attorney. On motion of Supervisor Johnson to adopt the ordinance, and carried by the fOllowing recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None IN RE: I CITIZENS' COMHENTS AND COMHUHICATIONS .L. Concerned citizens of Catawba Valley to sneak on Pronosed Interstate 73. Mr. Hodge updated the Board and audience of action taken regarding the proposed Interstate 73 route through the Catawba Valley (AI ternate 6). He advised that the Virginia Department of Transportation had ranked all of the proposed routes for the interstate, and this alternate ranked 5th. When cost figures were included, the route fell to 11th out of 12 alternates. I Bud Oakey, with the Roanoke Regional Chamber of Commerce, advised that he discussed this alternate with Secretary of Transportation Robert Martinez, and Secretary Martinez felt that the route through the Catawba Valley was ranked so low that it would not be considered. Nine citizens spoke in opposition to Interstate 73 ~ ,.. 138 March 8, 1994 Alternate 6 which comes through the Catawba Valley. They were: 1. Louise Garman, 8430 Gravel Hill Road, Catawba 2. Delbert J. Eyer, 7110 Blacksburg Road, Catawba 3. Jim Martin, 7150 Blacksburg Road, Catawba 4. Sharon Kennedy, 7388 Bending Oak Drive, Catawba 5. Deedie Kagey, 4496 Bonsack Road, Roanoke 6. Dr. William Gorge, 3130 Evergreen Lane, Roanoke 7. Lisa Ciaffone, 6900 Blacksburg Road, Catawba 8. Richard J. Kelly, 8564 Gravel Hill Road, catawba 9. Bob Peckman, 8131 Webster Drive, Roanoke Their concerns included the destruction of the beauty of the valley, ,the cost of this alternate route, the effect on real estate values, the historic and natural resources in the Catawba Valley, and the negative affect to the Appalchian Trail The Board of Supervisors expressed support for their previous resolution which supported another route through the Roanoke Valley, but advised that the resolution was not in support of Alternate 6 through the Catawba Valley. They directed staff to send a copy of all the citizen comments to Transportation Secretary Martinez so that the state would be aware of their concerns.
