R-41393-1 Chairman Minnix presented the members of the North Cross School Basketball Team and coaches with certificates of appreciation and County pins. The motion carried by the following recorded vote: AYES: Supervisors Kohinke, Eddy, Minnix NAYS: None ABSENT: Supervisors Johnson, Nickens RESOLUTION 41393-1 OF CONGRATULATIONS TO NORTH CROSS SCHOOL BASKETBALL TEAM FOR WINNING THE VIRGINIA INDEPENDENT SCHOOLS CHAMPIONSHIP WHEREAS, the North Cross School Basketball Team, coached by Jim Muscaro, Dutch Muscaro, and Scott Caldwell, had an outstanding 1993 season, achieving an overall record of 27 wins and 6 losses; and WHEREAS, throughout the year, the members of I the team demonstrated the qualities of good sportsmanship, ~ ~ ~ April 13, 1993 220 I I athletic ability and teamwork; and WHEREAS, the North Cross School Basketball Team won the 1993 Virginia Independent School Basketball Championship, after participating in the tournament in Alexandria and winning matches against Richmond Collegiate, Teagle Christian, Trinity Episcopal and st. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, does her¢by extend its congratulations to the NORTH CROSS SCHOOL BASKETBALL TEAM for winning the 1993 Virginia Independent Schools Basketball Championship; and FURTHER, BE IT RESOLVED that the Board of Supervisors commends the North Cross School Basketball Team for demonstrating outstanding athletic skill and good spor=smanship throughout the season and tournament. The motion carried by the following recorded vote: AYES: Supervisors Kohinke, Eddy, Minnix NAYS: None ABSENT: Supervisors Johnson, Nickens ~ ~ I I ~ April 13, 1993 2'2 Z ~ IN RE: NEW BUSINESS ~ Request for Authorization to Submit a Pinkard Court Planninq Grant to the Virqinia DeDartment of Housinq and Community DeveloDment. (Janet Scheid, Planninq & zoning) R-41393-2 I Ms. Scheid reported that when the Administrative Offices move to the Trë.velers Building, the Recreation Department will be consolidating their functions at the Administration Center. As a resul t, The Leisure Arts Center located in Pinkard Court will be vacated. Ms. Scheid advised that staff had met with residents of the neighborhood and several alternatives were suggested including a community center, small- scale apartments for either the elderly and/or physically disabled individuals, and a day care center. She advised that the Planning staff recommended that the County apply for a Community Development Block Grant Program planning grant to explore the housing option. The grant will include preliminary engineering and design activities and cost estimates. At the end of the grant the County would donate the facility to a responsible entity to follow through with construction. The $12,000 grant will be for one year. Supervisor Eddy inquired whether the County's involvement would end with the planning grant. Ms. Scheid responded that it could end at that time, or after application for a Community Development Block Grant construction grant. The motion carried by the following recorded vote: AYES: Supervisors KOhinke, Eddy, Minnix NAYS: None ABSENT: Supervisors Johnson, Nickens RESOLUTION 41393-2 AUTHORIZING THE APPLICATION FOR A PLANNING GRANT FROM THE VIRGINIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT WHEREAS, the Virginia Department of Housing and Community Development administers Community Development Block Grants for the Commonwealth of Virginia; and WHEREAS, the Roanoke County Department of Planning and Zoning recommends that the County apply for a Virginia Community Development Block Grant/Planning Grant to conduct preliminary engineering and design studies and prepare cost estimates to analyze the feasibility of converting the Leisure Arts Center into apartments for the elderly and the physically disabled; and WHEREAS, Roanoke County will, at the end of the Planning Grant, donate the Leisure Arts Center to an entity that , will be responsible for the construction phase of this project. NOW, THEREFORE be it resolved by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County Administrator is hereby authorized to submit an application to the Department of Housing and Community Development for a Virginia Community Development Block .... ~ I I I I ~ April 13, 1993 224 Grant/Planning Grant to conduct preliminary engineering and design studies and prepare costs estimates to analyze the feasibility of converting the Leisure Arts Center into apartments for the elderly and physically disabled. 2. That if the Virginia Department of Housing and Community Development awards this grant to Roanoke County, then this grant will be submitted to the Board of Supervisors for form21 acceptance. 3. That the grant amount will include $1,000 in in- kind services to be provided by County staff. On motion of Supervisor Eddy to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Kohinke, Eddy, Minnix NAYS: None ABSENT: Supervisors Johnson, Nickens L. Request for Appropriation to Fund Enqineering Consultant for UDqrade for the Reqiona1 Wastewater Treatment Facilities. (Clifford Craiq, utility Director) Mr. Craig advised that Finkbeiner, Pettis and Strout (FPS) have completed initial work on assisting the City of Salem, Town of vinton and Counties of Botetourt and Roanoke in negotiations with the City of Roanoke for upgrade of the Regional Wastewater Treatment Facilities. The localities have now requested FPS to represent them in the actual negotiations with ~ III'" 225 ~' April 13, 1993 Roanoke City at an estimated cost to Roanoke County of $12,000. Mr. Craig requested that the funds be appropriated from the Starkey Sewer Pump Station Project for the County's share of funding the consultant. Following discussion, Supervisor Eddy announced that he did not have enough information and would like to know more about the capacity allocation and cost allocation of the sewage treatm;nt plant. Supervisor Eddy moved to hold an Executive Session after the regular session and defer action until following the Executive Session. The motion was defeated by the following recorded vote: AYES: Supervisors Eddy NAYS: Supervisors Kohinke, Minnix ABSENT: Supervisors Johnson, Nickens Supervisor Minnix moved to approve the staff recommendation. Mr. Mahoney advised that appropriations can only be approved by the majority of the entire Board and not the majority of those present. He reminded the Board that two members were absent. Supervisor Minnix withdrew his motion and asked that the matter be deferred to the April 27, 1993 Board Meeting when all members will be present. Supervisor Eddy requested that the consultant attend the April 27, 1993 Board Meeting. ~ Request for ADDroval of Finance Agreement with .... ~ I I I I ~ April 13, 1993 '226 Richfield for Payment of Water Connection Fee. (Clifford Craiq, utility Director) Mr. Craig advised that Richfield Retirement Community does not meet the requirements in the current policy whereby the Board could pay the water connection fees. They have requested to pay the fee over three years with no interest char,ged as recognition of their economic benefit to the County. The ordinance requires that the fee must be increased by twenty percent to include interest. Mr. Craig recommended that the Board of Supervisors approve an agreement with Richfield whereby Richfield could 'pay the $125,000 water connection fee in 36 equal payments and the County would pay the $25,020 interest. In response to a question from Supervisor KOhinke, Mr. Craig advised that there is no precedent for this action, and that this is the first time a nonprofit organization has asked for assistance. In response to an inquiry from Supervisor Eddy, he advised that there are not many organizations similar to Richfield so this action would not set a precedent that could include requests from housing developers. Supervisor Eddy moved to approve the request. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Minnix NAYS: Supervisor Kohinke ABSENT: Supervisors Johnson, Nickens Mr. Mahoney advised that the motion failed because there was no majority vote by the entire Board. ~ ".. 227 April 13, 1993 Supervisor Eddy moved to reconsider. Mr. Mahoney ruled that the motion was invalid' because Supervisor Eddy was not on the prevailing side. Supervisor Kohinke moved to reconsider and defer the matter to the April 27,1993 Board Meeting when all Board members will be present. The motion carried by the following recorded vote: AYES: NAYS: ABSENT: Supervisors Kohinke, Eddy, Minnix None Supervisors Johnson, Nickens ~ Request for ADproval of Agreement with East Tennessee Natural Gas COmDany for Constructinq a Gas Line at SDrinq Hollow Reservoir., (Clifford Craiq, utility Director) A-41393-3 Mr. Craig reported that East Tennessee Natural Gas owns and operates a transmission line within a right of way across the Spring Hollow Reservoir property. In order to flood the area, East Tennessee needs to relocate or parallel the existing gas line. They have decided to construct river weights on the existing gas line and construct a parallel gas line within the existing right-of-way. An agreement has been prepared whereby Roanoke County will pay the total cost of the construction estimated at $486,000. Mr. craig requested that the Board authorize execution of the agreement. Supervisor Minnix moved to approve the agreement. (Clifford craiq, utility Director) A-41393-4 Mr. Craig advised that staff has developed a tentative agreement with Appalachian Power to provide power for the 'Spring I Hollow facility. The agreement will be an addendum to the existing agreement dated August 12, 1991. The 1991 agreement is due for renewal this year and negotiations are being scheduled at this time. Future electrical service costs for Spring Hollow will be negotiated as part of the Public Authority Rate. Supervisor Eddy moved to approve the agreement. ".. 229 " ' April 13, 1993 ~ ~ DeDartment services Related to Traffic Control for Parades and Investiqations Backqround for Concealed WeaDons Permits and Conservators of the Peace. (Paul Mahoney, County Attorney) Senior Assistant county Attorney Joseph Obenshain reported that the ordinance proposed establishes three classifications of parades. An administrative fee would be calculated for Class I parades based upon the size and duration öf the parade. The charge for police officers would be the standard hourly rate of $18.00. Mr. Obenshain advised this ordinance also approves a fee schedule for initial investigation for both concealed weapons permits and conservator of the peace appointments. Supervisor Eddy asked if the hourly rate for police officers in the fee schedule for Class I parades would have to come to the Board for approval every time the rate changed. Mr. Obenshain responded that the ordinance was prepared that way but they could look at it before the Second Reading. Supervisor Minnix moved to approve the first reading of the ordinance. I I I I ~ April 13, 1993 230 L. Ordinance Authorizinq the Acquisition of 4.0 Acre Parcel of land from JoseDh H. Davis and Suzanne R. Widney for the SDrinq Hollow Reservoir proiect. (Paul MahoneY, County Attorney) Mr. Mahoney reported that in 1991, staff extended a written offer of' $4,000 for the parcel of land and the owners made a verbal counter-offer of $20,000. In November 1991, the Board authorized eminent domain proceedings. The owners have now indicated they will accept $6,000 for the purchase and requested that the County maintain a family cemetery located on an adjoining parcel. In response to a question from Supervisor Eddy regarding costs to maintain the cemetery, Assistant Administrator John Chambliss advised that the cemetery at Vineyard Park, is maintained at a cost of $300 - $400 annually. Mr. Mahoney emphasized that cemetery maintenance was an important issue to the property owners. Supervisor Kohinke moved to approve the first reading of the ordinance. Supervisor Minnix moved to approve the first reading of the ordinance. The motion carried by the following recorded vote: AYES: NAYS: ABSENT: IN RE: 0-41393-5 Supervisors KOhinke, Eddy, Minnix None Supervisors Johnson, Nickens SECOND READING OF ORDINANCES ~ Ordinance Rescindinq Resolution 11988-2 and Authorizinq the Lease of a Portion of the Back Creek Volunteer Fire COmDany ProDerty. (Paul Mahoney, County Attorney) Mr. Mahoney reported that at the first reading a Board member suggested the staff investigate the possibility of conveying the house and real estate to the Back Creek Volunteer Fire Company. He recommended that the property not be conveyed because: (1) it does not have frontage on 12 O'Clock Knob Road; (2) the tract does not have sufficient road frontage to meet County requirements; (3) the lot would conflict with the fire station parking lot; (4) the house and fire station share the ~ I I I I ~ April 13, 1993 232 same septic system; and (5) County ownership assures the future land use of the property. Supervisor Eddy moved to approve the ordinance wi th· change in the lease to indicate that the rental payments would go back to the Back Creek F ire Department. The motion carried by the following recorded vote: AYES: Supervisors Kohinke, Eddy, Minnix NAYS: None ABSENT: Supervisors Johnson, Nickens ORDINANCE 41393-5 RESCINDING RESOLUTION 11988-2 AND AUTHORIZING THE LEASE OF REAL ES- TATE, A PORTION OF THE BACK CREEK VOLUNTEER FIRE COMPANY PROPERTY (TAX MAP NO. 95.01-1- 4.1) BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to the provisions of Section 18.04 of the Charter of Roanoke County, a first reading and public hearing on an ordinance concerning the lease of a portion of the Back Creek Volunteer Fire Company property was held on March 23, 1993. The second reading on this matter was held on April 13, 1993. 2. That Resolution 11988-2 adopted on November 9, 1988, be, and hereby is, rescinded. 3. That it is in the County's best interests to delegate to the Back Creek Volunteer Fire Company the authority and responsibility to lease a portion of the Back Creek Volunteer ~ ,... 23,3 April 13, 1993 Fire Company property, subject to the provisions of an approved lease agreement. 4. That the County Administrator is authorized to execute such documents and take such actions on behalf of Roanoke County as are necessary to accomplish this transaction, all of which, shall be upon a form approved by the County Attorney. That this matter came this day to be heard upon the proceedings herein, and upon the application of .29 miles of Rome Drive, .06 miles extension of McIntosh Lane, and .05 miles extension of Huntridge Road to be accepted and made a part of the Secondary System of State Highways under section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said roads have heretofore been dedicated by virtue of a certain map known as The Orchards, Applewood, Section 7, Subdivision which map was recorded in Plat Book 13, Page 73, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on March I I I I ~ April 13, 1993 236 22, 1991 and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right- of -way from the abutting property owners is necessary. The Board hereby guarantees said drainage easements and a right-of- way for the street. 3. That said roads known as Rome Drive, McIntosh Lane, and Huntridge Road and which are shown on a certain sketch accompanying this Resolution, be, and t~e same are hereby established as public roads to become a part of the state Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said streets or highways by the Virginia Department of Transportation. On motion of Supervisor Kohinke to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors KOhinke, Eddy, Minnix NAYS: None ABSENT: Supervisors Johnson, Nickens RESOLUTION 41393-6.d AUTHORIZING THE SCHOOL BOARD OF ROANOKE COUNTY, VIRGINIA TO PAY THE CHAIRMAN OF THE SCHOOL BOARD ADDITIONAL COMPENSATION WHEREAS, Section 22.1-32. C of the Code of Virginia, 1950, as amended, authorizes any school board, in its discretion, to pay the chairman of the school board an additional salary not exceeding $1100 per year, upon the passage of an appropriate resolution by the governing body of the appropriate county, city ..... ,... 237 April 13, 1993 or town; and, WHEREAS, the Board of Supervisors of Roanoke County, Virginia, has been requested to adopt the appropriate resolution to accomplish this action. NOW THEREFORE, BE IT RESOLVED, By the Board of Supervisors of Roanoke County, Virginia: 1. That the School Board of Roanoke County, Virginia is hereby authorized in its discretion to pay the chairman of the school board an additional salary not exceeding $1100 per year, in accordance with the provisions of Section 22.1-32 of the Code of Virginia, 1950, as amended. 2. That this Resolution shall be in full force and effect from and after the date of its passage. 3. That the Clerk to the Board of Supervisors shall mail a certified copy of this Resolution to the Clerk to the School Board. On motion of Supervisor Kohinke to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors KOhinke, Eddy, Minnix NAYS: None ABSENT: Supervisor Johnson, Nickens IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Kohinke: (1) He attended the Fort Lewis Elementary School PTA with Supervisor Nickens to discuss the pros and cons of elected school boards. Supervisor Eddv: (1) He asked about the status of the ~ ~ I I ~ ~ April 13, 1993 23 8 I I boundary adjustment with Roanoke City and Town of vinton. Mr. Mahoney advised that the request is in the city Attorney's Office and has a low priority with the City. (2) He announced that he had been asked to serve on a committee to look at the Economic Development Partnership Bylaws and asked for suggested changes from the other board members. (3) He asked Mr. Hodge if the health insurance category for employee and one dependent could be added to the County ~ealthcare policy. Mr. Hodge will check and respond back by Friday, April 16, 1993. (4) He asked the other board members if they had recei ved any complaints about cars being parked on the road during the recent blizzard. Mr. Hodge and Supervisor Minnix responded that they had no complaints. (5) He asked about the state Compensation Board meeting in Salem and advised that he had a list of the other localities who received addi tional personnel because of j ail overcrowding. Mr. Hodge advised that he and others attended the meeting and made a plea for new positions. Goria Commercial Real Estate. ~ ,... 2·39 April 13, 1993 Mr. Goria complained of having to obtain sampling manholes in order to receive a permanent occupancy permit at his shopping mall on Route 419 and questioned the interpretation of the Sewer Use Ordinance. He advised that sampling manholes were not necessary in Roanoke City unless it was a industrial user. Staff explained that the County sewer use ordinance is the same as Roanoke City's ordinance and they assumed that the City followed the same requirements. Supervisor Eddy asked for a letter from the ci ty of Roanoke on how they interpret the Code pertaining to the installation of sampling manholes. Supervisor Minnix directed Mr. Mahoney to give Mr. Goria a copy of the Code and asked Mr. Hodge to respond to Mr. Goria in fourteen days. Mr. Hodge will report back on April 27, 1993. IN RE: WORK SESSIONS ~ Work Session to ModifY Sewer Use Ståndards for ADDlication to Private Sector SSEIR Proqram utility Director Clifford Craig advised that the draft ordinance is based upon Board comments and' direction. It provides for a graduated level of enforcement procedures based on the amount of infiltration and inflow in the public sewer system. In response to questions from Supervisor Eddy, Mr. Craig advised that they complete two or three houses per day and the only surprise they have found was some areas in higher elevations had 500 gallons per day of infiltration and inflow. In response to a question from Supervisor Kohinke, Mr. Craig advised that he did not think some of the homeowners were aware that they were causing the problems. He advised he plans to send out a mailing outlining the enforcement procedures. Supervisor Eddy asked that alternatives be included that would not terminate service but establish surcharge. The consensus of the Board was that the ordinance define that appeals will be limited to determination by the utility Director of I&I and will not include appeal of penalties.
