Roanoke, Virginia 24018 June 8, 1993 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the second Tuesday, and the first regularly scheduled meeting of the month I of June, 1993. The Pledge of Allegiance was recited by all present. IN RE: NEW BUSINESS h Reauest for Adoption of the Emerqencv Operations Plan. (Emerqencv Services Coordinator Larrv Loqan) R-6893-1 Deputy Chief Logan advised that the draft copy of the Emergency Operations Plan had previously been distributed to the Board of Supervisors. The plan describes emergency operations, assigns duties and responsibilities to agency heads, and serves as the basis for the development of programs and procedures in time of emerg~ncy. Deputy Chief Logan advised that corrections and suggestions by the Board members will be incorporated in the final document. He also reported that the County held a disaster exercise on May 26. Supervisor Nickens moved to adopt the Emergency Operations Plan. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Eddy, Nickens, Minnix NAYS: None RESOLUTION 6893-1 AUTHORIZING ADOPTION OF EMERGENCY OPERATIONS PLAN FOR ROANOKE COUNTY WHEREAS, the Board of Supervisors of the County of I I ~ ~ ~ June 8, 1993 372' Roanoke, Virginia, is greatly concerned with the health, safety, and well-being of its citizens and desires that the best possible emergency services be available to them; and WHEREAS, the Commonwealth of Virginia Emergency Services and Disaster Law of 1973, Chapter 3.2 of Title 44 of the Code of Virginia, 1950, as amended, requires that each city and county in the Commonwealth maintain an Emergency Operations Plan (EOP) which addresses its planned resp0tl3e to emergency situations; and WHEREAS, such an EOP has been developed by County staff in coordination with the Virginia Department of Emergency I Services incorporating input from responsible local agencies. l NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Roanoye, Virginia that, on the 8th day of June, 1993, it does hereby officially adopt the revised and current Roanoke County Emergency Operations Plan, to include plans and procedures for both peacetime and war-caused disasters. Reauest for Approval of Proposed Legislative Reauests for Virqinia Association of Counties. I (Paul M. Mahoney. County Attorney) The Board members made several suggestions and .... ~ 373 June 8, 1993 addi tions, and requested more information from Mr. Mahoney on certain items.· It was the consensus of the Board that Explore would be deleted from the VACo request and added as a local request. Supervisor Kohinke requested, and it was the Board consensus to ask for stronger D.U.l. legislation. Supervisor Eddy presented a list of requests and asked that they be reviewed. Following discussion, this item was continued to June 22, 1993. The Board will provide input and additional requests prior to the June 22, 1993 meeting. IN RE: FIRST READING OF ORDINANCES h Ordinances Amendinq Ordinance 82592-12. the zoning Ordinance and the Zoninq District Maps for Roanoke County. (Terry Harrinqton. Planninq & Zoninq Director) Supervisor Kohinke asked that the issues be separated for discussion and vote. h Ordinance Amendinq and Reenactinq Ordinance 82592-12. the Zoninq Ordinance for Roanoke County. bY the Adoption of certain Minor Amendments to Said ordinance. Mr. Harrington advised that the proposed amendments ~ ~ I I ~ ~ June 8, 1993 37\4 I I address minor areas of the new zoning ordinance including expansion of uses now permitted by Special use Permit, prohibiting the sale of firearms as a home occupation, exempting family and church cemeteries under certain conditions, and expanding the districts in which Day Care Center and Cultural Services are allowed by Special Use Permit. Supervisor Nickens moved to approve the first reading and set the public hearing for June 22, 1993. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Eddy, Nickens, Minnix NAYS: None Ih.. Ordinance Amendinq and Reenactinq Ordinance 82592-12. The Zoninq Ordinance for Roanoke County. by the Adoption of certain provisions Concerninq Amateur Radio Towers in the Various Zoninq Districts of the County. Mr. Harrington reported that after adoption of the new zoning ordinance, staff was advised that the Federal Communication Commission issued a limited preemption on the legal regulation of amateur radio towers which conflicts with the County's zoning ordinance. This ordinance attempted to address the conflicts. Supervisor Nickens moved to approve the first reading. The motion was withdrawn with no vote. The following individuals spoke in opposition to any .... ~ 3.75 June 8, 1993 ~ ordinance regulating amateur radio towers because the towers are already regulated by the FAA, and in their opinion, federal law prohibits local governments from enacting such ordinances: 1. The motion carried by the fOllowing recorded vote: AYES: Supervisors Johnson, Kohinke, Eddy, Nickens, Minnix NAYS: None The Clerk to the Board was directed to cancel the legal advertisement for the public hearing originally scheduled for June 22, 1993. Mr. Mahoney will review the citizen comments and suggested revisions to the ordinance. Staff was directed to survey other localities, and have the draft ordinance available for those citizens who request a copy. .... I I ~ I I ~ June 8, 1993 376 ~ Ordinance Amendinq and Reenactinq the Zoninq District Maps for Roanoke County by the Adoption of Certain Miscellaneous Chanqes Throuqhout the County of Said Maps. Mr. Harrington reported that the zoning map amendments resul ted from citizen comments and technical map errors. The Planning Commission recommended approval of six of the requested changes and denial of six of the requested changes. Two requests were tabled by the Planning Commission for further study. They were changes along the Blue Ridge Parkway and the Sowder property. Supervisor Eddy requested that the revised zoning for the Sears property be approved. Supervisor Kohinke requested that the revised zoning for the Old Virginia Brick property, the Wingate property, and the Moran property be approved. Supervisor Nickens asked that all requests be approved. Supervisor Kohinke moved to approve the first reading with the modifications as requested by the Board members, and set the public hearing for June 22, 1993. That the County Administrator may authorize or delegate the authorization of the transfer of any unencumbered balance or portion thereof from one department to another within a fund. 3. That all funded outstanding encumbrances, both operating and capital, at June 30, 1993, are reappropriated to the 1993-94 fiscal year to the same department and account for wh~.ch they are encumbered' in the previous year. 4. That appropriations designated for capital projects will not lapse at the end of the fiscal year but shall remain appropriated until the completion of the project or until the Board of Supervisors, by apprópriate action, changes or eliminates the appropriatiòn. Upon completion of a capital project, staff is authorized to close out the project and transfer to the funding source any remaining balances. This section applies to appropriations for Capital Projects at June 30, 1993, and appropriations in the 1993-94 budget. 5. That all school fund appropriations remaining at the end of the 1992-93 fiscal year not lapse but shall be appropriated to the School Capital Improvements Fund in fiscal year 1993-94. That this matter came this day to be heard upon the proceedings herein, and upon the application of Whipplewood Court from the intersection of Branderwood Drive (State Route 1960) to the cul-de-sac for a distance of 0.16 miles to be accepted and made a part of the Secondary System of State Highways under section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said road have heretofore been dedicated by virtue of a certain map known as ~ ~ I I ~ ~ June 8, 1993 386 I Forest Walk in Branderwood Section 5, Subdivision which map was recorded in Plat Book 13, Page 42, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on January 14, 1991, and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said drainage easements and a fifty (50) foot right-of-way for streets. 3. That said road known as Whipplewood Court and which is shown on a certain sketch accompanying this Resolution, be, and the same is hereby established as a public road to become a part of the State Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said street or highway by the Virginia Department of Transportation. Proclamations Siqned bY the Chairman IN RE: EMPLOYEE SERVICES AWARDS AND RECEPTION Chairman Minnix and Mr. Hodge presented certificates to County employees recognizing 5 years, 10 years, 15 years, 20 years, 25 years, and 30 years of service. IN RE: RECEPTION , Chairn~an Minnix declared a recess at 5: 10 p.m. for a reception honoring the employees who received recognition for their years of service to the County. Following the reception the Board and staff traveled to the Roanoke County/Salem jail for a work session. IN RE: WORK SESSION (5:50 P.M.) h Work Session and Dinner at the Sheriff's Office and Jail Facilities. Sheriff Holt presented the jail population statistics since 1966 and projected future average daily population through 2007. He explained that when the jail was built, the sixth floor was left open for future expansion. He advised that the current daily inmate 'population averaged 147 which does not include federal prisoners, and the facility only has 104 beds. Sheriff Holt recommended that an engineering study be conducted to determine the feasibility of completing the sixth floor and double bunking the prisoners. The cost of the study would be approximately $15,000, and the City of Salem would be asked to ~ ~ I I ~ June 8, 1993 38 8 ~ ~ fund their share. Mr. Hodge was directed to bring back a request for $15,000 for an engineering and feasibility study. Mr. Hodge advised that staff will investigate finanqing methods for the possibility of the sixth floor expansion.
