Roanoke, Virginia 24018 February 25, 1992 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the fourth Tuesday, and the second regularly scheduled meeting of the month of February, 1992. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS County Administrator Elmer Hodge requested a discussion on the fiscal year 1992-93 budget at the conclusion of the afternoon session. Chairman Eddy advised that Ms. Chappelle was unable to attend the board meeting and requested that the Resolution of I th~ Plan~ing Commission be placed on Appreciation for her service on the Consent Agenda. Chairman Eddy added a report from Mr. Hodge concerning the contamination of wells in North County. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None RESOLUTION 22592-2 OF CONGRATULATIONS TO NED DOWLING UPON WINNING THE ROANOKE COUNTY SCHOOL LOGO ART CONTEST WHEREAS, in 1991, Roanoke County in a contest among County employees adopted as a slogan, Roanoke County, Heart of the Blue Ridqe, representing both the geographic location of Roanoke County and the caring nature of its citizens and employees, and WHEREAS, at that time, it was determined that a similar contest should be conducted through the Roanoke County Schools for a visual design that would portray the image of the slogan, and WHEREAS, an art contest was sponsored by the Roanoke County Schools in which there were 31 entries in the contest from high school art students, and WHEREAS, Ned Dowling, a student at Cave Spring High School was chosen by the judges as the winner of the contest. NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, expresses its sincere congratulations to NED DOWLING for winning the Roanoke County School Logo Art Contest, and FURTHER, the Board of supervisors supports the future use of the slogan and visual design by the County in ways that may be deemed ..... Owen was present and recognized by Chairman Eddy. IN RE: NEW BUSINESS ~ status of Contamination of Wells in North County. Mr. Hodge advised that the Health Department and Water Control Board reported that the well supplying a trailer park in North County on Plantation Road was found to be contaminated with TCE (trichloroethylene). This trailer park of approximately 35 - 40 units has been put on the County water system and more connections may have to be made after further testing. Mr. Hodge requested that the Board grant permission to extend the County water lines to those residents whose wells are contaminated by TCE at a cost not to exceed $50,000 from the utility Fund, and give the residents until July 1st to pay their water connection fees. Mr. Neil Obenshain, Regional Director, Water Control Board, reported that sixteen wells were sampled Friday and half were found to be contaminated with TCE. Additional wells will be tested in other areas to determine the extent of the contamination. He indicated that one possible source of the chemical could be the ITT Gallium Arsenide Technology Center on Enon Drive and advised that there will be an ..o II"'" :118 February 25, 1992 ~ investigation to find the sources for a possible recovery of costs. Dr. Molly Hagan, Director, Alleghany Health Department, é" described TCE and advised that there are no immediate health risks from low-level exposure found in the wells. She recommended that residents whose wells tested for TCE should drink bottled water and install carbon filters until they can be hooked up to a safe water supply. Dr. Hagan advised that the County staff, tne Health Department and the Water Control Board will continue tq work closely together to monitor and remedy the situation. She recommended that residents with questions call either the Health Department or the Water Control Board. Supervisor Johnson advised that he will abstain because the I contaminate was discovered on a parcel of land wi th which he is professionally associated. Supervisor Nickens moved to grant Mr. Hodge's request to (1) extend County water lines to residents whose wells are contaminated by TCE at a cost of no greater than $50,000 from the utility Fund, but with authority to go beyond the cap in an emergency ·if necessary and (2) give residents until July 1st to pay water connection fees. The motion carried by the following recorded vote: AYES: Supervisors Kohinke, Minnix, Nickens, Eddy NAYS: None ABSTAIN: Supervisor Johnson I k Reauest for Reconsideration of County position on APCO ~ ~ I I "'1111 February 25, 1992 119 Power Line. A-22592-4 Supervisor Kohinke advised that he was requesting reconsideration of the Board action at the February 11, 1992, meeting which approved w~ thdrawing the letter of protest that the county Attorney sent to the State Corporation Commission and taking a neutral position on the APCO power line. He felt this letter of protest should not be withdrawn due to the many citizens' concerns expressed to him. Supervisor Nickens and Supervisor Johnson objected that the majority decision at the February 11, 1992 meeting had been countermanded by the Chairman without notification to the other members of the Board. Chairman Eddy responded that since Supervisor Kohinke notified him the next day of his intention to ask for the vote to be reconsidered, he felt it proper to suggest that the County Attorney take no action until this meeting. Supervisor Johnson directed that the record state that the County has no jurisdiction in making decisions concerning the power line and the power line is the responsibility of the State Corporation Commission. Charles Simmons, vice President with Appalachian Power Company, was present to answer questions. Supervisor Kohinke moved to reconsider the County position on the APCO power line. L. Reauest to ADDrove Roanoke Reqional AirDort Commission I Fiscal Year 1992-1993 Budqet. R-22592-5 Ms. Hyatt advised that the Roanoke Regional Airport Commission's budget contains revenues of $4,483,231, expenditures of $3,969,751 with the capital expenditure program totaling $1,542,100. Roanoke County will continue to make its annual payment of $264,640 wi th no additional supplements for this budget being requested from either Roanoke County or Roanoke City. After discussion, Supervisor Nickens moved to approve the budget and adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors JohnsOn, Kohinke, Minnix, Nickens, Eddy I NAYS: None ~ ~ I I ""'l1lI 12 1 ~, February 25, 1992 RESOLUTION 22592-5 APPROVING THE ROANOKE REGIONAL AIRPORT COMMISSION BUDGET FOR FY 1992-1993, UPON CERTAIN TERMS AND CONDITIONS WHEREAS, Section 24.B of the Roanoke Regional Airport Commission Act and Section 17.(a) of the contract between the City of Roanoke, Roanoke County, and the Roanoke Regional Airport Commission provide that the Commission shall prepare and submit its operating budget for the forthcoming fiscal year to the Board of Supervisors of the County and City Council of the city¡ and WHEREAS, by report dated February 13, 1992, a copy of which is on file in the office of the Clerk to the Board, the Vice-Chairman of the Roanoke Regional Airport Commission has submitted a request that the County approve the FY 1992-1993 budget of the Roanoke Regional Airport commission. THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia that the FY 1992-1993 budget and proposed capital expenditures for the Roanoke Regional Airport commission as set forth in the February 13, 1992, report of the Commission Vice-Chairman, a copy of which is incorporated by reference herein, is hereby APPROVED, and the County Administrator and the Clerk are authorized to execute and attest, respectively, on behalf of the County, any documentation, in form approved by the County Attorney, necessary to evidence said approval. R-22592-6 Ms. Hyatt advised that the Roanoke Valley Resource Authority's budget totals $185,144 for the five month period ending June 30, 1992. This includes a $55,760 payment to Roanoke County for services provided during this time period. The Roanoke Valley Regional Solid Waste Management Board will pay for the operating expenses as part of the $3 million Assignment Agreement. Supervisor Minnix moved to approv~ the budget and adopt the I resolution. On motion of Supervisor Minnix to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None h Recommendations from the Smokinq Committee Reqardinq the Smokinq Policy. A-22592-7 Mr. Hodge advised that on December 17, 1991, the Board adopted a smoking policy to be effective January 1, 1992, which prohibited smoking in all County owned and county leased buildings. At the January 18, 1992 Board Meeting, the staff requested additional time to work on some of the issues. Mr. Hodge advised that the Smoking Committee recommended .... II"'" " 12. 4 February 25, 1992 amendments to the Smoking Policy which would include penalties, ~ reimbursement for approved smoking cessation programs, and designated smoking areas in each County owned or occupied building wherever possible. These designated smoking areas are necessary to bring the policy into compliance with the County ordinance adopted December 4, 1990, and with the Virginia Indoor Clean Air Act. Mr. Hodge advised that the Facilities Management Team would designate the smoking areas and decisions could be appealed to the Smoking Committee. Chief Gene Wagner, a member of the Smoking Committee, advised that he felt the fire and rescue volunteers would agree to the amendments. After discussion, Supervisor Nickens moved to approve the I staff recommendations (1) to allow smoking in designated areas (2) adopt the penalty provisions (3) appropriate $1,500 from the Board Contingency Fund to reimburse employees up to $30 for participating in stop-smoking programs and (4) ask the School Board, the Constitutional Officers, and Jail to go along with this plan. A-225'92-S Mr. John Chambliss, Assistant County Administrator, recommended that letters be submitted to the administrative level of the Roanoke Valley governments requesting their financial assistance for the Therapeutics Program. They would be given documentation pointing out the participation by residents of their community. Supervisor Nickens requested that the documentation also contain the percent of utilization by residents of the various political subdivision as well as the total number of participants. Supervisor Nickens moved to approve sending a request for financial participation in the Therapeutics Program to the other Roanoke Valley governments. A-22592-9 Ms. Hyatt recommended appropriating $14,500 from the 1990- 91 year end school surplus for the purchase of a Special Education bus with a chairlift. After this appropriation, there~ will still be sufficient surplus funds to cover the anticipated shortfall. Supervisor Johnson moved to approve the request. The flood plain designation will have an impact on the grading of the site and location of the building. In response to Supervisor Johnson's question about the location of the underground gasoline tanks, Mr. Harrington advised that this would be addressed by the site plan review process and safe guards are provided by new standards.
