Roanoke, Virginia 24018 April 14, 1992 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the second Tuesday, and the first regularly scheduled meeting of the month of April, 1992. I IN RE: CALL TO ORDER Chairman Eddy called the meeting to order at 2:40 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Lee B. Eddy, Vice Chairman Edward G. KOhinke, Supervisors Bob L. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Chairman Eddy added Item 6 to the Consent Agenda, Approval of a Raffle Permit for the Cave Spring American Baseball League. Chairman Eddy also added an Executive Session regarding an agreement with the Town of Vinton and an agreement for certain audit services. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS ~ Resolution of AD~reciation to prentiss A. Webb for his service to Roanoke County throuqh Activities on the Leaque of Older Americans. R-41492-1 Mr. Webb was present to accept the resolution. Supervisor Johnson moved to adopt the resolution. The motion was carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy. NAYS: None RESOLUTION 41492-1 OF APPRECIATION TO PRENTISS A. WEBB FOR SERVICES TO ROANOKE COUNTY THROUGH ACTIVITIES ON THE LEAGUE OF OLDER AMERICANS WHEREAS, Prentiss A. Webb has given countless hours and boundless energy to serving the elderly in Southwest Virginia, particularly through his work with the League of Older Americans, which provides various services to senior citizens in eight jurisdictions; and ~ ~ I I ~ 4 April 14, 1992 .' ."\ 'l9':J WHEREAS, Mr. Webb has worked in various capacities with the League, beginning as a volunteer in 1974, and recently served as President of the organization; and WHEREAS, the contributions made by Mr. Webb over the past eighteen years are numerous, and have served to improve and enrich the lives of many of our elderly citizens; and WHEREAS, Mr. Webb has stepped down as Chairman of the Board of Directors of the League of Older Americans and plans to remain active in the league as a volunteer with the Retired Senior Volunteer Program. NOW, THEREFORE, BE IT RESOLVED, that the Board of I Supervisors of Roanoke County, Virginia, expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to PRENTISS A. WEBB for his years of volunteer service to the League of Older Americans and to the elderly of this Valley. Steven Craig, from the Virginia Municipal Pool, presented the award to Bob Jernigan, Roanoke County Risk Manager. I ~ Proclamation declarinq the week of Aoril 12 - 18 as PUblic Safety Telecommunicators Week. The Proclamation was accepted by Roanoke County Dispatchers ~ Jl"'" ,194 April 14, 1992 Debbie Robertson, Jennifer Maddock and Sue Fore. L. Proclamation declarinq the week of Aoril 19 - 25 as Professional Secretaries Week. The Proclamation was accepted by Susie Owen, Economic Development Secretary, and she introduced other secretarial support staff who were present. IN RE: NEW BUSINESS ~ Presentation bY the Roanoke Valley Convention and Visitors Bureau. (Martha Mackey, Convention and Visitors Bureau) Martha Mackey from the Roanoke Valley Convention and Visitors Bureau introduced Larry Framme, Secretary of Economic Development; State Senator Brandon Bell; supporters of tourism Dave Saunders; Gerald Carter, Holiday Inn-Tanglewood; E. C. Warren; and Richard Wells, President of the Visitors Bureau. Virginia Delegate C. Richard Cranwell was also present and spoke to the Board. The speakers presented new trends in tourism, the revenue implications of increased tourism and identified the primary problem as a lack of identity for the Roanoke Valley. The organization asked that all Roanoke Valley governments fund the Visitors Bureau on a new formula based on tax receipts as follows: Roanoke city, 58%; Salem, 15%; Roanoke County, 22%; Botetourt County; 4% and Vinton; 1%. The Board expressed appreciation to the group for their presentation. No action was taken. ~ Reoort from Virginia Association of Counties (VACo) l þ I I 4 I I ~ April 14, 1992 1~9; 5 (c. Fliooo Hicks, VACo) Mr. Hicks offered the support of the Virginia Association of Counties to Roanoke County. He also introduced Wendy Wingo, a member of the Botetourt County Board of Supervisors, who is Roanoke County's regional representative. ~ Request for AÞoroval of 1992-93 Emoloyee Health Insurance Plan. (Diane Hyatt, Finance Director) A-41492-2 Finance Director Diane Hyatt reported that a Health Insurance Committee was formed to review health insurance proposals. Seven bids were received and three companies interviewed. Ms. Hyatt advised that the committee chose Blue Cross/Blue Shield with a 13.37% increase over last fiscal year. Supervisor Johnson moved to approve Blue Cross\Blue Shield for health insurance coverage for 1992-93. The motion was carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy. NAYS: None L. Request from School Board for Acceotance of $52,000 in Grants and Donations and Aoorooriation to the School Grants Fund. (Pat Sales, princioal, Penn Forest Elementary School) A-41492-3 Pa~ Sales, Principal of Penn Forest Elementary School, reported that the pi Kappa Phi National Fraternity and People Understanding the Severely Handicapped (PUSH) have selected Penn Forest ~ Jl"'" ,t9:6 .' April 14, 1992 þ l Elementary School as the first Virginia site to develop an outdoor recreational area with facilities totally accessible to the handicapped and nonhandicapped. other organizations and foundations in the valley have shown interest in working with the project that will be constructed in October 1992 by 150 to 200 volunteers. In response to a question from Supervisor Nickens, Ms. Sales advised that the area will be maintained by school personnel. Supervisor Minnix moved to accept the $52,000 grant. NAYS: None ~ Aooroval of 1992-93 Ooeratinq BUdqet for the Roanoke Valley Resource Authority (Diane Hyatt, Resource Authority Treasurer) A-41492-4 Supervisor Johnson inquired if the County will be reimbursed by the Resource Authority for their expenses. Ms. Hyatt responded that the County has received reimbursement for direct expenses and is collecting information for reimbursement of indirect expenses. Supervisor Nickens moved to approve the budget. The motion was carried by the following recorded vote: AYES: supervisors Johnson, Kohinke, Minnix, Nickens, Eddy. NAYS: None ~ Request for Aoorooriation of Funds for Reoavment of I I 4 I I ~ April 14, 1992 1':9-" ':1 Sewer Deficit (Diane Hyatt, Finance Director) A-41492-5 Ms. Hyatt presented the staff report requesting the transfer of $350,000 from the General Fund to cover deficits in the Sewer Fund. Staff recommended that the sewer rates not be increased until the cost of expanding the treatment plant is known. Supervisor Eddy felt that the sewer rates should be adjusted now so it wouldn't be necessary to reimburse the sewer fund in the future, but advised that he would support the appropriation this time. Supervisor Johnson moved to appropriate the funds to reimburse the sewer fund. The motion was carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Minnix, Eddy. Supervisors KOhinke, Nickens ~ Request from the River Foundation for Fundinq of Well for Hofauqer House (EXÞlore Proiect). (Tim Gubala, Economic DeveloÞment Director) A-41492-6 Mr. Gubala advised that the River- Foundation is requesting reimbursement up to $10,000 for the costs of drilling a well at the Hofauger House at Explore. The County had previously assisted Explore with the drilling of a well during 1991. Richard Burrough from the River Foundation was present and advised that the HOfaugher House should be complete in four weeks. He updated the Board on progress at the Explore Project. In response to questions ~ Jl"'" 1,,9;',8, '. ~ April 14, 1992 from, Supervisor Eddy, Mr. Hodge advised that vinton should not share in the costs of the line because the well is outside the Vinton water district. Supervisor Nickens moved to fund the actual cost of the well drilling up to $10,000. The motion was carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy. NAYS: None ~ Request to ADDrove the EXÞenditure of UD to $10,000 from the Cable TV CaDital Grant Fund for Character Generators. (Anne Marie Green, Public Information Officer) A-41492-7 Ms. Green, a member of the Roanoke Valley Regional Cable TV Committee, reported that the committee recently voted unanimously to request an appropriation of $10,000 from Cable Television Capital Account to purchase two character generators - one located at the County Public Information Office and the other at the Cox Cable studio. The committee will also bring to each participating locality an ordinance changing Exhibit A of the franchise agreement listing the injection points to be installed by Cox Cable, and asked the attorneys for the locali ties to meet and draft an operating agreement for the proposed television studio. Supervisor Nickens, also a member of the committee, advised that he supported the character generators and the changing' of the insertion points, but was opposed to earmarking any funds for the l þ I I 4 I I ~ April 14, 1992 199 television studio. In response to a legal question from Supervisor Eddy, Assistant County Attorney Joe Obenshain advised it was legal to hold these funds in trust for cable use only, and the county would lose its share of the funds if it does not participate. Supervisor Nickens suggested that use of the funds be tabled until the County ascertains whether Roanoke City and the Town of vinton plan to support the studio. Supervisor Eddy requested a copy of the budget for the Roanoke Valley Regional Cable Television Committee. Supervisor Johnson moved to appropriate the $10,000 for the character generator. R-41492-8 Supervisor Minnix moved to set the real estate tax rate at $1.13 per one hundred dollars assessed value. NAYS: None RESOLUTION 41492-8 SETTING THE TAX RATE ON REAL ESTATE SITUATE IN ROANOKE COUNTY FOR THE CALENDAR YEAR 1992 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the levy for the twelve-month period beginning January 1, 1992, and ending December 31, 1992, be, and hereby is, ~ Jl"'" ,. 20 0 ~ f) ('~ \-~.. April 14, 1992 set for a tax rate of $1.13 per one hundred dollars of assessed valuation on all taxable real estate and mobile homes classified by §§ 58.1-3200, 58.1-3201, and 58.1-3506.B of the 1950 Code of Virginia, as amended, situate in Roanoke County. On motion of Supervisor Minnix to adopt the resolution setting the real estate tax rate at $1.13, and carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy, NAYS: None 10. Resolution AdoDtinq the 1992-93 Personal ProDerty Tax Rates and Machinery and Tools Tax Rate. R-41492-9 Supervisor Minnix moved to approve the personal property tax rate at $3.50 per one hundred dollars assessed value, and the machinery and tools tax rate at $3.00 per one hundred dollars assessed value. NAYS: None RESOLUTION 41492-9 SETTING THE TAX LEVY ON ALL CLASSES OF PERSONAL PROPERTY SITUATE IN ROANOKE COUNTY FOR THE CALENDAR YEAR 1992 BE IT RESOLVED by the Board of Supervisors of Roanoke County, virginia, as follows: 1. That the levy for the twelve-month period beginning January 1, 1992, and ending December 31, 1992, be, and hereby is, set for l þ I I 4 I I ~ April 14, 1992 '20 1 a tax rate of $3.50 per one hundred dollars of assessed valuation on all taxable, tangible personal property, excluding all those classes of household goods and personal effects as are defined in §§ 58.1-3504 and 58.1-3505 of the 1950 Code of Virginia, as amended, but including the property separately classified by §§ 58.1-3500, 58.1-3501, 58.1-3502, 58.1-3506 in the 1950 Code of Virginia, as amended, of public service corporations based upon the assessed value thereof fixed by the state Corporation Commission and duly certified. 2. That there be, and hereby is, established as a separate class of personal property in Roanoke County those items of personal property set forth in § 58.1-3507 of the 1950 Code of Virginia, as amended, and generally designated as machinery and tools. 3. That the levy for the twelve-month period beginning January 1, 1992, and ending December 31, 1992, be, and hereby is, set for a tax rate of $3.00 per one hundred dollars of assessed valuation on all taxable, tangible personal property as herein established as a separate classification for tax purposes and as more fully defined by § 58.1-3507 of the 1950 Code of Virginia, as amended, and generally designated as machinery and tools. Supervisor Nickens also requested a work session on the results of the employee survey. G. FIRST READING OF ORDINANCES ~ Ordinance Authorizinq the Lease of Real Estate, a 0.680 Acre Parcel for Parkinq Facilities at the Roanoke County Courthouse and Jail. (Paul Mahoney, County Attorney) Supervisor Nickens asked if the County could make improvements to private property. County Attorney Paul Mahoney responded it was permissible with a lease although they could lose the improvements if they did not continue the lease. Supervisor Minnix moved to approve first reading of the ordinance. The motion was carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Eddy. NAYS: None ORDINANCE 41492-10 AUTHORIZING THE ACQUISITION OF 29.634 ACRES OF LAND FROM APPALACHIAN POWER COMPANY FOR THE WATER TREATMENT PLANT WHEREAS, in order to construct a water treatment plant, staff has located a site near the reservoir, consisting of 29.634 acres in the Catawba Magisterial District of Roanoke County, presently owned by the Appalachian Power Company; and WHEREAS, staff has negotiated the purchase of said property from Appalachian Power Company for the sum of $89,900.00, being the estimated fair market value based upon an appraisal; and WHEREAS, section 18.04 of the Roanoke County Charter directs that the acquisition of real estate be accomplished by ordinance; the first reading of this ordinance was held on March 24, 1992; the l þ I I 4 I I ~ April 14, 1992 20 :5 second reading was held on April 14, 1992. THEREFORE, BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County Administrator is hereby authorized to acquire from Appalachian Power Company a 29.634-acre tract of land, identified as a portion of Tax Map No. 72.02-02-03, for an amount not to exceed $89,900.00, which shall be paid out of the funds available from the Water Treatment Plant project budget. 2. That the County Administrator is authorized to execute such documents and take such actions on behalf of Roanoke County in this matter as are necessary to accomplish the acquisition of this property, all of which shall be approved as to form by the County Attorney. (2) Asked Mr. Hodge to update the Board on Coùnty Government Day and the Open House. Mr. Hodge advised the Board on plans for the activities. (3) Inquired about Senate Bill #270. Mr. Mahoney will provide information. (4) Asked about legal costs on the Grumman J.itigation. Mr. Mahoney will report back. (5) Announced that the Hazardous Waste Collection Day was highly successful. Thorton. 1007 Barrens Villaqe Court spoke in opposition to the Dillon Rule. He was informed that public meetings are being held around the state to receive comment on the Dillon Rule. IN RE: REPORTS Supervisor Johnson moved to receive and file the following reports. The motion carried by a unanimous voice vote. 1. General Fund Unappropriated Balance 2. Capital Fund Unappropriated Balance 3. Board contingency Fund 4. Accounts Paid - March 1992 5. Proclamation Declaring April 1992 as Child Abuse Prevention Month. 6. I IN RE: EXECUTIVE SESSION At 5:40 p.m., Supervisor Kohinke moved to go into Executive Session pursuant to the Code of Virginia 2.1-344 (a) (7) consultation with legal counsel concerning an agreement with the Town of Vinton and Roanoke City and (7) for consultation with legal counsel concerning an agreement for certain audit services. IN RE: CERTIFICATION OF EXECUTIVE SESSION , R-41492-12 At 7:02 p.m., Supervisor Johnson moved to return to Open session and adopt the Certification Resolution. NAYS: None RESOLUTION 41492-12 CERTIFYING EXECUTIVE MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened an executive meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certif ication by the Board of Supervisors of Roanoke County, Virginia, that such executive meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge:, 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting which this certification resolution applies, and 2. None IN RE: WORK SESSIONS ~ smith GaD Landfill Chief Executive Officer of the Roanoke Valley Resource Authority John Hubbard presented a status report on the smith Gap Landfill and reported on the construction progress. He pointed out on a map where the proposed APCO transmission line corridor would be and that it could affect 23 years of the landfill life. The Resource Authority is working with APCO to minimize that affect. He presented the artist's rendering and design plan for the transfer station. Several Board members expressed concern at the potential cost of the building. The Roanoke City Planning commission will review the plans in May. ~ SDrinq Hollow Water proiect utility Director Clifford Craig updated the Board on the Spring Hollow Project. Also present was John Bradshaw with Hayes, Seay, Mattern and Mattern. He asked for Board input on eliminating one of the roads at the project. There was Board consensus to support Mr. Craig's suggestion. Mr. Hodge advised that they would bring all change orders back to the Board of Supervisors. h Budqet Mr. Hodge advised that the budget included $300,000 from the tobacco tax that may still not pass. He suggested several ~ þ I I ~ April 14, 1992 215 alternatives for the $102,000 funds that he proposed to be set aside for the 1/2% salary increase: (1) the funds should be set aside for employee salaries until the County knows whether the tobacco tax passes or fails; (2) return the money to the department budgets; or (3) begin a vehicle replacement fund. Supervisors Johnson and Minnix supported holding the $102,000 for employee salaries; Supervisors Eddy, Nickens and Kohinke supported limiting salary increases to 3% and utilizing the funds elsewhere. Following a discussion on sewer rates, there was no consensus to raise sewer rates at this time. Following additional discussion, Mr. Hodge advised he would incorporate the Board members' suggestions and bring back the 1992- II 93 budget for approval to the April 28 meeting IN RE: REGULAR SESSION Supervisor Nickens moved to return to Regular Session.
