Roanoke, Virginia 24018 May 26, 1992 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the fourth Tuesday, and the second regularly scheduled meeting of the month of May, 1992. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Supervisor Eddy added Item D-11, Designation of Agent for the County to Obtain Federal and State Financial Assistance for Damages During the 1992 Flood. Chairman Eddy moved Item D-10, Ratification of Agreements and Acknowledgement of the Issuance of Solid Waste System Bonds for the Roanoke Valley Resource Authority, to the Executive Session. IN RE: I PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS h Resolution of Appreciation and Conaratulations to the Roanoke Appalachian Trail Club upon their 60th Anniversarv. R-52692-1 Mr. Hal Cantrill, President, Roanoke Appalachian Club, was present to accept the resolution. Supervisor Nickens moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None RESOLUTION 52692-1 OF APPRECIATION AND CONGRATULATIONS TO ROANOKE APPALACHIAN TRAIL CLUB UPON ITS 60TH ANNIVERSARY I ~ I I ~ May 26, 1992 '29 5 ~ WHEREAS, the Appalachian Trail is a 2,100 mile long National Scenic Trail, which runs from Georgia to Maine; and WHEREAS, 20 miles of the Appalachian Trail passes through Roanoke County, from Cove Mountain to Tinker ~ountain, and this section contains two of the top attractions along the trail, Dragon's Tooth and McAfee's Knob; and WHEREAS, the upkeep, maintenance and improvement of the Trail is almost entirely provided by private clubs under the guidance of the Appalachian Trail Conference; and WHEREAS, the Roanoke Appalachian Trail Club is responsible for caring for a 113 mile section of the Appalachian Trail, from Bland County in the south, to Botetourt County in the north, and has added a variety of improvements to the trail, including shelters, foot bridges, and the McAfee's Knob parking area on Virginia 311; and WHEREAS, the Roanoke Appalachian Trail Club was founded in 1932, and is celebrating its 60th Anniversary, with a membership of over 200 people. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, on its own' behalf and on behalf of the people from around the world who hike the Appalachian Trail each year, does hereby extend its appreciation to the ROANOKE APPALACHIAN TRAIL CLUB for its care and concern for this national treasure since 1932; and further BE IT RESOLVED, that the Board of Supervisors does hereby extend congratulations to the Club on the occasion of its 60th Anniversary. (Anita Hammerstrom,· Trainina Coordinator) Anita B. Hammerstrom presented the report and introduced the members of the "Extra Mile Club" who were present. She explained that the Extra Mile Club was established by the Customer Service Resource Committee to recognize county employees by citizens or coworkers for their customer service efforts. Members will receive a certificate and recognition in The County Siqnal. The Board will recognize thell members twice yearly. IN RE: NEW BUSINESS h Adoption of a Resolution Supportinq the Inclusion of Roanoke County in the Appalachian Reqional Commission. (Tim Gubala, Economic Development Director) R-52692-2 Mr. Gubala reported that the Fifth Planning District Commission is serving as coordinator in requesting that the Roanoke Valley governments be included within the boundaries of the Appalachian Regional Commission. The Commission was created in the 1960's, and has programs that may be potential sources of funds for water and sewer'lI vocational training, and planning and economic development projects. Supervisor Nickens moved to adopt the resolµtion. The ~ "l1li ~ May 26, 1992 297. motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None RESOLUTION 52692-2 IN SUPPORT OF THE INCLUSION OF ROANOKE COUNTY IN THE APPALACHIAN REGIONAL COMMISSION. WHEREAS, the Appalachian Regional Commission (ARC) was formed in 1965 to enhance the economic development and the quality of life of the of the people in the Appalachian area of the united States; and WHEREAS, ARC, through its federal, state and local partnership, has pursued its mission in a very effective manner by supporting local economic development projects and could be of great assistance to I Roanoke County in its economic development efforts; and WHEREAS, the ARC region currently includes three counties adjacent to Roanoke County and these communities have close economic and social ties with Roanoke County; and WHEREAS, Roanoke County has significant economic linkages with the counties and ci ties in the ARC region of western/ southwestern Virginia and southeastern West Virginia; and WHEREAS, Roanoke County's ability to promote industrial growth within this region of the Commonwealth of Virginia could be greatly enhanced by participation in the ARC; and , WHEREAS, Roanoke County recognizes the need to approach economic development from a regional perspective. I NOW, THEREFORE BE IT RESOLVED that Roanoke County, Virginia, requests Congressman Jim Olin and Congressman Rick Boucher to pursue the inclusion of Roanoke County as a member of the Appalachian ~ """ 29 8 ... On motion of Supervisor Nickens to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy, NAYS: None ~ Reauest for Acceptance of Grant from Virainia Department of Fire proarams for Repairs to Trainina Center. (Mark Liaht, Deputv Fire and Rescue Chief) A-52692-3 Deputy Chief Light explained that since 1986, the Fire Training Center has been used to train firefighters in fire attack procedurejll and techniques which requires that fires be started to simulate actua! fire situations. The buildings now need to be repaired, and a $5,000 grant has been approved by the Virginia Department of Fire Programs for funding of the repairs. Deputy Chief Light requested acceptance of the grant. Supervisor Kohinke moved to accept the grant. (Paul Mahonev, County Attornev) II A-52692-4 Mr. Mahoney reported that the City of Roanoke has submitted ~ ~ I II "l1li 2'9 9,' May 26, 1992 a claim of $320,353 for unpaid charges from the purchase by the County of bulk water. The Code of Virginia requires that the Board of Supervisors act on the claim before further legal action is taken. Mr. Mahoney advised there had been correspondence in November and December 1991 regarding the charges, and since that time, there has been further correspondence between City and County officials. There was Board consensus that the staff continue to attempt to negotiate with the City regarding this issue and that staff may include elected officials in the negotiations. Reauest for Approval of Industrial Revenue Financina for Richfield Retirement Communi tv. Gubala, Economic Development Director) Bond (Tim R-52692-5 Mr. Gubala advised that Richfield Retirement Community is requesting approval of up to $3.8 million of tax exempt Industrial Revenue Bonds to finance the construction and equipment of a 44,000 square foot 120-bed home for the elderly. The Industrial Development Authority approved the request at a public hearing on May 21, 1992. Supervisor Nickens moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy ~ ".. 3, 0 ~o~ May 26, 1992 ~ NAYS: None RESOLUTION 52692-5 APPROVING REQUEST OF THE INDUSTRIAL DEVELOPMENT AUTHORITY OF ROANOKE COUNTY, VIRGINIA, FOR INDUSTRIAL REVENUE BOND FINANCING FOR RICHFIELD RETIREMENT COMMUNITY WHEREAS, the Industrial Development Authority of Roanoke County, Virginia (the Authority) has considered the application of Richfield Retirement Community (the borrower) requesting the issuance of one or more of the Authority's revenue bonds or notes in an amount not to exceed $3,800,000 (the Bonds) to assist in the financing of the construction and equipping of a 120-bed home for the elderly (the Project) on the borrower's campus located at 3615 West Main Street_in Roanoke County, Virginia, which will be owned and operated by the Borrower, and has held a pUblic hearing thereon; and II WHEREAS, it has been requested that the Board of Supervisors of Roanoke County, Virginia (the Board) approve the financing of the Project and the issuance of the Bonds, and such approval is required for compliance with Section 147 (f) of the Internal Revenue Code of 1986; BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA: 1. The Board approves the financing of the proj ect and the l issuance of the Bonds by the Authority for the benefit of the Borrower, as required by said Section 147(f), to permit the Authority to assist in the financing of the Project. 2. The approval of the issuance of the Bonds, as required bill said Section 147(f), does not constitute an endorsement of the Bonds ~ ~ "l1li May 26, 1992 30 1 II or the creditworthiness of the Borrower or otherwise indicate that the Project possesses any economic viability. The Bonds shall provide that neither the Commonwealth of Virginia (the Commonwealth) nor any political subdivision thereof, including Roanoke County (the County) and the Authority, shall be obligated to pay the principal of or interest on the Bonds or other costs incident thereto except from the revenues and receipts pledged therefor and that neither the faith or credit nor the taxing power of the Commonwealth or any political subdivision thereof, including the County and the Authority, shall be pledged thereto. 3. This Resolution shall take effect immediately upon its adoption. 4. The Bonds are hereby designated as qualified tax-exempt obligations for purposes of Section 265(b) (3) of the Code, but only if the bonds are issued during 1993. The County has not designated, and will not designate, more than $10,000,000 of obligations to be issued during 1993 as qualified tax-exempt obligations for purposes of Section 265(b) (3) of the Code. (Diane Hvatt, Director of Finance) II A-52692-6 Ms. Hyatt requested that delinquent utility accounts of ~ """ 30 L' May 26, 1992 ~ $17,309.42 from the years 1985, 1986, and 1987 be written off. The staff has made numerous efforts to collect the debts, and some have judgements or liens against them. She advised these debts represent .1% of the revenue collected for those years. Supervisor Nickens moved to approve the authorization. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None ~ Reauest from Dennis Kafura to Use Sprina Hollow Access Road for Access to his Property. (Clifford craia, utility Director) I A-52692-7 Mr. Craig reported that Mr. and Mrs. Dennis Kafura have purchased the 40 acre parcel adjacent to County owned property known as the "Old YMCA Camp" and would like to access their property by using the Spring Hollow access road. Staff recommended approval of the request and that the County Attorney prepare the necessary documents. In response to a question from Supervisor Eddy, Mr. Craig advised there was an additional gate at the Y camp so there would be no opportunity for people to enter the camp. Supervisor Minnix moved to approve the request. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy I NAYS: None ~ Reauest from School Board for Appropriation for ~ ~ -,\ 303 ~ May 26, 1992 Reqional Special Education Board 1992-93 Budqet. Eddie Kolb, Roanoke County Schools) (Dr. A-52692-8 Dr. Kolb reported this is a regional program providing education for autistic and severe/profound handicapped and the County School Board serves as the fiscal agent. Staff recommends appropriating $2,063,286 to the School Board Budget. Supervisor Johnson moved to approve the request. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None II ~ Request for Approval of Reqional Cable TV Committee Aqreement. (Joseph Obenshain, Sr. Assistant County Attornev) A-52692-9 Mr. Obenshain advised that this agreement authorizes a Regional Cable Television Committee to develop, administer and operate education and institutional television facilities. This committee would replace the current committee which is advisory in nature. Supervisor Eddy moved to approve the agreement. (Terrv Harrinaton, Plannina & Zonina Director) A-52692-10 Mr. Harrington advised that this grant is in the amount of $10,188 and will be used in the development of measures to protect public wells from contamination. The proposed County wells to be involved in the pilot project are Bonsack I, starkey I, and Hidden Valley 6. Mr Harrington explained that the County will not be obligated to implement any of the protection measures proposed. Supervisor Nickens moved to accept the grant. He asked for support from the Board on going forward with a promotional program. Mr. Hodge suggested a tour of the projects after the special meeting on June 2. The Board reviewed Supervisor Eddy's memorandum regarding the payments of the bond and other questions. Supervisor Eddy asked School Superintendent Bayes Wilson about the reliability of the cost estimates for school renovations. There was Board consensus that Dr. wilson should get more detailed cost estimates and bring them back to the Board. Supervisor Eddy also questioned using bond money for II Virginia Department of Transportation revenue sharing, however the majority of the Board supported the use of bond money for this purpose.
