Roanoke, ~irginia 24018 August 11, 1992 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the second Tuesday, and the first regularly scheduled meeting of the month of August, 1992. IN RE: CALL TO ORDER Chairman Eddy called the meeting to order at 3:04 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Lee B. Eddy, Vice Chairman Edward G. Kohinke, Sr., Supervisors Bob L. Myers, Assistant County Administrator; Anne Marie Green, Information Officer IN RE: OPENING CEREMONIES The invocation was given by the Reverend Gordon Grimes, Cave Spring Baptist Church. The Pledge of Allegiance was recited by all present. ....1 ".. 446 August 11, 1992 IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS Chairman Eddy added two items to the Executive Session: (1) removal action for Dixie Caverns Landfill and (2) possible selection of outside legål counsel. Supervisor Johnson added one item to the Executive Session: (1) personnel matter regarding the Roanoke Regional Airport commission. Chairman Eddy announced that the request for a resolution of support for the Roanoke Valley Air Show had been deleted. IN RE: NEW BUSINESS ~ Request for acceptance of a Local Government Challenqe Grant from the Virqinia Commission of the Arts CReta Busher, Director of Manaqement & BUdqet) A-81192-1 Ms. Busher reported that each year, Roanoke County applies for a Local Government Challenge Grant, and the Virginia Commission for the Arts will match up to $5,000 any donation from the County to qualified art organizations. In the 1992-93 budget, the Board approved an appropriation of $2,500 each for the Arts Council for the Blue Ridge and the Roanoke Symphony, and applied for the maximum amount of matching funds from the state. The state awarded a grant to the County of. $2,000 which will be ~ ~ I I ~ August 11, 1992 447 equa the two organizations. Supervisor Johnson moved to accept the grant for $2,000. CReta Busher, Director of Manaqement & BUdqet) R-81192-2 Ms. Busher advised that when Roanoke County suffered damage from the April- _ 1992 flood, the staff filed for reimbursement from the Federal Emergency Management Agency. A I requirement of the agency is formal adoption of the provision of the Drug-Free Workplace Act. This act includes establishment of a drug-free-awareness program and will be included in the revised Employee Handbook. Supervisor Minnix moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS:- None RESOLUTION 81192-2 EXPRESSING THE INTENTION OF THE COUNTY OF ROANOKE, VIRGINIA TO IMPLEMENT AND ENFORCE THE PROVISIONS OF THE DRUG-FREE- WORKPLACE ACT I WHEREAS, the Congress of the united States has enacted the "Drug-Free Workplace Act," P.L. 100-690,41 U.S.C. § 701-707, ~ ".. 448 August 11, 1992 the "Drug-Free Workplace Act," P.L. 100-690, 41 U.S.C. § 701-707, which requires any grantee of federal funds to certify as a condition of the receipt of such funds that it will provide a drug-free workplace ~ by taking certain steps including establishing a drug-free awareness program, publishing notice of the requirements of this act to all employees, and maintaining a good faith effort to maintain a drug-free workplace; and WHEREAS, it is the intention of the County of Roanoke, Virginia, to fully comply with the requirements of the "Drug-Free Workplace Act" and to inform its employees of the requirements of this law; and BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the policy entitled "DRUGS IN THE WORKPLACE" is adopted as the official policy of the County of Roanoke, Virginia, pursuant to the "Drug-Free Workplace Act", P.L. 100-690 as follows: DRUGS IN THE WORKPLACE DRUG-FREE WORKING ENVIRONMENT The Roanoke County Board of Supervisors is committed to providing a drug-free "working environment for all employees. The unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance by an employee in the Roanoke County workplace is prohibited and is cause for immediate dismissal. No employee shall distribute, dispense, possess, use or be under the influence of any alcoholic beverage or other ~ ~ I I ~ ~ August 11, 1992'_4'4-9 I I intoxicating liquors. It is the intent of Roanoke County to fully comply with- the requirements-of the Drug-Free Workplace Act. The Drug-Free Workplace Act also requires that employees notify their employer of any criminal drug statute conviction for a violation occurring in the workplace within five days of such conviction. Information about an employee's conviction should be provided to the Director of Human Resources at 772-2018. This requirement constitutes a condition of employment for all Roanoke County employees. SUBSTANCE ABUSE AWARENESS DANGERS OF DRUG ABUSE IN THE WORKPLACE A. Accidents involving self or others when impaired by alcohol or other drugs or when suffering withdrawal symptoms. Negative effects on health of abuser, damages pancreas and liver, increases heart rate and blood pressure, and may adversely affect kidneys, lungs, stomach, small intestines, and nervous system depending upon type of drug used, frequency, and amount of drug use. . Impairs judgment. May contribute to violence or other behavioral problems. Reduces productivity. B. C. D. E. ~ ".. 45·0 August 11, 1992 ~ EMPLOYEE ASSISTANCE PROGRAM Any employee who feels that he or she has developed an addiction to, dependence upon or problem with alcohol or drugs, legal or illegal, is encouraged to seek assistance. Assistance may be sought by contacting the Roanoke County Employee Assistance Program (EAP). The Employee Assistance Program is available to assist employees and their families. The program is completely confidential. 2. That the Department of Human Resources is directed to take all necessary steps to insure that this policy is pUblished as a notice to all employees of the county and to distribute a copy of this policy to all employees of the county. Further, the Department of Human Resources is charged with the responsibility of insuring that employees abide by the terms of this pOlicy and that the provisions of the policy are implemented. 3. That this resolution shall be in full force and effect on and after August 11, 1992. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None ORDINANCE 81192-3 FOR AUTHORIZATION TO ACQUIRE NECESSARY EASEMENTS AND PROPERTY TO CONSTRUCT THE SOUTH TRANSMISSION LINE AND THE STARKEY ROAD WATER PROJECT WHEREAS, location plans for the South Transmission Line II Project and the Starkey Road Water Line Project have been completed and the projects will require acquisition of property and easements across certain properties; and, WHEREAS, said property and easements are to be acquired to facilitate any future construction of the water line project; and, WHEREAS, section 18.04 of the Roanoke County Charter directs that the acquisition of real estate be accomplished by ordinance; the first reading of this ordinance was held on July 28, 1992, and the second reading was held on August 11, 1992. That this matter came this day to be heard upon the proceedings herein, and upon the application of Carriage Hills Drive from the intersection of Fernway Drive ( Route 1791) to the cul-de-sac for a distance of 0.23 miles to be accepted and made a part of the Secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage - easements and a fifty (50) foot right-of-way for said road have heretofore been dedicated by virtue of a certain map known as carriage Hills, Section 4, Subdivision which map was recorded in ....1 ".. -4.6·0 August 11, 1992 Plat Book 10, Page 134, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on March 10, 1988 and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said drainage easements and a right-of-way for the street. 3. That said road known as Carriage Hills Drive and which is shown on a certain sketch accompanying this Resolution, be, and the same is hereby established as a public road to become a part of the state Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said street or highway by the Virginia Department of Transportation. On motion of Supervisor Nickens to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Nickens: (1) He announced that he had just returned from a trip to Europe. (2) He invited the Board members to a ribbon cutting for Bushdale Road when the project is completed. (3) He was pleased to see the sale of bonds for the landfill were approved and expressed confidence in Finance Director Diane Hyatt and Mr. Hodge. (2) He asked about the status of the boundary adjustment for Vinyard Park. Mr. Mahoney advised that the issue should be heard by Roanoke City Planning commission in August. Supervisor Kohinke: He advised that he received good ~eports on the success of the reenactment of the Battle of South Salem at Green Hill Park. Supervisor Eddy: (1) He announced that he had been invited to attend Mayor Bowers' economic summit on September 2nd and asked for suggested items for the meeting. Supervisor Johnson suggested a discussion of water issues. (2) He asked that changes be made to the parade permit procedure as a result of complaints over a recent parade on Brambleton Avenue. Mr. Hodge advised that staff is working on this and will bring the procedure back to the Board. (3) He asked for support for changes to the policy regarding use of the community room including allowing civic and political use. Supervisors Nickens and Minnix supported some changes but recommended proceeding with caution. Staff will bring back a report. (4) He received a letter from the State about a proposed VHDA Housing project. Mr. Hodge advised that staff is investigating. Supervisor Johnson asked that staff include water pressure, fire services, and schools in the study. Mr. Harrington advised that no public hearing was necessary. (5) He asked for and received support to attend the County Board Chairman Institute. (6) He asked ~ II"" 462·' August 11, 1992 ~ for an update on the private SSE/R Program. Mr. Hodge advised that staff is working on a procedure for notifying. IN RE: REPORTS Supervisor Johnson moved to receive and file the following reports. The motion carried by a unanimous voice vote. h General Fund Unappropriated Balance ~ Capital Fund Unappropriated Balance ~ Board continqency Fund h Report on Personal Property Tax Refunds IN RE: RECESS Chairman Eddy declared a ten-minute recess at 3:45 p.m. I IN RE: RECONVENEMENT At 3:55 P.M., Chairman Eddy recovened the meeting. IN RE: WORK SESSIONS ~ Water proiects Capital Improvement Proqram utility Director Clifford Craig advised that the utility Capital Improvement Program has been in existence since 1983. Funding for the upgrade is provided by a depreciation concept which equals approximately $350,000 per year. These projects are now combined with the capital Improvement Program which was approved in the Spring. until 1986, these were not I ~ ~ August 11, 1992 4~:J"'~ es abl1shed by pr10rity need but divided by magisterial district. In 1986, the following criteria was used to establish the priority in which the existing water systems are upgraded: (1) Water Quality; (2) Adequacy of pressure and volume; (3) Cost of maintenance; (4) Flow for fire protection. Mr. Craig reviewed the list of projects and advised that the staff did not reprioritize the existing list based on the criteria, but have used the criteria for all projects added since 1986. Supervisor Eddy advised that some residents in the Sugar Loaf Farms area oppose the water system upgrade because the upgrade would require that walls, trees and shrubbery would be removed from the right of way. I middle of the road and a new Mr. Hodge advised that he and , residents in that area. The current waterline is down the line would be in the right of way. Mr. Craig would be meeting with the Supervisor Eddy asked for a revised list of projects in strict priority for comparison with the current list. He also asked for maps of the individuals projects. Mr. Hodge responded that maps will be included in CIP. ~ Bulk and Brush Collection Mr. Hodge provided a history of the bulk/brush collection. Twice monthly collection was instituted for the first 6,600 automated homes. In the next phase the collection was revised to one a month. Staff received no significant I complaints as a result of the changes and on December 17, 1992, the Board of Supervisors voted to return all automated customers ....1 II"" '4 6,4.: August 11, 1992 to once a month bulk/brush service. Director of General Services Gardner Smith outlined the additional costs to implement additional collection of bulk and brush. He recommended that the service remain the same, and that citizens be informed that they can purchase additional refuse cans for their bulk and brush at $65.00. Supervisor Eddy advised that he had received numerous complaints on this issue. However, the other Board members reported that this was not a problem in their districts. Supervisor Minnix suggested publicizing the availability of additional refuse carts for bulk and brush. Following discussion, it was the consensus of a majority of the Board to continue handling bulk and brush by the current once per month method. Staff will publicize and encourage purchase of additional containers for bulk and brush. IN RE: EXECUTIVE SESSION At 5: 20 p. m., Supervisor Johnson moved to go into Executive Session pursuant to the Code of Virginia Section 2.1- 344 A (1) To discuss a personnel matter regarding assignment of an employee; (3) To discuss consideration of the acquisition of real property for public purposes; (1) To discuss a personnel matter regarding the Airport Commission; (7) To consul t wi th legal counsel concerning a proposed administrative order by consent for removal action for the Dixie Caverns Landfill; (7) the possible selection of outside counsel. Only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Board of Supervisors of Roanoke County, Virginia. Jeff Balon and Karen Decosta of Parks and Recreation described how their department developed their team management program in July 1991 and how the staff has revised and refined the structure into four operational teams. Steve McGraw, Clerk of Circuit Court, explained how a less structured effort at team management in his office led to more involvement in decision making by his staff.
