Roanoke, Virginia 24018 October 13, 1992 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration center, this being the second Tuesday, and the first regularly scheduled meeting of the month I of October, 1992. R-101392-1 The resolution was accepted by Tony White Eagle Mountain Nelson from the Minniconjou Lakota sioux Tribe and Tanya Rainbow Miller of the Quachan of Southern California Tribe. Supervisor Minnix moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Eddy NAYS: None ABSENT: Supervisor Nickens RESOLUTION 101392-1 DECLARING THE WEEKEND OF OCTOBER 16-17, 1992 AS "THE FIRST ANNUAL ROANOKE VALLEY NATIVE AMERICAN HERITAGE FESTIVAL AND POW WO~" I I ~ ~ n~~nnø~ 13. 1992 779; I I WHEREAS, nearly 500 years ago, the first English settlers to reach this 'continent encountered natives who called this land home for over 10,000 years; and WHEREAS, ,these Native Americans greeted the colonists with grace and hospitality and shared with them their knowledge of the land and its resources; and WHEREAS, the first encounters with these original Americans played an important role in the history of Virginia and , the Roanoke Valley; and WHEREAS, the Shenandoah Valley translated means "Daughter of the Stars", and Roanoke being one of the first native words taken into the English language meaning "the place of white shells". NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, on its own behalf and on behalf of the citizens of Roanoke County, does hereby declare the weekend of October 16-17, 1992, as "THE FIRST ANNUAL ROANOKE VALLEY NATIVE AMERICAN HERITAGE FESTIVAL AND POW WOW", and extends its best wishes for an authentic and successful event. Chairman Eddy presented a plaque to Mary Allen, Clerk to the Board of Supervisors. IN RE: NEW BUSINESS h Reauest for Appropriation of Funds for the Purchase of Hepatitis B Vaccine and Eauipment. (Bob Jerniaan, Risk Manaaer) A-101392-2 Mr. Jernigan advised that in 1991 The U. S. Department of Labor Occupational Safety and Health Administration (OSHA) determined that employees face a health risk from occupational exposure to blood and other potential infectious materials such as Hepatitis Band HIV which causes Acquired Immunodeficiency Syndrome (AIDS). OSHA has concluded that this hazard can be minimized or eliminated by the use of protective clothing and equipment, hepatitis B vaccinations and other precautions. Mr. Jernigan reported that written exposure plans and training to occupationally exposed employees have now been implemented. Personal protective equipment has been issued or is on order, and the Hepatitis B vaccine should be available in approximately two weeks. The estimated cost for the program was $33,800. Employees affected by the program include Fire and Rescue, POlice, Sheriff/Jail, Custodial Services, Youth Haven II, Solid Waste, Parks and Recreation and Communication. Mr. ~ ~ I I ~ I I ~ n~~nn~r 13. 1992 78 1 - Jernigan advised that the County will realize a savings of $29,700 by administering the vaccine through the Risk Management Department. In response to questions from Supervisors Minnix and Johnson, Mr. Jernigan advised that the program is mandatory and was not included in the budget because the effective date was June 1992 and the staff did not know during the budget process which departments would be in the program. Supervisor Kohinke advised he would oppose this item because the federal government mandated the program but did not provide funding. Supervisor Nickens expressed concern at the cost but moved to approve a $33,800 appropriation from the General Fund Unappropriated Balance. The motion carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Minnix, Nickens, Eddy Supervisor Kohinke ~ Request for Appropriation of Funds to Repair a Ladder Truck at the Cave Sprinq Fire station. (Tommy Fuqua, Fire and Rescue Chief) A-101392-3 Chief Fuqua reported that as a result of a vehicle check at the Cave Spring Station, the aerial ladder on the ladder truck was found to need repairs. The ladder was taken to a repair facility for emergency repairs, because at that time, only one ladder truck was in service for the entire county. The total cost estimate for the repairs was estimated at $19,001.00. ~ II'" -..782 October 13, 1992 Supervisor Minnix moved appropriation from Capital Reserve. following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None to approve $19,001 The motion carried by the ~ Request for Authorization to Upqrade Hewlett- Packard System to Support Administrative Computinq. (Oscar D. Bryant, Director, M.I.S.) DENIED Mr. Bryant advised that new computer equipment with twice the power can now be purchased at 25% of the cost of the current equipment, and there is an additional savings of approximately $620 per month for hardware and software maintenance. There would be no additional funds required in the current year, with a total of $119,641-included in future budget requests. Supervisor Nickens expressed concern about spending the funds and asked what would happen if the County did not upgra~e the computer. Mr. Bryant advised that they would continue to operate but would have to limit the number of users and users would have to log off at certain times. Supervisor Johnson reminded the Board that in 1988, the computer was planned to last five years. Supervisor Eddy supported the upgrade of the computer system-because of the substantial savings offered by the vendor. Supervisor Eddy moved to authorize the lease-~urchase agreement. (Arnold Covey, Director, Enqineerinq & Inspections) A-101392-4 Mr. Covey reported that staff is now submitting projects P- 116 through P-158 for approval and inclusion to the Drainage Maintenance Priority List. The projects are estimated to cost $135,400 and funding is available in the current budget. Supervisor Johnson moved to approve the drainage maintenance priority list. The motion carried by the following recorded vote: AYES: NAYS: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy None Arnold Covey was directed to provide to the Board members a ranking criteria for drainage projects. h Request for Appropriation of Funds for Jones & Jones Associates Space Evaluation Study. (Elmer C. Hodqe ~ounty Administrator) A-101392-S Mr. Hodge reported that the space study identified a need of approximately 10,000 square feet of additional office space and that the school administration estimated a future need of 5,000 square feet. Staff recommended an appropriation of $5,000 from ~ II'" 78·4 October 13, 1992 the Board Contingency Fund to cover the costs of the study, and further recommended that staff bring ~ack a report on November 17 outlining the alternatives and financial implications to meet the future space needs. Supervisor Johnson moved to approve (1) $5,000 appropriation from Board Contingency, (2) staff bring back report and plan of action for implementation on November 17, 1992, and (3) that no current leases be renewed prior to the report. The motion carried by the following recorded vote: AYES: Supervisors Johnson, Kohinke, Minnix, Nickens, Eddy NAYS: None h Request to Accept a Vehicle Donated by Botetourt county to the Read Mountain Fire Department. (John Chambliss, Assistant County Administrator) A-l01392-6 Mr Chambliss advised that Botetourt County has offered to donate a 1989 Chevrolet, a retired sheriff vehicle, to the Read Mountain Fire Department. The Fire Department will assume maintenance responsibilities. Mr. Chambliss requested that the vehicle be added to the County fleet and included on the County insurance policy. Supervisor Kohinke moved to accept the donated vehicle. The motion was amended by Supervisor Eddy that a letter of appreciation be sent to Botetourt County. Musselman. (Arnold Covey, Director, Enaineerina & Inspections) Mr. Covey presented the staff report. Supervisor Eddy asked Mr. Hodge and M'r. Mahoney to br ing back a report and recommendations on the possibility of charging fair market value for vacation of easements and rights-of-way. Supervisor Kohinke moved to approve the first reading. The .... (Arnold Covey, Director, Enaineerina & InsÞections) Supervisor Johnson moved to approve the first reading. Vest. (Clifford Craig, utility Director) Mr. Craig reported that the property owners have agreed to sell the tract for $50,000 with the condition that the property be used for a water supply for the Forest Edge and Carriage Hills communities or as a public park. They have also requested firs~ right of refusal if the County sold the property. (Paul Mahoney, County Attorney) Supervisor Johnson moved to approve the first reading. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None h An Ordinance Authorizina the County Administrator to Grant the Right to Use a County Sanitary Sewer Easement for Private Sanitary Sewer Service by Property Owners. (Paul Mahoney, County Attorney) Mr. Mahoney reported that the owners want to extend two private sewer lines in the County's easement to provide service to the properties. He offered three alternatives: (1) adopt the ordinance to grant the right to use a County sanitary sewer easement for private sanitary sewer service; (2) adopt an ordinance authorizing the County Administrator to sell, for fair market value, the right to use the sanitary sewer easement; and (3) decline to adopt the ordinance. In response to a question from Supervisor Minnix, he advised ~ II'" 788 October 13, 1992 that approval of alternative #2 would not set a precedent because this transaction is unique. Supervisor Johnson moved to approve alternative #1, approval of the first reading granting the right to use the sanitary sewer easement for private sewer service. (Alfred C. Anderson, County Treasurer) A-101392-7 Mr. Anderson reported there are some problems related to the banking institutions and having the citizens pay the service fee charged by the provider, but if the ordinance is adopted, it can go into affect as soon as this problem is resolved. Supervisor Kohinke moved to adopt the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None ORDINANCE 101392-7 AMENDING AND READOPTING ARTICLE I "IN GENERAL" OF CHAPTER 21 "TAXATION" OF THE ROANOKE ~ ~ I I ~ 11 OctohAr 1~, 1QQ~ 789 COUNTY CODE BY THE ADDITION OF A NEW SECTION 21-9 "USE OF CREDIT CARD IN PAYMENT OF TAXES" WHEREAS, section 58.1-3013 of the Code of Virginia, 1950, as amended, enables a local governing body by ordinance to authorize the treasurer to accept payment of local taxes, other fees and charges generated by the sale of utility services by use of a credit card, and, WHEREAS, the Treasurer of Roanoke County has recommended to his Board of Supervisors that such ordinance be adopted in order to improve customer service and assist in the collection of taxes, other fees and charges, and, I WHEREAS, the first reading and public hearing of this ordinance was held on September 22, 1992, and the second reading of this ordinance was held on October 13, 1992. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, as follows: 1) That a new section numbered 21-9 and entitled "Use of credi t card in payment of taxes, other fees or charges" be and hereby enacted to read and provide as follows: Sec. 21-9. Use of credit card in payment of taxes, other fees or charges. The treasurer is authorized to accept payments of local taxes, other fees or charges generated by the sale of utility services by use of a credit card. In addition to any penalties II and interest, the treasurer shall add to such payment a sum not to exceed four (4) per centum of the amount of the tax, penalty ~ II'" 7,9 0' October 13, 1992 and interest paid, as a service charge for the acceptance of such card. That this matter came this day to be heard upon the proceedings herein, and upon the application of Larson Lane from the intersection of Larson Lane (state Route 1679) and Tomarrane Drive (state Route 1679) to the cul-de-sac, for a distance of 0.20 miles and Larson Oaks Drive ~rom the intersection of Larson Lane to the cul-de-sac for a distance of 0.20 miles to be accepted and made a part of the Secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said roads have heretofore been dedicated by virtue of a certain map known as Larson Oaks Subdivision which map was recorded in Plat Book 12, Page 72, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on February 7, 1990 and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said drainage easements and a right-of-ways for the streets. 3. That said roads known as Larson Lane and Larson Oaks Drive and which are shown on a certain sketch accompanying this Resolution, be, and the same are hereby established as public roads to become a part of the State Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said streets or highways by the Virginia Department of Transportation. That this matter came this day to be heard upon the proceedings herein, and upon the application of Millwood Drive, from the Salem Corporate limit west to the cul-de-sac to be accepted and made a part of the Secondary system of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said road have heretofore been dedicated by virtue of a certain map known as Woodbridge, Section 2 Subdivision, which map was recorded in Plat Book 9, . Page 83, of the records of the Clerk's Off ice of the Circuit Court of Roanoke County, Virginia, on March 15, 1977, and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said drainage easements and a right-of-way for the street. 3. On motion of Supervisor Johnson to adopt the resolution, and carried by the following recorded vote: AYES: Supervisors Johnson, KOhinke, Minnix, Nickens, Eddy NAYS: None IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Nickens: He asked that a personnel matter regarding the compensation package of the school superintendent " and associate school superintendent be discussed in Executive Session. Supervisor Johnson: He complimented the staff on the bond referendum brochure. Public Information Officer Anne Marie Green reported that the brochure will be mailed to all County residences next week, and she reported on the community meetings explaining the bond issue. Supervisor Kohinke: (1) He advised that there is confusion over redistricting in his district and asked that staff help clarify that the Catawba Magisterial District Supervisor remained the same; only the Congressional District in portions of the Catawba District changed. (2) He asked if the Board plans to ~ II'" 7,9 6 October 13, 1992 take a position on joining the Roanoke River Basin Organization and advised that Roanoke city has chosen to remain neutral. There was no Board consensus to do anything at this time. Supervisor Eddv: .(1) He asked if Supervisor Nickens still wanted information on the Division of Motor Vehicle office relocation on a future agenda. Supervisor Nickens advised that he had received the information. (2) He asked about the status of tax exemption for disabled veterans. It was Board consensus that Mr. Mahoney should bring back a draft ordinance. (3) He asked about the tax break for air pollution control equipment. Mr. Hodge reported that he would bring back more information after the first of the year. (4) He asked for report from Mr. Hodge on team training. Mr. Hodge reported that the team decided to pursue the team approach below the department head level and that staff will begin working on programs from Reinventinq Government. (5) He asked Cliff Craig about the Private SSE/R Program. Mr. Craig advised that acceptance of the program has gone well, with 38 residences being notified, and they have only found two somewhat serious problems. Supervisor Minnix: He asked about plans for Salem joining the Resource Authority. Mr. Hodge advised that the Resource Authority is involved with this and there have been no problems so far. IN RE: CITIZENS' COMMENTS AND COMMUNICATIONS Rav Scher, Bonsack area, stated that he felt that the ~ ~ I I ~ ~ 7.,97 OctobAr 1~_ 1QQ~ denial of the purchase of the computer equipment was a shortsighted decision. He also asked how repairs to the schools will be covered if the bond referendum does not pass.
