Roanoke, Virginia 24018 February 12, 1991 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the second Tuesday, and the first regularly scheduled meeting of the month of February, 1991. IN RE: CALL TO ORDER Chairman McGraw called the meeting to order at 3:02 p.m. The roll call was taken. MEMBERS PRESENT: Chairman steven A. McGraw, Supervisors Lee B. Eddy, Bob L. Johnson (arrived at 3:05 p.m.) Richard W. Robers MEMBERS ABSENT: Vice Chairman Harry C. Nickens STAFF PRESENT: Elmer C. Hodge, County Administrator; Paul M. Mahoney, County Attorney; Mary H. Myers, Assistant County Administrator, Anne Marie Green, Information Officer IN RE: OPENING CEREMONIES The invocation was given by the Reverend J. Harrison Stephens, 065 February 12, 1991 i:::= = Raleigh Court Presbyterian Church. The Pledge of Allegiance was recited by all present. IN RE: REQUESTS TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF AGENDA ITEMS County Attorney Paul Mahoney requested the addition of first reading of an ordinance extending the cable TV franchise. Chairman McGraw announced that the work session on the Capital Improvement Program had been postponed. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS ~ proclamation declarinq the month of Februarv 1991 as Black Historv Month Chairman McGraw presented the proclamation to Norma Underwood representing the Harrison Afro-American Cultural Museum. Supervisor Eddy moved to adopt the proclamation. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens IN RE: NEW BUSINESS ~ Recommendation on the location for the National Park Service visitors Center. A-21291-1 County Administrator Elmer Hodge reviewed the history of February 12, 1991 066 ~ - the project. He advised that five sites have been studied for the -' visitors center, and Roanoke County staff feels that site #3 would be the best site because it affords the best visibility of the valley, is the most easily accessible, would be the least expensive and would require minimal site preparation. He announced that the Explore Project and Town of Vinton also support this site. He recommended that the Board of Supervisors write a letter to the National Park Service Southeast Regional Director stating the County's preference, and that they be invited to attend a work session on February 26 on the parkway project. Supervisor McGraw requested that the Town of Vinton's support for Site #3 be included in the letter, and Supervisor Eddy requested that the letter enthusiastically support the overall project as well as the visitors center location. Supervisor Robers moved to adopt the staff recommendation. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens ~ AcceÞtance of $3.000 qrant for Action Plan 2000 and aÞDroDriation to the School Board. A-21291-2 Garland J. Kidd, Director of Vocational and Adult Education for the County Schools presented the staff report, explaining that this program is designed to improve the delivery ---~~------- ------------~--'_.-- 067 February 12, 1991 ~ ~ of career guidance, counseling and instruction to students in grades 6 - 12. Supervisor Johnson moved to accept the grant. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens h AÞÞroÞriation of funds to reimburse Botetourt County for industrial access road at Bonsack Industrial Park. A-21291-3 Mr. Hodge reported that Arkay Packaging, an industry who met the requirements for state funding of the industrial access road has decided not to begin construction on the site. As a result, the Virginia Department of Transportation has requested reimbursement of the costs of the project. The cost ($261,354.99) will be shared by Roanoke and Botetourt Counties, with Roanoke County's share being $130,677.49. Staff recommended authorizing the payment to Botetourt County with funds allocated from the Economic Development Budget ($64,614) and the Consolidation Account ($66,062.49) . Supervisor Johnson moved to approve the staff recommendation. However, he withdrew his motion and moved to table the issue to allow Director of Management and Budget Reta Busher to report back on questions from the board members regarding the consolidation account. The motion carried by a unanimous voice February 12, 1991 068 = vote with Supervisor Nickens absent. - Following a report from Ms. Busher in reference to the remaining funds in the Consolidation Account, Supervisor Johnson moved to appropriate the funds. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens IN RE: REQUESTS FOR WORK SESSIONS ~ Reauest for Work Session on February 26. 1991 on Six Year Plan. Supervisor Johnson moved to set the work session on February 26, 1991. The motion carried by a voice vote with Supervisor Eddy abstaining and Supervisor Nickens absent. Chairman McGraw asked that the Clerk provide for the board members a transcript on the 1990 work session on the Six Year Plan. IN RE: REQUESTS FOR PUBLIC HEARINGS ~ Reauest for PUblic Hearinq on March 26. 1991 for citizen comment on the Six Year Plan. Supervisor Johnson moved to set the public hearing on March 26, 1991. The motion carried by a voice vote with Supervisor Eddy abstaining and Supervisor Nickens absent. ~69 February 1'-, ,qq, = ,- IN RE: FIRST READING OF ORDINANCES ~ Ordinance vacatinq a fifteen foot Public utility Easement on Lots 2. 3. and 4 of Franklin Estates Subdivision located in Catawba Haaisterial District. There was no discussion and no one spoke on the ordinance. Supervisor McGraw moved to approve the first reading of the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens h Ordinance vacatina a 20 foot Water Line Easement recorded in Plat Book 11. Paqe 155. located in Windsor Hills Maqisterial District. There was no discussion and no one was present to speak on the ordinance. Supervisor Eddy moved to approve first reading of the ordinance. Motor Vehicle and Traffic of the Roanoke County Code. Mr. Mahoney advised that this ordinance would stiffen the penalties for all parking violations including handicapped parking February 12, 1991 070 - AYES: NAYS: ABSENT: spaces. The basic parking violation penalty will be raised to $15.00 and the penalty for parking in handicapped parking spaces will be raised to $50.00. Supervisor Robers moved to approve first reading of the ordinance. The motion carried by the following recorded vote: Supervisors Eddy, Robers, Johnson, McGraw None Supervisor Nickens ~ Ordinance amendina Article II of ChaDter 12. Motor Vehicle and Traffic. Section 12-34 of the Roanoke County Code to increase the Þermissible maximum Þenalty for violations. Mr. Mahoney reported that the Commonwealth Attorney's Office has recommended an increase in the fine imposed for violations of the vehicle decal ordinance to $100.00 This action would increase compliance of the decal ordinance. Supervisor Johnson moved to approve the first reading. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens h Ordinance extendina the franchise of Cox Cable Roanoke. Inc. to oÞerate a cable television system in Roanoke County for a Deriod of 60 days and Þrovidinq for a 1% increase in the franchise fee Davment. 071 ~., February 12, 1991 - = - Assistant County Attorney Joseph Obenshain explained that the committee negotiating the franchise had not yet reached agreement and it will be necessary to extend the agreement for another sixty days and also increase the franchise fee from 4% to 5%. Supervisor McGraw asked for a copy of the agreement which raised the fee from 3% to 4%. He further asked for information regarding the franchise fee with Salem Cable TV. Mr. Obenshain responded that he had written asking for information regarding the franchise fee with Salem Cable TV. Supervisor McGraw moved to approve first reading of the ordinance. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens IN RE: APPOINTMENTS ~ Grievance Panel Supervisor Robers nominated Joy McConnell to serve a three year term as an alternate member. Her term will expire September 10, 1993. ~ LeaQUe of Older Americans Advisory Council Supervisor Eddy nominated Frances HOlsinger to another one-year term expiring March 3l, 1992. h LeaQUe of Older Americans Board of Directors Supervisor McGraw nominated Murry K. IN RE: CONSENT AGENDA R-21291-4 Supervisor Johnson moved to approve the Consent Agenda with Item 4 removed for discussion. SMITH INDUSTRIAL PARK February 12, 1991 074 - - WHEREAS, Jack C. Smith has served as Secretary of the Greater Roanoke Valley Development Foundation since 1961, as well as the Executive Vice President of the Roanoke Regional Chamber of Commerce; and WHEREAS, under Mr. Smith's leadership, the Greater Roanoke Valley Development Foundation and the Roanoke Valley Development Corporation, purchased the 70-acre Bonsack industrial site in 1975; and WHEREAS, since that time, Mr. Smith has been actively involved in the development and sale of the site which has greatly enhanced the economic base and community facilities of both Botetourt and Roanoke counties; and WHEREAS, under the leadership of Mr. Smi th, the Greater Roanoke Valley Foundation and the Roanoke Valley Development Corporation donated two acres of the Bonsack industrial site for the purpose of a jointly developed library, and over five million dollars of investment has taken place at the Bonsack industrial site. NOW, THEREFORE, BE IT RESOLVED that the Botetourt County Board of Supervisors and the Roanoke County Board of Supervisors do hereby name the Botetourt/Roanoke County Industrial Park at Bonsack the JACK C. SMITH INDUSTRIAL PARK in recognition of his dedicated leadership, his many accomplishments, and his assistance to both counties. On motion of Supervisor Johnson to adopt resolution, and carried by the following recorded vote: 075 February 1'-, 1qq1 - = AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: None ABSENT: Supervisor Nickens IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS SUPERVISOR EDDY: (1) Asked for an update on communication with businesses regarding the smoking ordinance. Public Information Officer Anne Marie Green advised she will bring back a report on options to disseminate the information. (2) Asked for an update on the possibility of selling delinquent tax properties. Mr. Mahoney responded that he and County Treasurer Alfred Anderson are working on this and will begin the process in summer 1991. Mr. Mahoney further advised he will bring back revenue projections on March 12, 1991. (3) Expressed concern about extending water and sewer lines to Allied Signal property. Mr. Hodge advised he is going forward with bids and will bring the information back to the Board. Following discussion, there was board consensus to go forward with the bid process. SuÞervisor Johnson: (1) Advised that the Airport Commission will discuss the airport budget at its next meeting. (2) Asked Mr. Hodge to contact the soccer association officials to make a presentation on the proposed soccer complex and to offer county assistance. Following discussion, there was board consensus to discuss the possibility of making park land available for the soccer complex. February 12, 1991 076 - tlt1Þer".i.:::¡gr RoÞers: (1) Asked for an update on the 5% proposed department cutbacks. Mr. Hodge advised he will include these in the budget process. (2) Announced he had discussed with Keith Cook a comparison of Blue Cross/Blue Shield and Community Care Network. (3) Asked for an update on the parking problems at the Holiday Inn-Tanglewood. Mr. Hodge responded that the problems are being worked out. (4) Suggested that the County make a contribution to United Way instead of individual human service agencies. (5) Proposed that the private sector get involved in funding school activities such as sports, band, etc. Supervisor McGraw suggested hiring a volunteer coordinator for one year to work with businesses and agencies. (6) Advised there will be a meeting on the Smart Highway in March. SuÞervisor McGraw: (1) Announced that VACo legislation to expand the moratorium on annexation (HB1418) had passed the House of Delegates and had been sent to the Senate Committee on Local Government. (2) Announced that the VACo Board has begun a funding process to reconsti tute the Grayson Commission. (3 ) Announced that the VACo Executive Committee will meet in Roanoke in March, and the VACo Board of Directors will meet in Roanoke in April.
