Roanoke, Virginia 24018 April 16, 1991 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the third Tuesday of the month of April 1991, and an adjourned meeting from April 9, 1991. IN RE: CALL TO ORDER Chairman McGraw called the meeting to order at 4:07 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Steven A. McGraw, Vice Chairman Harry C. Nickens, Supervisors Lee B. Myers, Assistant County Administrator, Anne Marie Green, Information Officer, Reta Busher, Director of Management and Budget IN RE: READING OF ORDINANCES 21 3 April 16, 1991 : - : - h Second Readinq of Ordinance authorizinq the acquisition of a 0.10B acre Ðarcel of land from Mamie E. Webster for the Bushdale Road Rural Addition proiect (CONTINUED FROM APRIL 9, 1991). 0-41691-1 There was no discussion and no one was present to speak. Supervisor Nickens moved to adopt the ordinance. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Johnson, Nickens, McGraw. NAYS: None ABSENT: Supervisor Robers ORDINANCE 41691-1 AUTHORIZING THE ACQUISITION OF A 0.10B-ACRE PARCEL OF "LAND FROM MAMIE E. WEBSTER FOR THE BUSHDALE ROAD RURAL ADDITION PROJECT WHEREAS, Bushdale Road is a private road located in the Vinton Magisterial District of Roanoke County; and, WHEREAS, Bushdale Road has been placed on the Rural Addition Priority List for upgrade of the roadway to state standards for acceptance into the State Secondary System; and, WHEREAS, on December 19, 1989, the Roanoke County Board of Supervisors approved the acquisition of right-of-way necessary for the upgrade of Bushdale Road to Secondary Road Standards and appropriated the sum of $15,000.00 from the General Fund Unappropriated Balance to proceed with right-of-way acquisition, and; WHEREAS, it is necessary to acquire a certain parcel of 214 April 16, 1991 - real estate consisting of 0.108 acre, together with all right, title and interest in and to the existing private Bushdale Road, from Mamie E. Webster for said improvements; and, WHEREAS, Roanoke County Staff has negotiated an agreement to acquire said parcel and right-of-way from Mamie E. Webster; and, WHEREAS, Section 18.04 of the Roanoke County Charter directs that the acquisition of real estate be accomplished by ordinance; the first reading of this ordinance was held on March 26, 1991, and the second reading was held on April 9, 1991, and April 16, 1991. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, as follows: 1. That the acquisition and acceptance of a certain parcel of real estate consisting of 0.108 acre, together with all right, title and interest in and to the existing private Bushdale Road, from Mamie E. Webster for the sum of $1,473.00 is hereby authorized and approved; and 2. That the consideration of $1,473.00 shall be paid from the funds previously appropriated by the Board of Supervisors from the General Fund Unappropriated Balance for costs of engineering and acquisitions in connections with the Bushdale Road Rural Addition Project; and, 3. That the County Administrator is hereby authorized to execute such documents and take such actions as may be necessary to accomplish this acquisition, all of which shall be on form approved by the County Attorney. 21 5 : April 16, 1991 - : = On motion of Supervisor Nickens to adopt ordinance, and carried by the following recorded vote: AYES: Supervisors Eddy, Johnson, Nickens, McGraw NAYS: None ABSENT: Supervisor Robers .L.. First Readinq of Ordinance adoÐtinq the Roanoke Valley cable television ordinance for Roanoke County, Virqinia. Assistant County Administrator Joseph Obenshain advised that the new contract calls for a twelve year franchise term with the provision for review of the franchise operations after six years to insure compliance with the agreement on extension of service, rebuild, capital grant and franchise fee payments. He reported on the highlights of the new franchise agreement as follows: (1) a one percent increase in the franchise fee to 5% effective July 1, 1991; (2) extension of service along Routes 221 Sand 220 S within four years; (3) a $480,000 grant to fund an institutional studio and other equipment for use by the school system and government agencies; (4) free cable to all schools and governmental buildings; and (5) upgrade with an increased capacity for 62 channels. Mr. Obenshain explained that there are no restrictions on how the franchise fee may be used by local government. Supervisor Nickens inquired where the grant money for the institutional studio will be kept. Mr. Obenshain responded that this has not been determined yet. l\.pril 1~, 1')')1 216 In regard to questions concerning the extension of Service, Mr. Johnny Benson of Cox Cable advised that the extensions will be phased in, with completion of all three phases completed within twelve months. There was discussion on the choice of government sites, particularly in the schools, and Dr. Jerry Hardy with the Roanoke County schools reported that the School Board is pleased with the choices. Supervisor Johnson moved to approve first reading of the ordinance. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw. NAYS: None IN RE: BUDGET WORK SESSION Mr. Hodge presented an updated two-year projected budget and a summary of the proposed budget adjustments necessary to balance the budget. He advised that the budget is $337,977 out of balance. He recommended $98,500 in new revenue from the amusement tax and cable TV franchise tax and the elimination of $239,477 in expenditures to balance the budget. The adjustments include: (1) elimination of the annual report; (2) reduction in part-time staffing; (3) elimination of baseballs for youth leagues; (4) fee generated Therapeutics Summer Program; (5) Other fees in Parks and Recreation; (6) reduction in legal fees - Dixie Caverns; (7) Valleypointe; (8) Reduction in addition to insurance reserve. There was a discussion on potential cost saving measures such as not filling vacant positions, postponing the purchase of 2 1 7 April 16, 1991 some new vehicles, a standardized vehicle replacement program and re-examination of the fee structure implemented in 1990. IN RE: RECESS At 6:07 p.m., Chairman McGraw declared a dinner recess. RECONVENEMENT: At 6:40 p.m., Chairman McGraw reconvened the meeting. IN RE: BUDGET WORK SESSION Discussion continued on possible adjustments to the 1991- 92 budget with the Board members offering various suggestions on cutbacks. Suggestions included saving money for vacant position to be set aside in a reserve for future salary increases; use of cutbacks based on the suggestions of individual departments; elimination of some car phones. County Administrator Elmer Hodge asked for a priority ranking from the Board members on service delivery so that he will know where to make any necessary cuts. Following discussion, there was board consensus to direct the staff to prepare a vehicle replacement policy. Mr. Hodge responded that Assistant County Administrator John Chambliss has already begun work on this. Supervisor Nickens asked for a list of car phones and their locations. IN RE: REGULAR SESSION Supervisor Johnson moved to reallocate budgeted funds ($55,435) for five vehicles that do not include emergency, public safety or the Sheriff's van to the 1991-92 Board Contingency Fund. The motion was approved by the following recorded vote: AYES: Supervisors Robers, JOhnson, Nickens IN RE: 218 April 16, 1991 NAYS: Supervisors Eddy, McGraw Supervisor Nickens moved that all non-emergency vacant positions be frozen with justification for filling any position to be brought to the Board of Supervisors for approval. The motion was denied by the following recorded vote: AYES: Supervisors Robers, Nickens NAYS: Supervisors Eddy, Johnson, McGraw Supervisor Nickens moved to authorize the County Administrator to cut $400,000 from the 1991-92 non-personnel portion of the General Funds, with funds being set aside in a reserve account. Supervisor Eddy offered a substitute motion to authorize the County Administrator and staff to examine the non-personnel non-school portion of the General Fund for recommended cuts of $400,000 to be brought back to the Board of Supervisors on April 23, 1991. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Johnson, McGraw. NAYS: Supervisors Robers, Nickens Supervisor Johnson advised that the $55,325 saved by not purchasing vehicles could be reallocated from the Board Contingency Fund and included in the $400,000 cutbacks. IN RE: EXECUTIVE SESSION At 8:34 p.m., Supervisor Nickens moved to go into Executive Session pursuant to the Code of Virginia 2.1-344 (A) to discuss legal matters regarding negotiations with the new landfill '., 2 1 9 ~i April 16, 1991 : - contract. NAYS: None IN RE: CERTIFICATION RESOLUTION R-41691-2 At 8:34 p.m., Supervisor McGraw moved to return to Open Session and adopt the Certification Resolution. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw. NAYS: None RESOLUTION R-41691-2 CERTIFYING EXECUTIVE MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Bòard of Supervisors of Roanoke County, Virginia has convened an executive meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such executive meeting was conducted. in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia~ hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted '" '..... - April 16, 1qq1 2 2 0 2; from open meeting requirements by Virginia law were discussed in the executive meeting which this certification resolution applies, and 2.
