Roanoke, Virginia 24018 May 14, 1991 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the second Tuesday, and the first regularly scheduled meeting of the month of May, 1991. R-51491-1.a.b.c Chairman McGraw introduced County employees Miquel Villarini, who served in the U. S. Marine Corps., Paul MCElvein, who served in the U. S. Coast Guard, and Daryell D. Sexton, who served in the U. S. Coast Guard during the Persian Gulf War. Chairman McGraw presented a Roanoke County flag to Mr. Villarini. Supervisor Johnson moved to adopt the prepared resolution. NAYS: None RESOLUTION 51491-1 OF APPRECIATION TO ROANOKE COUNTY EMPLOYEES WHO SERVED IN THE DESERT SHIELD AND DESERT STORM OPERATIONS WHEREAS, in August 1990, the United states joined other countries throughout the world in fighting the aggression against Kuwait by Iraq; and WHEREAS, at that time, the United States Armed Forces began efforts toward military preparedness, and many reservists 2 ,.. ,350 --, Ha.y~-1. g g 1 ---....>- were called to active duty to serve in the Persian Gulf or at other military bases; and WHEREAS, seven Roanoke County employees served their country with honor and distinction, both overseas and in the united states, during the DESERT SHIELD AND DESERT STORM OPERATIONS; and WHEREAS, it is fitting and proper to recognize their special contributions in helping the united states and its allies win the War. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, on behalf of its citizens expresses its profound appreciation and pride to MIQUEL VILLARINI, PAUL MCELVEIN, AND DARYELL D. SEXTON for the sacrifices they made by serving in the United States Armed Forces during the Persian Gulf War; and FURTHER, the Board directs that Resolutions of Appreciation be presented to WILLIAM GRAY, ROBERT R. SMITH, JR., RICHARD ROCK, AND MARVIN L. LOYD, still serving in the military, upon their return to employment with Roanoke County. The motion carried by a unanimous voice vote. ~ Resolution of ADDreciation to the Roanoke Valley Youth Soccer Club. Inc. R-51491-2 Danny Beamer with the Roanoke Valley Youth Soccer Club was present to receive the resolution. Supervisor Johnson moved to adopt the resolution. The motion carried by a unanimous voice vote. RESOLUTION 51491-2 OF APPRECIATION TO THE ROANOKE VALLEY YOUTH SOCCER CLUB, INC. FOR ITS ASSISTANCE IN HOLDING THE SIXTH ANNUAL FESTIVAL SOCCER TOURNAMENT IN THE ROANOKE VALLEY WHEREAS, The Roanoke Valley Youth Soccer Club, Inc. has been instrumental in establishing an annual soccer tournament to be held in the Roanoke Valley each year during the Memorial Day Weekend; and WHEREAS, this tournament has continued to grow so that this year there will be 188 teams competing in 22 divisions over two days of competition; and WHEREAS, over 3,200 participants, family members, and friends will come from 7 states to spend a weekend in the Roanoke Valley to enjoy excellent soccer, the Festival events, and the other opportunities and facilities of our community. NEW BUSINESS Authorization and aporooriation of funds for the Roanoke River InterceDtor Phase III Proiect. A-51491-3 utility Director Clifford Craig announced that the Allied Signal Project is on hold, but that the staff would like to go forward with the sanitary sewer project to provide possible future service at the Dixie Caverns landfill and development west of I-81 in the Cherokee Hills area. The bids that have been received are lower than bids received for a previous project three years ago, and staff recommended that the project be expanded to construct the river and railroad crossing portion of the sewer sub~main extension to Route 460, and a water line across the Roanoke River. The total cost of the project is $865,000. ." 353 May 14, 1991 In response to a question from Supervisor Robers, Mr. Craig advised that the saving is $120,000 less than the original estimate. Supervisor Eddy expressed concern about spending funds when it's not necessary. Supervisor Nickens moved to appropriate the funds. NAYS: Supervisor Eddy ~ Adootion of the Secondary System Six-Year Construction Plan for Fiscal Year 1991-92. A-51491-4 Supervisor Eddy advised that he felt a new listing of roads should be included every year instead of every other year. Supervisor Nickens moved to adopt the Secondary System Six-Year Construction Plan. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw. NAYS: None RESOLUTION 51491-4 APPROVING THE SECONDARY SYSTEM SIX-YEAR CONSTRUCTION PLAN FOR ROANOKE COUNTY FOR FISCAL YEAR 1991-92 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. The Board does hereby approve the Secondary Highway Six-Year Construction Plan for Roanoke County for Fiscal Year " 35 4 ~J _ UAY 14, 1_99~ 1991-92 as set out on the attached summary; and 2. That a public hearing was held on March 26, 1991, to receive comments on the Secondary Highway Six-Year Construction Plan for Roanoke County for Fiscal Year 1991-92; and 3. That a copy of this resolution duly attested be forthwith forwarded to the Virginia Department o~ Transportation Salem Residency Office along with a duly attested copy of the Secondary Highway Six-Year Construction Plan for Roanoke County for Fiscal Year 1991-92 by the Clerk to the Board. NAYS: None RESOLUTION 51491-5 CERTIFYING EXECUTIVE MEETING WAS HELD IN CONFORMITY WITH THE CODE OF VIRGINIA WHEREAS, the Board of Supervisors of Roanoke County, Virginia has convened an executive meeting on th1s date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by the Board of Supervisors of Roanoke County, Virginia, that such executive meeting was conducted in conformity with Virginia law. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County, Virginia, hereby certifies that, to the best of each members knowledge: 1. Only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the executive meeting which this certification resolution applies, and 2. Only such public business matters as were identified in the motion convening the executive meeting were heard, discussed or considered by the Board of Supervisors of Roanoke County, Virginia. A-51491-6 Supervisor Johnson moved to authorize the County Administrator to execute a software contract with Public Safety Systems Inc. to provide an integrated Computer Aided Dispatch System, and that the contract not exceed $125,000. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw. NAYS: None ~ Request from owners to Durchase Hiqhview Water Comoanv. Oakridqe Water System. and Ponderosa Park Water System. A-51491-7 utility Director Clifford Craig reported that the owners of the privately owned water systems have requested that Roanoke County purchase and/or take over their water systems due to the owners' inability to operate the systems as required by the State Health Department. The Highview Water Company is a user owned community water system serving 18 customers located off Brushy Mountain. The Oakridge Water system is owned by Roselawn Forest Inc. and serves 16 customers. Mr. Craig advised :,.. -----~~--'_._._--'-----------------~----- 357 May 14, 1991 that John Parker is willing to donate this system. The Ponderosa Park Water System is owned by H. B. Water Company and serves 28 customers in the Ponderosa Park Subdivision. staff recommended negotiating to purchase the Oakridge and Ponderosa Park Water System, but not the Highview Water system because of the liability of the County to assure high quality water. Zebulon Hooker, one of the owners of the Oakridge system was present and advised he was satisfied with the quality of the water. Dan Phelgar, President, Highview Water Company, was present and advised that the chemical quality was very good and the residents are willing to live with water restrictions. Chuck Conner with the State Health Department advised that the water system is a well maintained system and the state has received no complaints. Following discussion, Supervisor Robers moved to negotiate with the owners of the Ponderosa Park system. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw. NAYS: None Supervisor Johnson moved to authorize the staff to move forward on management only of the Highview Water System. The motion was carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw. NAYS: None Supervisor Nickens moved to authorize the staff to .,.. ---- Ma.y 14, 1991 358 ---~--- negotiate with the owners of the Oakridge Water System and that the negotiations include an outstanding debt of $40,000 owed to the County. A-51491-8 Supervisor Eddy moved to accept the $1,350 grant to support a spring lecture discussion series. NAYS: None ~ Reconsideration of Fralin and Waldron's request for Virqinia Housinq Develooment Authoritv Financinq. Mr. Hodge reported that Fralin and Waldron have requested reconsideration of the Board's action on April 23, 1991 disapproving VHDA financing of their proposed mUlti-family residential housing development. He advised that his concerns were: (1) that this is a 60 unit complex to be constructed on seven of more than 250 acres; (2) Fralin and Waldron have advised that the quality can be greater if VHDA funding is approved because they could put more funding in the project. However, this needs to be demonstrated; (3) Although some recreational ,.. 359 May 14, 1991 facilities are included in the proposal to VHDA, Fralin and Waldron need to more clearly define the recreational facilities they plan to provide. Supervisor Nickens moved to reconsider the action taken on April 23, 1991. The motion was denied by the following recorded vote: AYES: Supervisors Robers, Nickens NAYS: Supervisors Eddy, Johnson, McGraw IN RE: EMPLOYEE SERVICE AWARDS The Board of Supervisors and County Administrator recognized county employees who were awarded certificates of appreciation for five, ten, fifteen, twenty, twenty-five and thirty years of service. IN RE RECESS At 5:05 p.m., the Board declared a recess to attend a reception honoring those employees who were recognized for their years of service to Roanoke County. IN RE: EXECUTIVE SESSION At 5:30 p.m., Supervisor Johnson moved to go into Executive Session pursuant to the Code of Virginia 2.1-344 A (6) to discuss investment of public funds for the reservoir and landfill projects. Supervisor Johnson moved to set the work session for May 28, 1991 at 7:00 p.m. The motion carried by a unanimous voice vote. ~ Request for Strateqic Planninq Session in June 1991. There was board consensus to set a Strategic Planning Session for Saturday, June 8, 1991 at 7:30 a.m. and continue on Sunday, June 9, 1991, if necessary. Supervisor Eddy ~ Ordinance authorizinq conveyance of a .4 acre Darcel of real estate located on Route 311 in the Catawba Maqisterial District to Sherill L. and Maxine Smith. May 14, 1991 364 orecincts. County Attorney Paul Mahoney explained that this amendment included changes made by Governor Wilder after the ordinance was approved. There are changes to the precincts and boundaries, but no change to the people within the magisterial district. Supervisor Eddy asked for copies of a map with the new districts. Supervisor Johnson announced he would not support this action because felt the Bonsack area should be in the vinton Magisterial District rather than the Hollins Magisterial District. Supervisor Johnson APPOINTMENTS .L. Clean Valley Council Supervisor Robers nominated Supervisor Eddy to serve a two-year term expiring June 30, 1993 as the Board liaison. ~ Fifth Planninq District commission Supervisor McGraw nominated Supervisor Eddy to serve as a member of the Executive Committee. Supervisor Nickens nominated Charles Steve Garrett to a three-year term which will expire June 30, 1994. ~ Parks and Recreation Advisory Commission ,.. ~6 5 May 14, 1991 Supervisor Johnson nominated Richard Cox to a three- year term which will expire June 30, 1994, representing the Hollins Magisterial District. Supervisor McGraw nominated Fenton W. Harrison, Jr. and Michael Wathall to three year terms expiring June 30, 1994, representing the Catawba Magisterial District. IN RE: CONSENT AGENDA There was board consensus to remove Item 3 and that this request be included in Roanoke County's legislative packet and VML/VACo's legislative program, and that Frederick County be informed of this action. That this matter came this day to be heard upon the :,.. :\6 7 ~ May 14, 1991 proceedings herein, and upon the application of Lange Lane, from the intersection with Pleasant Hill Drive (state Route 1549) to the cUl-de-sac, for a distance of 0.05 miles, to be accepted and made a part of the Secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said road have heretofore been dedicated by virtue of a certain map\maps known as Queens Court Subdivision which map was recorded in Plat Book 10, Page 97, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on September 22, 1987 and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said right-of-way for drainage. 3. That said road known as Lange Lane and which is shown on a certain sketch accompanying this Resolution, be, and the same is hereby established as public road to become a part of the State Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said street or highway by the Virginia Department of Transportation. That this matter came this day to be heard upon the proceedings herein, and upon the application of Green Meadow Road approximately 0.13 miles from the intersection of Farmington Drive to the new cul-de-sac for a distance of 0.02 miles, and Lakeland Drive approximately 0.17 miles from the intersection of Farmington Drive to the new cul-de-sac for a distance of 0.10 miles to be accepted and made a part of the secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said roads have heretofore been dedicated by virtue of a certain map\maps known as Windemere Subdivision which map was recorded in Plat Book 10, Page 169, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on August 1, 1988 and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said right-of- way for drainage. 3. That this matter came this day to be heard upon the proceedings herein, regarding final approval for that portion of Reservoir Road (State Route 648) which lies within the County of Roanoke, said road being within the secondary highway system and having been improved and funded pursuant to § 3 3 . 1-75. 1 of the Code of Virginia (1950, as amended). 2. That this Board does guarantee unto the Commonwealth of Virginia an unrestricted fifty-foot (50') right-of-way and necessary easements for said portion of Reservoir Road, heretofore acquired from the abutting property owners, the deeds having been recorded in the Clerk's Office of the Circuit Court of Roanoke County. 3. Mr. Mahoney advised that the books have been received and asked direction from the Board on setting a fee to charge citizens who wish to purchase them. There was board consensus that he set the fee based on the cost of the books. (2) Asked about a letter to Congressman Olin in support of increased payments in lieu of taxes. Mr. Hodge will investigate and send a letter if one has not been sent. (3) Asked about the Memorial Day parade. (4) Invited the board members to his home on May 25 to meet his son who has returned from the Persian Gulf war. (5) Asked whether the Board should be involved in the new management structure and organizational changes. There was board consensus that Mr. Hodge has the authority to make the changes. suoervisor Nickens: (1) Asked the County Attorney to investigate the legality of hiring a private firm to collect :,.. 37 1 May 14, 1991 unpaid taxes. Mr. Mahoney will bring back a report on May 28, and Mr. Hodge will begin the bid process to ascertain the costs. (2) Asked that the staff establish an employee service award program with better participation. Suoervisor Johnson: (1) Noted that the majority of citizens responding in the newspaper do not favo! tax increases. (2) Advised he supported an employee bonus if there is a surplus of funds at the end of the year. He asked Mr. Hodge to bring back a report on this issue when the audit is presented. Suoervisor Robers: (1) Asked for a report on privatization of county services as soon as possible. (2) Announced that u. S. Congressman Boucher has asked for $22 million for the Smart Highway. He also updated the Board on other Smart Highway action. Suoervisor McGraw: (1) Announced that the VACo/VML Task Force will meet soon. (2) Asked that the Board consider putting the issue of county funding for the Hotel Roanoke on a bond issue in the fall of 1991. He asked that this be included in the CIP work session and planning session discussions. IN RE: REPORTS Supervisor Johnson moved to receive and file the following reports.
