Roanoke, Virginia 24018 May 28, 1991 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the fourth Tuesday, and the second regularly scheduled meeting of the month of May, 1991. The Pledge of Allegiance was recited by all present. IN RE: REQUEST TO POSTPONE, ADD TO, OR CHANGE THE ORDER OF 'I'D AGENDA ITEKS Supervisor Eddy requested that negotiations with Roanoke City concerning the regional landfill be discussed in the Executive Session. County Administrator Hodge added Item S.3 - Adoption of Resolution for reimbursable expenses related to Spring Hollow Reservoir. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS ~ Resolutions and recoanition for the Crowell GaD Road Clean-uD Proiect. 1991. R-52891-1 Chairman McGraw presented a resolution of appreciation for each organizations involved in the clean-up project and individual certificates of appreciation to those who were present. Supervisor Eddy moved to adopt the resolution. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Nickens, McGraw NAYS: None ABSENT: Supervisor Johnson ". 37 5- May 28, 1991 - -- .--- RESOLUTION 52891-1 OF APPRECIATION TO ORGANIZATIONS FOR VOLUNTARY PARTICIPATION IN 'I'D CROWELL GAP ROAD CLBAH-UP PROJECT 1991 WHEREAS, the management of solid waste is one of the priority issues facing local government: and WHEREAS, roadside dumping of garbage continues to be a problem for the County of Roanoke and adjacent municipalities; and WHEREAS, cleaning up of our environment is a critical concern for all citizens, and the removal of trash from County road sides and illegal dumps makes a substantial contribution to this effort: and WHEREAS, an illegal trash dump on Crowell Gap Road along the Roanoke County/Franklin County line has existed for more than ten years and has been one of the largest dumps in the County; and WHEREAS, the clean-up by volunteers of the trash dump on Crowell Gap Road over a three-day period resulted in the disposal of more than 33 tons of trash at an estimated cost savings of $100,000 in personnel, equipment and supplies. On motion of Supervisor Eddy, and carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Nickens, McGraw NAYS: None ABSENT: Supervisor Johnson IN RE: HEW BUSINESS ~ ADDroval of Mutual Assistance Aareement with the Town of Vinton. A-52891-2 John Cease, Roanoke County Police Chief, advised that this .r- .r- May 28, 1991 377_ Mutual Assistance Agreement with the Town of Vinton is necessary so that the arrest powers and law enforcement capabilities of police officers will be recognized in each locality and in cases of emergency situations. The agreement was developed by Chief Cease and Chief Foutz of the vinton Police Department and will be revised annually and reviewed periodically throughout the year. The agreement has been reviewed by the County Attorney. Supervisor Nickens moved to approve the agreement. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Nickens, McGraw NAYS: None ABSENT: Supervisor Johnson ~ AcceDtance of Grant and aDDroDriation to the School Federal proarams Fund for Job Trainina PartnershiD Act (JTPA) Summer Youth Proaram. A-52891-3 Mr. Willie Waker, Principal of Roanoke County Career Center, requested the acceptance of a $97,530.40 grant from the Fifth District Planning EmploYment and Training Consortium's Private Industry Council and Policy Board for the JTPA Summer Youth Program for the second consecutive year. The program will be housed at the Roanoke County Career Center and no matching funds are required. Supervisor Robers moved to accept the grant and appropriate the funds to the School Board Federal Programs Fund. The motion carried by the following recorded vote: ,.,. '. 378 May 28, 1991 AYES: Supervisors Eddy, Robers, Nickens, McGraw NAYS: None ABSENT: Supervisor Johnson ~ Consideration of Droiects for 1991-92 VDOT Revenue Sharina proaram A-52891-4 Mr. Hodge advised that a priority list of proposed projects to be constructed with revenue sharing funds had been prepared by staff. According to VDOT, funds do not have to be appropriated at this time, and due to budgetary constraints, Mr. Hodge recommended deferring the $435,200 appropriation for the projects until later. In response to Mr. Eddy's inquiry, Mr. Hodge advised that VDOT has no cut-off date for appropriations and whenever the funds are appropriated, VDOT will go forward with matching funds and complete the projects. Steve Buston, Virginia Department of Transportation, advised that the list of projects must be submitted to VDOT by May 31, 1991 in order for the state to appropriate the eligible amount for Roanoke County. However, the projects can be completed by priority as funding is received from Roanoke County. Supervisor Eddy moved to submit the approved project list to VDOT but defer appropriations until later in fiscal year 1991-92. Supervisor Johnson made a substitute motion to table the item until the June 11, 1991 meeting in order to discuss the appropriations at the Board Plaftfting Session on June 8, 1991. The ,. ,. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw NAYS: None ~ ADDroval of contracts for emolovee health and dental insurance. A-52891-5 Keith Cook, Director, Human Resources, recommended approval of contracts with Blue Cross/Blue Shield of Virginia for employee health insurance and Delta Dental Plan for employee dental insurance. In response to Supervisor Eddy's questions, Mr. Cook advised that competitive bids were not solicited this year. Under State requirements, contracts for professional services are allowed to be bid every three years. He explained that the rates are within the area of medical inflation which are rising about 22% to 25% per year and the committee felt that bidding the contract would not result in better rates. Supervisor Eddy expressed concern that the proposal for Blue Cross/Blue Shield of Virginia contained a 23.9% increase for County employees and 18.3% for School Board employees, and the Delta Dental Plan of Virginia contained a 25% increase for all employees. Mr. Cook .. .. 380 May 28, 1991 advised that there will be no increase in the premiums to the employees. This will be accomplished by using budgeted funds and the County insurance reserves. In respond to Supervisor Nickens' inquiry about Community Care Network (CCN), Mr. Cook advised that this is an overlay to contractual arrangement and can be used with any insurance company. CCN has discounts with Community Hospital and Lewis Gale Hospital but the County would lose the hospital discount received from Blue Cross/Blue Shield, and would have to impose a monetary penalty or incentive for employees to use the participating hospitals. The County would also lose the physician's discount from Blue Cross/Blue Shield. There would be no saving according to two comparisons recently completed. Supervisor Johnson moved to approve the contracts. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw NAYS: None Supervisor Eddy requested that the staff prepare an analysis which would include the percent of premium increase for other governments as well as how they handle the bidding process. Mr. Hodge advised that staff would report back to the board in thirty days. ~ AcceDtance of CaDi tal Grant from Cox Cable TV for education and aovernment access. A-52891-6 Mr. Hodge advised that Cox Cable Roanoke, Inc. will be ',. ,. May 28, 1991 38 1 ~ making the first installment of $200,000 of a capital grant payment in connection with the renewal of its cable television franchise. The three Roanoke Valley governments need to accept and determine how the funds will be handled. Supervisor Nickens expressed concern about the hidden cost of the grant such as the costs for additional personnel to run the program. Supervisor Eddy moved to receive the funds jointly as a capital grant payment, and paYment of expenditures to be subject to authorization from the three localities on the recommendations of the CATV Committee. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, McGraw NAYS: Supervisor Nickens IN RE: REQUESTS FOR WORK SESSIONS Mr. Hodge advised that the Parks & Recreation Advisory Commission had requested a work session for June 11, 1991, at 5:30 p.m. to consider use of the Ogden Senior citizens facility and to update their activities for the year. IN RE: REQUEST FOR PUBLIC JIBBING AND FIRST READING FOR REZONING ORDlHAIICES - CONSENT AGBNDA 1. An ordinance to rezone approximately 3.39 acres from R- 1 and B-1 to R-l to bring the zoning into conformity with the residential use, located at 5245, 5249, 5241, ti,. '. 382 May 28, 1991 and 5237 Falcon Ridge Road, Cave Spring Magisterial District, upon the petition of Roanoke County Planning Commission. 2. An ordinance to rezone 2.35 acres from B-3 to M-2 and obtain a Special Exception Permit to operate an automobile graveyard, located at 4116 West Main Street Catawba Magisterial District, upon the petition of H&H Associates/Import Auto Recycling Supervisor Nickens moved to approve the first reading and set the second reading and public hearing for June 25, 1991. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw NAYS: None IN RE: SECOND READING OF ORDINANCES ~ Ordinance aDorooriatina funds for the Fiscal Year 1991-92 Budaet. 0-52891-7 Supervisor Johnson moved to adopt the ordinance upon second reading. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw NAYS: None ORDINANCE 52891-7 APPROPRIATING FONDS FOR THB 1991-92 FISCAL YEAR BUDGET FOR ROANOKE COUNTY, VIRGINIA WHEREAS, upon notice duly published in the newspaper, a public hearing was held on April 9, 1991, concerning the adoption of ",. May 28, 1991 383 the annual budget for Roanoke county for fiscal year 1991-92; and WHEREAS, the Board of Supervisors of Roanoke County, Virginia, approved said budget on April 23, 1991, pursuant to the provisions of Section 13.02 of the Roanoke County Charter and Chapter 4 of Title 15.1 of the 1950 Code of Virginia, as amended; and WHEREAS, the first reading of this appropriation ordinance was held on May 14, 1991, and the second reading of this ordinance was held on May 28, 1991, pursuant to the provisions of Section 18.04 of the Roanoke County Charter. This was in response to Mr. HOdge's memo about the possibility of creating special tax districts for fire and rescue. Supervisor McGraw advised that he was being sent to the conference in his capacity as President of VACo. (4) He advised that Supervisors Eddy and Robers participated in the Memorial Day Parade. (5) He explained his reasons for publishing the Windsor Hills ReDorter with detailed information about Spring Hollow Reservoir. SUPERVISOR JOHNSON: (1) He expressed his opinion that matters discussed in executive session should remain confidential until the majority decides they are for public disclosure. (3) He acknowledged the significant economic impact of the recent soccer tournament and requested that the Chairman direct staff to cooperate fully for future tournaments. That this ordinance shall be in full force and effect thirty (30) days after its final passage. Supervisor Nickens explained that any request for an extension of time should be directed to the Roanoke County Resource Authority. He advised that the Roanoke County Resource Authority could review the proposals and decide to accept additional bids. 2. William T. Carter. 4435 Cordell Drive. landowner in Montgomery County and resident of Roanoke County, questioned who will construct, own and operate the landfill. He expressed his concern about whether the Smith Gap Landfill will accept out of state garbage, his opposition to the rail spur and possible contamination of Spring Hollow Reservoir. Supervisor Nickens advised that the Roanoke County Resource Authority will construct, operate and own the smith Gap Landfill and transfer station. The intent is to not accept waste from out of state but accept the refuse stream from the valley governments first, and possibly outside but still within the state. 3. Pat Laverv. 4759 North Fork Road. Elliston. VA. expressed her concerns about valley water in connection with the potential rail spur to the landfill. 4. Louise SDanaler. 4731 North Fork Road. A-52891-17 Supervisor Johnson moved to approve proceeding with the preconstruction grouting program for Spring Hollow Reservoir. The motion carried by the following recorded vote: AYES: Supervisors Eddy, Robers, Johnson, Nickens, McGraw NAYS: None Supervisor Eddy requested that the board return to a work session format to continue discussing the Spring Hollow Water proj ect. There was no consensus to return to the work session. Supervisor Eddy expressed concern that the financial plans submitted were extended only to the year 2000 and a discussion followed. Supervisor Eddy inquired whether adjusting the ratio between the base charge and the volume charge in the rate structure had been considered. After discussion, Supervisor Nickens requested that Cliff Craig, utility Director, provide Supervisor Eddy with additional information concerning base rates. '" ,. A-52891-18 Mr. Hodge advised that this is a request for $150,000 to be transferred from the utility fund to the Spring Hollow account in order to pay the total costs of $188,982 for design changes. In response to Supervisor Eddy's question about the specific utility fund, Ms. Hyatt advised that this will be a loan from the unappropriated balance and water off-site facilities fund. The resolution following states that this loan will be reimbursed by bond proceeds. Supervisor Nickens moved to approve the additional engineering services for Spring Hollow Reservoir. The Board of Supervisors of the county of Roanoke, Virginia (the "County") has determined that it is necessary and desirable to make capital improvements within the County by acquiring and constructing the Spring Hollow Water Project costing approximately $75,000,000 and including, but not limited to, the acquisition, construction, and equipping of a water reservoir, a dam, a water treatment plant, a transmission and distribution system consisting of, among other things, water pipes, water mains, pumps, elevators, lift stations, storage lagoons and storage tanks, and all electrical, mechanical and other services necessary, and other related appurtenances (the "Project") over the next several years. NOW, THEREFORE, Be it resolved by the Board of Supervisors of the County of Roanoke, Virginia as follows: Section 1. Statement of Intent. The County presently intends, at one time or from time to time, to finance the Project with tax-exempt bonds (the "Bonds") and to reimburse capital ,.. ,. May 28, 1991 43 3 expenditures paid by the County (including expenditures previously paid by the County to the extent permitted by law) in connection with the Project before the issuance of the Bonds by incurring such tax-exempt debt to pay all or any portion of the costs of the Project. Section 2. Source of Interim Financina and Pavment of Bonds. The County expects to pay the capital expenditures related to the proj ect and incurred before the issuance of the Bonds with an interfund loan from the County's general fund and from a temporary loan of any revenues derived from the County's water system available for such purpose. The County expects to pay debt service on a portion of the Bonds in the principal amount of $l5,000,000 from its general fund consisting of general tax revenues and on the remaining portion of the Bonds from revenues derived from users of the County's water system, including the Project when completed. Section 3. Effective Date: Public Ins'Dection. This Resolution shall be 'in full force and effect upon its adoption. The Clerk of the County shall file a copy of this Resolution in the records of the County within 10 days after its adoption and thereafter keep it continuously available for inspection by the general public during the County's normal business hours.
