The Board of Supervisors of Roanoke County, Virginia, met
this day at the Roanoke County Administration Center, this being the
fourth Tuesday, and the second regularly scheduled meeting of the
month of May, 1991.

Supervisor Eddy requested that negotiations with Roanoke
City concerning the regional landfill be discussed in the Executive
Session.
County Administrator Hodge added Item S.3 - Adoption of
Resolution for reimbursable expenses related to Spring Hollow
Reservoir.

each organizations involved in the clean-up project and individual
certificates of appreciation to those who were present.

RESOLUTION 52891-1 OF APPRECIATION TO ORGANIZATIONS
FOR VOLUNTARY PARTICIPATION IN 'I'D
CROWELL GAP ROAD CLBAH-UP PROJECT 1991
WHEREAS, the management of solid waste is one of the
priority issues facing local government: and
WHEREAS, roadside dumping of garbage continues to be a
problem for the County of Roanoke and adjacent municipalities; and
WHEREAS, cleaning up of our environment is a critical
concern for all citizens, and the removal of trash from County road
sides and illegal dumps makes a substantial contribution to this
effort: and
WHEREAS, an illegal trash dump on Crowell Gap Road along the
Roanoke County/Franklin County line has existed for more than ten
years and has been one of the largest dumps in the County; and
WHEREAS, the clean-up by volunteers of the trash dump on
Crowell Gap Road over a three-day period resulted in the disposal of
more than 33 tons of trash at an estimated cost savings of $100,000 in
personnel, equipment and supplies.
NOW THEREFORE BE IT RESOLVED that we, the Board of
Supervisors of Roanoke County, Virginia, do hereby recognize the

~ ADDroval of Mutual Assistance Aareement with the Town
of Vinton.

John Cease, Roanoke County Police Chief, advised that this

Mutual Assistance Agreement with the Town of Vinton is necessary so
that the arrest powers and law enforcement capabilities of police
officers will be recognized in each locality and in cases of emergency
situations. The agreement was developed by Chief Cease and Chief
Foutz of the vinton Police Department and will be revised annually and
reviewed periodically throughout the year. The agreement has been
reviewed by the County Attorney.
Supervisor Nickens moved to approve the agreement. The
motion carried by the following recorded vote:

~ AcceDtance of Grant and aDDroDriation to the School
Federal proarams Fund for Job Trainina PartnershiD Act
(JTPA) Summer Youth Proaram.

Mr. Willie Waker, Principal of Roanoke County Career Center,
requested the acceptance of a $97,530.40 grant from the Fifth District
Planning EmploYment and Training Consortium's Private Industry Council
and Policy Board for the JTPA Summer Youth Program for the second
consecutive year. The program will be housed at the Roanoke County
Career Center and no matching funds are required.
Supervisor Robers moved to accept the grant and appropriate
the funds to the School Board Federal Programs Fund. The motion
carried by the following recorded vote:

~ Consideration of Droiects for 1991-92 VDOT Revenue
Sharina proaram

Mr. Hodge advised that a priority list of proposed projects
to be constructed with revenue sharing funds had been prepared by
staff. According to VDOT, funds do not have to be appropriated at
this time, and due to budgetary constraints, Mr. Hodge recommended
deferring the $435,200 appropriation for the projects until later.
In response to Mr. Eddy's inquiry, Mr. Hodge advised that
VDOT has no cut-off date for appropriations and whenever the funds are
appropriated, VDOT will go forward with matching funds and complete
the projects.
Steve Buston, Virginia Department of Transportation, advised
that the list of projects must be submitted to VDOT by May 31, 1991 in
order for the state to appropriate the eligible amount for Roanoke
County. However, the projects can be completed by priority as funding
is received from Roanoke County.
Supervisor Eddy moved to submit the approved project list to
VDOT but defer appropriations until later in fiscal year 1991-92.
Supervisor Johnson made a substitute motion to table the
item until the June 11, 1991 meeting in order to discuss the
appropriations at the Board Plaftfting Session on June 8, 1991. The

sent to VDOT without any funding provision. The motion carried by the

dental insurance.

Keith Cook, Director, Human Resources, recommended approval
of contracts with Blue Cross/Blue Shield of Virginia for employee
health insurance and Delta Dental Plan for employee dental insurance.
In response to Supervisor Eddy's questions, Mr. Cook advised
that competitive bids were not solicited this year. Under State
requirements, contracts for professional services are allowed to be
bid every three years. He explained that the rates are within the
area of medical inflation which are rising about 22% to 25% per year
and the committee felt that bidding the contract would not result in
better rates.
Supervisor Eddy expressed concern that the proposal for Blue
Cross/Blue Shield of Virginia contained a 23.9% increase for County
employees and 18.3% for School Board employees, and the Delta Dental
Plan of Virginia contained a 25% increase for all employees. Mr. Cook

advised that there will be no increase in the premiums to the
employees. This will be accomplished by using budgeted funds and the
County insurance reserves.
In respond to Supervisor Nickens' inquiry about Community
Care Network (CCN), Mr. Cook advised that this is an overlay to
contractual arrangement and can be used with any insurance company.
CCN has discounts with Community Hospital and Lewis Gale Hospital but
the County would lose the hospital discount received from Blue
Cross/Blue Shield, and would have to impose a monetary penalty or
incentive for employees to use the participating hospitals. The
County would also lose the physician's discount from Blue Cross/Blue
Shield. There would be no saving according to two comparisons
recently completed.
Supervisor Johnson moved to approve the contracts. The

Supervisor Eddy requested that the staff prepare an analysis
which would include the percent of premium increase for other
governments as well as how they handle the bidding process. Mr. Hodge
advised that staff would report back to the board in thirty days.

making the first installment of $200,000 of a capital grant payment in
connection with the renewal of its cable television franchise. The
three Roanoke Valley governments need to accept and determine how the
funds will be handled.
Supervisor Nickens expressed concern about the hidden cost
of the grant such as the costs for additional personnel to run the
program.
Supervisor Eddy moved to receive the funds jointly as a
capital grant payment, and paYment of expenditures to be subject to
authorization from the three localities on the recommendations of the
CATV Committee. The motion carried by the following recorded vote:

Mr. Hodge advised that the Parks & Recreation Advisory
Commission had requested a work session for June 11, 1991, at 5:30
p.m. to consider use of the Ogden Senior citizens facility and to
update their activities for the year.

WHEREAS, upon notice duly published in the newspaper, a
public hearing was held on April 9, 1991, concerning the adoption of

the annual budget for Roanoke county for fiscal year 1991-92; and
WHEREAS, the Board of Supervisors of Roanoke County,
Virginia, approved said budget on April 23, 1991, pursuant to the
provisions of Section 13.02 of the Roanoke County Charter and Chapter
4 of Title 15.1 of the 1950 Code of Virginia, as amended; and
WHEREAS, the first reading of this appropriation ordinance
was held on May 14, 1991, and the second reading of this ordinance was
held on May 28, 1991, pursuant to the provisions of Section 18.04 of
the Roanoke County Charter.
BE IT ORDAINED by the Board of Supervisors of Roanoke
County, Virginia, as follows:

of any unencumbered balance or portion thereof from one classification
of expenditure to another within the same department or agency. That
the County Administrator may transfer up to $10,000 from the
unencumbered balance of the appropriation of one department or agency
to another department or agency, including the contingency account
encompassed in the Non-Departmental appropriation.

3. That all funded outstanding encumbrances, both operating
and capital, at June 30, 1991, are reappropriated to the 1991-92
fiscal year to the same department and account for which they are
encumbered in the previous year.
4. That appropriations designated for capital projects will
not lapse at the end of the fiscal year but shall remain appropriated
until the completion of the project or until the Board of Supervisors,
by appropriate action, changes or eliminates the appropriation. Upon
completion of a capital project, staff is authorized to close out the
project and transfer to the funding source any remaining balances.

ORDINANCE 52891-8 FOR AUTHORIZATION TO ACQUIRE
NECESSARY EASEKENTS TO CONSTRUCT THE ROANOKE RIVER
SEWER INTERCEPTOR PHASE III PROJECT
WHEREAS, location plans for the Roanoke River Sewer
Interceptor Phase III Project have been completed and the project will
require acquisition of easements across eleven properties; and,
WHEREAS, said easements are to be acquired for water and
sanitary sewer to facilitate any future construction of a water line
project: and,
WHEREAS, the total cost for the necessary acquisitions is
estimated not to exceed $10,800.00, to be paid from the Roanoke River
Sewer Interceptor Phase III Project Fund: and,
WHEREAS, Section 18.04 of the Roanoke County Charter directs
that the acquisition of real estate be accomplished by ordinance; the
first reading of this ordinance was held on May 14, 1991, and the
second reading was held on May 28, 1991.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF SUPERVISORS OF
ROANOKE COUNTY, VIRGINIA, as follows:
1. That the acquisition and acceptance of the necessary

MAGISTERIAL DISTRICT TO SHERRILL L. SKITH AND
MAXINE SKITH
WHEREAS, a certain parcel of real estate located in Roanoke
County, Virginia, was declared surplus by the County School Board of
Roanoke County on October 8, 1987: and
WHEREAS, the said parcel was accepted by the Board of
Supervisors of Roanoke County by Ordinance No. 12187-10 and conveyed
to Roanoke County by deed dated December 10, 1987, of record in the
Roanoke County Circuit Court Clerk's Office in Deed Book 1278 at page
1606: and
WHEREAS, the County has ceased to use this property for any
of its purposes.
THEREFORE, BE IT ORDAINED by the Board of Supervisors of

1. That pursuant to the provisions of § 18.04 of the
Roanoke County Charter, the acquisition and disposition of real estate

IN RE: RBPORTS AND INQUIRIES OP BOARD KBKBERS
SUPERVISOR EDDY: (1) He requested an update on a noise
ordinance for the County in view of the new City ordinance. Mr.
Mahoney will report back to board at the first meeting in
December as to the experience of the City as to the effectiveness
of ordinance.
(2) He requested a limited staff study of the
ratio of benefits versus taxes paid in the different type areas.
This was in response to Mr. HOdge's memo about the possibility of
creating special tax districts for fire and rescue. (3) He asked
if there would be a representative at the NACo Conference in Salt
Lake City, utah.
Supervisor McGraw advised that he was being
sent to the conference in his capacity as President of VACo. (4)
He advised that Supervisors Eddy and Robers participated in the
Memorial Day Parade. (5) He explained his reasons for publishing
the Windsor Hills ReDorter with detailed information about Spring
Hollow Reservoir.
SUPERVISOR JOHNSON:
(1) He expressed his opinion that
matters discussed in executive session should remain confidential
until the majority decides they are for public disclosure. (2)
He advised that the noise study for the airport had been

completed.
(3) He acknowledged the significant economic impact
of the recent soccer tournament and requested that the Chairman
direct staff to cooperate fully for future tournaments. He asked
that resolutions of appreciation be sent to people involved. (4)
He expressed support for Mr. Hodge's response to the County
budget problems for 1992 by his efforts at reducing the staff by
20 positions.
SUPERVISOR ROBERS:
(1) He expressed his opinion that
executive sessions are unnecessary and indicated that he will
vote against future executive sessions unless they involve
personnel or negotiation matters.
SUPERVISOR MCGRAW:
(1) He advised that the VACo/VML
task force met in Richmond last week and will meet again June 5,
1991, to discuss the final half of draft legislation to be
presented to the General Assembly through the Grayson Commission.

expressed her concern about dusk to dawn lights infringing on the

~ utility Rates and Feasibilitv studY.
Mr. Hodge introduced those present and gave an overview
of the Spring Hollow Reservoir Project. He distributed copies of
a June 24, 1986 board report on Spring Hollow Reservoir. Diane
Hyatt, Director, Finance, and Cliff Craig, Director, utility,
were present to answer questions.
Mr. John Bradshaw from Hayes, Seay, Mattern & Mattern
outlined the history documenting the need for a new water source
and the background regarding the selection of the Spring Hollow
site. He exhibited several drawings of the project.
Mr. John Hubbard, Assistant County Administrator, gave
a description of the Spring Hollow Water Project.
Mr. Jim Johnson from Wheat, First Securities, Inc.
outlined the preliminary financing plans and distributed a
prepared report. He also had a slide presentation.
Mr. John Price, from Burns & MCDonnell, reviewed the
draft feasibility study as contained in his prepared report and
through a slide presentation.

1. Doualas E. Brinckman. Attornev for Houston Motor
EXDress. requested an extension for submitting construction bids
on Smith Gap Landfill which are due May 31, 1991.
Supervisor Nickens explained that any request for an
extension of time should be directed to the Roanoke County
Resource Authority. He advised that the Roanoke County Resource
Authority could review the proposals and decide to accept
additional bids.
2. William T. Carter. 4435 Cordell Drive. landowner
in Montgomery County and resident of Roanoke County, questioned
who will construct, own and operate the landfill. He expressed
his concern about whether the Smith Gap Landfill will accept out
of state garbage, his opposition to the rail spur and possible
contamination of Spring Hollow Reservoir.
Supervisor Nickens advised that the Roanoke County
Resource Authority will construct, operate and own the smith Gap
Landfill and transfer station. The intent is to not accept waste
from out of state but accept the refuse stream from the valley
governments first, and possibly outside but still within the
state.
3. Pat Laverv. 4759 North Fork Road. Elliston. VA.
expressed her concerns about valley water in connection with the
potential rail spur to the landfill.

Supervisor Eddy with additional information concerning base
rates.

from the unappropriated balance and water off-site facilities
fund.
The resolution following states that this loan will be
reimbursed by bond proceeds.

The Board of Supervisors of the county of Roanoke,
Virginia (the "County") has determined that it is necessary and
desirable to make capital improvements within the County by
acquiring and constructing the Spring Hollow Water Project
costing approximately $75,000,000 and including, but not limited
to, the acquisition, construction, and equipping of a water
reservoir, a dam, a water treatment plant, a transmission and
distribution system consisting of, among other things, water
pipes, water mains, pumps, elevators, lift stations, storage
lagoons and storage tanks, and all electrical, mechanical and
other services necessary, and other related appurtenances (the
"Project") over the next several years.
NOW, THEREFORE, Be it resolved by the Board of
Supervisors of the County of Roanoke, Virginia as follows:
Section 1. Statement of Intent. The County presently
intends, at one time or from time to time, to finance the Project
with tax-exempt bonds (the "Bonds") and to reimburse capital

expenditures paid by the County (including expenditures
previously paid by the County to the extent permitted by law) in
connection with the Project before the issuance of the Bonds by
incurring such tax-exempt debt to pay all or any portion of the
costs of the Project.
Section 2. Source of Interim Financina and Pavment of
Bonds. The County expects to pay the capital expenditures
related to the proj ect and incurred before the issuance of the
Bonds with an interfund loan from the County's general fund and
from a temporary loan of any revenues derived from the County's
water system available for such purpose. The County expects to
pay debt service on a portion of the Bonds in the principal
amount of $l5,000,000 from its general fund consisting of general
tax revenues and on the remaining portion of the Bonds from
revenues derived from users of the County's water system,
including the Project when completed.
Section 3. Effective Date: Public Ins'Dection. This
Resolution shall be 'in full force and effect upon its adoption.
The Clerk of the County shall file a copy of this Resolution in
the records of the County within 10 days after its adoption and
thereafter keep it continuously available for inspection by the
general public during the County's normal business hours.
