Supervisor Johnson moved that Item 4, regarding the construction of a soapbox derby track at Walrond Park be continued to April 24, 1990. The motion carried by a unanimous voice vote. Supervisor Nickens added Item 7, a resolution regarding increased postage costs. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS AND AWARDS h Proclamation declarinq the week of April 8 - 14, 1990 as Public Safety Telecommunicators Week Captain Art LaPrade introduced the dispatchers who were present. Linda Gailey, supervisor of the Dispatchers, accepted the proclamation and expressed thanks to the Board. Supervisor Nickens moved to approve the proclamation. The motion carried by the following recorded vote: AYES: supervisors Eddy, McGraw, Johnson, Nickens, Robers NAYS: None RESOLUTION 41090-2 OF CONGRATULATIONS TO CHARLOTTE POFF UPON HER SELECTION AS ROANOKE COUNTY EMPLOYEE OF THE YEAR FOR 1989 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: WHEREAS, in 1986, the Board of Supervisors of Roanoke County, Virginia, approved an Employee of the Year Program; and WHEREAS, the purpose of this program is to recognize outstanding employees and encourage excellence in performance of job duties; and WHEREAS, a committee appointed by the County Administrator and made up of five representatives from the Employee Advisory Committee selected the 1989 Roanoke County 23 7 April 10, 1990 ,- Employee of the Year from a group of departmental nominees; and - WHEREAS, Charlotte Poff was chosen by the Committee as the 1989 Roanoke County Employee of the Year, and is deserving of special recognition by the Board of Supervisors of Roanoke County and the citizens of Roanoke County for her outstanding contributions made during the year 1989. On motion of Supervisor Nickens, and carried by the following recorded vote: AYES: Supervisors Eddy, McGraw, Johnson, Nickens, Robers NAYS: None IN RE: NEW BUSINESS h Approval of proposed amendment to the charter and aareement for the consolidation of Roanoke County and Roanoke city A-41090-3 County Attorney Paul Mahoney explained that on March 13, 1990, the Board requested that Roanoke City Council consider April 10, 1990 23 8 - - a modification to the proposed consolidation agreement regarding the composition of the school board. This change would require an amendment to the proposed charter and would have to be presented to the General Assembly at its veto session on April 18. Roanoke City Council endorsed the amendment to the agreement and charter on April 2nd. Mr. Mahoney advised that the amendment would change the composition of the school board by the addition of two members, one appointed from the Town of Vinton and another appointed from either the County or City based upon school-age population. Supervisor Johnson suggested an amendment, adding the words "school district" pertaining to the old city and old county. He also requested that a memorandum of understanding be prepared for both localities to sign. He advised he had discussed this change with Delegate Chip Woodrum and Roanoke city Councilman Fitzpatrick and they had no opposition to the change. Supervisor Eddy read a prepared statement pointing out that he was opposed to continued use of the old city and old county boundary and the change to the proposed charter is based on the old lines. However, he advised that while he was opposed to using the old boundary lines, he would vote in favor of the change because it offered the County residents a larger representation on the School Board. Supervisor Robers suggested that the agreement could also contain language allowing the county teachers to continue teaching in county schools after consolidation. Mr. Mahoney 239 . April 10, 1990 - responded he would discuss this with the City Attorney and suggested that this be included in the memorandum of understanding. However, Supervisor Johnson questioned the legality of encumbering future school boards. Supervisor Robers moved' to approve the change to the charter and agreement regarding the number of school board members, as amended by Supervisor Johnson to include the words "School District" where appropriate, and further moved that a memorandum of understanding be prepared between Roanoke City and Roanoke County so there is no misunderstanding of the modification. The motion carried by the following recorded vote: AYES: Supervisors Eddy, McGraw, Johnson, Robers NAYS: Supervisor Nickens Supervisor Nickens suggested that since Chairman Robers is now discussing future modifications to the agreement with the Roanoke City negotiating team, the original county negotiating team should be dissolved. Supervisor Johnson advised he felt that both localities should have an equal number of negotiators to discuss any issue. Chairman Robers responded that he would invite the individual supervisor who had requested each of the modifications to future negotiations. A-41090-4 Mr. Hodge reminded the board that this item had previously been discussed during work sessions and at a board meeting. Approval of the grant and $150,600 will match funds available from the Landfill Board. with the grant, the County will purchase an automated refuse truck and containers for a pilot commingled recycling program. staff recommended approval of the grant and funding. Supervisor McGraw moved to approve the matching grant and appropriate $150,600 from the unappropriated balance. Request for aDpropriation of funds to renovate of the Revenue' s Office, Treasurer' s Office and commissioner Procurement. A-41090-S Mr. Hodge explained that there are heating and air conditioning problems in the Treasurer's and Commissioner of Revenue I s Offices and the windows cannot be opened to regulate the heat and air. There is also a leak in the Procurement Department which causes flooding, especially in heavy rains. Mr. Hodge recommended allocation of $56,000 to make these necessary 241 April 10, 1990 - repairs and replacements. Supervisor Eddy advised he understood the need to replace the air conditioning before the summer months, but questioned why the repairs to Procurement could not be included in the budget process. Supervisor Nickens replied that he felt - this should be fixed as soon as possible. Supervisor Nickens moved to approve the staff recommendation. The motion carried by the following recorded vote: AYES: Supervisors Eddy, McGraw, Johnson, Nickens, Robers NAYS: None h Request from the Roanoke Area SoaDbox Derby Ine. to construct a soapbox DerbY track at Walrond Park. This item was continued to April 24, 1990. ~ ReDort on concession aqreement authorizinq the Recreation Clubs and others to operate concession stands in Roanoke county. Assistant County Administrator John Chambliss reported that in 1984, the services of Woods, Rogers, Muse, Walker and Thornton were retained to investigate the practices employed elsewhere regarding the operation of concession stands and to recommend a policy for Roanoke County. The pol icy recOmmended that the lessee should have liability insurance naming the County as the beneficiary to protect the County from loss resulting April 10, 1990 242 - from operations over which the County is not supervising. It has - been determined that this type of coverage will cost approximately $250 per organization for an annual policy. staff recommended retaining the current policy regarding concession agreements and to expand the scope of coverage to include all concession operations at any County owned facility. Supervisor Nickens stated that he could not support this recommendation. He pointed out that volunteers spend many hours to raise funds that will go back to the county providing such things as uniforms. He also felt there were legal inconsistencies involved because all organizations are not required to provide the coverage. County Attorney Mahoney advised that the policy should be applied to all organizations who operate concessions. Supervisor Nickens moved that the County include in the budget the funds for the liability coverage for all organizations who operate concessions. In response to questions from Supervisor McGraw, Mr. Mahoney advised that this policy has not been applied to all organizations in the past. Supervisor McGraw expressed concern that there is no knowledge of how many organizations would be involved or what the costs might be for the coverage. Supervisor Nickens advised that the Risk Manager and County Attorney should investigate who needs the coverage before taking action. Supervisor Johnson moved to table the issue until the Board of Supervisors receives a report from the Risk Manager 24 3 April 10, 1990 ~ regarding the need for the coverage, what organizations would == need the coverage and what the costs would be to provide the coverage. A-41090-6 School Superintendent Bayes Wilson explained to the Board why the schools made the decision to go forward with the expanded Career Center Program when funds were not available. The School System planned to offset the costs from other areas in the budget. However, they were not able to reduce the number of positions anticipated, and had to add several special education teachers. Dr. Theodore Viars advised that the program has grown from 70 to 140 students and only 4 students have dropped out. One of the primary reasons for expanding the program to a full day was the travel time to transport the students to the old William Byrd School and to meet the needs of the students. Supervisor Eddy advised he was not opposed to the $500,000 appropriation for the project, but was concerned about the agreement that was made regarding the transfer of the finance operation from the schools to the County while leaving those funds in the school budget to meet the 5.2 percent salary adjustment. He felt the result of this agreement was increased April 10, 1990 24 4 - = costs and possible renovations ror ~ne aaa1t1onal Í1nance personnel. supervisor Johnson responded that committees have met for several years in an effort to consolidate services and this will accomplish one of those goals. The school system also needs the additional funds to meet healthcare costs for its employees. Mr. Hodge replied he will agree not to renovate space and will accommodate the additional personnel within· existing space. Following discussion of changes to the school board budget, Supervisor Johnson moved to approve the staff recommendation and appropriate the funds. Postal service to consider a "local government Dostal rate". R-41090-7 Supervisor Nickens moved to approve the prepared resolution. The motion carried by the following recorded vote: AYES: Supervisors Eddy, McGraw, Johnson, Nickens, Robers NAYS: None RESOLUTION 41090-7 URGING THE U.S. POSTAL SERVICE TO INSTITUTE A LOCAL GOVERNMENT POSTAL RATE WHEREAS, the united States Postal Service has filed notice for an increase in postage rates to be effective 2.45 April 10, 1990 -- upon ~ne approval of all appropriate bodies; and WHEREAS, such a postal increase will mandate a = significant financial impact on local county governments throughout the united states for essential services provided by local entities, i.e., tax notices, voter registration forms, jury duty summonses, jury duty pay, general payments for local counties, et. aI, including certain payments made by counties for the Federal Government; and WHEREAS, in essence, such a postal rate increase will be a form of "double taxation" on local county government taxpayers, for required governmental services; and WHEREAS, such a postal increase will cost the taxpayers of Roanoke County an estimated $38,557 additional in postal payments per year just to commence this services; and WHEREAS, the National Association of Counties (NACo) has endorsed the concept of a "local government postal rate". NOW THEREFORE, BE IT RESOLVED by the Roanoke County Board of Supervisors that it does hereby join the National Association of Counties (NACo) to request that the United States Postal Service strongly consider the institution of a "local government postal rate" as a part of its current Rate Filing in an effort to reduce the burden of cost increases in postal rates to local county government taxpayers. Mr. Mahoney reported that the intent of this ordinance is to authorize an agreement with the residents of the Highfields area to allow construction and financing of a sewer project. The second reading will be April 24, 1990. Supervisor Eddy asked for an opportunity to discuss with staff the ordinance that authorizes the financing and agreements with residents for public improvements. Supervisor Nickens moved to approve first reading of the ordinance. Mr. Mahoney presented the staff report and advised that first reading for one of the parcels was held on March 27, 1990. However, it was later decided to include both parcels in the ordinance. He explained that the Virginia Department of Transportation is acquiring rights of way for the widening of Route 221, and this ordinance will authorize the acceptance and acquisition of the necessary property and the conveyance to the state. VDOT has offered $73,632 for one of the parcels and $63,220 for the other parcel. Second reading will be April 24, 1990. Supervisor McGraw moved to approve first reading of the ordinance. He felt that the costs had increased and that there might be better ways to recognize their efforts. He suggested that the board members look at other ways to express April 10, 1990 248 - ~ne1r apprec1at10n. supervisor Johnson: Announced that the report had been received from the consultants who studied the proposed consolidated school systems. They have advised that the neighborhood school concept is legal and, in their opinion, will continue to be legal. SUDervisor McGraw: Announced that Ann Hess, Chairman of the Montgomery County Board of Supervisors, has asked for a discussion with Roanoke County regarding j oint water and sewer lines, and the possibility of other joint projects. He suggested a meeting between the Chairman, Vice Chairman and County Administrators of the two localities to discuss these issues, provided there are no legal impediments to such a meeting. supervisor Nickens: (1) Asked for an update at the April 24th meeting regarding progress of the new automated library system. (2) Asked if a letter had been sent to Mayor Taylor requesting joint funding of the therapeutics program because he had not yet received a response. RECONVENEKENT At 5:10 Chairman Robers reconvened. ~ IN RE: IN RE: WORK SESSIONS ~ Budaet Work Session Mr. Hodge presented an overview of the proposed budget. Members of the School Board and Dr. Bayes Wilson were also present. He advised that the budget was based on priorities established by the Board of Supervisors as follows: Landfill and Recycling, Bond Improvements Plan, Employee Benefits, Economies/Efficiencies, Economic Development and Public Safety. The major accomplishments include a 5.2 percent salary increase for school and county personnel; establishment of a County Police Department, funding of five new police officers, construction of the Read Mountain Fire Station, expansion of the recycling program, funding of a market survey for county employees, funds for four new paramedic firefighters, funding for a zoning ordinance update and projects for the Capital Improvements Program. Mr. Hodge reported that the proposed budget for 1990- 9l is over $67 million, a 7.5% increase, generated from increased real estate and personal property tax assessments and increased April 10, 1990 252 - - user fees. Mr. Hodge recommended that the Spring Hollow Reservoir be placed on hold at this time since it was no longer a regional project. After discussion, the board members concurred that staff should go forward with the design and construction bids and funding methodology. supervisor Eddy suggested that the funding method be established before going forward with bids. They directed that staff bring back a report on the funding to the board on April 24, 1990, and that bids should go out shortly after that date. Regarding the landfill, Supervisor Johnson recommended increasing the tippage fee for private haulers. Mr. Hodge advised he has budgeted a 5.2% salary increase for all employees and implementation of a market survey to make employee salaries competitive with other localities, at a cost of $391,000. The Board members requested that the survey be brought to them for discussion prior to discussion with staff. supervisor Eddy stated that he felt the only positions that should be adjusted are those that are problems to fill. supervisors Nickens and Robers supported increased funding for economic development. Supervisors Nickens and Eddy advised they did not support hiring additional police officers at this time, while Supervisors McGraw and Johnson expressed support for the addition. Mr. Hodge presented a list of proposed capital projects for a possible bond issue in 1991. He advised these will be 253 April 10, 1990 included in the Cap1tal Improvement Plan process ana the p.lan will be updated. Several board members expressed support for a gradual reduction of the real estate tax rate. In response to a question from Supervisor McGraw regarding a possible real estate tax rate reduction, Mr. Hodge replied the reduction should become effective at the beginning of a calendar year. Supervisor Nickens asked if there was additional funding for a county supplement to Social Service salaries equal to the county salaries. He asked that funding be included in the budget and he would come back with a recommendation from the Social Services Board. Mr. Hodge responded he will meet with the Director of Social Services. other comments from board members included: (1) Supervisor Nickens asked that information concerning an amusement tax be considered; (2) Supervisor Eddy expressed concern about the continued lease-purchase of vehicles. R-41090-9 The following citizens spoke regarding the real estate tax rate: 1. Shelby Thomason, 3938 Vauxhall Road S. W., representing the Roanoke County Education Association, spoke in support of increased school funding and in opposition to reducing the real estate tax rate. 2. David Courey, 3419 Ashmeade Drive asked that the real estate tax rate be decreased. 3. M. T. Supervisor Eddy offered a substitute motion to set the tax rate for 1990 at $1.15 with instructions to the County Administrator to prepare the budget for 1990-91 based on revenues from $1.13 real estate tax rate. He explained that the tax rate is based on a calendar year and this would allow next year's budget to be prepared on the reduced rate. The motion was defeated by the following recorded vote: AYES: Supervisors Eddy, Johnson NAYS: Supervisors McGraw, Nickens, Robers Supervisor Nickens offered another substitute motion to set the real estate tax rate for 1990 at $1.15, but that on July 1, 1990, 2 cents will be set aside for capital improvements. He stated that he felt that the County's capital needs should be met if possible, and $270,000 could be set aside to meet these needs by this action. In response to a question from Supervisor Johnson, Mr. Hodge advised that if this motion passed, half of the money would come from the school budget and hal f from the county; and the capital funds would also be divided in half to meet the needs. Supervisor McGraw asked where the funds would be cut from in order to set aside additional money in the capital April 10, 1990 25 6 - - budget. Mr. Hodge responded that funds were set aside should the Board choose to cut the tax rate. He further advised he would reduce the landfill account if the Board reduces the real estate tax rate. Mr. Hodge advised that this would not have a negative impact on either the school or county budget and no cuts would be made to either the schools or county programs.
