IN RE: CALL TO ORDER Chairman Garrett called the meeting to order at 3: 05 p.m. The roll call was taken. MEMBERS PRESENT: Chairman Lee Garrett, Vice Chairman Richard Robers, Supervisors Bob L. Resolution of Conaratulations to Dr. Carol Gilbert who was named Outstandina ODerational Medical Director: Supervisor Johnson moved to adopt the prepared resolution that was presented to Dr. Gilbert. Resolution of Conaratulations to Betsv Starnes for beina named Miss Job's Dauahters for the State of Virainia. Supervisor Nickens moved to adopt the prepared resolution that was presented to Betsy Starnes. The motion was seconded by Supervisor Robers and carried by the following voice vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None I I I 37 5 December 13, 1988 RESOLUTION 121388-2 OF CONGRATULATIONS TO BETSY STARNES UPON BEING SELECTED AS MISS JOB'S DAUGHTERS OF VIRGINIA WHEREAS, Betsy Starnes, daughter of Mr. and Mrs. Starnes, has been active in Job's Daughters, an organization associated with the Masons, and is a former Honor Queen of Bethel 7; and WHEREAS, on November 26, 1988, in Norfolk, Virginia, she was honored by being selected from 44 contestants and 10 finalists from throughout the state as Miss Job's Daughters of Virginia; and WHEREAS, this honor recognizes her knowledge of the Job's Daughters rituals, which strive to teach young women ages 11 and over to become stronger indi viduals and stresses such attributes as integrity. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, wishes to express its congratulations to Miss Starnes for attaining this high honor in Job's Daughters; and FURTHER, the Board of Supervisors expresses its pride to Miss Starnes, a Junior at William Byrd High School, for this outstanding achievement and wishes her continued success in her future endeavors. MCGUIRE FOR NINETEEN YEARS OF SERVICE TO ROANOKE COUNTY WHEREAS, Wiley W. McGuire was first employed in April, 1969, as a Plumbing Inspector in the Building Inspections Department; and WHEREAS, Wiley W. McGuire has also served as the Assistant Building Official, as of January 1, 1984, for the Department of Construction Building Services. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Roanoke County expresses its deepest appreciation and the appreciation of the citizens of Roanoke County to WILEY W. The motion was seconded by Supervisor Robers and carried by the following recorded vote: AYE S : Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None RESOLUTION 121388-5 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVI SORS OF ROANOKE COUNTY TO DOT ELLER FOR OUTSTANDING CONTRIBUTIONS TO HER COMMUNITY WHEREAS, the Roanoke County Board of Supervisors is indebted to its citizens who offer their time, talent and energy through many volunteer activities and desires that these efforts be recognized in an appropriate manner; and 37 8 December 13, 1988 WHEREAS, Dot Eller has been a driving force in the many accomplishments of the Fort Lewis Civic League, and served with distinction as President during 1987/88; and WHEREAS, the Fort Lewis Civic League is composed of 370 members and does provide the community with services such as food baskets for the needy, elderly and shut-ins, and has been instrumental in improving the Andrew Lewis Place Subdivision water lines, and the draining of the pond on Route 460; and WHEREAS, the Fort Lewi s Ci vic League further provides services to the community by participation in the Clean Valley Council, adopting Route 11-460 as a cleanup project and providing a $200 scholarship each year for a Glenvar High School senior. I NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, expresses its deep appreciation and the appreciation of the citizens of Roanoke County to DOT ELLER for her leadership and outstanding contributions to the quality of life in her community, and Roanoke County. On motion of Supervisor McGraw, seconded by Supervisor Robers and carried by the following recorded vote: AYES: Supervisors Johnson, McGraw, Nickens, Robers, Garrett NAYS: None RESOLUTION 121388-4 EXPRESSING THE APPRECIATION OF I THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO BARBARA FASNACHT FOR OUTSTANDING CONTRIBUTIONS TO HER COMMUNITY I I 37 9 December 13, 1988 WHEREAS, the Roanoke County Board of Supervisors is indebted to its citizens who offer their time, talent and energy through many volunteer activities and desires that these efforts be recognized in an appropriate manner; and WHEREAS, Barbara Fasnacht served with distinction as President of Cherokee Hills Homeowners Association for 1988/89, having served one previous term as President; and WHEREAS, under her leadership, the Cherokee Hills Homeowners Association was instrumental in getting the roads in Cherokee Hills Subdivision brought into the state secondary system, and helped to reduce speeding in the neighborhood; and WHEREAS, she provided a calm positive approach in efforts to solve problems with the water system and the potential of a future landfill site in the community, and because of her concern, was appointed as a member of the Roanoke County Citizens Landfill Advisory Council in July, 1988. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia, expresses its deep appreciation and the appreciation of the citizens of Roanoke County to BARBARA FASNACHT for her leadership and outstanding contributions to the quality of life in her community, and Roanoke County. BOWEN FOR OUTSTANDING CONTRIBUTIONS TO HIS COMMUNITY WHEREAS, the Roanoke County Board of Supervisors is indebted to its citizens who offer their time, talent and energy through many volunteer activities and desires that these efforts be recognized in an appropriate manner; and WHEREAS, Kenneth D. Bowen has served with distinction during 1985/86 and 1987/88 as President of Mason Cove Civic Club, Inc.; and during 1986 as Vice President; and WHEREAS, under his leadership, the Mason Cove Civic Club, Inc. has been instrumental in revi ving the Neighborhood Watch Program and helped the community deal in a professional manner wi th such issues as the flooding in Masons Creek, the road repairs on Bradshaw Road, the improvements to the Mason Cove Elementary School and the potential of a future landfill site in the community; and WHEREAS, Mr. Bowen has also been active in youth athletics and is serving his second term on the Roanoke County Parks & Recreation Advisory Commission and was Vice-Chairman in 1987/88. ReceiDt of 1987/88 Annual Audit. Director of Finance, Diane Hyatt presented the report of the annual audit and announced that the County will be able to add $1,656,795 to its current fund balance. She advised that this was the first year that proration of personal property tax was in effect for the full year. Staff recommends that the Board accept the audit for 1987-88 and that $1,656,795 be appropriated to the Fund Balance. Supervisor Garrett moved to approve the staff recommendation. The motion was seconded by Supervisor Nickens and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett r 38 2. December 13 1988 NAYS: None 2. Reauest from the Cave SDrina Rescue Sauad for assistance in constructina a new rescue sauad buildina: Fire and Re s cue Chief Tommy Fuqua presented the staff report. He advised that the rescue squad is requesting county assistance in constructing a two-story facility with 8,000 square feet of space at a cost of $500,000 on county owned property at the corner of Valley Forge and Brambleton. They are requesting that the County appropriate $300,000 through a lease/purchase as the County's share of the construction costs. The squad will se 11 the current property and use the proceeds for construction costs and would raise the balance of the cost of the project. An agreement would be negotiated between the County and Cave Spring Rescue Squad regarding the use of the County property and the payment of project costs. Following discussion, Supervisor Robers moved to approve the request of the Cave Spring Rescue Squad. The motion was seconded by Supervisor Nickens and approved by the following unanimous recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None I I I I 1 I 38 3 December 13, 1988 3. Reauest for SUDDort for a Reaional Jail Work Farm. Sheriff Michael Kavanaugh reported that he would like to provide a jail annex for lower security prisoners and would like for it to be a regional annex for surrounding localities from several planning districts. He recommended that the Virginia Department of Corrections conduct a needs assessment survey. He also recommended that this annex would be placed in Roanoke County and under the supervision of the Roanoke County Sheriff. County Administrator Elmer Hodge advised that he is requesting support from the Board for the regional concept of a work farm at this time. The specifics of the plan will be brought back to the Board. Supervisor Nickens moved to adopt the prepared resolution. The motion was seconded by Supervisor McGraw and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None RESOLUTION 121388-9 OF SUPPORT FOR THE CONCEPT OF A REGIONAL WORK FARM FOR NON-VIOLENT OFFENDERS WHEREAS, there exists a need in the Roanoke Valley for a productive use of non-violent offenders presently being housed in the valley's jails; and r 38 ~ D WHEREAS, many non-violent offenders could be available to serve the citizens in their localities as well pay their debt to society; and this regional work farm could provide services to the localities resulting in savings in jail operations, and also give non-violent offenders the opportunity to perform productive work for their community, and WHEREAS, the Sheriff of Roanoke County has begun a study of the feasibility of a work farm for nonviolent offenders, and the Honorable Kenneth Trabue has expressed his support for a work farm that would be regional in nature. THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County, Virginia supports the concept of a regional work farm, and BE IT FURTHER RESOLVED that the Board of Supervisors supports the continuation of the study being conducted by Sheriff Michael I Kavanaugh, and that other law enforcement officials be invited to participate in the study to determine the need for such a regional facility. I I 38 5 December 13, 1988 4. AdoDtion of Amended EmDlovee Handbook: Director of Human Resources Keith Cook reported that the final draft of the employee handbook is now ready for adoption. Changes requested at the November 22nd meeting have been incorporated. Supervisor Nickens moved to adopt the Employee Handbook effecti ve January 1, 1989. The motion was seconded by Supervisor McGraw and carried by a unanimous recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens and Garrett NAYS: None 5. Reauest for amendment to EmDlovee Handbook to allow mDensatorv time or overtime Dav for non-exemDt emDlovees. Following discussion of this issue, Supervisor McGraw moved to continue the item to January 24, 1989. The motion was seconded by Supervisor Johnson. At that time, the staff will present examples of compensatory time and overtime pay for a variety of job position. The staff will also survey private and public sectors on their policies concerning compensatory time and overtime pay. Reauest for acceDtance of Dlannina arant for Pinkard Court. Acting Planning Director Dale Castellow presented the staff report. He advised that Roanoke COunty had been notified on September 19, 1988 by the Virginia Department of Housing and Community Development that they had been awarded a $9,000 grant to fund specific advance planning activities for Pinkard Court. This does not commit the County to going forward with a construction grant but only funds for advance planning. Supervisor Nickens moved to approve acceptance of the grant. The motion was seconded by Supervisor Robers and carried by the following unanimous recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Nickens, Garrett NAYS: None I 7 . Reauest from School Board for aDDroDriation for 2 + 2 proaram in automated manufacturina technoloav. Supervisor Nickens moved to approve the $20,000 revenue and related expenditures for this program. Reauest for amendment to State Code reaardina desianation of Clerk to the Board of SUDervisors. Mr. Hodge reported that he is requesting Board support for an amendment to the State Code that would allow Roanoke County to appoint a Clerk to the Board of Supervisors other than the County Administrator. The State Code presently allows this only for counties with populations of between 100,000 and 143,000. If approved, this will become part of the the legislative package to the General Assembly. Supervisor Nickens moved to approve the staff recommendation. The motion was seconded by Supervisor McGraw and carried by the following recorded vote: AYES: Supervisors Johnson, Robers,McGraw, Nickens, Garrett NAYS: None ~ AODroval of Rural Addition Prioritv Listina ~ r I I 38 8 December 13, 1988 There was considerable discussion on this issue, and the Board members did not feel ready to approve the listing. They requested additional information and suggested that a work session should be held for detailed discussion. Supervisor Garrett moved that approval be delayed and that a work session be set for February 14, 1989. Reauest for action regardina court action on the Deti tion of C. L. & 0 Investors for a rezonina from R-1 Residential to B-1 Business. County Attorney Paul Mahoney advised that on June 14, 1988, the Board of Supervisors voted to deny a petition to rezone 1. 7 acres of land located at the intersection of Route 419, Cordell Drive and McVitty Road. C. L. & O. Investors then filed a motion for declaratory judgment challenging this denial. On October 20, the Circuit Court found that the existing rezoning was unreasonable and that the B-1 zoning is reasonable. Mr. I Mahoney advised that the Board that they may choose to rezone the property from R-1 to B-1 subject to the proffered conditions or ~ I I December 13, 1988 38 9 may take no action. However, if no action is taken, a permanent injunction will be effective enjoining the Board from preventing the use of the property for B-1 use. Roger Lorden, 4390 Sheldon Drive advised he had attended the court hearing and felt the land should be developed in conformance with the 419 Frontage Plan. He requested that the Board challenge the judge's ruling. Supervisor Nickens moved that the Board convey to the court that they will comply and not make an appeal and that the costs be covered from the court order. The motion was seconded by Supervisor Garrett. In response to a question from Supervisor Johnson, Mr. Mahoney responded that Supervisor Nicken's motion would not specifically include the proffered conditions. He suggested that the Board approve the rezoning which would include the proffers. Supervisor McGraw offered a substitute motion to rezone the property with proffered conditions and cover the court costs. The substitute motion was seconded by Supervisor Robers and carried by the following unanimous recorded vote: AYES: Supervisors Johnson, Robers, McGraw, Garrett NAYS: Nickens 39 0 December 13, 1988 IN RE: REQUEST FOR WORK SESSIONS Chairman Garrett advised that two work sessions have been set. One on January 10, 1989 on the Comprehensive Annual Financial report and one on February 14, 1989 on the Rural Addition Priority List. IN RE: APPOINTMENTS 1. ReDort on Court Service Unit Advisorv Council/Youth and Familv Services Advisorv Board Michael Lazzuri was present and requested that the Board of Supervisors continue this committee. He called a meeting of the board and they recommended that it be continued. Supervisor Nickens moved to continue the board and appoint new members. The motion was seconded by Supervisor McGraw and carried by the following unanimous recorded vote: AYES: Supervisor Johnson, Robers, McGraw, Nickens, Garrett NAYS: None Supervisor McGraw asked Mr. Lazzuri to report back with how many current members are willing to continue to serve. He also requested that the County Administrator investigate funding of the Regional Partnership, including how much of the funding goes toward economic development, and how much each participating locality funds economic development in their individual budgets. That that certain section of the agenda of the Board of 39 2 December 13, 1988 Supervisors for December 13, 1988, designated as Item I - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 10, inclusive, as follows: 1. Confirmation of appointments to the Mental Health Services of the Roanoke Valley Board of Directors 2. Request for Bingo Permit from the Vinton Moose Lodge. 3. The motion was seconded by Supervisor Nickens and carried by the following recorded vote: AYES: Supervisors Johnson, Robers, Nickens, Garrett NAYS: None ABSTAIN: Supervisor McGraw Reauest from Marie Mitchell to waive the water ordinance: Supervisor Robers expressed concern about making a special exception for one person and not for others with similar problems. Utility Director Clifford Craig advised that this was a sincere hardship situation which could cost an elderly woman $60,000. Supervisor Johnson moved to approve the waiver. Alfred Powell, 3440 Franklin Street spoke in support of current method of selecting board of zoning appeal members by circuit court rather than by the Board of Supervisors. Supervisor Nickens moved to delete this request from the General Assembly legislative package. There was no second and the motion died. I IN RE: REPORTS Supervisor Johnson moved to receive and file the following reports with Item 4 removed for discussion. Status Report on Library Automation I L_ I I 39 5 December 13, 1988 Supervisor Johnson moved to continue this item to New Business on January 10, when there will be adequate opportunity for discussion and input. The motion was seconded by Supervisor McGraw. Mr. Hodge advised that action on this item will only allow the concept to go forward for the bid process. Assistant County Administrator John Chambliss explained how the process will go forward. The motion was unanimously defeated by a recorded vote. Supervisor McGraw moved to allow the staff to continue its st udy of a shared library automation system through the bidding process without a financial commitment at this time. The motion was seconded by Supervisor Robers. There was discussion on the merits of going forward with the automated system versus a single library system which could then be automated. Accounts Paid - November 1988 IN RE: EXECUTIVE SESSION r 39 6 December 13, 1988 At 5: 45 p.m. Supervisor Garrett moved to go into Executive Session pursuant to the Code of Virginia Section 2.1-344 (a) (1) to discuss a personnel matter and (7) to discuss a legal matter, consolidation. Planner Jon Hartley presented the staff report advising 39 8 December 13, 1988 that this was a request to relocate the Hop In presently located on Route 419 to the corner lot. The property is located in a Core Land Use category. There are two access points, one from Route 419 and one access to Glen Heather Drive. The primary concern was the access on Glen Heather Drive. Several people spoke in opposition at the Planning Commission. The Planning Commission recommended approval with proffered conditions. Ed Natt, attorney for the petitioner presented the plans the petitioner had for the property. The present building will continue to be used as a pizza delivery and a small pet shop. He described the plans for the gasoline storage tanks and the entrance and egress plans for the project. The following citizens spoke concerning the proposed rezoning: 1. Bob Caudle, 4410 Chesterton Street S. W. in support because of the better access and improved appearance. 2. Mabel Smith. 4502 Wyndale Avenue opposed because of the new access on Glen Heather Drive and the possibility of apartments in the future. 3. Lewis McNeace, 4522 Wyndale Avenue, opposed to the entrance on Glen Heather Drive. I 4 . Jon Hart ley presented the staff report. He reported that the service center will consist of four service bays. There were no significant impact factors. The proffers have limited the type of work to be performed. The Planning Commission recommended approval by a unanimous vote. He advised that the business will employ five people and the peti tioner will have a buffer that will be R-3 residential which will address the neighborhood concern. Mr. Robrecht advised that they were not, at the present time, planning to sell gasoline. Supervisor Johnson advised that this is an old dump site and asked that buffhide tanks and a moni toring system be installed to avoid future leakage. Mr. Hartley responded that as of January 1989 the EPA will require a monitoring system and special tanks. Following discussion, Supervisor Johnson directed the staff to prepare an ordinance on inground storage of gasoline tanks by February 1989. Supervisor Johnson moved to grant the petition.
