Chambliss, Assistant County Administrator of Management Services. The Pledge of Allegiance was recited by all present. , 2 July 8, 1986 IN RE: COUNTY ADMINISTRATOR'S COMMENTS Mr. Hodge announced that Rob Stalzer has received an award from the Roanoke Valley Chamber of Commerce for his completion of the Leadership Roanoke Valley class. Chairman Brittle formally presented the plaque to Mr. Stalzer. IN RE: REQUESTS TO POSTPONE, ADD, OR CHANGE THE ORDER OF AGENDA ITEMS Mr. Hodge requested that an Item F8 (New Business> concerning the 75/25 policy be added to the agenda. IN RE: NEW BUSINESS 1. Transfer of $200,000 to Roanoke Regional Airport Commission for Fiscal Year 1986/87 - Chairman Brittle presented an oversized check to Mr. John Schaar, President of the Salem/Roanoke Valley Chamber of Commerce, and to Mr. Bill Hawkins, President of the Roanoke Valley Chamber of Commerce, representing Roanoke County's portion of funding for fiscal year 1986-87. Chairman Brittle then presented the authentic check to Mr. Hawkins for deposit into the airport account. 2. Approval of E-911 Street Naming - Mr. Rob Stalzer, Director of Planning, Zoning & Grants presented the proposed street names of unnamed streets in Roanoke County to the Board for their approval. The naming of all streets and roads is necessary due to the implementation of the E-9ll system. Chairman Brittle inquired if there were any streets in the County, particularly on boundary lines, where the left side of the street has a different name from the right side. Mr. Stalzer reported that the only situation like this is Belle Avenue and Carson Road. He reported that Carson Road is 3 July 8, 1986 recognized by the Virginia Department of Highways and Transportation Road Law as the name for that particular road and that Belle Avenue is located within the limits of Roanoke city. Supervisor McGraw inquired about the spelling of Mowles Lane. Mr. Stalzer reported that the spelling was not changed in the process of naming streets for the E91l system because the street already had a designated name. He also reported that the petition he received to change the spelling only had five signatures of the 14 adjoining property owners. His office contacted the adjoining property owners and the majority voted to leave the spelling of the name as Mowles Lane. Supervisor Garrett inquired about the number of people who would be impacted by changing the name of Brambleton Avenue to Bent Mountain Road. Mr. Stalzer reported that approximately 125 people would be affected by this change. He also noted that 125 of the 183 households have already instituted the change of address and that many business will be affected if the street name is changed to Bent Mountain Road. His information is based on the number of homes on that road that have changed the address on mailboxes and from the number of telephone calls received. Mr. G. Hampton Moulse, 924 Watts Street, Salem, Virginia, 24153, was present to request that the Board change the spelling of Mowles Lane to Moulse Lane. Ms. Sharon Vest, Route 7, Box 187, Roanoke, Virginia, 24018, was present requesting the Board to change Brambleton Avenue to Bent Mountain Road from Route 897 to the Floyd County line. Supervisor Johnson moved to approve the staff's recommendation with the following changes: that Route 22l be named Bent Mountain Road after the intersection of Route 897 to the Floyd County line¡ that the spelling of Mowles Lane be changed to Moulse Lane¡ that Route 460 East within the boundary of Roanoke County be changed to Challenger Avenue¡ that the ~ 4 July 8, 1986 County Administrator be authorized to make minor changes henceforth. The motion was seconded by Supervisor Brittle. RESOLUTION 7-8-86-150 DESIGNATING THE STREET NAMES OF ALL PUBLIC AND PRIVATE ROADS WITHIN ROANOKE COUNTY WHEREAS, the E911 communications system now being implemented by Roanoke County requires that all roads in the County be assigned names¡ and WHEREAS, the County Administrator was authorized to develop and administer a street naming policy program and to administratively assign names to said streets and roads on behalf of the Board of Supervisors¡ and WHEREAS, pursuant to Section 15.1-379 of the Code of Virginia, as amended, the governing body of any county, authorized by resolution duly adopted, may name streets, roads, and alleys therein outside the corporate limits of towns except for those state highways conforming to Section 33.1-12 of the Code of Virginia, as amended. NOW, THEREFORE BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that all public and private streets are named in accordance with the attached list as recommended by staff. On motion of Supervisor Johnson to approve staff's recommendations with the following changes: that a portion of Route 221 beginning at Route 897 to the Floyd County line be named Bent Mountain Road¡ that the spelling of Mowles Lane be changed to Moulse Lane¡ that Route 460 East within the boundary of Roanoke County be named Challenger Avenue¡ and that the County Administrator be authorized to make minor changes in street names henceforth. The motion was seconded by Supervisor Brittle and carried by the following recorded vote: AYES: Supervisors McGraw, Nickens, Johnson, Garrett, and Brittle NAYS: None ~ 5 July 8, 1986 3. Placement of Workers Compensation Insurance for the 1986/87 Fiscal Year - John Chambliss reported to the Board that he has received the renewal premium notice effective July 1, 1986, for workers compensation insurance through the Virginia Municipal League. The renewal premium has increased from $257,923 to $416,520. He also received a proposal from Yeager and Company, Inc., of Richmond which provides that Yeager and Company will serve as the third party administrator for all or part of the County's insurance program and gave a specific proposal for the Workers' Compensation program. The proposed cost will be $44,315 which includes the administrative costs plus reinsurance for catastrophic losses. In addition, the County would reimburse the administrator for actual claims paid (estimated at $25,000 including the necessary reserves). He reported that staff recommends approval of a contract with Yeager and Company, Inc. Supervisor Nickens moved to approve staff's recommendation. The motion was seconded by Supervisor Johnson and carried by a unanimous roll call vote. 4. Selection of a Public Information Firm or Firms for the Annual Report, Bond Referendum Economic Development, and Other Potential Projects - Mr. Hodge reported that proposals had been requested to contract for preparation of brochures and other materials on bond referendum. Proposals were requested in early June and John Lambert and Associates and Bolt Advertising were the only responses to the proposals. Mr. Hodge recommended that the contract be awarded to John Lambert and Associates. Mr. Hodge also reported that each project would be negotiated individaully with this agency. The only figures that have been received are for the bond referendum in the amount of $15,000 to $25,000. Supervisor Nickens moved to concur with staff's recommendation. The motion was seconded by Supervisor Garrett and carried by a unanimous roll call vote. ----- 6 July 8, 1986 5. Request from Fire and Rescue Squad #5 to Purchase an Ambulance - Mr. Tommy Fuqua, Fire and Rescue Chief, reported to the Board that Fire and Rescue Squad #5 has had numerous problems with one of their ambulances. When this particular ambulance was purchased, the title to the previous ambulance owned by Crew 5 was given to the County. The County has placed this ambulance in operation at the Catawba-Mason Cove Rescue Squad. Crew 5 is requesting that they be allowed to sell or trade the County owned unit with the crew paying the additional cost. Supervisor Johnson moved to approve the staff's request. The motion was seconded by Supervisor Garrett and carried by a unanimous roll call vote. 6. Revision of Adopted 1986-92 Secondary Highway Six-Year Plan - Mr. John Peters, Traffic and Roads Coordinator, reported to the Board that the Virginia Department of Highways and Transportation has revised the 1986-92 Secondary Highway Six-Year Plan which was previously approved by the Board of Supervisors on March 25, 1986. This revision is necessary since Nelms Lane, Route 840, was omitted inadvertently. The Highway Department will go in on cooperative efforts with the County to alleviate the drainage problem in this area. The project is estimated to cost $60,000 of which $30,000 will be funded from the State Highway Department. Supervisor Johnson inquired when this project would be completed. Mr. Peters reported that it should be completed during this fiscal year. He also requested that the citizens in that area be notified that Nelms Lane has been included in the Six Year Plan. Supervisor Johnson moved to approve the revision of the Six-Year Plan. The motion was seconded by Supervisor Brittle and carried by a unanimous roll call vote. "" 7 July 8, 1986 7. Authorization to Proceed with Planning Process on "Explore" Project - Mr. Gubala reported to the Board that there is a need to collect community input concerning the "Explore" Project. The staff feels that the community work should be done by the County staff. Supervisor Nickens requested that the County work with the Planning Commission of the Town of vinton and that the County's efforts be in consort with the River Foundation staff and their consultants so that there will be no duplication of effort. Supervisor Nickens moved to concur with staff's recommendation. The motion was seconded by Supervisor Brittle and carried by a unanimous roll call vote. 8. 75/25 Economic Balance Policy - Mr. Hodge reported to the Board that it is necessary to have a balance of growth in both residential and commercial areas throughout the County. This policy will establish guidelines to help reach this balance. Supervisor Johnson requested that a committee be established to look at the County plans (Comprehensive, Land Use Plan, Zoning Map) to be sure they are all coordinated. Supervisor Johnson moved to concur with staff's recommendation with the appropriate committee established (Chairman of the Board of Supervisors, Chairman of the Planning Commission, Mr. Hodge, Tim Gubala, Rob Stalzer, and Brent Sheffler) . The motion was seconded by Supervisor Garrett and carried by a unanimous roll call vote. IN RE: REQUESTS FOR PUBLIC HEARINGS 1. Request for a Public Hearing on July 22, 1986, to set the Water Connection Fees - Mr. Clifford Craig, Director of utilities, reported that the water connection fees have been the same since 1976 and are no longer adequate to cover costs of the ----- 8 July 8, 1986 facilities for water. These proposed new fees will be discussed with the Contractor's Association on July 17, 1986. Supervisor Brittle requested that all developers, associations, etc., be notified in writing of the proposed increase. Supervisor Nickens moved to set a public hearing on July 22, 1986, to set the water connection fees. The motion was seconded by Supervisor Brittle and carried by a unanimous voice vote. IN RE: APPOINTMENTS Chairman Brittle nominated Mr. Joseph Cronin and Mr. Mike Lazzuri to their previous positions on the Community Corrections Resources Board. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS 1. Supervisor Garrett - Supervisor Garrett inquired about the water situation in regards to the use of water on the weekends. Mr. Clifford Craig responded that the water use problem is still critical but that the County's is not to the point of a mandatory conservation policy. Supervisor Garrett also inquired about illegal parking in handicapped areas and fire lanes. He requested that the Sheriff's Department let people know about the fines they could face for this violation. Chairman Brittle directed that the Sheriff's Department be notified of the increase in this problem and that the enforcement of this law be more strict. 2. Supervisor Johnson - Supervisor Johnson inquired about mandatory conservation. Mr. Craig reported that as long as 9 July 8, 1986 the water supply from Roanoke City is not cut back, the County will not have to go to a mandatory conservation policy. IN RE: CONSENT AGENDA Supervisor Brittle moved to approve the Consent Agenda. The motion was seconded by Supervisor Johnson. RESOLUTION NO. 7-8-86-148 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM K - CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain section of the agenda of the Board of Supervisors for July 8, 1986, designated as Item K - Consent Agenda be, and hereby is, approved and concurred in as to each item separately set forth in said section designated Items 1 through 6, inclusive, as follows: 1. Resolution requesting State Compensation Board to fund additional position in the Sheriff's Department. 2. Resolution urging the General Assembly to Clarify Legislation concerning the Conflict of Interest Act. 3. Abandonment and Acceptance of Right-of Way in conjunction with reconstruction of Route 115. 4. Request for Acceptance of Martha Drive and Gates Circle in the Highway Department Secondary System. 5. Confirmation of Appointments to the Recreation Commission and the Virginia Western Community College Board. 6. Request for New Telephone Equipment in the County Attorney's and County Administrator's Office 2. That the Clerk to the Board is hereby authorized and directed where required by law to set forth upon any of said items the separate vote tabulation for any such item pursuant to this resolution. 10 July 8, 1986 On motion of Supervisor Brittle, seconded by Supervisor Johnson and upon the following recorded vote: AYES: Supervisors McGraw, Nickens, Johnson, Garrett, and Brittle NAYS: None RESOLUTION 7-8-86-148.A REQUESTING THE STATE COMPENSATION BOARD TO AUTHORIZE CERTAIN ADDITIONAL PERSONNEL IN THE SHERIFF'S DEPARTMENT OF ROANOKE COUNTY BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board does hereby request the State Compensation Board to authorize the following additional personnel for the Sheriff's Department of Roanoke County, Virginia, to-wit: (a) One Circuit Court of Appeals Bailiff 2. That the County does hereby express its intent to place in its 1986-87 fiscal year budget funds sufficient to fund its portion of the cost and expense of such additional position¡ and 3. That an attested copy of this resolution be forthwith forwarded to the Sheriff of Roanoke County and to the State Compensation Board. On motion of Supervisor Brittle, seconded by Supervisor Johnson and the following recorded vote: AYES: Supervisors Nickens, McGraw, Johnson, Garrett, and Brittle NAYS: None RESOLUTION 7-8-86-148.B REQUESTING THE GENERAL ASSEMBLY TO CLARIFY LEGISLATION CONCERNING THE COMPREHENSIVE CONFLICT OF INTERESTS ACT WHEREAS, the General Assembly has adopted a Comprehensive Conflict of Interests Act¡ and WHEREAS, the Virginia Supreme Court has made a restrictive interpretation of the Virginia Comprehensive Conflict of Interests Act in the case of West v. Jones, 228 Va. 409, which 11 July 8, 1986 held that a school principal who was on a city council could not vote on the appointment of school board members¡ and WHEREAS, the Attorney General has issued formal opinions in accordance with the West v. Jones case, ruling that teachers who are members of a governing body, or members of a governing body who have spouses employed as teachers in the school system may not vote on the school budget or on appointments to the school board¡ and WHEREAS, these rulings and opinions are contrary to the long-standing practices and policies in Virginia, and are also contrary to prior opinions from the Attorney General¡ and WHEREAS, the new rulings prohibit many members of governing bodies throughout the Commonwealth of Virginia from voting on important issues on behalf of their constituents, thereby depriving these citizens from having a voice or vote on the school budget and appointment to the school board¡ and WHEREAS, it appears that the General Assembly did not intend the results which have been reached under the new interpretations of the Virginia Comprehensive Conflict of Interests Act. NOW, THEREFORE, the Board of Supervisors of Roanoke County, Virginia, hereby urges the General Assembly to clarify legislation concerning the Comprehensive Conflict of Interests Act in order to allow members of governing bodies of localities to vote upon school budgets and appointments to school boards in accordance with prior rulings of the Attorney General. IT IS FURTHER RESOLVED that the Deputy Clerk forward a copy of this resolution to area legislators requesting their support for appropriate amendments to the existing law. IT IS FURTHER RESOLVED that the County Administrator forward a copy of this resolution to the Virginia Association of Counties and to the Washington County Board of Supervisors. J. 12 July 8, 1986 On motion of Supervisor Brittle, seconded by Supervisor Johnson and the following roll call vote: AYES: McGraw, Nickens, Johnson, Garrett, and Brittle NAYS: None RESOLUTION 7-8-86-148.C ACCEPTING A PORTION OF ROUTE 115 INTO THE SECONDARY HIGHWAY SYSTEM OF STATE HIGHWAYS AND ABANDONMENT OF A PORTION OF PRIMARY ROUTE 115 WHEREAS, Primary Route 115, from the intersection of Route 11 to 0.24 mile north of Route 11, a distance of 0.24 mile, has been altered, and a new road has been constructed and approved by the State Highway Commissioner, which new road serves the same citizens as the road so altered¡ and WHEREAS, certain sections of this new road follow new locations, these being shown on the attached sketch titled, "Changes in Primary and Secondary System due to Relocation and Construction on Route 11 and l15, Project 0011-080-104,C501/0115-080-103,C502 and RW 201, dated at Richmond, Virginia, December 3, 1985." NOW, THEREFORE, BE IT RESOLVED that the portion of Primary Route 115, i.e., Section 2, shown in pink on the aforementioned sketch, a total distance of .13 mile be, and hereby is, transferred to the Secondary System of State Highways, pursuant to Section 33.1-35 of the Code of Virginia, as amended. BE IT FURTHER RESOLVED that the sections of old location of Primary Route 115, i.e., Sections 1 and 3, shown in blue on the aforementioned sketch, a total distance of .11 mile, be, and the same hereby is abandoned as a public road. On motion of Supervisor Brittle, seconded by Supervisor Johnson and upon the following recorded vote: AYES: Supervisors McGraw, Nickens, Johnson, Garrett, and Brittle NAYS: None RESOLUTION 7-8-86-148.D ADDING A PORTION OF SECONDARY ROUTES 1801 and 1901 INTO THE SECONDARY SYSTEM OF STATE HIGHWAYS 13 July 8, 1986 AND ABANDONMENT OF A CERTAIN PORTION OF SECONDARY ROUTE 1901 WHEREAS, Secondary Route 1901 and 1801, from the intersection of old Route 115 to Route 11, a distance of 0.19 mile, has been altered, and a new road has been constructed and approved by the State Highway Commissioner, which new road serves the same citizens as the road so a1tered¡ and WHEREAS, certain sections of this new road follow new locations, these being shown on the attached sketch titled, "Changes in Secondary System Due to Relocation and Construction on Routes 11 and l15, Project 0011-080-l04,C50l/01l5-080-l03,C502 and RW-201 dated at Richmond, Virginia, December 3, 1985." NOW, THEREFORE, BE IT RESOLVED that the portions of Secondary Route 1901, i.e., Section 6, shown in red on the sketch titled, "Changes in Secondary System Due to Relocation and Construction on Routes 11 and 115, Project 0011-080-104,C50l/0115-080-103,C502 and RW-201 dated at Richmond, Virginia, December 3, 1985," a total distance of .03 mile be, and hereby is added to the Secondary System of State Highways, pursuant to Section 33.1-229 of the Code of Virginia as amended¡ BE IT ALSO RESOLVED that the portions of Secondary Route 1801, i.e., Section 5 shown in red on the sketch titled, "Changes in Secondary System Due to Relocation and Construction on Routes 11 and 115, Project 0011-080-104,C501/0115-080-103,C502 and RW-20l dated at Richmond, Virginia, December 3, 1985," a total distance of .05 mile be, and hereby is, added to the Secondary System of State Highways, pursuant to Section 33.1-229 of the Code of Virginia, as amended. BE IT FURTHER RESOLVED that the section of old location, of Secondary Route 1901, i.e., Section 4 shown in blue on the aforementioned sketch, a total distance of .03 mile, be, and the same hereby is, abandoned as a public road, pursuant to Section 33.1-155 of the Code of Virginia of 1950, as amended. 14 July 8, 1986 On motion of Supervisor Brittle, seconded by Supervisor Johnson and the following recorded vote: AYES: Supervisors McGraw, Nickens, Johnson, Garrett, and McGraw NAYS: None RESOLUTION 7-8-86-148.E REQUESTING ACCEPTANCE OF MARTHA DRIVE AND GATES DRIVE INTO THE VIRGINIA DEPARTMENT OF HIGHWAYS AND TRANSPORTATION SECONDARY ROAD SYSTEM BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That this matter came this day to be heard upon the proceedings herein, and upon the application for Martha Drive and Gates Circle to be accepted and made a part of the Secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage ease- ments and fifty (50) foot rights-of-way for said roads have heretofore been dedicated by virtue of a certain map known as Northgate Subdivision, which map was recorded in plat Book 9, Page 184, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on February 17, 1981, and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guaran- tees said rights-of-way and right for drainage. 3. That said roads known as Martha Drive and Gates Circle and which are shown on a certain sketch accompanying this Resolution, be, and the same are hereby established as public roads to become a part of the State Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said streets or highways by the Virginia Department of Highways and Transportation. The motion was seconded by Supervisor Johnson and carried by a unanimous voice vote. IN RE: OPEN SESSION Supervisor Brittle moved to return to Open Session the motion was seconded by Supervisor McGraw and carried by a unanimous voice vote. IN RE: ADJOORNMENT Chairman Brittle adjourned the meeting at 5:30 p.m. Immediately following adjournment, the Board went to the Public Service Center for a tour on the progress being made.
