The Pledge of Allegiance was recited by all present. IN RE: COUNTY ADMINISTRATOR'S COMMENTS County Administrator Elmer Hodge introduced D. Keith Cook, Department of Human Resources, who recognized the members and alternates of the Accident Review Committee. Mr. Hodge also congratulated Gary Huff who was elected 2nd Vice Chair for the Southwester District for the Virginia Recreation and Park Society, and announced that Assistant Director of Engineering John Peters has resigned to accept a position with the City of Roanoke. Mr. Hodge introduced Fire and Rescue Chief Tommy Fuqua who presented to the board members the new patch that fire and rescue personnel will be wearing. Mr. Fuqua recognized Billy Duff who designed the patch. Chairman Johnson added Item II, Request for Support 0 a Joint Roanoke Valley Statement on 1988 Legislative Capita P r o j e c t A g e n d a IN RE: NEW BUSINESS 1. Re uest for recreational access funds for the Explore Project: Mr. Hodge advised that staff at the Explor Project has requested that Roanoke County allocate its annua entitlement of $200,000 from the Va. Department of Transportatio for recreational access funds to the Explore Project fo planning, engineering and an environmental impact study for th 806 ·f December 1, 1987 ------------- --~--,._-- creation of the Roanoke River Parkway. Richard Burroughs from the Explore Project was present to answer questions. He explained that this $200,000 will be matched with $800,000 in federal money to begin this project. Supervisor Nickens pointed out that if neighboring localities agree to allot unused portions of their recreational access funds, Roanoke County's share will be reduced. He also requested that the resolution be amended to reflect that the Explore Project is to be developed by the River Foundation. Supervisor Nickens moved to approve the prepared resolution as amended. The motion was seconded by Supervisor Garrett and carried by the following recorded vote: AYES: Supervisors Brittle, Garrett, Nickens, Johnson NAYS: None ABSENT: Supervisor McGraw RESOLUTION 12187-1 REQUESTING RECREATIONAL AREA ACCESS ROAD FUNDS FROM THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO PROVIDE ACCESS TO THE EXPLORE PROJECT (THE RIVER FOUNDATION) TO BE LOCATED IN ROANOKE COUNTY WHEREAS, the Explore Project is to be developed by The River Foundation as a recreational facility serving the residents of Roanoke County and adjoining counties; and WHEREAS, the facility is in need of adequate access; and 307 December 1, 1987 .. ,.- '----' _'_'""_'.."._._".._'__'.'_"_ _ _._._..,.._.·_,_M_.__·..~.__,.____·______·~···_ WHEREAS, the right-of-way of the proposed access i provided by The River Foundation at no cost to the State; and WHEREAS, the procedure governing the allocation 0 recreational access funds as set forth in Section 33.1-223, Cod of Virginia 1950, as amended, requires joint action by th Director of Conservation and Historic Resources and the Highwa and Transportation Board; and WHEREAS, a statement of policy agreed upon between th said Director and the Board approves the use of such funds fo the construction of access roads to publicly owned recreationa areas and historical sites; and WHEREAS, the Board of Supervisors of Roanoke County ha duly adopted a zoning ordinance pursuant to Article 8 (Sectio 15.1-486, et seq.), Chapter 11, Title 15.1; and WHEREAS, it appears to the Board that all requirement of the law have been met to permit the Director of Conservatio and Historic Resources to designate Explore Project as a recrea tional facility or historical site and further permit the Virgin ia Transportation Board to provide funds for access to this pub lic recreational area in accordance with Section 33.1-223, of Virginia 1950, as amended; and WHEREAS, the Board acknowledges that pursuant to th provisions of Section 33.1-62, as amended, this road shall b designated a "Virginia Byway" and recommends the State Highwa 308 December 1, 1987 -~---~-"--'--'-~-'~""'----'-"..".~_. ____u___, ._--~--_.. and Transportation Board, in cooperation with the Director of Conservation and Historic Resources, take the appropriate action to implement this designation. NOW, THEREFORE, BE IT RESOLVED that the Board of Super- visors of Roanoke County hereby requests the Director of Conserva- tion and Historic Resources to designate the Explore Project as a public recreational area and to recommend to the State Highway and Transportation Board that recreational access funds be allo- cated for an access road to serve said park; and BE IT FURTHER RESOLVED that the Virginia Transportation Board is hereby requested to allocate the necessary recreational access funds to provide a suitable access road as hereinbefore described. 2. Authorization to proceed with South Park/Willowlawn and Sun Valley/Palm Valley Drainage Projects: Assistant Director of Engineering John Peters reported that the Board approved funding for drainage improvements in these areas, with the understanding that the residents would donate easements for these projects. He presented the status and bid prices of the two projects. Sun Valley/Palm Valley had a total bid of $55,526. Mr. Peters outlined what will be done in that area for this cost. Chairman Johnson requested that Mr. Peters contact the Highway Department to investigate the culverts under Hershberger Road that lead from Palm Valley. The staff recommended board approval to proceed with these two projects. The funding is included in the current drainage budget. Supervisor Garrett moved to approve the staff recommendation. A roval of the 1987/88 Count -wide draina e projects: Mr. Peters advised that the board approved a priority list of seven drainage projects in July. The drainage crew has now completed five of the projects. The remaining projects were outlined in the earlier report. He presented a report on the seven projects with a description and cost. He also pointed out the drainage related projects that will be included in the Secondary Highway Six Year Construction Plan. Staff is now requesting that several projects be ~dded to th priority list to begin preliminary work. They include 5417 Geiser Road, Bower and Vauxhall and 4919 Fawn Dell Road. 310 December 1, 1987 --.-------,.-....-------------.--- -~_._,_._-~~ Supervisor Johnson asked if the staff had investigated up creek retention of storm water. Mr. Peters responded he had met with the Corps of Engineers concerning retention facilities and they have investigated several possible sites but none of them were feasible because of the cost versus the benefits. Supervisor Johnson stated he would still like staff to investigate this possibility further. Mr. Hodge responded that they will discuss this possibility with the Corps of Engineers and bring back a report at the second meeting in January. Supervisor Johnson asked Director of utilities Clifford Craig to outline the project of replacing manhole covers. Mr. Craig responded that the manhole covers have been sealed in Boxley Hills and they have ordered new seal-down manholes. This is not part of the drainage projects. Supervisor Nickens moved to approve the staff recommendation. Acceptance of the Valleypointe Agreement: Assistant County Administrator presented a summary of the project including property acquisition, industrial access funds, water and sewer, and the costs for this. There is also a project documen between Lingerfelt Development Corporation and the County tha relates to the use of the development, and specifies th responsibilities of the developer and county concerning th project. Re uest for Industrial Access Funds for Valleypointe: Brent Sheffler, Economic Development Specialist reported this request was for Phase 1 of the project which i approximately 52 acres. The County is requesting industria access funds from the state in the amount of $321,500. It i necessary to request these funds by resolution. ABSENT: Supervisor McGraw RESOLUTION 12187-5 REQUESTING INDUSTRIAL ACCESS FUNDS FROM THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO PROVIDE ACCESS TO A NEW PROJECT TO BE LOCATED IN ROANOKE COUNTY BE IT RESOLVED by the Board of Supervisors of Roanoke County, virginia, as follows: 1. That having duly considered the request and assurances of Lingerfelt Development, Inc. concerning the proposed development of Valleypointe, Phase I, the Board respectfully urges and recommends to the Virginia Department of Transportation that consideration be given, that immediate study be made, and that a project be approved and initiated pursuant to the provisions of Section 33.1-221 of the 1950 Code of Virginia, as amended, to provide approximately 3,400 feet of neede 2. A roval of the 1988 Le islative pro'ect, Charter Amendments: County Attorney Paul Mahoney reminded the boar that at the November 17th meeting, there was a work session and public hearing concerning the charter amendments. If th resolution is approved, it must be submitted to the Genera Assembly. Supervisor Nickens asked if there must be a specifi limit set for the meals and tobacco tax. Mr. Mahoney responde that if the General Assembly grants the authorization for thes taxes, the Board must still adopt an ordinance establishing 814 December 1, 1987 "~'.'_'_'---------~_'_'~'"'_-- .-.----.-- specific limit. Supervisor Nickens requested that the resolution be amended to authorize a meals tax and a tobacco tax as limited by state law. The motion was seconded by Supervisor Nickens and carried by the following recorded vote: AYES: Supervisors Brittle, Garrett, Nickens, Johnson NAYS: None ABSENT: Supervisor McGraw RESOLUTION 12187-6 REQUESTING THE GENERAL ASSEMBLY FOR THE COMMONWEALTH OF VIRGINIA TO AMEND THE CHARTER FOR ROANOKE COUNTY WHEREAS, Article VII, Section 2 of the Constitution of Virginia, and Chapter 17 of Title 15.1 of the Code of Virginia authorizes the General Assembly to grant a governmental charter to a county or to amend an existing charter; and WHEREAS, the 1986 General Assembly granted Roanoke County a charter, as found in the 1986 Acts of Assembly, Chapter 617; and WHEREAS, the Roanoke County Board of Supervisors finds that certain amendments thereto are necessary for the public health, safety, and welfare of the County, and for more efficient and effective local government; and 815 December 1, 1987 - . - -_._.~_..~ ,.....__.~~,-" -..- - -_.,,~-.'--'.'--"" --_.._-..-'---,.__.........--_.._-----_.~.- WHEREAS, Roanoke County has complied with the provi sions of Section 15.1-835 of the Code of Virginia, and has held public hearing on these proposed charter amendments on Novembe 17, 1987, after due legal notice, at which the citizens had th opportunity to be heard concerning these proposed charter amend ments. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervi sors of Roanoke County, Virginia, that the General Assembly fo the Commonwealth of Virginia is hereby requested to amend th charter for Roanoke County, Virginia. The requested charte amendments are as follows: 1. Amend Section 2.02 to authorize a meals tax and a tobac co tax as limited by State law; 2. Amend Chapter 8 to create a new Section 8.03 to autho rize the creation of the office of license inspections, whic would authorize the enforcement of the County license ordinanc through the issuance of tickets or summons by officials in th office of the Commissioner of the Revenue; 3. Amend Section 9.03 to authorize the appointment of mem bers of the Board of Zoning Appeals by the Board of Supervisors. Approval of the 1988 Leqislative Package: Mr. Mahoney advised that this package was discussed at the November 17th work session, and several items were added at the Board's request. Supervisor Johnson moved to approve the 1988 Legislative Package. Approval of funding method for County share of Starkey Road improvements: County Administrator Elmer Hodge advised that at the November 17th meeting, the Board authorized the Va. Department of Transportation to proceed with the improvements. At that time, the staff recommended that the local share of $72,300 for curb and guttering be distributed to property owners along those roads as a special assessment. The Board met with the property owners to explain this process. Th staff is now recommending the cost of curb and guttering only The staff is also recommending that VDOT be authorized to procee immediately with the improvements to Starkey Road and Penn Fores Blvd, with the cost of curb and gutter improvements bein allocated through a special tax assessment. The staff i recommending a public hearing for the second meeting in Januar to advise the citizens. The staff would also like to apply thi methodology to the improvements to Ogden Road and continu efforts to get state funding. Supervisor Johnson stated that he agreed that a publi hearing should be held because this is the first time Roanok County has established a special assessment such as this, an would set a precedent for future road improvements. The motion was seconded by Supervisor Johnson an carried by the following recorded vote: AYES: Supervisors Brittle, Garrett, Nickens, Johnson NAYS: None ABSENT: Supervisor McGraw RESOLUTION 12187-8 APPROPRIATING ROANOKE COUNTY'S SHARE OF CURB AND GUTTER CONSTRUCTION COSTS FOR STARKEY ROAD (ROUTE 904) PROJECT -318 December 1, 1987 .o_._~,_. ----1----- WHEREAS, Starkey Road Project (Route 904) provides an important urban highway link to commercial property in Roanoke County; and the Roanoke County Board of Supervisors desires to improve this commercial link; and WHEREAS, Route 904 was placed on the Secondary Highway Six-Year Construction Plan by the Roanoke County Board of Supervi- sors and was assigned a project number of 0904-080-215-C501, by the Virginia Department of Transportation; and WHEREAS, Virginia Department of Transportation Policy Memorandum DPM-8-6 requires participation by localities for por- tions of storm sewer construction costs if curb and gutter "is desired" and for sidewalk rights-of-way; and WHEREAS, the Virginia Department of Transportation has determined that the Roanoke County Board of Supervisors is respon- sible for $72,300 for its portion of storm sewer construction, and $89,500 for its portion of sidewalk rights-of-way on Project 0904-080-215-C50l. Relocation of the Re istrar's Office and Central Absentee Votin Precinct to the Administration Center: Elizabeth Leah, County Registrar, advised that this office need to relocate from their present office to offices nearer th Treasurer, Commissioner of the Revenue and other offices dealin directly with the public in the Administration Center. also be necessary to relocate the Central Absentee Votin Precinct to this building. The move could be accomplished b moving the Engineering Department to the Public Service Cente and relocating either the Accounting Department or Assessor's Office to that area. Ms. Leah stated that while a public hearin is not necessary, it is advisable. Approval of this move must b granted by the U. S. Request for Support of a Joint Roanoke Valley Statement on 1988 Legislative Capital Project Agenda: Chairman Johnson moved that the Board of Supervisors adopt this statement, that the statement be placed in the minutes and that the Chairman be authorized to inform the area legislators of this action. The motion was seconded by Supervisor Brittle and carried by the following recorded vote: AYES: Supervisors Brittle, Garrett, Nickens, Johnson NAYS: None 82,1 December 1, 1987 - ...___0_________________ ABSENT: Supervisors McGraw JOINT ROANOKE VALLEY STATEMENT ON 1988 LEGISLATIVE CAPITAL PROJECT AGENDA In 1981, with the assistance of the Roanoke Valle post office in downtown Roanoke. The Commonwealth did not hav Chamber of Commerce, a contingency of the General Assembly including the Governor and his cabinet were brought to th Roanoke Valley on a special train to hear and see first han about, what were viewed at that time as crucial capital needs fo the Roanoke Valley. The 1981 legislative agenda was ambitious i scope. Many of these capital projects had no precedent of significant state funding for similar projects. Among the capital requests was state participation an cooperation in establishing a regional state office in the ol and had not considered the idea of consolidated regional stat offices. Each agency and department of the State handled its ow space requirements. Another new concept was state participation in fundin Center in the Square. Center in the Square was a revolutionar idea, bringing five diverse arts and cultural organizations int the same space for the enjoyment and education as well as th economic well-being of the entire western part of the state. I was an attempt by the leaders of the Roanoke Valley to get stat 32"2 December 1, 1987 ~- _..--"-'-' -_.'~-^-- '..<--'-',~~---~'" ---, -----n--- II _·"·__._____~..w....,_____.__._,_~..,._, __~______..__.__k assistance in establishing an arts and cultural center outside of the Richmond area. The third project was a much needed pedestrian overpass over Colonial Avenue for Virginia Western connecting the two parts of the campus. Lastly, and perhaps most importantly, the seeds were planted at that time with the General Assembly members, for the recognition that the State needs to playa much larger role in assisting Virginia localities with their airport facilities. Specifically, state participation was requested in a 13 million dollar runway extension at the Roanoke Regional Airport. We now know that with sound logic, patience and persistence the Roanoke Valley was able to succeed in all of these projects. Though they were diverse, no one considered them to be in competition with each other. It was felt that each would stand on its own merit and eventually all would prevail. In 1986, two capital intensive projects captured the imagination of citizens of the Roanoke Valley. They were the Explore concept and the new terminal for the Roanoke Regional Airport. Much public concern was expressed that perhaps it was unrealistic to expect that the Roanoke Valley would ever receive funding for both. Much discussion persisted that if the Roanoke Valley were to have any chance of getting state funding for either,they would have to choose priorities. With such public discussion, many prominent busines leaders at that time spoke up to say that if this scenario 0 setting priorities were indeed true and that the Roanoke Valle would only get one capital project for a long time to come, tha the airport terminal must come first. With such concer expressed in our community, many of our local state legislator spoke out to say that once again, as in 1981, that these project were not competing, that each would stand on its own merit an that with good logic, patience and persistence, we would be abl to achieve both projects. Their statements turned out to be tru as we received unprecedented state participation in our airpor terminal as well as initial funding for the Explore Project. In recent years, valley governmental cooperation 0 example of cooperation is the establishment of the Roanok Regional Airport Commission and the resulting construction of new 25 million dollar air terminal. A second example is th Regional Partnership which is funded and actively supported b all valley governments in partnership with the business community. And a third example is that all valley governments have joined i support of a new reliable water supply to meet future need 3·24 December 1, 1987 --- --- by endorsing the Spring Hollow Reservoir concept. These are but three examples of strong support for important valley-wide projects. Today, once again, the Roanoke Valley has developed a list of far reaching capital projects. Projects which complement each other, build on the natural strengths of the greater Roanoke area, and if accomplished, will allow the Roanoke Valley to continue to lead the western part of the State, in terms of economic development, into the 21st century. During a joint house and senate capital appropriations committee's tour of the state, the Governor and General Assembly members received a presentation on the concept of the Explore Project. What was significant about that day was Governor Baliles' comments. In summary, the Governor said that the Explore concept was an important project in the future of the western part of Virginia. The Governor, however, said very straight-forwardly, with all the conviction and enthusiasm that this Governor has brought to state initiatives that it was not the only project that was needed to move western Virginia forward. In recognition of that, the Roanoke Valley leadership has once again put forward a list of projects, which in total should enable western Virginia to become more competitive. As i 1981 with that General Assembly package and in 1986 with th Explore and Airport proposals on the table, we do not believ that the projects put forward at this time compete. Each of the as with projects in the past, must stand on its own merits. With the same kind of logic, persistence, patience an a strong dose of cooperation, we believe all of these project can be achieved in the Roanoke Valley. Each is a project tha should receive the support of all the governments and people i the Roanoke Valley as we attempt to move forward. With mutua support and cooperation, we believe that there need not be th perception of competitiveness. Therefore, the mayors, vic mayors, chairman and vice chairmen of the City of Roanoke, th Town of Vinton and the County of Roanoke, with the consensus 0 the Salem City Council, urge implementation of these projects an a recognition, as in the past, that these projects are not i competition. IN RE: REQUEST FOR PUBLIC HEARINGS Chairman Johnson noted there were two previous requests for public hearings: a public hearing on Funding Methods for the Starkey Road Improvements on January 26, 1988, and a public 326 December 1, 1987 hearing to relocate the Registrar's Office and Central Absentee Voting Precinct on December 15, 1987. Walker 3313 Stonehen requested the answers to the following questions: (1) Requeste an item-by-item public accounting of all funds spent to-date on the Southview School; (2) Why did the County sell the historic Courthouse in Salem, and why was the County and Roanoke College willing to close the sale without a clear unencumbered sale as stipulated in the contract; (3) When did the County appropriate by resolution or ordinance matching funds for the state grant for the renovations to the Courthouse; (4) Why did the state send $100,000 before the state contract was in hand and why did the County misplace the check rather than deliver it immediately to the Treasurer. Mr. Key felt that Roanoke County was not an urban County. 4.
