IN RE: CALL TO ORDER Chairman Brittle called the meeting to order at 1:03 p.m. The roll call was taken. I MEMBERS PRESENT: Chairman Alan H. Brittle; Vice-Chairman Bob Johnson; Supervisors Lee Garrett and Steven A. McGraw MEMBERS ABSENT: Supervisor Nickens STAFF PRESENT: Elmer C. Allen, County Administrator's staff. IN RE: EXECUTIVE SESSION I Supervisor Johnson moved to go into Executive Session pursuant to the Code of Virginia Section 2.1-344 (a), (2). The motion was seconded by Supervisor Brittle and carried by a unanimous voice vote. The motion was seconded by Supervisor Johnson and carried by a unanimous voice vote. I IN RE: BUDGET WORK SESSION Ms. Charlsie Pafford, Chairman of the Roanoke County School Board, presented the 1986-87 budget of the Roanoke County Schools. She reported that if additional funding is received by the County, the School Board will make increase in teachers' salaries their number one priority. Mr. Bayes Wilson, Superintendent of Roanoke County Schools, thanked the Board of Supervisors for their support. He reported that in order to meet the budget, the School Board has cut personnel instead of programs. Mr. Hodge presented a budget update to the Board of Supervisors. Supervisor Nickens moved that Mr. Hodge and Mr. Wilson work together to obtain an additional $142,000 from the County budget to be added to the School Board budget to be directed to instructional salaries and if there are any funds remaining, that they revert back to the County Board of Supervisors and not remain in the School Board budget. The motion was seconded by Supervisor McGraw. Supervisor Johnson requested that Supervisor Nickens amend his motion to delete the portion concerning that the funds revert back to the Board of Supervisors. Supervisor Nickens accepted Supervisor Johnson's amendment. Mayton of Woodlawn United Methodist Church gave the invocation. The Pledge of Allegiance was recited by all present. IN RE: CITIZENS COMMENTS AND COMMUNICATIONS I Ms. Patty Maurino of the Clean Valley Council was present to explain the procedures of Clean Valley Day on Saturday, April 12, 1986. She also invited each Board member to participate and presented registration forms. IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS I Chairman Brittle presented a proclamation to Ms. Christi Beck, Director of Career Placement of National Business College declaring April 13-19, 1986, as National Education for Business Week. Mr. Brittle also announced that a joint proclamation with Roanoke City, the City of Salem, and the Town of vinton will be signed at a later date. Supervisor Johnson moved to accept the proclamation. The motion was seconded by Supervisor Nickens and carried by a unanimous voice vote. PROCLAMATION - ~ ~ o~ ~ l~ April 8, 1986 WHEREAS, all our business educators and their institutions playa vital role in supporting government, business, and commercial life of the United States of America; I and WHEREAS, men and women trained as secretaries, accountants, and specialists in marketing, merchandising, and data processing occupations which contribute to efficient business life, are essential to the continued prosperity of these United States; and WHEREAS, it is altogether fitting and proper that the educational efforts of America's business educators and their institutions be recognized, encouraged, and honored. NOW, THEREFORE, I, Alan H. Brittle, Chairman of the Roanoke County Board of Supervisors, do hereby declare and set aside the week of April 13-19, 1986, to be NATIONAL EDUCATION FOR BUSINESS WEEK to recognize the significant efforts and I educational contributions of our business educators and their institutions to the well-being of business and governmental life in America. Chairman Brittle also presented a proclamation declaring April as Fair Housing Month. Supervisor Brittle moved to accept the proclamation. The motion was seconded by Supervisor Nickens and carried by a unanimous voice vote. PROCLAMATION WHEREAS, April 1986, marks the eighteenth anniversary of the Federal Fair Housing Act of 1968; and WHEREAS, the U. S. Department of Housing and Urban I Development has adopted the theme, "With Liberty, Justice and Fair Housing For All"; and WHEREAS, the Federal Fair Housing law has resulted in significant strides in lessening discriminatory housing practices; and - ~ ,., 5 (\ (~ ~.' ...7,./ April 8, 1986 WHEREAS, the challenge of overcoming continuing housing discrimination remains a shared goal and responsibility for all; I NOW, THEREFORE, I, Alan H. Brittle, Chairman of the Roanoke County Board of Supervisors, do hereby proclaim the month of April, 1986, as FAIR HOUSING MONTH in Roanoke County, Virginia. Mr. Skip Nininger was present to receive a proclamation presented by Chairman Brittle declaring April 13-19, 1986, as National Building Safety Week. Supervisor Brittle moved to accept the proclamation. The motion was seconded by Supervisor McGraw and carried by a unanimous voice vote. PROCLAMATION WHEREAS, the safety of buildings we occupy in our everyday lives is essential to the well-being of the citizens of I Roanoke County; and WHEREAS, among our basic laws and ordinances are those which provide standards for safe construction in the home and workplace; and WHEREAS, for building and related construction codes to be effective, understanding and cooperation must exist between code officials and the people they serve - building occupants and all sectors of the construction industry; and WHEREAS, the general public often does not recognize the importance of construction safety codes and their effective enforcement until a tragedy may result from unsafe construction; and I WHEREAS, the contribution made to the health, safety and welfare of our built environment by dedicated professional code officials may not be fully realized by the public at large; and WHEREAS, units of state and local government across the United States - along with such prestigious organizations as the ~ .~ ~ 60 April 8, 1986 Council of American Building Officials, the National Conference of States on Building Codes and Standards, and BOCA International - are joining to promote safe buildings through the observation of National Building Safety Week; and WHEREAS, the theme of National Building Safety Week has been designated as "Building Safety is No Accident", NOW, THEREFORE, I, Alan H. Brittle, Chairman of the Roanoke County Board of Supervisors, do hereby proclaim April 13-19, 1986, as BUILDING SAFETY WEEK in Roanoke County and urge all citizens to recognize the importance of modern construction safety codes and the vital contributions rendered by the dedicated individuals who administer them in Roanoke County and elsewhere. -I Chairman Brittle presented a proclamation to Ms. Jennifer Price-Singleton, Coordinator of Voluntary Action Center, declaring April 20-27, 1986, National Volunteer Week. Supervisor Brittle moved to accept this proclamation. The motion was seconded by Supervisor McGraw and carried by a unanimous voice vote. I PROCLAMATION WHEREAS, countless Virginians continue to offer their volunteer time and skills to fill otherwise unmet needs; and WHEREAS, the American traditions of self-help and giving continue to be essential threads in the fabric of our country; and WHEREAS, the creativity and energy of volunteer efforts contribute significantly to the quality of life in the Commonwealth; NOW, THEREFORE, I, Alan H. Brittle, Chairman of the Roanoke County Board of Supervisors, do hereby join Governor Gerald L. Baliles in proclaiming the week of April 20-27, 1986, as VOLUNTEER RECOGNITION WEEK, and I call the message it suggests to the attention of all the citizens of Roanoke County and I - ~ ~ 601 April 8, 1986 encourage them to discover opportunities to serve in some valuable volunteer capacity. 1 Chairman Brittle also presented a resolution of congratulations to the Glenvar Elementary Hotshots Basketball Team. The Hotshots were unable to attend this meeting, therefore, the resolution and certificates of appreciation will be mailed to the team. Supervisor Brittle moved to approve the prepared resolution. Supervisor McGraw seconded the motion. RESOLUTION 4-8-86-84 COMMENDING AND CONGRATULATING THE MEMBERS AND COACHES OF THE GLENVAR HOTSHOTS UPON WINNING THE VIRGINIA RECREATION AND PARKS SOCIETY ITTY BITTY LEAGUE CHAMPIONSHIP BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: I WHEREAS, the Glenvar Hotshots recently won the Virginia Recreation and Parks Society Itty Bitty League Championship in the five to nine year old age group; and WHEREAS, they have qualified for participation in the State Tournament Championship; and WHEREAS, the County Board of Supervisors likewise applaud and appreciate the dedication and expenditure of time and energy on the part of Coaches Roger McPeak and Ray Huff. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the Glenvar Hotshots: Kevin Blevins, Matthew Edwards, steven Hodges, Eric McPeak, Brian Rose, Jason Darnell, Jason McPeak, Jeff Schaffer, I Curtis Hite, and their coaches, Roger McPeak and Ray Huff, be individually and collectively recognized for the outstanding achievement of winning the Virginia Recreation and Parks Society Itty Bitty League Championship in the five to nine year old age group. - ~ r I {~.'. ~.) \(~ {: ....} i April 8, 1986 On motion of Supervisor Brittle, seconded by Supervisor McGraw and upon the following recorded vote: AYES: Supervisors Nickens, Garrett, McGraw, Johnson, and Brittle 1 NAYS: None IN RE: COUNTY ADMINISTRATOR'S COMMENTS Mr. Hodge requested that Ms. Bev Waldo, Director of Youth Haven II, introduce the new employee in her program. Ms. Waldo introduced Mr. Michael Metz, Counselor III, of Youth Haven II. IN RE: REQUESTS TO POSTPONE, ADD, OR CHANGE THE ORDER OF THE AGENDA Mr. Hodge requested that an Item L6 be added to the I Consent Agenda to request the State Compensation Board to take over certain salaries within the Sheriff's Department. Mr. John Hubbard requested that Item L4 of the Consent Agenda concerning acceptance of water and sewer lines in Chaparral Estates be deleted. Supervisor Johnson requested that potential litigation be added to the Executive Session agenda. IN RE: PUBLIC HEARINGS 1. Public Hearing to Establish the Personal Property Tax Rate for the 1986 Tax Year - Mr. John Chambliss, Assistant County Administrator of Management Services, reported to the I Board that the requested rate of $3.50 per $100 assessed valuation is the same rate that was established last year. The revenues from this tax will be used to finance the current fiscal year's budget (1985-86). i--- ~ .., ~" " lit V U c..> April 8, 1986 I There was no one present in opposition. Supervisor Garrett moved to approve the tax rate at $3.50 per $100.00 assessed valuation. Public Hearing to Establish the Machinery and Tools Tax Rate for the 1986 Tax Year - Mr. Chambliss reported that the requested rate of $3.00 per $100 assessed valuation is also the same rate that was established last year. The revenues from this tax will be used to finance operations of the 1985-86 fiscal year. I There was no one present in opposition. Supervisor Nickens moved to approve the tax rate of $3.00 per $100 assessed valuation. The motion was seconded by Supervisor Garrett and carried by the following roll call vote: AYES: Supervisors Nickens, Garrett, McGraw, Johnson, and Brittle NAYS: None IN RE: NEW BUSINESS I 1. Request for Support to Develop Sister City/Province Program - Mr. Brent Sheffler of the Department of Development presented a request to the Board of Supervisors to approve a sister city concept. He reported that the basic concept is to develop local economic trade and public relations with a city or province of another country which has like interests, population, economies, or other characteristics where there can be mutual benefits for both entities. A copy of Mr. Sheffler's report is included in the packet of the Deputy Clerk. Supervisor Nickens moved to endorse the recommendation of the County Administrator (to approve the application process) ~ ~ ~ 60 April 8, 1986 and to further pursue this process. The motion was seconded by Supervisor Garrett and carried by the following roll call vote: AYES: Supervisors Nickens, Garrett, McGraw, Johnson, and Brittle NAYS: None 2. Acceptance of Annual Report of the Roanoke County Health Department - Dr. Nancy Welch presented the Health Department's Annual Report to the Board. A copy of this report is included in the packet of the Deputy Clerk. The Board directed Mr. Hodge to work with John Hubbard and Dr. Welch on adding septic tank permits to building permits. 3. Request for Implementation of Door Decals for Businesses - Mr. Wayne Compton, Commissioner of Revenue, and Mr. Tommy Fuqua, Fire and Emergency Services Coordinator, were present to answer any questions the Board might have. They both agreed that, if implemented, this will be an excellent project. Supervisor Johnson moved to concur with the County Administrator's recommendation that the funds be taken from the Commissioner of Revenue's budget. The motion was seconded by Supervisor Brittle and carried by the following recorded vote: AYES: Supervisors Nickens, Garrett, McGraw, Johnson, and Brittle NAYS: None I I IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Nickens - Supervisor Nickens requested that the Fifth Planning District Commission Training Consortium be contacted about hiring additional personnel to help with park maintenance. Supervisor Nickens moved that the Board reconsider the public hearing of J. Carson Quarles, originally held on March 25, 1986. The motion was seconded by Supervisor Garrett and carried by the following recorded vote: AYES: Supervisors Nickens, Garrett, McGraw, Johnson, and Brittle I - ~ ~ 605 April 8, 1986 NAYS: None Supervisor Johnson moved to grant the petitioner's I request with proffered conditions. The motion was seconded by Supervisor Nickens. FINAL ORDER NOW, THEREFORE, BE IT ORDERED that the aforementioned parcel of land, which is contained in the Roanoke County Tax Maps as Parcel 38.06-5-10 and recorded in Deed Book 1093, Page 26, and legally described below, be rezoned from B-2 District to B-3 District. I BEGINNING at a point on the westerly side of u.s. Highway Route #11 and 220 (said side of the Highway being 50' westerly from the center line of same) and commencing to the American Bowling Enterprises, Inc., property; thence along U. S. Highway Route 11 and 220 south 11° 58 1/2' east 105' to a point; thence leaving the said highway and with a new division line south 78°-01-1/2' west 225' to a point; thence north 11° 58 1/2' west 105' to American Bowling Enterprises, Inc., line; thence with said line north 78°-01-1/2' East 22' to the place of BEGINNING; and BEING the northerly 105' of the property conveyed by Bank of Virginia, N.A., to the Grantor by deed dated September 13, 1976, and recorded in the aforesaid clerk's office in Deed Book 1049, Page 691. <Current deed recorded in D.B. 1093, Page 26). BE IT FURTHER ORDERED that a copy of this order be transmitted to the Secretary of the Planning Commission and that he be directed to reflect that change on the Official Zoning Map of Roanoke County. ADOPTED on motion of Supervisor Johnson, seconded by I Supervisor Nickens and the following recorded vote: AYES: Supervisors Nickens, Garrett, McGraw, Johnson, and Brittle NAYS: None PROFFER OF CONDITIONS BEING in accord with Section 15.1-491.1 et seq. of the Code of Virginia and Section 2l-l05E. of the Roanoke County ~ ~ 606 April 8, 1986 Zoning Ordinance, the Petitioner, J. Carson Quarles, hereby voluntarily proffers to the Board of Supervisors of Roanoke County, Virginia, the following conditions to the rezoning of the I above-referenced parcel of land: 1). For the express purpose of used car sales lot and no other B-3 uses, further conditioned that if used car sales business ceases to exist, the zoning will revert to B-2. Supervisor McGraw - Supervisor McGraw directed staff to investigate the Houston Dooley rezoning matter. He also directed staff to investigate the street light and road conditions in the willow Creek subdivision. Supervisor Johnson - Supervisor Johnson directed staff to report back to the Board by July 1, 1986 on what our future economic outlook is in regards to 75/25 commercial-industrial/ residential split and how to proceed in establishing a more I equitable percentage between residential and industrial areas. Supervisor Johnson also directed staff to contact the State Highway Department concerning the Verndale Road conditions. IN RE: CONSENT AGENDA Supervisor Johnson moved to approve the consent agenda with the deletion of Item 4 and the addition of Item 6. The motion was seconded by Supervisor Nickens. RESOLUTION 4-8-86-85 APPROVING AND CONCURRING IN CERTAIN ITEMS SET FORTH ON THE BOARD OF SUPERVISORS AGENDA FOR THIS DATE DESIGNATED AS ITEM L - CONSENT AGENDA BE IT RESOLVED by the Board of Supervisors of Roanoke I County, Virginia, as follows: 1. That the Board of Supervisors hereby supports the Roanoke County Sheriff and the annual budget that the Sheriff has submitted to the State Compensation Board for FY 1986-87. That this matter came this day to be heard upon the proceedings herein, and upon the application for Colony Court to be accepted and made a part of the Secondary System of State Highways under Section 33.1-229 of the Virginia State Code. 2. That it appears to the Board that drainage easements and a fifty (50) foot right-of-way for said road have heretofore been dedicated by virtue of a certain map known as revised Green Valley Estates, which map was recorded in Plat Book 9, Page 349, of the records of the Clerk's Office of the Circuit Court of Roanoke County, Virginia, on November 22, 1985, and that by reason of the recordation of said map no report from a Board of Viewers, nor consent or donation of right-of-way from the abutting property owners is necessary. The Board hereby guarantees said right-of-way and right for drainage. 3. That said road known as Colony Court and which is shown on a certain sketch accompanying this Resolution, be, and the same is hereby established as a public road to become a part of the State Secondary System of Highways in Roanoke County, only from and after notification of official acceptance of said street or highway by the Virginia Department of Highways and Transportation. IN RE: JOINT MEETING WITH THE ELECTORAL BOARD I The Board met with the Electoral Board and Mr. Roy Lawyer to discuss new voting machines. Mr. Lawyer demonstrated a new machine to the Board. The Board requested that Mr. Hodge present a detailed report to the Board before the final budget is approved.
