6/17/1986 - Regular ~ 696 I Roanoke County Board of Supervisors Roanoke County Administration Center 3738 Brambleton Avenue, SW Roanoke, Virginia 24015 June 17, 1986 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the third Tuesday, and the first regularly scheduled meeting of the month of June, 1986. IN RE: CALL TO ORDER Chairman Brittle called the meeting to order at 3:01 p.m. The roll call was taken. I MEMBERS PRESENT: Chairman Alan H. Brittle; Vice-Chairman Bob Johnson; Supervisors Steven A. McGraw, Harry C. Nickens, and Lee Garrett MEMBERS ABSENT: None ~'.' I Elmer C. Hodge, County Administrator, Timothy W. Gubala, Assistant County Administrator of Community Development; John M. Chambliss, Assistant County Administrator of Management Services; John R. Hubbard, Assistant County Administrator of Public Facilities; Paul M. Mahoney, County Attorney; D. Keith Cook, Director of Human Resources; Otho C. Payne, Human Resources; Tommy Fuqua, Fire and Emergency Services Coordinator; Ron Edwards, Fire and Emergency Services; Harry Franks, Data Processing; Darrell Shell, Parks and Recreation; Sally J. Turner, Public Relations; Bobbie L. Hall, Deputy Clerk; and Mary H. Allen, County Administrator's Office. STAFF PRESENT: I IN RE: OPENING CEREMONIES The invocation was given by the Reverend Roger Kluttz of st. Johns Lutheran Church. The Pledge of Allegiance was recited by all present. - ~ ".. 697 June 17, 1986 IN RE: PROCLAMATIONS, RESOLUTIONS, RECOGNITIONS, AND AWARDS Chairman Brittle presented a "Treasurer of the Year" I plaque to Mr. Alfred C. Anderson, Roanoke County Treasurer. This plaque was awarded to Mr. Anderson from the Treasurers Association of Virginia. IN RE: COUNTY ADMINISTRATOR'S COMMENTS Mr. Hodge asked Tim Gubala to present certificates to Susie B. Owen, Liz Bradley, and Sue Palmer recognizing their completion of the "Leadership Skills for Women" course. IN RE: REQUESTS TO POSTPONE, ADD, OR CHANGE THE ORDER OF AGENDA ITEMS I Mr. Hodge requested that the Board go into Executive Session immediately following Item F 5 on the agenda. Supervisor Nickens also requested an Executive Session to discuss a legal matter. IN RE: NEW BUSINESS I. Request for Funding for Center in the Square - The Board received a request from Center in the Square for a donation to help fund their various cultural, historical, scientific and theatrical events. Supervisor Johnson moved to allocate $15,000 to Center I in the Square. The motion was seconded by Supervisor Garrett and carried by a unanimous roll call vote. Supervisor Nickens noted that $15,000 is the entire amount budgeted for cultural events and that in the future other groups should also be considered for funding. - ~ ~ 698 June 17, 1986 I 2. Authorization to Purchase Mobile and Base Station Radio System - Mr. Ron Edwards of Fire and Emergency Services presented a report to the Board asking for authorization to purchase a 800 MHz SMARTNET trunked radio system for use with the E9ll system. He reported that bond monies in the amount of $1,560,400 were included in the budget for the purchase of this system but that an additional $1,000,000 is needed. He recommended that the staff be authorized to obtain financing for the $1,000,000 needed to complete the project from a local lending institution. Supervisor Johnson questioned if this loan would be paid back from the utility tax revenues. Mr. Hodge responded that the utility tax revenues have already been earmarked and that he plans to include this payback in the Police and Fire and Rescue budgets as line items for the next seven years. Supervisor Garrett moved to approve staff's recommendation and proceed with the purchase of this equipment. The motion was seconded by Supervisor Nickens and carried by a unanimous roll call vote. 3. Approval to Purchase Land in Penn_Fore~t for Development of Park Land - Darrell Shell, Director of Parks and Recreation, presented a request to the Board to purchase an option on 19 acres of land off of Route 897 in the vicinity of Penn Forest Elementary School. He reported that this site contains three tracts, 7.78 acres at $50,000; 5.11 acres at $37,500; and 5.5 acres at $13,750. He reported that bond funds in the amount of $250,000 have been set aside for this project, which leaves $148,250 for development. This site utilizes a flood plain which is not suitable for other development. Chairman Brittle inquired if Mr. Shell has met with the citizens in that area. Mr. Shell reported that he had met with citizens at the Ogden Center and received no opposition. I I r--- ~ ~ 699 June 17, 1986 Chairman Brittle requested that he be informed of any future I meetings with citizens concerning this proposed park. Mr. Shell reported that the County has received firm I offers on two of the tracts and a verbal agreement on the third. Mr. Hodge requested that Chairman Brittle and Supervisor Garrett be informed of all meetings with citizens concerning this proposed park. Supervisor Garrett inquired about the types of facilities that will be offered. Mr. Shell reported that there have been no definite decisions made since the design stages have not yet been completed. He hopes to include a soccer and baseball field, and restroom facilities. Supervisor Brittle moved to approve staff's recommendation. The motion was seconded by Supervisor Johnson and carried by a unanimous voice vote. 4. Authorization to Settle Sherertz, et ale v. Roanoke I County, et ale - Mr. Mahoney reported that the School Board adopted a similar resolution at their meeting on June 12, 1986. Supervisor Nickens moved to approve the prepared resolution. The motion was seconded by Supervisor Garrett. RESOLUTION 6-17-86-128 AUTHORIZING THE SETTLEMENT OF PENDING LITIGATION, SHERERTZ, ET AL. V. COUNTY OF ROANOKE, ET AL. WHEREAS, the Board of Supervisors of Roanoke County is a party defendant to certain litigation concerning an alleged public nuisance at the Hidden Valley Junior High School; and WHEREAS, this litigation is styled Charles G. Sherertz, et ale v. County of Roanoke and County School Board of Roanoke County: and I WHEREAS, there currently exists an opportunity to re- solve, compromise and settle this litigation, the parties having discussed and negotiated same. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that the County Attorney - ~ ,., J' 'tOu June 17, 1986 .. I is hereby authorized to endorse an Order on behalf of the County of Roanoke and to take such actions as may be necessary to resolve, compromise, and settle certain pending litigation styled çÌ!~!:.!..~~_ç~_ê.Ì!~!:.~!:.~~L_~~_~!..~_~~_ç~l!~Sl._~~_~~~~~~~_~~ª-_ç~l!~Si._ School Board of Roanoke County; and FURTHER that this settlement would require the Board of Supervisors to remove and relocate certain lights at its cost, but that the County will be assured that it can utilize the facil- ities in question for recreational and athletic activities during daylight hours; however, no recreational activities shall com- mence on Sundays earlier than twelve noon. Further the County can continue to utilize the lights at the ballfields through the 1986 summer athletic season. On motion of Supervisor Nickens, seconded by Supervisor Garrett and the following recorded vote: AYES: Supervisors McGraw, Nickens, Garrett, Johnson, and Brittle NAYS: None 5. Final Publication of Land Use Plan - Mr. Mahoney reported that the changes in the Land Use Plan are editorial and do not change the meaning of the plan. Supervisor Johnson moved to approve staff's recommendation. The motion was seconded by Supervisor Nickens and carried by a unanimous roll call vote. I IN RE: EXECUTIVE SESSION I Supervisor Nickens moved to go into Executive Session pursuant to the Code of Virginia 2.1-344 (a) (1) and (6). The motion was seconded by Supervisor Brittle and carried by a unanimous voice vote. IN RE: OPEN SESSION - ~ 701 June 17, 1986 Supervisor Johnson moved to return to Open Session. The motion was seconded by Supervisor Garrett and carried by a unanimous voice vote. I IN RE: NEW BUSINESS (CONTINUED) 6. Adoption of Updated Classification and pa Plan for County Employees - Supervisor Nickens moved to approve the Updated Classification and Pay Plan with changes in the County Administrator salary to $69,550 and County Attorney salary to $51,360; staff's recommendation to authorize the County Administrator to implement the Classification and Pay Plan, approval of the Employee Handbook amendments, establishment of a review process to the Classification and Pay Plan, adoption of the 1985 Salary and Benefit Survey, and authorization of two additional department head level positions (Director of Finance and Director of Management and Budget. The motion was seconded by Supervisor Johnson. Discussion followed for clarification of the motion. Supervisor Nickens call for questions. The motion carried by a unanimous roll call vote. That the Roanoke County Employee Handbook be, and hereby is, amended as follows: III. Your position F. Changes in Status 3. position Reclassification, Abolishment and Establishment a. position Reclassification The County reserves the right to make changes in the classification system and to adjust compensation of an employee if the duties have increased or decreased to the extent that a different classification is required. The County reserves the right to make minor changes in the job description or title without affecting the position classification. I A position reclassification may be distinguished from a position establishment by the gradual increase or decrease of job duties and responsibilities. Other Classification Adjustments The County reserves the right to make changes in the classification system and to adjust compensation of employees due to periodic market-place or wage and salary surveys. Adjustments may occur within identified groups or classes of positions or system-wide. I The reallocation of a position or positions in the classification plan as a result of periodic market-place or wage and salary survers is distinguished from a position reclass1fication in section III F-3a. In the implementation of periodic market-place or wage and salary surveys the County Administrator defines the method by which employee's salaries are adjusted or reallocated in the classification plan upon ratification by the Board. This process is wholly separate from the reclassification process. VII. Salary A. Personnel Pay and Classification Plan The pay of all classified employees is established by the Personnel Pay and Classification Plan. The Department of Human Resources is responsible for developing and maintaining a uniform plan. This plan consists of minimum and maximum rates of pay for each position listed. A class is assigned for every position; and, for every position within the class, steps are provided, usually A through H G. Initial emploYment is normally at the first pay step for that position. If a new employee more than meets the minimum qualifications of the class, he or she may be appointed at the second step or, in unusual cases, at a still higher step. Approval from the County Administrator must be obtained if an employee is hired at Step D or above. This amendment to be in full force and effect from and after its passage. Implementation of Hold-Back Pay for County Employees - Supervisor Johnson moved to table the issue of hold-back pay. The motion was seconded by Supervisor McGraw and carried by a unanimous roll call vote. Supervisor Johnson stated that the intent of his motion is that this matter be brought back to the Board for consideration for fiscal year 1988. I IN RE: REQUESTS FOR WORK SESSIONS Supervisor Johnson requested that the Board consider financial options for the regional water supply after the work session on June 24, 1986. Mr. Hodge reported that he would supply the Board with the financial information before that Board meeting. IN RE: REQUESTS FOR APPOINTMENTS I 1. Recreation Commission - Supervisor Garrett nominated Mr. Paul D. Bailey. 2. Sesquicentennial Committee - Supervisor Garrett nominated Mr. Carroll Gentry. 3. Virginia Western Community College Board - Supervisor Nickens reported that he will make an appointment at the June 24, 1986, Board of Supervisors meeting. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor McGraw - Requested that the Board reconsider establishing a second Assistant County Attorney position in the County Attorney's office. Supervisor Johnson inquired if that reconsideration is proper according to Robert's Rules of Order. Mr. Mahoney reported that it was permissible to proceed with this discussion as long as the Board understood that it was not a I ------ ~ 71b 1 June 17, 1986 motion to reconsider and that it should be determined by the Chair whether to allow this discussion. Chairman Brittle ruled I to allow the discussion. Supervisor McGraw moved that the Board consider the appointment of an additional Assistant County Attorney position. The motion was seconded by Supervisor Johnson. Supervisor McGraw reported that he felt this additional position was necessary in the fact that it would save money on hiring outside legal services. Supervisor Garrett inquired if this additional position would guarantee that outside legal services would no longer be needed. Paul Mahoney responded that some outside legal services will still be needed but not to the extent that was necessitated earlier. Supervisor Nickens felt that more discussion was needed. Mr. Mahoney also reported that partial funding of this position will come from the School Board. I Chairman Brittle stated that he would like to see if an increase in office space of Ms. Lehe, Assistant County Attorney, would help in the workload of that office and that the Assistant County Attorney should not be involved in Bingo/Raffle permits. Supervisor Nickens moved to table the issue.
