IN RE: CALL TO ORDER Chairman McGraw called the meeting to order at 3:04 p.m The roll call was taken. MEMBERS PRESENT: Chairman Steven A. McGraw; Supervisors Alan H. Brittle, Harry C. Nickens, and Gary J. Minter MEMBERS ABSENT: Vice Chairman Athena E. Burton IN RE: EXECUTIVE SESSION Supervisor Nickens moved to go into Executive Session pursuant to the Code of Virginia Section 1.334 (a), (1), (2), (4), and (6). The motion carried by a unanimous voice vote. IN RE: OPEN SESSION Supervisor Minter moved to return to Open Session at 4:10 p.m. The motion carried by a unanimous voice vote. Work Session - Audit for Fiscal Year Endinq June 30~ 1984 - Dianne Hyatt, Assistant Superintendent of Fiscal . - Management presented the audit and management letter for the year ended June 30, 1984, which was completed by Peat, Marwick, Mitchell & Company. AYES: Supervisors Minter, Nickens, Brittle, McGraw NAYS: None ABSENT: Supervisor Burton RESOLUTION 85-11.a ACCEPTING THE DONATION OF WATER AND SEWER LINE EXTENSIONS CONSTRUCTED TO SERVE THE VIRGINIA DEPARTMENT OF HIGHWAYS AND TRANSPORTATION PROPERTY OFF STATE ROUTE 311 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the offer of the Virginia Department of Highways and Transportation to donate the water and sewer line extensions installed to serve the highway department's property I off State Route 311 as shown on engineering plans prepared by Buford T. Lumsden & Associates dated April 16, 1982, be, and hereby is, accepted; and 2. That upon receipt of a duly executed deed upon a form approved by the County Attorney from the Virginia Department - ~ -., January 29, 1985 425 of Highways and Transportation, the County Administrator is hereby authorized to authenticate the acceptance thereof, as made I and provided by §15.1-286 of the 1950 Code of Virginia, as amended. The motion carried by a unanimous roll vote. Supervisor Nickens moved for approval of Item 2 of the Consent Agenda. I RESOLUTION 85-12 ACCEPTING CERTAIN BIDS MADE TO ROANOKE COUNTY SET FORTH AS FOLLOWS BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That those certain bids set forth as follows in the following words and figures be, and hereby are, accepted, upon all and singular the terms and conditions of the invitation to bid, the specifications of the County of Roanoke, the bidder's proposals, and the provisions of this resolution, to-wit: a. Purchase of three fire hydrants to be installed at Farmingdale South Subdivision from Warner Supply Corporation in the amount of $3,157.94. I b. Award of a seventeen month contract beginning February 1, 1985, for maintenance and repair service to all County well pumps and motors with Roanoke Pump Sales & Service Company in an amount not to exceed $51,850.00 2. That the County Administrator is hereby authorized and directed to execute the necessary documents on behalf of Roanoke County upon a form approved by the County Attorney; and 3. AYES: Supervisors Minter, Nickens, Brittle, McGraw NAYS: None I ABSENT: Supervisor Burton Supervisor Minter moved that the County be sure that the County property owners in the Airport area are reimbursed fOl damages caused by the construction of the runways and also reported that he feels that if the County is requested to donate a substantial amount of funds, the County should have a voice in the operation of the airport. Supervisor Nickens offered a substitute motion to defe action regarding funding of the Municipal Airport Terminal (Item 4, Consent Agenda) until the County receives more information an< to make this letter a part of the packet when that information i~ received. RESOLUTION 85-13 ACCEPTING THE CONVEYANCE OF 0.848 ACRES LOCATED AT 5929 COVE ROAD FROM THE SCHOOL BOARD OF ROANOKE COUNTY WHEREAS, on January 10, 1985, the County School Board of Roanoke County by resolution declared a portion of real estatE consisting of 0.848 acres and having a mailing address of 5929 Cove Road, Roanoke, Virginia, as well as a structure formerly housing the Roanoke County Department of Parks and Recreation, t< I be surplus property pursuant to §22.1-129 of the 1950 Code of virginia, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: - ~ -., January 29, 1985 427- - 1. That the Board does hereby accept the conveyance of said real property declared to be surplus property by the County I School Board of Roanoke County; and 2. AYES: Supervisors Minter, Nickens, Brittle, McGraw NAYS: None ABSENT: Supervisor Burton I Supervisor Brittle moved to amend the prepared resolution to provide staggered two year terms with mechanism to be discussed at a later work session. RESOLUTION 85-14 AMENDING THE TERMS OF APPOINTMENT OF MEMBERS OF THE HUMAN SERVICES COMMITTEE WHEREAS, on February 14, 1984, the Board of Supervisors established a Human Services Committee; and WHEREAS, the purpose of this Human Services Committee is to screen applications for public funds and to make recommendations to the Board concerning the amount of public funds to be budgeted and expended for human services agencies; and I WHEREAS, this Committee would also monitor those programs receiving public funds; and WHEREAS, on February 28, 1984, the Board appointed five citizens to serve for a one-year term on said Human Services Committee. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: - ~ "..- 4 2 ~ ~ January 29, 1985 1. That the appointments to the Human Services Committee made on February 28, 1984, are hereby rescinded; and 2. That the term of the members of the Human Services Committee is hereby established as a two-year term, the initial appointment to the newly established Human Services Committee shall be as follows: three of the members shall be appointed for a term 0 two years; and two of the members shall be appointed for a term of one year. Assignment of the individual terms of members shall be determine( by lot at the first meeting of said Committee; the staggered constitution of the Committee shall provide for continuity of existence; and 3. PRO C LAM A T ION I WHEREAS, diseases of the heart and blood vessels are responsible for more deaths than all other causes combined, causing widespread suffering, and often creating serious economic hardship in our homes and businesses; and - ~ -., January 29, 1985 429 WHEREAS, your American Heart Association carries forward a relentless fight against these diseases through its programs of I research, education and community service, as made possible by public contributions to the Heart Fund. NOW, THEREFORE, I, Steven A. Shindell were I present to donate property to Roanoke County to be used as a park. Supervisor Nickens moved for approval of the prepared resolution accepting the donation of the BurgessjShindell property. RESOLUTION 85-15 ACCEPTING DONATION OF PROPERTY FROM MARY JANE BURGESS AND CHERIE B. SHINDELL FOR PUBLIC PARK PURPOSES WHEREAS, Mary Jane Burgess and Cherie B. Shindell desire to donate to Roanoke County approximately 34.5 acres of real estate located in the southwest portion of Roanoke County, Virginia, off State Route 221 on State Route 692, known as "Happy Hollow"; and I WHEREAS, Mary Jane Burgess and Cherie B. Shindell have executed a certain agreement dated the 23rd day of January, 1985, to donate said property upon certain terms and conditions; and WHEREAS, it is the intention of the County to develop this property as a public park, and more specifically, a nature center or natural area. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: I ~ ~ r 430 ~ January 29, 1985 1. AYES: Supervisors Minter, Nickens, Brittle, McGraw NAYS: None ABSENT: Supervisor Burton IN RE: PUBLIC HEARINGS Sale of right, title and interest in and to the water and sewer lines, fixtures and easements contained in Lot 3, Block 8, Map No.3 of Summerdean in the Hollins Magisterial District. I APPROVED Michael Aheron was present representing Mr. Simpson who is currently buying the property from Roanoke City. In 1979 Roanoke City conveyed everything on the land, water and sewer distribution lines, fixtures and easements lying in Roanoke County, to the County of Roanoke, except certain lots that the city desired to maintain. Mr. Aheron questioned the value that the County Assessor has placed on the property. Supervisor Minter moved to place a $1.00 value on this property. The motion carried by the following roll call vote: I AYES: Supervisors Minter, Nickens, Brittle, and McGraw NAYS: None ABSENT: Supervisor Burton - Petition of Thomas F. Davis, Kathryn M. Davis, James L. Swortzel, and patricia D. Swortzel for a Special Exception Permit to construct and operate a private psychiatric hospital ~ -., 431 January 29, 1985 I on a 14.291 acre tract located on the east side of Route 460, approximately 600 feet northeast of the Roanoke County Corporate limits, located in the Hollins Magisterial District APPROVED John Mercer, representing Community Psychiatric Centers, the proponent to actually construct and operate the facility. The hospital is to be located at the old Trail Drive In on Route 460 East. The payroll will consist of $2 million per year, employing approximately 88 employees, and the facility will contain 52 beds for adolescent patients. The actual facility will cost approximately $5.2 million to be paid in cash to prevent a request to an authority in Roanoke County or Roanoke City for funding. The hospital will also provide workshops and seminars available to the community. I Mr. Toby Chambers, State Route 758, Roanoke, Virginia, was present in opposition to the construction of the psychiatric hospital. Mr. Chambers is concerned because the hospital will be constructed so close to his home since he lives in a secluded area. Chairman McGraw read a letter sent to Mr. Harold Crickenburger of J. G. Sheets & Sons from Dr. Richard H. Lowe, Jr., stating that he thinks the construction of this psychiatric hospital would be an asset to the County. Mr. Mercer reported that the type of patient at this hospital would basically be suffering from situational disorders, adjustment reactions, conduct disorders, some neurosis, psychosis, none of which include the illnesses that typically I result in violent behavior. The staff ratio will be two staff members to one patient. Mr. Mercer assured the Board that any time a patient is out of the building, there will be staff members with him. Mr. Ron Vest, a concerned citizen asked Supervisor Minter what steps were necessary to stop the construction of this - I~ "..- 432 January 29, 1985 hospital. Supervisor Minter reported that he should appear before the Board and express his opposition, then appear at the hearing for Certificates of Need, and if the permit is approved I by the Board, he would have to go to Court to appeal their decision. Jerri Walmsley, Route 1, Roanoke, Virginia, also spoke to the Board in opposition of the hospital. Supervisor Nickens moved for approval of the Special Exception Permit and asked that Mr. Mercer meet with the people present at this meeting in opposition to show them more detailed information of what the Community Psychiatric Center actually does. Supervisor Minter offered a substitute motion to hold the decision on this Special Exception Permit to allow Mr. Mercer to meet with the citizens. The motion carried by a unanimous voice Vacation of a portion of the Sanitary Sewer Easement for Lots 1 through 7, inclusive, Block 9, Section 4, Phase II, Ruxton of Roanoke, located in the Cave Spring Magisterial District. FINAL ORDER NOW THEREFORE, BE IT ORDERED, that the water and sewer easements, to the extent they encroach on the parcels of property hereinabove described as shown on the striped portions of said easements on a plat attached hereto and made a part hereof by Buford T. Lumsden and Associates, dated October 10, 1984, be permanently vacated and abandoned. BE IT FURTHER ORDERED that a copy of this order be transmitted to the department of Development and that this order be recorded by the Petitioner along with the attached plat among the land records of Roanoke County. The motion carried by a unanimous voice vote. Supervisor Nickens directed Paul Mahoney to check on legality of having three Supervisors serving on the Fifth Planning District Commission. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS 1. Supervisor Minter - No Report. 2. Supervisor Nickens - Asked Paul Mahoney about the status of the Cable Television Franchise Tax. Mr. Mahoney - ~ r 434 . January 29, 1985 requested a discussion of that matter in Executive Session. Supervisor Nickens also requested Mr. Mahoney to report back to the Board at a later date regarding police authority of Animal I control Officers. 3. Supervisor Brittle - Moved to authorize the County Administrator to write a letter of congratulations to Rockbridge County congratulating them on the attainment of the Horse Center. The motion carried by a unanimous voice vote. Chairman McGraw directed the County Administrator to prepare a letter and place it over his signature. Supervisor Brittle also requested staff to report back to the Board on February 26, 1985, regarding the paving at the Ogden Center. 4. Supervisor Burton - Absent. 5. Supervisor McGraw - Presented a rough draft of a I valley seal which includes the seals of all four Valley localities. IN RE: REPORTS OF OFFICERS, DEPARTMENTS AND COMMITTEES 1. Department of Public Facilities - John Hubbard, Superintendent of Public Facilities, presented Change Order Number 5 for additional shelving for the Vinton Branch Library. Supervisor Nickens moved for approval of the prepared resolution. RESOLUTION 85-8 APPROVING CHANGE ORDER NO. 5 FOR THE VINTON BRANCH LIBRARY BE IT RESOLVED by the Board of Supervisors of Roanoke I County, Virginia, as follows: 1. That Change Order No.5 to the County's contract with Q. M. Tomlinson, Inc. for renovation and reconstruction of the Vinton Branch Library be, and hereby is, approved as follows: Two units of wall shelving $721.26 - ~ ~ January 29, 1985 35 4 2. RESOLUTION 85-9 APPROVING CHANGE ORDER NO. 2 TO THE COUNTY'S CONTRACT WITH HAYES, SEAY, MATTERN AND MATTERN FOR PROJECT 84-1-S, STARKEY PUMP STATION BE IT RESOLVED by the Board of Supervisors of Roanoke I County, Virginia, as follows: 1. That Change Order No.2 to the County's contract with Hayes, Seay, Mattern and Mattern for engineering services in connection with Project 84-1-S, Starkey Pump Station, be, and hereby is, approved as follows: Additional engineering services at a cost not to exceed $5,000 2. That the County Administrator is hereby authorized and directed to execute the necessary documents approving Change Order No.2. On motion of Supervisor Brittle and the following recorded vote. AYES: Supervisors Minter, Nickens, Brittle, McGraw I NAYS: None ABSENT: Supervisor Burton Mr. Hubbard presented the request of the City of Roanoke to place directional signs for the airport on Virginia Department of Highways & Transportation roads within the County. The City is requesting the placement of five signs; three along Route 11 which the staff feels would be beneficial, two along ----- ~ r r; ~ (¡r;¡¡ 4 \L) (} ,,,,,". . January 29, 1985 Hershberger and Hollins which the staff feels would not be beneficial to the local traffic. Supervisor McGraw felt that since the City and Department of Highways and Transportation I would be installing the signs, that all signs should be approved. Supervisor Minter moved for approval of the placement of the five signs. Supervisor Brittle offered a substitute motion to concur with staff recommendations, to allow the three signs along Route 11 and deny the placement of the signs at Hershberger Road and Hollins Road. Department of Development - Mr. Tim Gubala, I Superintendent of the Department of Development, reported that he and his staff have worked up a plan for Economic Development. This plan consists of two goals: 1). developing an annual work program, organizational development of the economic development division, development of a good data base on land and sites available in coordination with the Comprehensive Plan, and ongoing internal promotion program, coordination with what is in progress (Regional Partnership, utility company programs); and 2) create a healthy, viable, diverse economy in the County_ The main objective of this goal is to carryon an active business and industry retention program. This goal also includes working toward new business and industry development (developing and identifying sites), and supporting the growing strength of small I businesses, and an evaluation strategy. Supervisor Nickens moved for approval of the prepared resolution. RESOLUTION 85-10 APPROVING AND ADOPTING AN ECONOMIC DEVELOPMENT STRATEGY WHEREAS, economic development is both a program and a - process that is an important function of local government; and ~ 431 ~ I January 29, 1985 WHEREAS, economic development program activities have been carried out by the Superintendent of Development and County I Administrator since 1981; and WHEREAS, the Economic Development Strategy proposes to formalize those activities and direct County efforts during 1985; and NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. That the Economic Development Strategy proposed by the Roanoke County Department of Development dated January, 1985, is hereby approved; and 2. That the establishment of goals and the development of the objectives will focus Roanoke County's economic development efforts for 1985. These goals and objectives I comprise the herein adopted Economic Development Strategy; and 3. That these goals and objectives include (a) the establishment of an on-going economic development program consisting of (1) the design of an annual work program; (2)the organizational development of the Economic Development Division; (3) data base development; (4) internal promotion; and (5) coordination with the other economic development programs; and (b) the creation of a healthy viable Division of Economic Development in Roanoke County consisting of (1) an existing business/industry retention program; (2) new business/industry development; and (3) nurturing smaller businesses. On motion of Supervisor Nickens and the following recorded vote. I AYES: Supervisors Minter, Nickens, Brittle, McGraw NAYS: None ABSENT: Supervisor Burton Mr. Gubala presented the December, 1984, Development Report and asked for comments from the Board since this was a trial report. Mr. Gubala reported that he intends to have this report published quarterly. Supervisor Nickens requested to - ~ "..- 438i January 29, 1985 include under "Type of Project" whether it is a new building or addition and if funded by IDA bonds. Supervisor Minter requested that Mr. Gubala include an estimate of the number of jobs a new industry will create. Mr. Gubala requested an Executive Session to discuss Economic Development. 5. Department of Fiscal Management - Mr. John Chambliss, Superintendent of Fiscal Management, requested that the report on data processing equipment and software for the Sheriff's Department (Jail) be held over for a future work session. I Mr. Chambliss reported on the architect/engineering services for Pathways. Mr. Chambliss recommended that the contract be awarded to William G. Wells and Associates of Salem and the he be allowed to give them immediate notice. Supervisor Minter moved to approve the report and authorize the County Attorney to prepare and execute the necessary documents. The motion carried by the following recorded vote: AYES: Supervisors Minter, Brittle, McGraw NAYS: Supervisor Nickens ABSENT: Supervisor Burton Mr. Chambliss reported that the County has been trying to receive proposals for a telephone system for the Roanoke County Administration Center and a proposal to purchase telephone equipment. No bids were received for the telephone system and only one bid was received for telephone equipment. Mr. Chambliss has rejected all bids and is currently in the process of readvertising. Mr. Chambliss reported that the item concerning Judges' robes can be handled administratively and does not require action by the Board. Mr. Chambliss reported on bids received by the County for the renovation of the two residential structures adjacent to the parking lot of the Roanoke County Administration Center and a I I - ~ ~ 439 January 29, 1985 AYES: NAYS: ABSENT: subsequent proposal for the purchase of a modular building. His staff has reviewed the proposals and feels that all are in excess of the expenditure of County funds and recommends that all proposals be rejected. Supervisor Nickens moved to reject bids as recommended by staff. The motion carried by the following recorded vote: Supervisors Minter, Nickens, Brittle, and McGraw None I I Supervisor Burton 6. County Administrator - Mr. Flanders, County Administrator, updated the Board on legislative matters. He reported that Roanoke County was not awarded the Horse Center. He also reported on the telephone charges negotiations effort. Mr. Flanders also requested an Executive Session to discuss personnel, economic development, real estate, and legal matters. Supervisor Minter directed the County Administrator to send a letter to representatives concerning the road bill that is being considered by the General Assembly and will allow more funding for roads within the County. Supervisor Brittle reported that the Senate has approved the installation of blue lights on police vehicles but did not allow for funding. This will mean an approximate cost of $4,000 to $22,000 for Roanoke County. Supervisor Brittle moved to send a letter to Legislators opposing their bill for blue lights on police vehicles with no state funding. The motion carried by a unanimous voice vote.
