IN RE: CALL TO ORDER Chairman McGraw called the meeting to order at 3:10 p.m. The roll call was taken. I MEMBERS PRESENT: Chairman Steven A. McGraw; Vice-Chairman Athena E. Burton; Supervisors Alan H. Brittle MEMBERS ABSENT: Supervisors Harry C. Nickens and Gary J. Minter IN RE: EXECUTIVE SESSION Supervisor Burton moved to go into Executive Session pursuant to the Code of Virginia Section 2.1-334 (a), (1), (2), (4), and (6). The motion carried by a unanimous voice vote. Supervisors Harry C. Nickens and Gary J. Minter arrived during Executive Session. I IN RE: OPEN SESSION Supervisor Nickens moved to return to Open Session at 4:10 p.m. The motion carried by a unanimous voice vote. Work Session - Report on Primary Road Allocations - Superintendent of Public Facilities, John Hubbard, presented the list of roads to submit to the Virginia Department of Highways r-- ~ "..- b ~"'~ (, 4 March 12, 1985 and Transportation to be considered for road allocations. Supervisor Nickens requested Mr. Hubbard to encourage the Route 460/Route 24 connector since vinton has already passed a resolution. The Board requested that Mr. Hubbard add past and present traffic counts to the prepared maps. Direction by Board for John Hubbard and staff to bring a prioritization schedule to the Board at the March 26, 1985, meeting. Work Session - Street Lights - Gary Huff, Assistant to John Hubbard, Superintendent of Public Facilities, discussed the current street light policy with the Board. He reported that the procedures now used rely on an evaluation of seventy (70) points to merit street light installation or acceptance. Appalachian Power Company has agreed to replace all 3500 Lumen Mercury lights with more energy efficient high pressure sodium under our current contract. This gives Appalachian 2 years to complete the project Appalachian is currently in the process of supplying the County with a cost estimate to replace all mercury vapor lights. His staff feels that the current evaluation procedure is systematic and seems to be an adequate method of controlling street light installation but the Board may choose to lower the point total to approve more lights. Supervisor Burton directed staff to check into the cost of a professional evaluation. Work Session - Mobile Homes - Director of Planning, Rob Stalzer, presented a draft of the mobile home policy to the Board He reported that the Planning Commission supported the idea of a combined district, that is mobile homes within a R-l district. Supervisor McGraw directed Mr. Stalzer to contact counties that have prohibited mobile homes to determine how citizens are responding and what process was used to come to the determination to disallow mobile homes. Work Session - Report on Airport - Superintendent of Fiscal Management, John Chambliss, reported on the regional airport request for funding from Roanoke County of $3 million. I I I - ~ -.., r "'.~ 5 Ù J March 12, 1985 Mr. Chambliss reported that the Board may want to consider this funding since in previous years, the application for state and I federal assistance has been leveraged by the indication that this airport serves a regional need. At present the County does not have the $3 million in ready cash to transfer unless the Board changes the priorities in the operations of the County. Mr. Chambliss and his staff recommend that the Board consider placing any contribution or pledge in the Capital Improvements Program for Roanoke County and include this funding in a Public Improvements Bond Referendum. It was also suggested that a Regional Airport Authority be considered to manage the facility and provide for its future needs. Supervisor Nickens directed staff to contact Senator McFarlane's office and ask for their support and to include the I airport in their legislation for southwestern Virginia. Work Session - Report on Arrest Authority for Animal Control Officers - County Attorney, Paul Mahoney, reported on his research of giving arrest authority to animal control officers. He reported that he felt that since animal control officers have the authority to issue summons to enforce animal laws, it does not appear necessary to have arrest authority. The State Code does provide, however, for a Humane Investigator, with the power to arrest. Since Ken Hogan, Chief Animal Control Officer, has been recently appointed by the Circuit Court as a Humane Officer, he has the power to arrest. In order to give arrest authority, each officer would have to be appointed by the Circuit Court to be a "Special Policeman." Each officer would have to submit a I written application to the Circuit Court and would have to give a $1,000 bond conditioned upon the faithful discharge of his official duties. The Board decided not to issue police authority to Animal Control Officers, other than through the Human Investigator process. ~ "..- 51 1 ,. j March 12, 1985 .- _. Work Session - Rules of Parliamentary Procedure - County Attorney, Paul Mahoney, reported that he had earlier given the Board members a memorandum concerning rules of parliamentary I procedure and a proposed draft set of rules or procedure that would support or clarify issues not specifically addressed by Robert's Rules of Order. The Board adopted Robert's Rules of Order at their January 3, 1985, Board meeting, to be in effect until February 12, 1985. Supervisor Nickens moved that future board motions be required to have a second before a vote can be considered. The motion failed by the following recorded vote: AYES: Supervisors Nickens and Brittle NAYS: Supervisors Minter, Burton, and McGraw The Board determined to continue the parliamentary procedures adopted at the January 3, 1985, Board meeting. Supervisor Nickens moved to include these items in the Consent Agenda and to approve the Consent agenda with the deletion of Item 4a. Supervisor Nickens also requested the Procurement Staff to obtain more documentation on Item 4a, litter containers for parks and recreation. That the County Administrator is authorized to execute such documents and undertake such actions as may be necessary to enable the County to participate in surveying archaeological and architectural resources in the Roanoke Valley. 2. That the Commonwealth of Virginia is offering matching grants to interested parties for these historical surveys. Therefore, the County's authorization to participate in these activities shall be limited to a maximum expenditure of $5,000 of County funds. That the County Administrator is hereby authorized to convey to the Virginia Department of Highways and Transportation Roanoke County's support for development, construction, and re-construction of that portion of Brambleton Avenue located in Roanoke County, Virginia, from Kenmore Avenue to the corporate limit of Roanoke City. I 2. That these improvements would include widening Brambleton Avenue to four (4) lanes and the addition of curbs, gutters, sidewalks, and tree plantings. These improvements would be of great value to the citizens and residents of the Roanoke Valley who travel along and use Brambleton Avenue and would be of great assistance to the economic and commercial health and success of the Brambleton Avenue residents. ~ I~ ~ 51- Q March 12, 1985 3. Supervisor Minter moved to approve the prepared resolution. - ~ -- ~ . o March 12, 1985 RESOLUTION 85-27 REQUESTING STATE COMPENSATION BOARD TO ASSUME CERTAIN SALARIES OF SHERIFF DEPARTMENT EMPLOYEES I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the State Compensation Board is hereby requested to assume the salaries and expenses of four (4) communications operators and one (1) secretary employed by the Sheriff of Roanoke County. 2. That the State Compensation Board has the responsibility to financially support certain salaries and expenses arising from the operation of the Sheriff's Department. The proper proportion of support for the Sheriff's Department requires that these five positions which are currently being funded by Roanoke County should be funded by the State I Compensation Board. McGraw presented a proclamation declaring March 10-17, 1985, as Safe Driving Awareness Week to Mr. Bill Clark of the Blue Ridge Sports Car Club of America. PRO C LAM A T ION WHEREAS, an increasing awareness of safe driving techniques to prevent temporary disabilities, permanent I disabilities, and sometimes, death are being launched nationwide; and WHEREAS, not-for-profit organizations and profit-making corporations alike are uniting to help provide a means of building public awareness and promoting safe driving; and ~ ~ "..- 521~ March 12, 1985 WHEREAS, this cooperative effort also extends throughout the Roanoke Valley of Virginia and to all citizens; and WHEREAS, The Easter Seal Society of Virginia, Inc., I Hop-In Food Stores, Inc. WSLQ-99 Radio, Coors, and the Blue Ridge Region of the Sports Car Club of America have designed a week-long program for the community to learn about defensive driving, safe driving and the lack thereof; and WHEREAS, these educational programs are open to the public at no cost. NOW, THEREFORE, I, Steven A. McGraw, Chairman of the Board of Supervisors of Roanoke County do hereby proclaim the week of March 10 through 17, 1985, be observed as SAFE DRIVING AWARENESS WEEK and recognized as a time to place added emphasis on safe driving habits. I Chairman Steven A. McGraw also presented a resolution congratulating Showtimers for the commencement of its thirty-fifth season. Supervisor Brittle moved to approve the prepared resolution. Supervisor Brittle also presented the resolution to Susan Brew, President of Showtimers. RESOLUTION 85-31 OF CONGRATULATIONS TO SHOWTIMERS WHEREAS, Showtimers commenced its first theatrical season in 1951; and WHEREAS, Showtimers is the only amateur community theater in the Roanoke Valley; and WHEREAS, Showtimers encourages community participation I since all of its members are volunteers from the local community; and WHEREAS, Showtimers has provided nearly thirty-five years of cultural entertainment to the citizens and thespian aficionados of the Roanoke Valley. - ~ ~ ~ .~) v ~ March 12, 1985 NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke County congratulates Showtimers on the I commencement of its thirty-fifth season. Supervisor Minter moved to spread a resolution supporting this request. I AT A REGULAR MEETING OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, HELD AT THE ROANOKE COUNTY ADMINISTRATION CENTER ON TUESDAY, MARCH 12, 1985 ß5-b~ RESOLUTION SUPPORTING REQUEST OF THE NORTH LAKES CIVIC LEAGUE FOR THE INSTALLATION OF A TRAFFIC CONTROL SIGNAL AT THE INTERSECTION OF NORTH LAKES DRIVE AND PETERS CREEK ROAD WHEREAS, the North Lakes Civic League has petitioned the Board of Supervisors of Roanoke County to assist it in securing a traffic control signal at the intersection of Peters Creek Road and North Lakes Drive; and WHEREAS, it appears that the traffic generated on such roads justifies the installation of a traffic control signal; and WHEREAS, the installation of a traffic control signal at this location is within the jurisdiction of the City of I Roanoke. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that the Board hereby supports this request by the North Lakes Civic League to install a traffic control signal at the intersection of Peters Creek Road and North Lakes Drive; and r-- ~ ,.- 523 March 12, 1985 FURTHER, that the Board requests the City Council of the City of Roanoke to favorably consider this request. On motion of Supervisor Minter anda the following recorded vote: I AYES: Supervisors Brittle, Burton, Nickens, Minter, and McGraw NAYS: None The Board directed John Hubbard, Superintendent of Public Facilities to send information to Mr. Mann on the history of traffic light requests and water softener requests in that area. Mr. Glenn W. Crowder, 251 Plymouth Drive, NW, Roanoke, Virginia, was present to oppose the County's possible funding of the airport. County Attorney, Paul Mahoney, was directed to send a carbon of a letter that was previously sent to Mr. Crowder concerning this possible funding. Jerry Bahnken of Elliston, Virginia, a representative I of Save Our Soil, was present to speak against the dam project being considered in Montgomery County. The Board directed that Mr. Bahnken be placed on the mailing list to receive County information on this project. IN RE: PUBLIC HEARINGS Request of Horace E. Walker for a Special Exception Permit to place a mobile home on a 1.0 acre tract located at 7030 Kelley Street, Wildwood Estates in the Catawba Magisterial District. HELD OVER TO APRIL 9, 1985 Mr. Horace E. Walker or a representative were not present concerning this request for a Special Exception Permit. Supervisor Nickens moved to hold over to April 9, 1985. The I motion carried by a unanimous voice vote. ORDINANCE 85-32 AMENDING THE ROANOKE COUNTY CODE TO AUTHORIZE THE IMPOSITION OF A LAW LIBRARY FEE TO SUPPORT THE ROANOKE COUNTY/SALEM LAW LIBRARY WHEREAS, the Roanoke County/Salem Law Library Association is the owner of certain law books, treatises and periodicals of a value substantially in excess of $500, and is willing to dedicate these assets to the public for the use and benefit of the citizens of Roanoke County and the City of Salem; and WHEREAS, by Resolution adopted at a December 6, 1984 meeting of the Roanoke County/Salem Bar Association, certain I findings and recommendations were made, unanimously, concerning the future funding, maintenance, upkeep and improvement of the law library; and WHEREAS, the local judiciary is in support of said recommendations, the general funds of Roanoke County and City of Salem have indirectly supported the Law Library Association ------ ~ "..- 531 March 12, 1985 through dues charged and paid by the Judges of the various courts, Commonwealth's Attorneys and attorneys for the County and City; and that space for the law library has been reserved in the new Roanoke County Courthouse; and I WHEREAS, Section 42.1-70 of the 1950 Code of Virginia, as amended, authorizes localities in Virginia to accept donations of law libraries and to adopt ordinances authorizing a fee of $2.00 per civil case filed with the Clerks of the various Courts to pay the costs of maintenance, upkeep and improvements of the law library; and WHEREAS, the $2.00 filing fee assessed against parties filing civil cases is equitable and just in that it places the cost of maintaining the law library upon those who precipitate litigation. That the donation of the assets of the Roanoke County/Salem Law Library Association, that is, law books, treatises and periodicals, is hereby accepted jointly with the City of Salem. 2. The Purchasing Agent may administratively purchase up to $5,000. Purchases made by either the Purchasing Agent or the bid committee shall be accomplished as described herein. Purchases in this group shall be accomplished through the use of at least three letter quotations whenever possible. A letter quotation is a written request sent to at least three vendors with a specified reply date and time. This is the most desirable method of acquiring necessary items and should be used when proper planning allows sufficient time. The use of letter quotations requires adequate time for preparation, mailing, receipt and award generally two or three weeks from receipt of requisition. All quotations received after the reply date and time are non-responsive and cannot be considered. Requests for letter quotations are issued by the Purchasing Agent. To initiate the letter quotation, the user department should submit a completed requisition to the Purchasing Agent, including a list of possible vendors, if available. 2. RESOLUTION 85-29 ACCEPTING A PROPOSAL MADE TO THE COUNTY OF ROANOKE FOR REVISION OF THE JOB DESCRIPTION FOR YOUTH AND FAMILY SERVICES OFFICER BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the job description of the Youth and Family Services Officer, Classification Code 822, adopted by Resolution No. 84-47 on March 13, 1984, be, and same hereby is, revised as follows: I Acceptable Education and Experience Graduation from a two year college with coursework in police science or one of the social sciences and a minimum of two years experience as a uniformed police - officer or deputy sheriff. Mr. Hubbard also reported on Matthews Electro-Plating (Big Hill Water Line). A news release has been issued that the bid has been awarded to a local contractor, Aaron J. Conner, General Contractor, in the amount of $1.5 million. Of this $1.5 million, the County is paying approximately $350,000. Chairman McGraw suggested that Mr. Hubbard may want to arrange a ground breaking. Supervisor Minter moved that Mr. Hubbard send a letter to the state inquiring about the reason they did not pay their part of this project. The motion carried by a unanimous voice vote. I 6. County Administrator - Reported that the Salem/Roanoke County Chamber of Commerce annual dinner, at which Senator Warner will speak, will be held March 26. Chairman McGraw directed Mr. Flanders to set up a meeting with two members from the Roanoke County Board and two members from the Botetourt County Board, Mr. Flanders, and the Botetourt County Administrator. RESOLUTION 85-28 CONCERNING LIBRARY COOPERATION BETWEEN ROANOKE AND BOTETOURT COUNTIES WHEREAS, the Comprehensive Plan for Roanoke County I calls for a library to be built in the Bonsack Area within ten years; and WHEREAS, Botetourt County desires to build a library in the general Blue Ridge area of that County; and WHEREAS, it would be beneficial for only one library to be built to serve both areas; and ~ "..- s:t 9 .) <..J1 . March 12, 1985 WHEREAS, the Library Board of Trustees of Roanoke County adopted a resolution concerning library cooperation between Roanoke and Botetourt Counties on February 27, 1985. NOW, THEREFORE, BE IT RESOLVED that the Board of I Supervisors of Roanoke County supports and endorses the Library Board of Trustees in its pursuit of cooperation with the Botetourt Library Board and in its attempt to formulate a plan for the construction of one library to serve its citizens of both counties. Supervisor Nickens moved that the County authorize a joint purchase of a ladder truck with the Town of Vinton at a base price of $243,864.00 including miscellaneous equipment at a cost of $3,400 and an engine brake at a cost of $3,400 and test of the aerial ladder device. The funding arrangements to be Town of Vinton.
