4/2/1985 - Regular ,., 56 u ,I Roanoke County Board of Supervisors Roanoke County Administration Center 3738 Brambleton Avenue, SW Roanoke, Virginia 24015 April 2, 1985 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the first Tuesday, and the first regularly scheduled meeting of the month of April, 1985. IN RE: CALL TO ORDER Chairman McGraw called the meeting to order at 4:11 p.m. The roll call was taken. I MEMBERS PRESENT: Chairman Steven A. McGraw; Vice-Chairman Athena E. Burton; Supervisors Harry C. Nickens, Gary J. Minter, and Alan H. Brittle MEMBERS ABSENT: None IN RE: WORK SESSIONS 1. Process of Community Certification Program by Robert Will, Virginia Office of Economic Development and Timothy Gubala - Mr. Robert Will, Regional Director for the Virginia Department of Economic Development, presented a film presentation on the Community Certification Program which will commence effective July 1, 1985. Since 1979 more communities are fighting I for fewer industry locations and the Certification Program is basically an effort to make communities more competitive to improve the chances of industry. 2. Report on Fee Waivers for Raffle Permits - County Attorney, Paul Mahoney, requested that this work session be held over as he has not had an opportunity to determine all the possibilities. He reported that there is no standard in the ¡--- u r 561 April 2. 1985 State Code and no standard imposed by the attorney general. Mr. Mahoney is currently in the process of contacting other cities and counties within the State of Virginia to discuss their procedures. The Board directed Mr. Mahoney to bring this back on May 7, 1985. 3. Report on Centralized Procurement Services - Mr. Jack Council, Director of Procurement Services, presented an outline of essentials necessary to develop a centralized procurement of Procurement Services. This system should reduce operating costs significantly. Mr. Council appeared before the Board to request approval and take necessary action to renovate the procurement warehouse space at the Public Service Facility. The estimated cost of this project will be $70,000. Supervisor Nickens moved to refer this back to the Management Advisory Council and upon their approval be made a part of the budgetary process. The motion carried by a unanimous voice vote. Supervisor Burton requested an estimate of what is being spent presently and how it will compare to future expenditures. 4. Report on Airport Advisory Council - Each Supervisor and Mr. Flanders has earlier received a report from Roanoke City concerning the organizational structure of the Airport Committee and pointed out that the Committee will act in an advisory capacity to the Council. The members of this committee are: Jack Smith, Chairman; Carter Burgess; Byron Smith; Claude N. Smith; Martha Zillhardt; Sidney Weinstein; william M. Claytor; James Harvey, II; T. W. White; Thomas Cook; Claude Carter; Jack L. Shelton. There is a staggered term on City appointees and the terms of appointees from various jurisdictions are at the determination of the respective body. Mr. Flanders has discussed with Mr. Ewert a coordination for a study of a regional facility and requested that a supervisor be appointed to work with him and Mr. Ewert and Mr. Harvey on this study. Supervisor Nickens moved to appoint 1 I I ~ -.., April 2, 1985 562 ,I Supervisor Minter as County representative to serve on the Airport Advisory Committee and also to serve as Board representative to serve on regional commission and to send a letter expressing the Board's appreciation to Mr. White for his previous service. The motion carried by a unanimous voice vote. 5. Policy on Filling Swimming Pools - Dianne Hyatt, Assistant Superintendent of Fiscal Management, presented the current policy for swimming pools. Presently, the County charges the customer for the water consumption when the pool is filled and also for the related sewage charge based on that water I consumption. The only way for the customer to eliminate the sewer charge is to have a separate meter that measures the water going into the swimming pool. Ms. Hyatt spoke with the Health Department about swimming pool water being discharged other than through the drainage system. The Health Department reported that this could cause a problem since private pools are not monitored for the level of chlorination. Supervisor Burton reported that since there is currently no law stating that swimming pools must be drained into a sanitary sewer, pool owners should not be charged the sewer costs. Supervisor Nickens suggested requiring all pool owners to contact the County before their pool is filled, giving measurements of the pool and then the County would credit their I account upon their submission of pool size. Supervisor Brittle directed Dianne Hyatt to contact all pool installers with this information for future pool owners and to send out public service announcements to pool owners. Supervisor Nickens moved for the County Attorney, Paul Mahoney, to draft whatever papers appropriate to bring back at his earliest opportune time to incorporate this suggestion. The motion carried by a unanimous voice vote. 6. Update on Comprehensive Plan Timetable - Tim Gubala, Superintendent of the Department of Development, updated ~ ~ 563 April 2, 1985 - the Board on the timetable of the Comprehensive Plan. There are three essential elements of the Comprehensive Plan: Land Use, the Community Facilities Plan, and transportation. Mr. Gubala 1 reported that his staff is presently writing a report on each element staffing it amongst the different actors in the County. These reports will then be taken to the Planning Commission for review and eventually a hearing and then to the Board of Supervisors. Twelve community meetings have been scheduled beginning April 3, 1985, at Back Creek. These meetings will last approximately two months and will be utilized for citizen input on the Comprehensive Plan. Staff has scheduled May 31, 1985, and will bring to the Board in June for a formal hearing process. Supervisor Burton expressed a concern about the Plan being presented to the Communities since the Plan is still not complete. 7. Garcia v. San Antonio Metropolitan Transit I Authority - County Attorney, Paul Mahoney, reported that the United States Supreme Court decision on February 19, 1985, followed by the Attorney General's Opinion on March 12, 1985, II that state and local governments will be subject to the Fair I Labor Standards Act. In response to these activities, Mr. ì I Mahoney, Mr. Cook, and Mr. Chambliss met to assess the impact on I ! County operations with concentration on the impact of the Sheriff's Department. A communication has been prepared for Mr. Flanders' signature to all constitutional officers and department heads limiting overtime work of county employees and constitutional officer employees unless that officer or employee has budgeted overtime funds in his/her budget to pay time and I one-half for all overtime (over 40 hours per work week). Mr. Cook is presently gathering information from all officers, constitutional officers, and departments as to the potential impact this opinion and court ruling will have on operations. This survey should be completed by April 6, 1985. He also ~ April 2, 1985 564 ., i I reported that currently it appears that the county is substantially in compliance already with the Fair Labor Standards II Act and would suffer no adverse legal impact and if there is any liability at all, it would probably be for only one month. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS 1. Supervisor Nickens - Recommended a facilities committee and presented a list of staff persons to serve on the committee and facilities that might be studied. Supervisor Burton requested that John Hubbard be removed from the list since it would be duplication as Gary Huff is already on the committee. Supervisor Minter moved to appoint a facilities committee consisting of Gary Huff, Roy Nester, Rob Stalzer, Bonnie Newlon, and Supervisor Nickens. The motion carried by a unanimous voice I vote. Supervisor Nickens also asked when the County would begin credit card dispensing of gasoline. Superintendent of Fiscal Management, John Chambliss, reported that the first site at Glenvar High School is almost complete. The Northside and Cave Spring sites are currently in the completion process. 2. Supervisor Minter - Asked about the brush complaints on the Slavensky property. Mr. Flanders reported that it has been cleaned up. Staff is to check into the clearing of this brush once again. 3. Supervisor Brittle - Reported that he has received correspondence from Cave Spring National Little League requesting a safety fence on the baseball/softball fields and turning the I electricity on at the Clearbrook baseball field. Mr. Flanders has already directed Mr. Hubbard to obtain costs of installation of nets immediately instead of waiting for the next budget cycle. Staff is also currently working on the lighting problem. Supervisor Brittle has also received correspondence from the Sheriff's Department concerning personnel changes in the ~ ~ ,.-- 565 Aoril 2. 1985 consolidation of the Youth Bureau into the Detective Bureau. Supervisor Brittle moved to approve the prepared resolution. RESOLUTION 85-43 AMENDING RESOLUTION NO. 84-101 APPROVING THE CLASSIFICATION PLAN FOR THE 1984-85 FISCAL YEAR TO ADD TWO POSITIONS OF DEPUTY SHERIFF AND ONE POSITION OF DETECTIVE AND TO DELETE THREE POSITIONS OF YOUTH & FAMILY SERVICES OFFICER I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Resolution 84-101 approving the classification plan for the 1984-85 fiscal year be amended to read and provide as follows: Grade 17 Code - 821 Grade 18 Code - 822 Title Dept. Supervisor Brittle also asked about the progress on the is currently being installed and understands that the library I Mount Pleasant Library. Mr. Flanders reported that the furniture will open in mid-April. 4. Supervisor Burton - Requested that staff give priority to establishing entrance area into the Burgess/Shindell property so that the volunteer groups who wish to donate their ~ ~ ~ April 2, 1985 566 I time to the identification of plants and the assistance in pruning and clearing of various gardens can start on their projects. Supervisor Nickens requested that staff develop a matching of funds policy for the donation of parks. Supervisor Burton also clarified the the expenditure of funds on the remodeling of the Roanoke County Administration Center. She reported that in 1982 when the County renovated the Mount Vernon School, the County renovated out of available funds and no funds could be appropriated at that time for upgrading furnishings. At that time it was discussed that to accomplish the upgrading of the furnishings that the County would try to upgrade on an annual basis by appropriations and in a manner that the offices dealing with the public would be upgraded first. The first year (1983-1984 fiscal year) $25,000 was appropriated to upgrade the Treasurer's area. Because the Courthouse bid of furniture was delayed because the Courthouse opening was delayed and bids are only good for up to 60 days, the funds for the Treasurer's area were held until the next fiscal year so that the unit price bid on the Courthouse furniture could be used. Mrs. Burton stressed that the unit price bid on the Courthouse furniture was used for Roanoke County Administration Center furnishings, but, not Courthouse funds. Roanoke County Administration Center furnishings were paid for from the County General Fund and not from Courthouse bond proceeds. In the 1984-l985 fiscal year $75,000 was budgeted to upgrade the Planning, Zoning, Building Inspections, Public Facilities, County Administrator, and Board of Supervisors offices. 5. Supervisor McGraw - Announced that Roanoke County intends to robustly proceed with all due course in obtaining help from the Federal Government to look at the possibility of building a dam in Montgomery County. County Administrator, Donald R. Flanders, will be going to Washington, D.C., in the near future to meet with the appropriate officials to work on I 1 ------ I~ r- 567 April 2, 1985 this project. Mr. McGraw also reported that the dam would provide water and flood protection for approximately 25,000,000 people while displacing only 400 to 600. I IN RE: REPORT FROM COUNTY ADMINISTRATOR Mr. Flanders reported that on March 28, 1985, John Willey, County Assessor, filed the County assessment which was three days before the deadline and that the County is at 95.4 percent of the 100 percent figure of assessed value in the County Two work sessions for the budget have been set. March II and 15, 1985, with the public hearing on March 18, 1985. Mr. Flanders has also spoken with Mr. Hume of the Department of Army Corps of Engineers relative to the County's permit for Roanoke River. Mr. Hume reported to Mr. Flanders that the Army Corps of Engineers would like to set up a meeting with the representatives of the State Water Control Board, the County, and the Army Corps of Engineers. The Roanoke County Courthouse dedication went off smoothly. Mr. Flanders expressed his appreciation to Margaret Reamy and the Public Facilities staff and to the Board in their support in the opening of the Courthouse. Mr. Flanders also reported on the Fort Lewis Mountain fire. Six Hundred Seventy-three acres were lost but no buildings or serious personal injuries occurred. Supervisor McGraw suggested that a resolution be prepared expressing the Board's appreciation to the County fire fighters and the members of the Virginia Division of Forestry who worked this fire. Supervisor Burton also requested that a resolution be prepared expressing appreciation to Margaret Reamy for her work on the Courthouse Dedication. Mr. Flanders also reported that Judge Koontz has been appointed to be the Chief of the Appeals Court. I I - ~ ~ April 2, 1985 5 I>" 8> " 0 '.
