I Roanoke County Board of Supervisors Roanoke County Administration Center 3738 Brambleton Avenue, SW Roanoke, Virginia 24015 July 23, 1985 The Roanoke County Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, this being the fourth Tuesday, and the third regularly scheduled meeting of the month of July, 1985. IN RE: CALL TO ORDER Chairman McGraw called the meeting to order at 3:07 p.m. The roll call was taken. I MEMBERS PRESENT: Chairman Steven A. McGraw; Vice-Chairman Athena E. Burton; Supervisor Harry C. Nickens MEMBERS ABSENT: Supervisors Alan H. Brittle (arrived at 3:09 p.m.> and Gary J. Minter IN RE: CONSENT AGENDA Supervisor Burton requested that Item 14 be removed from the Consent Agenda for discussion. Supervisor Nickens requested that Items 4, 11, 15, and 16 be removed for discussion. Item 4 - Supervisor Nickens requested a further breakdown on charitable organizations that will be impacted by I the charge. Item 11 - Supervisor Nickens questioned the use of fireworks in September. Mr. Hubbard, Superintendent of Public Facilities, reported that the fireworks would be a big attraction for people. Supervisor Nickens felt that the funds spent on fireworks could be used for a better service at the festival. - ~ r 040 July 23, 1985 Item 14 - Mr. Mahoney, County Attorney, reported that most of the localities that have responded to his letter almost uniformly charge a fee because of staff costs. Supervisor Burton I moved to advertise to amend the present ordinance to read that a $10.00 fee is applicable so that there is no waiver. The motion carried by the following recorded vote: AYES: Supervisors Burton, Brittle, Nickens, and McGraw NAYS: None ABSENT: Supervisor Minter Item 15 - Supervisor Nickens suggested that the Chairman or the Acting County Administrator write a letter to the citizens in the Big Hill area thanking them for their contribution concerning the drainage easement. Item 16 - Supervisor Nickens asked about coverage after July 1, 1986. Supervisor Nickens requested that the citizens be informed that they will still have fire protection after this I date. Chairman McGraw responded that he had earlier directed staff to start a negotiation process to have this agreement extended. Item 17 - Keith Cook, Personnel Director, requested that this item be removed from the Consent Agenda. Supervisor Nickens moved to approve the Consent Agenda. July 23, 1985 RESOLUTION 85-125.G ACCEPTING AN OPTION TO PURCHASE THE STARKEY ELEMENTARY SCHOOL PROPERTY BE IT RESOLVED by the Board of Supervisors of Roanoke I County, Virginia, as follows: 1. That on July 9, 1985, the Board held a public hearing on the sale and disposition of surplus real estate pursuant to the provisions of Section 15.1-262 of the Code of Virginia, 1950, as amended; and 2. That B. V. Nininger submitted a written offer dated July 9, 1985, for a 45-day option to purchase said real estate for the amount of $35,000.00. The purpose of the option is for the optionee to make necessary structural inspections and to compile cost data to effect renovation of this structure for a child care center. A good faith $300.00 deposit is provided with this offer; and 3. Coleman and Fred P. Bullington are the general partners (the Company), P. O. Box 92, Roanoke, Virginia 24022, requesting the issuance of the Authority's industrial development revenue bond in an amount estimated at $8,000,000 (the Bond) to assist in the financing of the Company's construction and equipping of a five-floor, 96-room addition to its existing Holiday Inn Hotel at 4368 Starkey Road, SW, Roanoke, Virginia 24018 (the Facility) and refunding of the outstanding principal balance under the Authority's $3,500,000 Industrial Development Bond issued December 17, 1980 (the Prior Bond), (the Project) at 4368 Starkey Road, SW, in Roanoke County, Virginia, and has held a public I hearing thereon on July 16, 1985. WHEREAS, Section 103(k) of the Internal Revenue Code of 1954, as amended, provides that the governmental unit having jurisdiction over the issuer of industrial development bonds and over the area in which any facility financed with the proceeds of industrial development bonds is located must approve the issuance of the bonds; and WHEREAS, the Authority issues its bonds on behalf of Roanoke County, Virginia (the County), the Project is to be located in the County, and the Board of Supervisors of RoanokeCounty, Virginia, constitutes the highest elected governmental officials of the County; and WHEREAS, the Authority recommends that the Board of I Supervisors approve the issuance of the Bond; and WHEREAS, a copy of the Authority's resolution approving the issuance of the Bond, subject to the terms to be agreed upon, and a certificate of the public hearing have been filed with the Board of Supervisors; - ~ ~ 050 July 23, 1985 BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA: 1. The Board of Supervisors approves the issuance of I the Bond by the Authority for the benefit of the Company, as required by Section 103(k), to permit the Authority to assist in the financing of the Project. 2. The approval of the issuance of the Bond, as required by Section 103(k), does not constitute an endorsement to a prospective purchaser of the Bond of the creditworthiness of the Project or the Company, and, as required By §15.1-1380 of the Code of Virginia of 1950, as amended, the Bond shall provide that neither the County nor the Authority shall be obligated to pay the Bond or the interest thereon or other costs incident thereto except from the revenues and moneys pledged therefor and neither the faith nor credit nor the taxing power of the Commonwealth, the County, or the Authority shall be pledged thereto. I 3. This Resolution shall take effect immediately uponits adoption. RESOLUTION 85-127 REQUESTING INDUSTRIAL DEVELOPMENT BOND FUNDS FROM THE STATE RESERVE AND AUTHORIZING THE ACTING COUNTY ADMINISTRATOR TO EXECUTE THE APPLICATION THEREFOR I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. Health Department - Dr. Nancy Welch, presented the second quarterly newsletter of the Health Department to the Board. 3. Animal Control Division - Chairman McGraw directed Mr. Lowell Gobble, VPI & SU Extension Agent to set up a committee to work on the poultry ordinance. Supervisor Nickens requested that the ordinance read "roaming at large" instead of being so I specific. Supervisor Burton moved to table this issue until after Executive Session. The motion carried by a unanimous voice vote. 4. Fire and Emergency Services Division - Mr. Mahoney, County Attorney and Acting County Administrator, reported that Bonnie Newlon and Mr. Gentsch are presently working on the public facilities master plan. Mr. Fuqua, Fire and Emergency Services Coordinator, reported that the public service center is the best area for the training program since the smoke will rise away from housing areas. Supervisor Burton reported that she is opposed to the site since the master plan has not been completed. Mr. Fuqua reported to the Board that the funds allocated must be used by July 1986 and that after the Board approves the site, they still I must appear before the State Fire Board at their quarterly meeting. Mr. Mark Light, Training Director, and Mr. Fuqua presented the schematic design. RESOLUTION 85-124 DIRECTING THE USE OF FIRE PROGRAM FUNDS AND DEDICATING LAND FOR REGIONAL TRAINING CENTER I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: WHEREAS, the General Assembly has recently adopted legislation that would provide funding to localities for the construction of a regional training center, or for the purchase of fire fighting equipment, or protective clothing, or for educational and training purposes, and WHEREAS, the Comprehensive Plan identifies the need to provide a training center for fire and rescue personnel at the Public Service Center site, and WHEREAS, the Roanoke County Fire Chiefs Board supports NOW, THEREFORE, the Board of Supervisors hereby I the use of fire program funds to construct said training center. resolves as follows: 1. That 6.075 acres of real estate at the Public Service Center is hereby dedicated for the use of a regional training center, and 2. That fire program funds to be allocated to Roanoke County shall be expended for the construction costs of said regional training facilities, and 3. That the State Fire Board is requested to authorize and approve this location and these facilities for a regional training center for emergency services. I RESOLUTION 85-128 AUTHORIZING THE COUNTY OF ROANOKE TO PARTICIPATE IN A CERTAIN WATER LINE EXTENSION IN AND ALONG TERMINAL ROAD BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County of Roanoke be, and hereby is, authorized and directed to participate in a certain water line extension in and along Terminal Road in Roanoke County at a cost to Roanoke County not to exceed $10,550.00 without additional authorization of the Board; and 2. Department of Public Facilities - John Hubbard, Superintendent of the Department of Public Facilities, presented the policy on curbside refuse collection. Supervisor Nickens suggested adopting a policy not to pick up big items such as - ~ r- 054 July 23, 1985 refrigerators, etc. Supervisors Burton and Nickens requested that the green boxes not be eliminated. In case of bad weather, the citizens can use these if trash service cannot get through. 6. Department of Development - No Report. 7. Personnel Department - No Report. 8. Department of Fiscal Management - No Report. I 9. County Attorney - Mr. William Strickland of McGuire, Woods & Battle, reported on the legal implications and deadlines concerning the bond referendum. Mr. Jim Strickland of Hayes, Seay, Mattern & Mattern, reported to the Board on the engineering of the West County Reservoir. Mr. Mahoney also discussed the alternative for disposition of surplus real estate and procedure for bidding. Supervisor Nickens requested two exposures to the public not including the legal ad. RESOLUTION 85-129 EXPRESSING THE APPRECIATION OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO ELIZABETH HARVEY FOR THIRTY YEARS SERVICE TO THE TOWN OF VINTON, ROANOKE COUNTY WHEREAS, Elizabeth Harvey was first employed as the Treasurer by the Town of Vinton, Roanoke County in February, 1956, and has faithfully served in that capacity until present; I and WHEREAS, she has also served the citizens of Vinton as a member of the Building Committee for the new Vinton Municipal Building during 1981; and f-- ~ ·tJ 5 6, t,. She reported that the state would be funding $75,000 in Southwest Virginia but it is up to the local governments to provide information and referral services to the citizens. Ms. Maryellen Perdue, Coordinator of Information and Referral Service, reported that she has made a formal request for funds in the amount of $3,400.00 through the Human Services Committee. Ms. Barbara Fasmacht, 5327 Canoe Circle, Salem, Virginia, 24153, President of the Cherokee Hills Association, requested that the Board apply for the roads in their subdivision to be included in the State Highway System. She reported that she has spoken with Mr. Hubbard, Superintendent of Public Facilities, who responded that the appraisals are nearing completion on what it would take to get the roads up to state standards. I - ~ ~ July 23, 1985 051 Mr. Hubbard reported that he has sent the Highway Department a request for cost estimates noting any easements or I additional right of ways prior to them accepting the road into the State System. After he receives the estimates, his staff will then prioritize the roads and will bring the priority list to the Board in the spring of 1986. IN RE: PUBLIC HEARINGS I Petition of The Bank of Virginia requesting rezoning to amend conditions to permit an entrance for a service road allowing ingress and egress to Virginia Route 419 and a sign not more than 75 square feet to be erected along Route 419 of a tract containing 1.4+ acres and located on the north side-of Virginia Route 419, approximately 350 feet + west of its intersection with Postal-Drive in the Cave Spring Magisterial District. The Planning Commission recommends approval. HELD OVER FROM JULY 9, 1985 APPROVED Mr. Jim Douthat, attorney for Bank of Virginia, reported that he has been unable to obtain an easement from the Postal Service. Supervisor Brittle reported that he had contacted Congressman Olin who contacted the Postal Service in Philadelphia. The Postal Service reported that there would be no changes because the plans have already progressed beyond that point. Supervisor Burton reported that she had contacted Senator Trible and received a report from the Post Office that they will not consider any changes in their plans for an additional road. Mr. Roger A. Lorden, 4390 Sheldon Drive, SW, Roanoke, I Virginia, representing the Cresthill Civic League, was present opposing this rezoning because of the effects it would place on their community. Supervisor Burton moved to approve the alteration to the site with the understanding that the frontage road will be dedicated, if needed, if the land that is now under option to the r I I I I -- 1 058 July 23, 1985 Post Office does not occur or if the Post Office agrees in that optioned land to allow an access easement that that will be exercised. FINAL ORDER I NOW, THEREFORE, BE IT ORDERED that the conditions applicable to the aforementioned parcel of land, which is a part of the property shown on the Roanoke County Tax Map as parcel 76.16-1-40 and recorded in Deed Book 1183, page 1238, and legally described below are hereby amended as hereinabove set forth. Supervisor Nickens - Reminded the other Board members of the meeting on July 29, 1985, at the Marriott in the Regional Partnership Office. He also asked John Hubbard, Superintendent of the Department of Public Facilities, about the cemetaries on Vineyard Park Property. Mr. Hubbard reported that they would be cleaned in the fall per agreement with Mr. Vineyard. Supervisor Nickens directed staff to look into the feasibility of an access road to the Main Library off Berry Lane. I 4. Supervisor Minter - Absent. 5. Supervisor McGraw - Gave Airport Commission information to County Attorney, Paul Mahoney. Thanked Jim Harvey, Roanoke City Councilman, for prompting Roanoke City to discuss the E911 system with the County.
