Roanoke, VA 24015 I April 10, 1984 The Board of Supervisors of Roanoke County, Virginia, met this day at the Roanoke County Administration Center, Roanoke, Virginia, this being the second Tuesday and the first regular meeting of the month of April, 1984. IN RE: CALL TO ORDER Vice Chairman Burton called the meeting to order at 3:03 p.m. The roll call was taken: MEMBERS PRESENT: Vice Chairman, Athena E. Burton, Supervisors Alan H. Brittle, Steven A. McGraw, Gary J. Minter I MEMBERS ABSENT: Chairman, Harry C. Nickens EXECUTIVE SESSION Supervisor McGraw moved to to into Executive Session pursuant to the Code of Virginia, Section 2.1-344(a) (1), (2), (4) and (6) to discuss personnel, real estate, location of a prospective business or industry, and legal matters. The motion carried by a unanimous voice vote. IN RE: OPEN SESSION Supervisor Brittle moved to return to Open Session at 4:25 p.m., and the motion carried by a unanimous voice vote. I Work Session - Rural Addition Priority Policy Superintendent of the Department of Public Facilities, John Hubbard, explained that there was no written policy whereby a citizen could apply for addition to the State Highway Department's Secondary Road System. Pending receipt of the Attorney General's opinion on statutes, Supervisor McGraw moved ~ ~ ~. 't_8.~ ~ ~, o 4-10-84 to approve the policy changing the petition requirements from 100% to 75%. The motion carried by a unanimous voice vote. Work Session - Policy on Concession Stand Use Assistant to Superintendent of the Department of Public Facilities, Gary Huff, explained that a policy needs to be I I established on the operation of concession stands in Roanoke County parks. The Board directed that he proceed to contact the recreation club presidents to explain the policy and the procedures and obtain their input. This will be brought back to the Board at a future meeting. Work Session - Carry-Over Appropriation Since the public hearing has already been held, and the required seven-day waiting period has lapsed, Superintendent of the Department of Fiscal Management, John Chambliss, reviewed the carry-over appropriations needed by the County. One resolution represented the operating expenses, encumbrances, and unpaid obligations I outstanding as of June 30, 1983, which should have been included in the 1982-1983 budget. The second resolution represented a reappropriation of unspent monies for capital projects outstanding as of June 30, 1983. Both resolutions were on the Consent Agenda (Item #5) and were voted on during the evening session. In order to consolidate the Board of Supervisors Meetings, County Administrator, Donald Flanders will draft a tentative agenda to be brought back before the Board. Nickens, hereby proclaim April 22-28, 1984, as NATIONAL YWCA WEEK IN ROANOKE COUNTY and invite our citizens to join with me in saluting the YWCA of Roanoke Valley as it celebrates, with some 450 communities and student YWCAs composed of two and one-half million women and girls nationwide, the 125th Anniversary of the YWCA of the united States. PRO C LAM A T ION WHEREAS, Parkinson's Disease is a progressive and as yet incurable neurological affliction that affects one out of every one hundred citizens over the age of sixty and whose cause is I still unknown; and WHEREAS, with improved methods of diagnosis, the onset of the disease is now being diagnosed as early as the age of forty and younger; and WHEREAS, with earlier diagnosis and the aging of our entire population, more and more of our citizens will be afflicted with Parkinson's Disease; and WHEREAS, it is important to educate the public about the need for research into the cause and cure of this disabling disorder; and WHEREAS, only public awareness of the terrible toll taken by this neurological affliction can spur Federal, State, and local I government agencies, and the private sector to establish the programs necessary to find a cure, improve treatment, and help those afflicted and their families to cope with this disabling disease. NOW, THEREFORE, I, Harry C. Nickens, do proclaim the week of April 8 through 14, 1984, as Parkinson's Disease Awareness Week - ~ ~ 493 4-10-84 and do call upon the citizens of Roanoke County to observe this week with appropriate programs, ceremonies and activities. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS I Supervisor McGraw - Will be conducting three public meetings in the Catawba Magisterial District for the purpose of discussing the tax issues - April 16, 1984 at 8:00 p.m. in Masons Cove Elementary School, April 17, 1984 at 8:00 p.m. in Northside High School Library, and April 19, 1984 at 8:00 p.m. in Glenvar High School Library. Supervisor Minter - Moved that the Board request the Attorney General's opinion on the legal recourses that the County has for developers who do not comply with standards. The motion carried by a unanimous voice vote. He also requested that the Board review his file on the internal auditor position and consider the establishment I of this position in the 1984-1985 budget process.. Supervisor Brittle - No report. Supervisor Burton - made a statement regarding the lighting facilities at Hidden Valley School. She requested that the media be given copies of the report indicating that the County has communicated with the City of Roanoke in responding to the complaints, that lights have been redirected, curfews have been imposed, and that the Department of Public Facilities is checking into the installation of automatic switches for the lighting. IN RE: PUBLIC HEARINGS I REQUEST TO SET A PERSONAL PROPERTY TAX RATE OF NOT MORE THAN $4.00 PER $100 ASSESSED VALUATION IN ROANOKE COUNTY. Those citizens speaking in opposition were Mr. J. E. I Hindle, 6065 Oriole Lane, Roanoke; Mr. W. A. Drewry, 844 Dillon Drive, vinton; Mr. Stan Reas, 6206 South Roselawn Road, Salem; Mr. G. T. Guthrie, a General Electric employee from Northwest Roanoke County; Mr. G. H. McFall, 821 Dillon Drive, vinton; and Mr. T. E. Robertson, 803 Ruddell Road, vinton. Mr. Bob Johnson, 6628 Northway Drive, Roanoke spoke in favor of the quality of services provided by Roanoke County and reminded senior citizens that they may qualify to have their taxes frozen. In response to Supervisor McGraw's question, Superintendent of the Department of Fiscal Management, John Chambliss, reported that for Machinery and Tools the City of Roanoke has a rate of $3.75, the City of Salem's rate is $3.25, I and the Town of vinton's tax rate is $1.00 per $100 of assessed valuation. The County Administrator, Donald R. Flanders, recommended the personal property tax rate for Roanoke County be continued at $3.50 per $100 of assessed valuation. Supervisor Brittle moved the following resolution: RESOLUTION NO. 84-68 SETTING THE TAX LEVY ON ALL CLASSES OF PERSONAL PROPERTY SITUATE IN ROANOKE COUNTY FOR THE CALENDAR YEAR 1984 BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the levy for the twelve-month period beginning January 1, 1984 and ending December 31, 1984, be, and it hereby is, set for a tax rate of $3.50 PER ONE HUNDRED DOLLARS of I assessed valuation on all taxable, tangible personal property, excluding all those classes of household goods and personal effects as are defined in Sections 58-829.1 and 58-829.1:1 and machinery and tools taxed as a separate class as defined in Sections 58-831 and 58-412 of the 1950 Code of Virginia, as amended, but including the property separately classified by - ~ ~ 493 4-10-84 Sections 58-829, 58-829.2, 58-829.3, 58-831.1 and 58-831.2 in the 1950 Code of Virginia, as amended, located in this County on January 1, 1984, and tangible personal property including the 58-829.3, 58-831.1 and 58-831.2 in the 1950 Code of Virginia, as I property separately classified by Sections 58-829, 58-829.2, amended, of public service corporations based upon the assessed value thereof fixed by the State Corporation Commission and duly certified. That there be, and hereby is, established a separate class of personal property in Roanoke County to include those items of personal property set forth in Sections 58-831 and 58-412 of the 1950 Code of Virginia, as amended, and generally designated as machinery and tools; and 2. That the levy for the twelve-month period I beginning January 1, 1984 and ending December 31, 1984, be, and hereby is, set for a tax rate of $3.00 PER ONE HUNDRED DOLLARS of assessed valuation on all taxable, tangible personal property as herein established as a separate classification for tax purposes and as more fully defined by Sections 58-831 and 58-412 of the ~ ~ 4-10-84 J . DAVIS FOR A SPECIAL USE PERMIT TO OPERATE A "BORROW PIT" ON A THREE-ACRE TRACT LOCATED ON OLD CAVE SPRING ROAD IMMEDIATELY WEST OF ROUTE 410 AND ROUTE 221 IN THE WINDSOR HILLS MAGISTERIAL DISTRICT. FORWARDED TO HIGHWAY DEPARTMENT (Reference Resol ution 84-95) Mr. Mike Lazzuri, 5812 Knowles Drive, acted as spokesman for the residents and explained the dangers to the children and residents which is a result of trucks using this route as a short cut through this residential section. Supervisor Brittle moved that a transcript of this public hearing be prepared and forwarded to the Virginia Department of Highways and Transportation to determine whether another public hearing is necessary and that the Board's support be conveyed for closing this road. HELD OVER Citizens speaking in opposition to the renewal of this mobile home permit were Mr. Warren C. Their main objection was related to a problem they encountered with Mr. that construction of the house which Mr. Lucas promised to build I Lucas regarding the use, maintenance, and upkeep of the road and has not begun. Ms. Jennifer Mulligan, attorney for Mr. Lucas, explained that the reason Mr. Lucas was requesting a renewal of the special exception is because of his financial difficulties, and the Bankruptcy Court must approve the construction of the home. She also indicated that the road problems were between the neighbors and not related to his request for the permit. She also indicated that she and Mr. Lucas would welcome the opportunity to negotiate an agreement with the neighbors regarding the road. Supervisor McGraw moved that the permit be granted for a one-year period, and that construction of a I permanent dwelling is to begin during this time and to be completed within eighteen months from this date. Supervisor Minter made a substitute motion to hold this over until the April 24, 1984 meeting in order to give Mr. Lucas time to check with { the bankruptcy court regarding construction of a home and extending the Board's encouragement for the citizens to communicate towards establishing a good-neighbor policy. The motion carried by a unanimous voice vote. PETITION OF ROBERT W. Minter's question, Superintendent of the Department of I from the State Health Department in Lexington and that in Development, Timothy Gubala, explained that a permit is required compliance with their guidelines fill dirt, rocks, and limbs will be approved for dumping in the land fill. Mr. Scott also indicated that he keeps the entrance locked. Supervisor Brittle moved to grant the permit, and the motion carried by a unanimous voice vote. PETITION OF BRENDA L. ROBSON FOR A SPECIAL EXCEPTION TO OPERATE A FLEA MARKET ON A 5.1-ACRE TRACT ZONED B-2, THE DIXIE DRIVE-IN THEATER, LOCATED ON THE SOUTH SIDE OF STATE ROUTE 24 APPROXIMATELY 0.5 MILE FROM THE VINTON TOWN LIMITS IN THE VINTON MAGISTERIAL DISTRICT. FOR A SPECIAL EXCEPTION TO RENEW THE OPERATION OF A VIDEO GAME ROOM LOCATED AT 7214 WILLIAMSON ROAD (MARKET SQUARE NORTH SHOPPING CENTER, ZONED B-2), IN THE HOLLINS MAGISTERIAL DISTRICT. APPROVED The owner and operator of Video Village, Tom Johnson was present. Mr. David Smith, Manager of Eckerd Drug Store in Market Square North, presented a letter of complaint from eight of the twelve merchants in the shopping center. Those merchants I present were James and Carolin Keith - Hallmark Card Shop; Percy Fuller - Shear Design Hair Salon; Reginald Gilbert - D & N Gilberts; George Dunkee - Second Act; and Philip Ferro - Ferro's Pizza. The merchants felt that although Mr. Johnson had complied with the conditions of the permit, the conditions have not been effective. Chairman Burton then read the complaint letter which related to the crowds of teenagers and their disturbing conduct on the shopping center premises. Mr. Johnson indicated that this was the first time he was aware of any complaints, and that he had hired a Sheriff's deputy to be on duty on the premises. He suggested that perhaps the officer could be on duty outside the premises rather than inside. Supervisor McGraw suggested that he can effectively eliminate the problem outside his business. Supervisor Brittle moved the following prepared I resolution: RESOLUTION NO. 84-70 APPROVING THE ISSUANCE OF CERTAIN INDUSTRIAL DEVELOPMENT AUTHORITY OF ROANOKE COUNTY BONDS FOR SEABOARD FARMS, INC. WHEREAS, the Industrial Development Authority of Roanoke County, Virginia, (the "Authority"), has considered the application of Seaboard Farms, Inc. (the "Company"), 750 Airport Road, Lakewood, New Jersey 08701, requesting the issuance of the Authority's industrial development revenue bond in an amount estimated at $1,000,000.00 (the "Bond") to assist in the financing of the Company's acquisition, construction and equipping of a feed mi 11 facility (the "project") in the Starkey Road area, north of Crescent Heights Subdivision, on the Norfolk I & Western Railway Company right-of-way, adjacent to a Shell Oil Company petroleum products terminal, Roanoke County, Virginia, and has held a public hearing thereon on April 6, 1984; and WHEREAS, Section 103(k) of the Internal Revenue Code of 1954, as amended, provides that the governmental unit having jurisdiction over the issuer of industrial development bonds and - ~ ~ 501 4-10-84 over the area in which any facility financed with the proceeds of industrial development bonds is located must approve the issuance of the bonds; and WHEREAS, the Authority issues its bonds on behalf of Roanoke County, Virginia (the "County"), the Project is to be located in the County and the Board of Supervisors of Roanoke County, Virginia (the "Board") constitutes the highest elected governmental officials of the County; and WHEREAS, the Authority recommends that the Board of Supervisors approve the issuance of the Bond; and WHEREAS, a copy of the Authority's resolution approving the issuance of the Bond, subject to the terms to be agreed upon, and a certificate of the public hearing has been filed with the Board of Supervisors. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board of Supervisors approves the issuance of the Bond by the Authority for the benefit of the Company, as required by Section 103(k), to permit the Authority to assist in the financing of the Project. 2. That the Board, having duly considered the request and assurances of Seaboard Foods, Inc., respectfully urges and recommends to the Highway Commission of Virginia that considera- tion be given, that immediate study be made, and that a project I be approved and initiated pursuant to the provisions of Section 33.1-221 of the 1950 Code of Virginia, as amended, to provide approximately 451 feet of fifty (50) foot wide needed industrial access improvements to provide access along an extension of Terminal Road to the new plant site of Seaboard Foods, Inc. situate in Roanoke County; and 2. Adopted by the following roll call vote: AYES: Supervisors McGraw, Minter, Brittle, Burton I NAYS: None ABSENT: Supervisor Nickens Department of Public Facilities - Superintendent, John Hubbard, reported that Roanoke County made a strong appeal for a more equitable share of construction funds at the Highway Department's public hearing for the six-year plan, indicating that allocations should be received within the next month. Department of Fiscal Management - Superintendent, John Chambliss recommended a contract be awarded to Video Production Services for development of a tape to be used for an I annual report and economic development. At the recommendation of Chairman Burton, this was held over until the April 24, 1984 meeting in order to obtain proposals, timetables, and samples from Appalachian Power and Norfolk and Western since they provide this service at no cost. ~ ~ 4-10-84 51 <i I Supervisor McGraw asked John Chambliss if the studies have been submitted on residential versus commercial property values, and Mr. Chambliss reported that the real estate office has summarized this and a report will be prepared. County Administrator - Donald R. Flanders reviewed the information on the County Vehicle Maintenance Control Program. Supervisor McGraw moved to approve the vehicle classification and numbering system, and the motion carried by a unanimous voice vote. IN RE: APPOINTMENTS Supervisor Minter moved for the appointment of Betty Lucas, Director of the Social Services Department, to serve on the Human Service Committee for a one-year term effective March 1, 1984. The motion carried by a unanimous voice vote. I IN RE: WORK SESSIONS Timothy Gubala reported that the Planning staff has prepared a work schedule and outline for the regulation of mobile homes, and the Board concurred with the schedule.
