The Board of Supervisors of Roanoke County, Virginia, met this day in
open session at the Roanoke County Administration Center, Roanoke, Virginia, this
being the second Tuesday and the first regular meeting of the month of February,
1983.
IN RE: CALL TO ORDER
Chairman May W. Johnson called the meeting to order at 3:12 p.m. The
roll call was taken.

Chairman Johnson indicated that Supervisor Minter would be arriving late.
Supervisor Minter arrived at 3:15 p.m. Chairman Johnson entertained a motion to
enter into executive session pursuant to the Code of Virginia, Section 2.1-344 (a), (1),
(2), (4), and (6) to discuss personnel, real estate, industrial development, and legal
matters.

Mr. Doug Prillaman was present and expressed his concern as to what the procedure
would be if there was no home built on this location after two years. Chairman
Johnson advised that the permit would have to be renewed if this were the case.

RATE INCREASE REQUEST BY SALEM CABLE TV
County Administrator Donald R. Flanders presented a letter from Mr. Ray Robrecht,
attorney, for information concerning the request of Salem Cable TV for a rate increase

pursuant to the request of the Cable vision Committee. On motion by Supervisor
Minter and approved by a unanimous voice vote, the request will be continued until
March 22, 1983.
IN RE: CITIZENS COMMENTS
There were no citizens present desiring to comment.
IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Minter gave a brief report on the water control meeting he

attended earlier in the day. A $25,000 federal and state grant is being sought to
analyze the different streams and their uses in the Roanoke Area. This project would
not require any loc'al funds.
Supervisor Burton had not report.
Supervisor Nickens had no report.
Chairman Johnson presented the following proclamation of appreciation to

the Big Brothers/Big Sisters of Roanoke Valley. Mr. Robert Stone, Vice President,
and Mr. Wayne Davis, Executive Director accepted the proclamation on behalf of the
organization.
PROCLAMATION
WHEREAS, there are a large number of girls and boys in the Roanoke Valley
who suffer from a lack of adequate adult time and attention because of death, divorce,
or other causes; and

WHEREAS, this deprivation can cause serious problems for the children and
for the community; and
WHEREAS, there is a dire need for service that can give such children the

with their unique one-to-one concept of friendship.
NOW, THEREFORE, I, May W. Johnson, Chairman of the Board of Supervisors
of Roanoke County, Virginia, do hereby proclaim February 13 - 19, 1983 as
BIG BROTHERS/BIG SISTERS APPRECIATION WEEK
IN THE County of Roanoke and call upon the citizens of the Roanoke Valley to
support the Big Brothers/Big Sisters Movement.

Chairman Johnson also presented a proclamation to Shenandoah Homes,
Incorporated, recognizing their service to the elderly citizens of the Roanoke Valley.

Chairman Johnson requested that a road sign be placed at the intersections
of Bernard Drive both at 419 and Penn Forest Boulevard. This is the road on which i
the Travelers Insurance Building is located.
Mr. Fred Bullington, owner of the Tanglewood Holiday Inn has requested that
an investigation be conducted for the need of a traffic light at the intersection of
Ogden and Starkey Roads at Tanglewood Shopping Center. Chairman Johnson requested
Superintendent of Public Facilities, Mr. John R. Hubbard, investigate this need since
a portion of the land has just been rezoned for a shopping center.
Chairman Johnson will present a signed petition concerning requests for Cable
Television in the Bridlewood Section to the County Administrator after the meeting.
IN RE: REPORTS OF OFFICERS, DEPARTMENTS AND COMMITTEES
County Attorney - Mr. James Buchholtz called to the Board's attention the
fact that one or more members have inquired about the opinion of the Attorney
General that was supported in the paper the past week. Mr. Buchholtz's office did
not receive a copy of the opinion. However, pursuant to the Board's action of the
meeting of January 25, 1983, all salary adjustments have been made and corrected as
required by law.

County Administrator - Donald R. Flanders reported that the letters from
Mr. Charles Saul and McGuire, Woods, & Battle Law Firm regarding the public hearing
for Industrial Revenue Bonds for industries will be held over until February 22, 1983,
a Work Session at 4:00 p.m. will be held on that date, at which time the federally
required public hearing process will be reviewed.
Delegate Richard Cranwell asked Supervisor Johnson what the County's
position was on Senate Bill 203 regarding tax-exempt status. Supervisor Nickens
moved for acceptance of the following resolution which states the Board's position
on Senate Bill 203:
RESOLUTION NO. 83-23 STATING ROANOKE COUNTY'S POSITION
RELATING TO SENATE BILL NO. 203
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the Board has not heretofore been apprised as to the nature and intent
of Senate Bill No. 203; and is therefore unable to favorably comment upon or endorse
said bill; and
2. That the Board opposes any legislation which grants tax-exempt status to
any person, corporation, institution, or entity not qualified therefore by both federal
and state regulations and guidelines, and which infringes upon the taxing authority
of Roanoke County; and
3. That an attested copy of this resolution be forthwith forwarded to the
members of the Senate and House of Delegates representing Roanoke County.

The Administrator also reported that progress is being made on methods to
provide a system for gas distribution control for Roanoke County and the school
system if the School Board desires to participate.

Department of Development- Superintendent, Timothy W. Gubala reported on the
noise caused by dune buggies being run on the Beasley property in the Ponderosa
Park area. Chairman Johnson wrote to the person who made the complaint and I
advised him to secure a warrant as the County would have to have constant surveillance
for any action to be taken by the County. Mr. Nick Beasley presented a signed
petition which indicated that the noise is not bothering most residents in the area.
Every neighbor who signed it had no opinion nor complaint. Chairman Johnson moved
that the petition be received and filed. Motion carried. Supervisor Nickens moved
that the report be received and filed as the report indicated there are no violations
of the noise code. The motion was carried.

Superintendent Gubala requested that the Board concur with other member
government units and authorize Chairman Johnson to sign an application to be sent
to the Governor which would agree with the continued existence of the Fifth District
Employment and Training Consortium as presently structured and also consent to the
admission of the City of Salem as a member. Supervisor Nickens moved the Board
authorize Chairman Johnson sign the application which Ms. Carolyn Barrett brought
to the meeting. After Chairman Johnson signed the document, Supervisor Nickens
moved that an appropriation resolution be prepared and spread in the minutes.
RESOLUTION NO. 83-24 AUTHORIZING THE CHAIRMAN OF THE BOARD
OF SUPERVISORS OF THE COUNTY OF ROANOKE TO EXECUTE A CERTAIN
APPLICATION RELATING TO THE FIFTH DISTRICT EMPLOYMENT AND
TRAINING CONSORTIUM.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as

1. That May W. Johnson, Chairman of the Board of Supervisors of Roanoke
County, Virginia, be, and hereby is, authorized and directed to sign a certain application
on behalf of Roanoke County agreeing to continued existence of the Fifth District

Employment and Training Consortium in keeping with said Consortium's present
jurisdictional configuration as the delivery agency pursuant to the Job Partnership
Training Act, the same to be effective from and after October 1, 1983, as made and
provided by law; and
2. That the Board further consents to the admission of the City of Salem as
a member of the Fifth District Employment and Training Consortium upon proper
application therefore by the appropriate authority of the City of Salem.

A water planning grant application in the amount of $10,000 is to be prepared
and submitted to secure funds from the State Water Control Board. The application
will also indicate that 25% of the grant funds will be provided by Roanoke County.

RESOLUTION NO. 83-25 AUTHORIZING ROANOKE COUNTY TO PREPARE
AND SUBMIT A CERTAIN GRANT APPLICATION SEEKING FUNDS FROM
THE STATE WATER CONTROL BOARD FOR A WATER QUALITY PLANNING
PROJECT.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That a certain grant application on behalf of Roanoke County seeking a
grant of $10,000 for a water quality planning project from the State Water Control
Board be, and such grant application hereby is, approved and authorized for preparation
and submission; and
2. That such application shall be executed on behalf of Roanoke County by the
County Administrator upon form approved by the County Attorney and shall contain
among other provisions that 25% of such grant funds shall be provided by Roanoke
County; and
3. That an attested copy of this resolution shall be forwarded along with said
grant application to the State Water Control Board.

Superintendent Gubala requested that the Board's objection to Senate Bill
#14 be withdrawn or held over. Supervisor Burton indicated it might be too late and
perhaps not in the County's best interest not to voice the Board's opposition.
Supervisor Burton agreed with Mr. Gubala's position on the State override of local
authority in Senate Bill #14 and requested that a letter and a copy of the resolution
be forwarded to the legislative delegation and that this matter be considered in
executive session.
Department of Fiscal Management - Superintendent, John Chambliss reported that
further consideration will be given to the issue of real estate reassessments near the
airport after the runway extension has been completed and it can be better determined
exactly what the impact will be. Supervisor Minter moved that the report be received
and filed, and the motion was carried by a unanimous voice vote.
Mr. Chambliss recommended that 50% of a total $15 claim be reimbursed to
Mr. Bill Bailey for the loss of three Coturnix quail which were killed by dogs. On
motion by Supervisor Burton and carried by a unanimous voice vote, $7.50 will be
reimbursed.
Chairman Johnson requested the County Attorney to write an ordinance
changing the policy on establishing reimbursement fees for damages. This report
should be verified by the Animal Control Officer. Chairman Johnson directed that
the County Attorney determine if it would be legal to adopt a resolution authorizing
handling of animal claims by the County Administrator.
The final statement for the period ending December 31, 1982, was discussed,
and it was decided that the Board is to be provided with a monthly financial report.
Supervisor Nickens requested John Chambliss provide a copy of the total
cost of operation of the Board of Equalization.

Superintendent Chambliss reported that two firms' proposals were considered
for the County and School Health and property and casualty insurance. The Insurance
Committee has recommended a 3-year contract be awarded to Industrial Insurance
Management Corporation from Richmond. On motion by Supervisor Minter, the
following resolution was adopted:
RESOLUTION NO. 83-26 ACCEPTING A CERTAIN PROPOSAL MADE TO
THE COUNTY OF ROANOKE FOR INSURANCE CONSULTING SERVICES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That that certain proposal of Industrial Insurance Management Corporation
in the amount of $7,500, plus travel expenses, for the first year, being the lowest
and best proposal received for insurance consulting services, upon all and singular
the terms and conditions of the invitation to bid, the specifications of the County
of Roanoke, the bidder's proposals, and the provisions of this resolution, be, and the
same hereby is, ACCEPTED; and
2. That the County Administrator is hereby authorized and directed to enter
into a contract upon a form approved by the County Attorney for this service; and
3. That all other bids for this service are hereby rejected and the County Clerk
is directed to so notify such bidders and express the County's appreciation for the
submission of their bids.

Mr. Chambliss requested that the normal bid procedures be waived for the
purchase of a car from a rental agency for the Youth and Family Services Division of
the Sheriff's department. Supervisor Burton moved that the Procurement Office be
authorized to secure proposals and make a recommendation to the Bid Committee who
would authorize this purchase not to exceed $5,027 budget amount, and that the Bid
Committee report action for approval at the next Board Session. The motion was

Department of Public Facilities - Superintendent, John Hubbard reported the additional
information concerning the need and funding for reconstruction of the intersection
of Orlando and Palm Valley Roads. Mr. F. C. Altizer, Jr., of the Virginia Department
of Highways and Transportation, recommended that since the problem was excessive
speeds, the citizens need to be made aware of the speed limit. Supervisor Minter made
a motion that the intersection be reconstructed at a cost of $12,000. A substitute
motion was made by Supervisor Nickens that Mr. Hubbard's staff consult with the
Highway Department to make certain that the signs are posted property and are
appropriate for the highway configuration that exists; and that if all this is true, that
no further action be taken. The motion carried by the following roll call vote:

Supervisor Minter made a motion that a letter be sent to the Sheriff's
Department calling special attention to speeding in the area. The motion carried by

John Hubbard reported that construction of 431 feet of gravity sewer line
for the Tinker Creek Interceptor project will generate a cost of $16,099 using Aaron
Conner General Contractor, Inc. He recommended submitting the cost to EPA for
possible funding; and if funding is approved, the County's share of this amount will
be $4,024.75. On motion by Supervisor Minter, the following resolution was adopted:

RESOLUTION NO. 83-27 APPROVING CHANGE ORDER NO. 14 TO THE
COUNTY'S CONTRACT WITH AARON J. CONNER, GENERAL CONTRACTOR,
INC. FOR CONSTRUCTION OF THE TINKER CREEK INTERCEPTOR,
PROJECT 79-5-S.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That Change Order No. 14 to the County's contract with Aaron J. Conner,
General Contractor, Inc. for construction of the Tinker Creek Interceptor, Project 79-
5-S, be, and hereby is approved as herein set forth in the following words and figures,

IN RE: CALL TO ORDER - OPEN SESSION
At 9:28 p.m. Supervisor Burton moved to return to open session. The motion
carried by a unanimous voice vote. Supervisor Burton moved to adopt the prepared
resolution which stated the Board's opposition to Senate Bill #14.
RESOLUTION NO. 83-28 STATING THE OBJECTION OF THE BOARD OF
SUPERVISORS OF ROANOKE COUNTY TO SENATE BILL #14
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the Board does hereby state its most strenuous objection to Senate Bill
#14 and would strongly urge and request that the delegation in both the Senate and
House of Delegates from Roanoke County take all appropriate measures to defeat
said measure; and
2. That the County Administrator be, and hereby is, directed to forthwith
forward attested copies of this resolution to all the members of both the Senate and
House of Delegates delegations from Roanoke County.
Adopted by the following roll call vote:
AYES: Supervisors Minter, Burton, Nickens, and Johnson
NA YS: None
ABSENT: Supervisor Myers
IN RE: EXECUTIVE SESSION
At 9:35 p.m. Supervisor Nickens entertained a motion to again go into
executive session pursuant to the Code of Virginia, Section 2.1-344(a), (2) and (6) to
discuss real estate and legal matters. The motion carried by a unanimous voice vote.
IN RE: RETURN TO OPEN SESSION
At 10:55 p.m. Supervisor Minter moved to return to open session. The motion
carried by a unanimous voice vote.
On motion by Supervisor Nickens the County Administrator was authorized
to enter into agreement with "Miss Utility" per the following prepared resolution:

RESOLUTION NO. 83-29 AUTHORIZING THE COUNTY TO ENTER INTO A
CONTRACT WITH "MISS UTILITY OF VIRGINIA" FOR THE PURPOSE OF
PROVIDING REQUIRED INFORMATION AS TO THE LOCA TION OF
UNDERGROUND UTILITIES.
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as

follows:
1. That the County be, and hereby is, authorized to contract with "Miss Utility
of Virginia" for the purpose of providing required information as to the location of
underground utilities as required, at a sum not to exceed $2800 annually; and
2. That the County Administrator be, and hereby is, authorized to enter into
the requisite contractual agreement with "Miss Utility of Virginia" upon a form
approved by the County Attorney.
