Roanoke, Virginia 24015 May 24, 1983 The Board of Supervisors of Roanoke County, Virginia, met this day in open session at the Roanoke County Administration Center, Roanoke, Virginia, this being the fourth Tuesday and the second regular meeting of the month of May, 1983. IN RE: CALL TO ORDER At 3:10 p.m. Chairman Johnson called the meeting to order. The roll call was taken: MEMBERS PRESENT: Chairman May W. Johnson, Supervisors Athena E. Burton, Gary J. Nickens IN RE: EXECUTIVE SESSION Chairman Johnson entertained a motion to go into Executive Session pursuant to the Code of Virginia, Section 2.1-344(a) (1), (2), and (6) to discuss personnel, real estate and legal matters. The motion was made by Supervisor Burton and carried by a unanimous voice vote. Supervisor Nickens arrived at 3:12 p.m. IN RE: OPEN SESSION At 5:30 p.m. Supervisor Minter moved to go into open session. Chairman Johnson read a Resolution from the School Board of the City of Salem which expressed appreciation to the County of Roanoke for the years of faithful and efficient service in providing education opportunities for the students of Salem. Supervisor Minter moved that the resolution be received and filed, and the motion carried by a unanimous voice vote. Six of those officers would be assigned to Route 419 and Route 221, and four would be used on the parking lot. The motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Myers, Minter, and Johnson NAYS: None IN RE: CAVE SPRING HIGH SCHOOL ACADEMIC RECOGNITION Superintendent of Schools, Bayse Wilson, explained the criteria that was required for Cave Spring High School being selected as one of the top five high schools in the State of Virginia. Cave Spring High School Principal, Mr. Garland I Life, introduced students Michelle Bodley, Karen Keister, and Judy Porter along with a faculty advisor and Government teacher, Ms. Becky Mason. He also indicated that Cave Spring High School had been selected as one of the top three schools competing for national recognition. Supervisor Burton moved for the following prepared resolution: 706 5-24-83 RESOLUTION NO. 83-91 CONGRATULATING CAVE SPRING HIGH SCHOOL ON ITS SELECTION AS ONE OF FIVE SENIOR HIGH SCHOOLS IN THE COMMONWEALTH TO BE CONSIDERED IN THE NATIONAL SECONDARY SCHOOL RECOGNITION PROGRAM WHEREAS, Cave Spring High School has demonstrated its excellence by its I selection as one of only five senior high schools throughout the Commonwealth to I be considered for the National Secondary School Recognition Program; and I WHEREAS, in achieving this distinction, Cave Spring High School was judged on the following criteria, to-wit: clear academic and behavioral goals, order and discipline, high expectations for students, teacher efficacy, rewards and incentives for teachers and students, positive school environment, administrative leadership, community support, extent of concentration on academic learning time, frequent and monitored homework, regular and frequent monitoring of student progress, well- coordinated curriculum, variety of teaching strategies, and an opportunity for student responsibili ty . NOW, THEREFORE, be it resolved by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board does hereby extend its most sincere congratulations to I Cave Spring High School for its selection for consideration in the National Secondary School Recognition Program; and 2. That the Board does hereby express its deepest appreciation to the Administration, faculty and students of Cave Spring High School for a job well done; and 3. HOLLAND FOR A SPECIAL EXCEPTION TO PLACE A MOBILE HOME ON A 3.94 ACRE TRACT LOCATED ON THE NORTH ~DE OF STATE ROUTE 744 APPROXIMATELY 0.6 MILE FROM U.S. ROUTE 221 IN THE WINDSOR HILLS MAGISTERIAL DISTRICT. APPROVED 5-24-83 707 Mr. Gerald Holland was present. Since there were no objections, Supervisor Burton moved for approval of the permit, and the motion carried by a unanimous voice vote. I CONFIRMATION OF THE SALE OF CERTAIN PARCELS OF REAL ESTATE OWNED BY THE COUNTY OF ROANOKE HERETOFORE OFFERED FOR SALE AT PUBLIC AUCTION DULY ADVERTISED AS MADE AND PROVIDED BY LAW. APPROVED Superintendent of the Department of Fiscal Management, told the Board that 17 parcels of land were offered for sale at the auction which took place on May 21, 1983 at 1:00 p.m. in the Roanoke County Administration Center Community Room. Approximately 150 people attended the auction. After staff review, seven bids were recommended for the Board's approval. That the County of Roanoke is hereby authorized and directed to enter into an option agreement with AMP Incorporated for the purchase of approximately 24.30 acres commonly known as New Tract "A" on Hollins Road (Virginia Route 115) in Roanoke County; and 2. That the County Administrator is hereby authorized and directed to execute said option agreement upon a form approved by the County Attorney. 3. APPROVED Mr. John Peters, of the Engineering Department, outlined the revisions of the construction fund priorities for the Secondary System of the State Highways for the fiscal year 1983-1984. Mr. Fred Altizer, of the State Department of Highways and Transportation, was present to answer any questions. Since no one was present for discussion, Supervisor Minter moved that a resolution be prepared by the County Attorney which would indicate the Board's approval of the priority listing, and that this resolution be spread in the Minutes. RESOLUTION NO. 83-94 APPROVING CONSTRUCTION FUND PRIORITIES FOR THE VIRGINIA DEPARTMENT OF HIGHWAYS AND TRANSPORTATION SECONDARY SYSTEM FOR ROANOKE COUNTY FOR FISCAL YEAR 1983-84 I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That pursuant to due notice and public hearing, the Board does hereby establish for fiscal year 1983-84 those certain construction fund priorities for the Virginia Department of Highways and Transportation secondary system of highways in Roanoke County as set out on that certain list of priorities with recommended amendments as presented to the Board at its meeting on May 24, 1983; and 2. That a copy of this resolution duly attested be forthwith forwarded to the Virginia Department of Highways and Transportation - Salem Residency office along with a duly attested copy of said priority list with amendments by the Clerk to the Board. " PUBLIC HEARING ON PROPOSED BUDGET FOR ROANOKE COUNTY FOR FISCAL YEAR 1983-1984, INCLUDING GENERAL REVENUE SHARING HELD OVER County Administrator, Donald R. Flanders, presented "Efforts to Bring Progress" - 1984-84 Fiscal Plan for the County of Roanoke, and requested final adoption of the budget at the June 14, 1983 meeting of the Board of Supervisors. Any changes by the Supervisors would be recognized at that time. Mr. Frank Ball spoke approving the proposed budget and requested adoption, with particular emphasis placed on the School Board Budget. Ms. Katherine Haynie, Ms. Jane Renick, and Ms. Anne Bickel, representing Planned Parenthood, requested reconsideration of their $5,000 request for support from Roanoke County for their educational services. Their request was previously denied by the Board at its May 16, 1983 Budget Work Session. No decision was made regarding this request. Mr. Richard P. Ioffreda, representing the Cave Spring American Little League, requested the Board's consideration of the Parks and Recreation area - in particular in Garst Mill Park where he feels space is already available which could be developed into another baseball diamond. This would take some of the burden off Hidden Valley. Supervisor Burton stated that this situation would be looked into; and Supervisor Nickens stated that the Board had, subject to the final approval of the budget, moved the allocation of $31,000 to Parks and Recreation. Mr. Darrell Shell and Mr. John Hubbard were requested to present their recommendations on how this money can be spent. Prior to the next budget work session, Supervisor Nickens requested cost justification for an additional auto mechanic to be supervised by County Schools to work the day shift effective July 1, 1983. Adoption of the new budget will be held over until the June 14, 1983, meeting according to State law. IN RE: CITIZENS COMMENTS AND COMMUNICATIONS The citizens from the Westward Lake Dam Area removed their request to present their petition to the Board pending the results of the engineering study. 1- 7 1 2 1 5-24-83 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Burton - requested that Magisterial Districts and specific locations be listed on all Department Reports. The Minutes of the Planning Commission should also include this information. Supervisor Minter - had no report. I Supervisor Nickens - had no report. Supervisor Myers - some citizens would like to purchase the Rock quarry on Route 612 from the County, and Mrs. Pedneau at 380-2805 should be contacted regarding this. The water tank lots on Loch Haven Drive and Peters Creek Road near the Hollins Fire Station need to be mowed, and debris needs to be removed from the Peters Creek location. Supervisor Johnson - expressed her thanks for all the support she received during her recent illness. IN RE: REPORTS OF OFFICERS, DEPARTMENTS, AND COMMITTEES I County Attorney - requested an Executive Session to discuss a legal matter. Resolution #83-88 which was adopted May 10, 1983, which authorized submission of a certain grant application for funding for energy conservation at Oak Grove and Glen Cove Schools. There was an error in this resolution which authorized the County Administrator to execute the agreement and it should have stated the County School Board. This has been corrected in the following prepared resolution. Supervisor Burton moved for adoption of the following resolution: RESOLUTION NO. 83-96 REPEALING RESOLUTION NO. 83- 88 AND AUTHORIZING THE SUBMISSION OF A CERTAIN GRANT APPLICATION FOR FUNDING FOR ENERGY CONSERV ATION MEASURES AT OAK GROVE AND GLEN COVE ELEMENTARY SCHOOLS BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That resolution No. 83-88 adopted May 10, 1983 be, and hereby is, I repealed; and 2. That the Roanoke County School Board is hereby authorized and directed to cause to be prepared and submitted a certain grant application in the amount of <>. .. I I I 5-24-83 713 $26,380.00, the same to be used for funding for energy conservation measures at Oak Grove and Glen Cove Elementary Schools; and 3. That the Board does hereby express its intent to appropriate a sum not to exceed one-half of the grant amount, to-wit: $13,190.00 as the County's share of such project; and 4. That the Roanoke County School Board be, and hereby is, authorized to execute the necessary documents on behalf of Roanoke County for this grant application. Adopted by the following roll call vote: AYES: Supervisors Burton, Nickens, Myers, Minter, and Johnson NAYS: None County Administrator - Presented Mr. Leonard Leask, Director of the Utility Division, who reported on the inclusion of Sylvan Brook Road in the secondary highway system. Mr. Leask requested $200 plus labor to replace a private water line provided all owners sign a liability release. Supervisor Burton moved for the authorization of this expenditure, and the motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Myers, Minter and Johnson NAYS: None Fralin and Waldron has requested that they be authorized to rent the Pollard Property for corn crops while the County is trying to market this property as an industrial site. Supervisor Nickens moved for the following prepared resolution: RESOLUTION NO. 83-95 AUTHORIZING THE COUNTY ADMINISTRATOR TO EXECUTE A CERTAIN AGREEMENT RELATING TO CERTAIN LAND OPTIONED BY THE COUNTY OF ROANOKE FROM FRALIN &: WALDRON, INC. KNOWN AS THE "POLLARD TRACT" BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain agreement dated May 16, 1983 by and between the Board of Supervisors of Roanoke County, Fralin and Waldron, Incorporated, and 714 · 5-24-83 George H. Seibel relating to the planting and harvesting of certain crops on a certain piece of property heretofore optioned by Roanoke County from Fralin and Waldron, Inc., the same being known and designated as the "Pollard Tract", be, and such agreement hereby is, APPROVED; and 2. That the County Administrator be, and hereby is, authorized to execute I said agreement on behalf of the County of Roanoke upon a form approved by the County Attorney. A revised job description has been prepared for the recruitment of a new Building Official, and was presented by Mr. Flanders to the Board for review. Regarding the AMP Option, this property will continue to be used as playgrounds until September 1, 1983. Department of Public Facilities - Mr. Leonard Leask gave an oral report indicating that new sewage and disposal regulations became effective November 1, 1982. These regulations do not apply to the County Utility Department nor the County sewage system. They were made primarily to apply to installation of septic I tanks in order to improve the design and installation of septic systems. There have been no complaints regarding the permit process, and the seven-page permit has been shortened to four pages. I I I 5-24-83 71S , John Peters presented a petition requesting that State Route 1871 be named Keaton Drive in order to eliminate rural mail service. Supervisor Minter moved for the following prepared resolution: RESOLUTION NO. 83-97 NAMING A CERTAIN STREET, LYING AND BEING IN THE HOLLINS MAGISTERIAL DISTRICT OF ROANOKE COUNTY AS KEATON DRIVE WHEREAS, the Board of Supervisors of Roanoke County pursuant to Section 15.1-379 of the 1950 Code of Virginia, as amended, is vested with the authority to name streets, roads and alleys within the County subject to provisions of Section 33.1-12 of the 1950 Code of Virginia, as amended. NOW, THEREFORE, be it resolved by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain road situate, lying and being in the Hollins Magisterial District designated as State Route 1871 beginning at its intersection with State Route 1895 and traversing northerly along the length of said State Route 1871 to its point of terminus, be, from and after May 24, 1983, and hereby is, designated and named Keaton Drive; and 2. That a duly attested copy of this resolution be forthwith forwarded to the State Department of Highways and Transportation, Residency Office, Salem, Virginia. Gubala presented a "Special Use Permit" request for a landfill from Mr. Ellis M. Paris, Jr. This was carried over from the May 10, 1983 meeting in order to give the Engineering Department an opportunity to look over the dumping situation and draw up a plan for siltation control. The field investigation revealed that there was a pipe under the road, and Mr. Paris will need a permit from the State Highway Department to dump in this location. Supervisor Myers moved that the permit be granted to allow Mr. Paris to complete the area that has been dumped on with siltation control, and 7 1 6t 5-24-83 that no additional dumping be permitted on other areas of the property. The motion carried by the following roll call vote: A YES: Supervisors Burton, Nickens, Myers, Minter, Johnson NAYS: None I IN RE: APPOINTMENTS On motion by Supervisor Burton, Mrs. Elizabeth Stokes was reappointed as Mrs. Johnson's designated representative to the Total Action Against Poverty Board of Directors for a three-year term effective June 14, 1983, and expiring June 14, 1986. On motion by Supervisor Myers, Mr. E. Cabell Brand was reappointed as Mr. Myers' designated representative to the Total Action Against Poverty Board of Directors for a three-year term effective June 14, 1983, and expiring June 14, 1986. This is a joint appointment with the City of Salem. On motion by Supervisor Burton, Dr. Harry C. Nickens was reappointed as the Board of Supervisors member of the Fifth Planning District Commission for a one-year term effective June 30, 1983 and expiring June 30, 1984. Mr. Stephen A. Musselwhite was appointed to serve as a County-wide representative to the Virginia Western Community College Board on motion by Supervisor Nickens. This is a four-year term beginning June 30, 1983 and ending June 30, 1987. Mrs. Sylvia Faw was reappointed to serve as a County-wide representative on the Virginia Western Community College Board for another four-year term from June 30, 1983 to June 30, 1987, on motion by Supervisor Nickens. All of the above appointments were approved by unanimous voice votes.
