The Board of Supervisors of Roanoke County, Virginia met this day in open
session at the Roanoke County Administration Center, Roanoke, Virginia, this being
the fourth Tuesday and the second regular meeting of the month of June, 1983.
IN RE:
CALL TO ORDER
Chairman Johnson called the meeting to order at 3:25 p.m. The roll call
was taken:

IN RE:
EXECUTIVE SESSION
Chairman Johnson entertained a motion to go into Executive Session
pursuant to the Code of Virginia, Section 2.1-344(a), (1), (2), and (6) to discuss
personnel, real estate, and legal matters. Supervisor Burton made the motion, and
it carried by a unanimous voice vote.
IN RE:
OPEN SESSION - WORK SESSIONS
At 4:23 p.m. Supervisor Minter moved to return to open session, and the
motion carried by a unanimous voice vote.
Work Session - Building Official's Job Description - Mr. Robert A. Franklin
will be retiring on August 1, 1983. The Personnel Officer, Mr. Keith Cook,
recommended a proposed revision to the current job description which would include
upgrading of educational requirements, and knowledge and skills related to structural
engineering. Supervisor Burton moved to advertise the position within the salary
range of a Grade 35 and considering a combination of the above listed requirements.

The motion carried by a unanimous voice vote. Superintendent of the Department
of Development, Timothy W. Gubala recommended Mr. Skip Nininger to serve as
Acting Building Official until the position is filled; and it was decided that this
would be further discussed in Executive Session.

Work Session - Subdivision Ordinance - Timothy W. Gubala and County
Attorney James E. Buchholtz, have completed a review of the proposed Subdivision
Ordinance and have incorporated their comments into the draft for the Supervisors'
review. Mr. Maury Strauss, of Strauss Construction Company, Mr. Buford T. Lumsden
and Mr. John Parker, of Buford T. Lumsden & Associates; and Mr. Jim Beavers of
Fralin and Waldron were present and participated in the discussion. This work
session will be continued for further discussion, particularly in regards to signs at
a future time.

RESOLUTION NO. 83-110.i CONGRATULATING ELIZABETH
W. STOKES ON COMPLETION OF HER TERM AS PRESIDENT
OF THE NATIONAL ASSOCIATION OF COUNTY RECORDERS
AND CLERKS
I
WHEREAS, Elizabeth W. Stokes has served the County of Roanoke and its
courts for a number of years as the Clerk to the Circuit Court of Roanoke County,
her term of office having originally commenced on January 1, 1968, from which time
she has continuously served in such capacity; and
WHEREAS, Elizabeth W. Stokes, has served as President of the National
Association of County Recorders and Clerks with honor and distinction for the
requisite term pursuant to the Association's by-laws.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Roanoke
County does extend to Mrs. Elizabeth W. Stokes, Clerk of the Circuit Court of
Roanoke County, its most sincere and genuine congratulations upon her most successful
and exemplary service as President of the National Association of County Recorders
and Clerks, and the Board does further express its deepest wish for Mrs. Stokes'

continued success.
BE IT FURTHER RESOLVED that a duly authenticated copy of this resolution
appropriately displayed be forthwith forwarded to Elizabeth W. Stokes.

IN RE:
PUBLIC HEARINGS
VIRGINIA COMMUNITY DEVELOPMENT BLOCK GRANT
PROGRAM GRANT APPLICATION AND RESOLUTION
HELD OVER
Mr. Bud Powell, 2326 Sourwood Street, N.E., Roanoke, Virginia; Mr. Buddy
Davis, One Homestead Lane, N.E., Roanoke; and Mr. Bob Anderson, 6010 Ponderosa
Circle, S. W., Roanoke, spoke in opposition to the grant application for industrial
development and expressed their concerns that the Board is considering action without
informing the citizens of their intent. The citizens also felt that industrial
development would result in increased taxes to them. Supervisor Minter moved to
table the grant application for 30 days to provide some time to review the application
I
and meet with the citizens. Supervisor Burton offered a substitute motion that the
Board deny the grant application in order to give the Board a chance to thoroughly
work with the people who are affected, listen to their concerns, and come to a
common ground. The motion carried by the following roll call vote:

IN RE:
CITIZENS COMMENTS AND COMMUNICATIONS
Mrs. Carolyn Black, an employee of the Roanoke County Department of
Social Services reported that for three months the air conditioning/heating units on
the third and fourth floors of the Salem Bank and Trust Building, 220 East Main

Street, Salem, Virginia, which is the location of the Social Services/Welfare
Department, have not been operating. Since there are no windows to be opened,
the office temperatures have soared to as high as 1030. This is causing an intolerable
situation and a serious health hazard. Since a bankruptcy problem is involved,

Supervisor Burton moved that the Administrative staff investigate the options for
relief and take whatever emergency actions are necessary to alleviate the problem

until it can be discussed at a future meeting. The motion carried by a unanimous
voice vote.
IN RE:
REPORTS AND INQUIRIES OF BOARD MEMBERS
Supervisor Burton - requested an investigation into the controls and
restrictions of itinerant merchants. She also requested another investigation on
restrictions for placement of satellite dishes used for home TV reception. Information
was also requested on the status of custodial service and building maintenance and
repairs with the schools. Supervisor Burton moved that Board members be put on
an industrial contact team along with staff and professional representatives until a
regional team can be coordinated. Supervisors Minter and Nickens felt this was
premature. County Administrator, Donald R. Flanders, expressed his support for the

establishment of this committee. The motion carried by the following roll call vote:

Supervisor Minter - has received a report from the Sheriff's Department
that Mr. Ron Stoots, of the Virginia Department of Highways and Transportation has
indicated that a request has been filed for two "No Thru Traffic" signs for Routes
604 and 605 in Botetourt, and that it should be no problem to request one for the
truck traffic on Plantation Road.
A petition was received from the residents of Sunnybrook Subdivision #1
requesting that fire hydrants be provided for the subdivision. The petition was
forwarded to the Superintendent of the Department of Public Facilities, John Hubbard.

Supervisor Minter also distributed the information he received on the
meetings of the Roanoke Valley Cablevision Committee concerning the request for
a rate increase.

A reply has been received on the Attorney General's opinion regarding
the situation whereby students guilty of vandalism, melicious mischief, or misbehavior
can work off their behavior problems. The State law apparently does allow for this
provision, and the information was passed on to Superintendent of Schools, Bayes
Wilson.

Supervisor Myers - no report.
Supervisor Johnson - inquired from John Hubbard if a petition had been
received regarding Raintree Road since the meeting was held. Mr. Hubbard informed
her that no petition had been received, and that 10096 cooperation from all citizens
involved was necessary for this addition into the State system.
Supervisor Johnson reported that she recently attended a committee
meeting which was held for the purpose of establishing a youth haven for girls in
the area for the use by all the courts. She will keep the Board informed of progress
on this project.

IN RE: REPORTS OF OFFICERS, DEPARTMENTS AND COMMITTEES
County Attorney - At the previous request of the Board, James E.
Buchholtz reported that there are three methods of collecting delinquent taxes:
1. Litigation, whereby each piece of individual property is subject to
judicial sale. This is the most costly method.
2. Escheating of property, whereby property on which no taxes have
been paid for 10 years or more is considered abandoned property; the
escheater then sells the property, and it is put back on the tax rolls.
3. On property which taxes have not been paid for the last 6 to 10
years, there is a method whereby the property is reduced to judgment;
the judgment is docketed, and a lien is placed against any real estate or
property owned by that individual until judgment is satisfied.

Mr. Buchholtz recommended the third method as the most economically
feasible along with the excheating process when applicable.
Supervisor Minter requested that this be further discussed in Executive
Session.
Because of a court ruling of approximately 12 to 18 months ago, it is
necessary for an amendment to the State Law regarding the Traffic Code to be
adopted annually. Supervisor Nickens moved for the following prepared ordinance as
an emergency item.
ORDINANCE NO. 83-111 AMENDING THE ROANOKE COUNTY
CODE AND READOPTING SECTION 10-3.1, ENTITLED
ADOPTION OF STATE LAW; AND PROVIDING FOR AN
EMERGENCY-- ----
BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as
follows:
1. That the Roanoke County Code be, and hereby is, amended by readopting
Section 10-3.1 entitled Adoption of State Law to read and provide as follows:
Sec. 10-3.1. Adoption of State Law.
(a) Pursuant to the authority of Section 46.1-88 of the Code of Virginia, all
of the provisions and requirements of the laws of the state contained in Title 46.1
and Article 2 of Title 18.2 (Sections 18.2-266, et seq.) of the Code of Virginia,
except those provisions and requirements the violation of which constitutes a felony
and except those provisions and requirements which, by their very nature, can have
no application to or within the county, are hereby adopted and incorporated in this
chapter by reference and made applicable within Roanoke County. References to
"highways of the state" contained in such provisions and requirements hereby adopted
shall be deemed to refer to the streets, highways and other public ways within the
county. Such provisions and requirements, as amended from time to time, are hereby
adopted and made a part of this chapter as fully as though set forth at length
herein, and it shall be unlawful for any person within the county to violate or fail,
neglect or refuse to comply with any provision of Title 46.1 of the Code of Virginia
which is adopted by this section; provided, that in no event shall the penalty imposed
from the violation of any provision or requirement hereby adopted exceed the penalty
imposed for a similar offense under Title 46.1 of the Code of Virginia.
(b) All definitions of words and phrases contained in the state law hereby
adopted shall apply to such words and phrases, when used in this chapter, unless
clearly indicated to the contrary.
2. That in order to promote and protect the welfare and safety of the
citizens of Roanoke County an emergency is deemed to exist and this ordinance
shall be in full force and effect from and after July 1, 1983.

The School Board presented two resolutions declaring the Starkey School
and the Craig Avenue School to be surplus property. The official description and

plat of the Starkey School property was presented to the County Administrator.
Supervisors Nickens moved for the following prepared resolution which
conveyed the Salem School properties from Roanoke County to the City of Salem:
RESOLUTION NO. 83-114 AUTHORIZING THE COUNTY
ADMINISTRATOR TO EXECUTE A CERTAIN DEED
CONVEYING CERTAIN REAL ESTATE TO THE CITY OF
SALEM
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the Board, having heretofore entered into a certain contractual
agreement with the City of Salem to convey certain real estate formerly used as
school facilities by Roanoke County, does hereby authorize that the conveyance of
those certain former school facilities of Roanoke County, to-wit: Academy Street,
Andrew Lewis, Broad Street, G. W. Carver, Central Avenue, Conehurst, East Salem,

South Salem, and West Salem, be conveyed to the City of Salem pursuant to said
contractual agreement; and
2. That the County Administrator be, and hereby is, authorized and directed
to execute on behalf of Roanoke County a certain deed conveying the hereinabove
mentioned parcels of real estate to the City of Salem, which deed shall be in form
approved by the County Attorney.

RESOLUTION NO. 83-115 AUTHORIZING ROANOKE COUNTY
TO ENTER INTO A CERTAIN CONTRACT FOR UTILIZATION
OF THE CRISIS INTERVENTION CENTER OPERATED BY THE
CITY OF ROANOKE AT 836 CAMPBELL AVENUE IN THE
CITY OF ROANOKE

BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,
as follows:
1. That the County of Roanoke be, and hereby is, authorized to enter into
a certain contract with the City of Roanoke to utilize the Crisis Intervention Center
in the City of Roanoke for the temporary care, services and board of juveniles
referred by the Juvenile and Domestic Relations District Court of Roanoke County,

give an oral report on the construction of the new courthouse. A change order is
needed to delete the Halon system, increase support for the floor and coping.
Supervisor Burton moved that an appropriation resolution authorizing these three
changes be prepared and spread in the Minutes.

At 9:15 p.m. Chairman Johnson called for a recess to review samples of
brick, carpet, etc. for the new courthouse.
IN RE:
RECONVENEMENT
At 9:50 p.m. the meeting reconvened. Supervisor Myers moved to proceed
with the brick, the carpet, and the entire color scheme, and the motion carried by
a unanimous voice vote.
Mr. Bob Frye then reported on the water marks which are visible on the
brick on the jail building and the concern for structural damage. Some recaulking
and repairing of the leak around the metal pocket in the wall have been completed.
Tests by the brick company and the Brick Institute of America have indicated that
this should not present any significant problems. It has been determined that there
are no construction defects, and that these water marks are apparently typical in
this type of brick.
Supervisor Nickens moved for the following prepared resolution authorizing
the exercise of an option on the Rosenberg property which is adjacent to the west
side of the County Administration Center.
RESOLUTION NO. 83-117 AUTHORIZING THE EXERCISE OF

1. That that certain option agreement bearing date of June 14, 1983, by
and between Morton C. Rosenberg and the Board of Supervisors of Roanoke County
granting unto the County an option to purchase a certain piece or parcel of land
being all of Lot 5, Section 4 according to the map of Mount Vernon Heights be, and
said option hereby is, directed to be exercised on behalf of Roanoke County by the
County Administrator; and
2. That the exercise of such option shall be accomplished by notice in writing

Department of Development - Superintendent Timothy W. Gubala explained
that two part-time employees in the Air Pollution Control Office have resigned in
addition to the recent death of the Air Pollution Control Officer, Carter Bradley.
Mr. Gubala requested the hiring of one full-time person to operate the Department at
a Grade 21 and informed the Board that money was available from four different
sources to fund the salary of $9,552 and fringe benefits of $2,235. Since part-time
help has been utilized in the past and because there was no specific job description,
Supervisor Nickens moved to fill the position with one permanent/part-time person
at an hourly rate not to exceed 35 hours per week.
Supervisor Burton made a substitute motion to approve one full-time
additional person for the Air Pollution Control Office. The motion was defeated by
the following roll call vote:

Mr. Gubala requested that his staff be authorized to amend the Zoning

since there was no opposition from any member of the Board.
The report on the Virginia Community Certification Program was held over.
The Special Use Permit request for a landfill by C. H. Abe and K. K.
Mills will be continued until the July 12, 1983 meeting at the written request of

Since no one has viewed the site where Strauss Construction Company
had requested a permit for a landfill, Supervisor Nickens moved to carry this over
until the July 12, 1983 meeting. The motion carried by a unanimous voice vote.
Department of Public Facilities - Superintendent John Hubbard submitted
a resolution authorizing the acceptance of a proposal made by William C. Overman
Associates, P.C. to provide certain engineering analysis and professional services to
assist in the long-range plan of Roanoke County for water and sewer programmin
in negotiations with the other Valley governments. Supervisor Nickens moved for

Department of Finance - Superintendent John Chambliss reported that the
analysis of the County's general liability, workers' compensation, and auto insurance
has been received from Industrial Insurance Management Corporation. Mr. Sam
Rosenthal, of Industrial Insurance Management Corporation was present to answer
any questions.
In order to have coverages effective July 1, 1983, Mr. Chambliss requested
that a resolution be adopted for a combined insurance program with Chaney, Thomas,
Stephenson & Hill Agency of Roanoke, Virginia. This would combine the County
and the School insurance at a "net" premium cost of $221,973 and would result in
a considerable savings in premium dollars for Roanoke County. Supervisor Burton
moved for the approval of this combined insurance program and that the members
of the Board of Supervisors and the School Board be included in the workers'
compensation insurance and that a resolution be prepared and spread in the Minutes.
RESOLUTION NO. 83-121 ACCEPTING A CERTAIN
PROPOSAL TO PROVIDE CERTAIN INSURANCE COVERAGE
FOR ROANOKE COUNTY
BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia,

1. That that certain bid to provide general liability insurance, workmen's
compensation coverage, public officials liability insurance and fleet insurance for

such insurance coverages for Roanoke County all of which shall be upon form
