Members present: Chairman Robert E. Myers, Vice-Chairman Lawrence E. Terry, and Supervisors May W. Johnson, Edward C. Park, Jr. and T. M. White. AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None IN RE: REQUEST OF PAUL HOLLYFIELD TO PLACE A COMMERCIAL CAMPGROUND * IN THE AGRICULTURAL DISTRICT A-l ON A 16.5 ACRE TRACT ON * THE SOUTH SIDE OF STATE ROUTE 889 1/2 MILE WEST OF STATE *DENIED ROUTE 221 IN THE WINDSOR HILLS MAGISTERIAL DISTRICT. * Arthur Crush, Attorney, was present to support the request of Mr. Hollyfield. Mr. Crush informed the Board of plans to develop a campground area with all modern facilities for restrooms, hookups, etc. Access to said property would be by way of a private road and not crossing other properties. An unidentified citizen complained about the traffic that would be generated by the campground since the private road is narrow and winding. He felt this would a problem for the area. After some discussion, Supervisor Terry moved to approve the request which was denied by the following recorded vote. AYES: Supervisors Terry and Myers NAYS: Supervisors White, Johnson, and Park Chairman Myers stated he voted yes because he felt a campground was not bad in any community on this much acreage. BE IT FURTHER RESOLVED AND ORDERED, that the Clerk of this Board shall forthwith certify a copy of this resolution and order to the Secretary of the Planning Commission of Roanoke County, Virginia, and a copy to Timber- line Condominium Associates, a Virginia Limited Partnership, Petitioners. ~ 12-9-81 208 The foregoing resolution was adopted on motion of Supervisor May Johnson and upon the recorded vote as follows: AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None I IN RE: REQUEST OF TINKER HILL ASSOCIATES TO VACATE CERTAIN LOT * LINES IN CONNECTION WITH LOTS 14 THROUGH 20 OF DILLARD * APPROVED FARMS SUBDIVISION IN THE HOLLINS MAGISTERIAL DISTRICT. * Mr. John Wingfield was present to support this request and no one appeared in opposition. On motion of Supervisor White and the following recorded vote, the request was approved. FINAL ORDER NOW, THEREFORE, BE IT RESOLVED AND ORDERED that at this meeting of the Board of Supervisors of Roanoke County, Virginia, held on the 9th day of December, 1981, that the lot lines described below be permanently vacated as described as follows: The lot lines to be vacated are more particularly described as the eastern lines of Lots 15-20, both inclusive (being also the western lines of Lots 14-19, both inclusive) of the remaining portion of R. E. Dillard Farm, as shown on plat dated October 31, 1980, made by Raymond C. Weeks, CLS, a copy of which is attached hereto, and has been recorded in the Clerk's Office of the Circuit Court of Roanoke County, Virginia in Deed Book 1159, page 766. AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None IN RE: REQUEST OF ADAMS CONSTRUCTION COMPANY TO REZONE FROM RESIDENTIAL DISTRICT RE TO INDUSTRIAL DISTRICT M-2 A PARCEL OF LAND CONTAINING 112 ACRES LOCATED AT THE NORTHEASTERLY INTERSECTION OF INTERSTATE 1-581 AND 1-81* IN THE CATAWBA MAGISTERIAL DISTRICT. * ";~ * CONTINUED I * Talford Kemper, Attorney, was present to represent Adams Constructio Company and Richard Padgett, Attorney, was present, along with several citizen to oppose said request. Mr. Kemper presented a map of the area indicating the particular parcel requested to be rezoned. Also the surrounding area was I I I 12-9-81 209 highlighted and its zoning status. Mr. Kemper further informed that an industrial park was planned for the area but no particular manufacturers or companies have been contacted or inquired regarding location in the proposed park. The owner of the adjoining parcel, Strauss Construction, forwarded a letter (filed with the minutes of this meeting) to Adams Construction Company which cites their approval of rezoning with the buffer zone being rezoned to allow only M-l industry. They further state their view that this rezoning will have no material effect on the value of their land or sale of proposed homes. Mr. Padgett submitted a petition and letter (filed with the minutes of this meeting) for which area residents oppose this rezoning request. They feel there is inadequate water supply, that no particular use for the land was submitted to the Planning Commission, the buffer zone is not adequate, and nearly non-existent in some places, and access to the property is by way of a narrow state road which would not handle heavy traffic use. Mr. Jim Sumpter, resident of the area, spoke on behalf of those opposing the rezoning and recapped the outline of Mr. Padgett and reminded the Board to consider those residents already in the area. On motion of Supervisor Terry and a unanimous voice vote, this request was continued until the meeting of December 22. IN RE: ORDINANCE NO. 3029 AMENDING SECTION 19-3 OF THE ROANOKE COUNTY CODE ENTITLED LOCAL SALES TAX. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Section 19-3 of the Roanoke County Code is hereby ai'snded by the addition of the following paragraph to be inserted between the existing first and second paragraphs of this section. Said paragraph to read as follows: An exemption is hereby granted pursuant to Virginia Code Section 58-441.49:3 which removes the one per cent sales tax imposed by the County through Section 19-3 on the sales of artificial or propane, gas, firewood, coal or home heating oil used for domestic consumption. The term domestic consumption is hereby defined to mean the use of artificial or propane gas, firewood, coal or home heating oil by a~ individual purchaser for other than business, commercial or industrial purposes. This amendment to take affect December 9, 1981 I~ 12-9-81 210 Adopted on motion of Supervisor Terry and the following recorded vote. AYES: Supervisors \Vhite, Johnson, Park, Terry and Myers NAYS: None IN RE: RAFFLE PERMITS I On motion of Supervisor Terry and a unanimous voice vote, a raffle permit for 1981 for Achievers Association, the Jr. Achievement of Roanoke Valley, and fee for said permit was waived. On motion of Supervisor Johnson and a unanimous voice vote, the Ladies Auxiliary of Cave Spring Rescue Squad was approved to receive a raffle permit for 1981. IN RE: COUNTY ADMINISTRATOR County Administrator Don Flanders stated that he is most impressed with the County Seal (logo) adopted by the Board of Supervisors in July, 1968, but shocked to learn that we have no County Flag. Therefore, a display of the County Seal on various colored poster board was presented for consider- I ation of color as background for a flag. The Board unanimously concurred that Kelly green would be their preference. A County flag will be submitted to NACo organization to be placed on display in the headquarters lobby. On motion of Supervisor Terry and a unanimous voice vote, the Board adopted Kelly green as the color for County flags. He also suggested that tie tacks, charms and stick pins with the seal be made available for sale. Administrator Flanders also reviewed the list of activities for Supervisors and County staff for the month of December. Administrator Flanders further informed the Board that in reviewing the Supervisors' travel budget, he finds it necessary to appropriate $2,000.00 I to said account to cover expenses to various meetings to which the Board is committed. The following resolution was adopted. AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None I IN RE: CARVIN STREET WATER AND SEWER John Hubbard, Director of Engineering for Utility Dept., reminded the Board of a problem of poor quality water and of sewers backing up in the Carvin Street and Enon Drive area. Mr. Hubbard stated the recommendation that water and sewer lines be installed to alleviate the problem but that no money is budgeted for such capital improvement. Supervisor White moved that next year funds be provided in the budget for this particular capital improve- ment; adopted by the following recorded vote. AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None IN RE: RESOLUTION NO. 3031 AUTHORIZING THE COUNTY OF ROANOKE TO EXECUTE A CERTAIN DEED OF EASEMENT GRANTING APPALACHIAN POWER COMPANY AN EASEMENT ACROSS THE HUNTING HILLS BOOSTER STATION. I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County of Roanoke be, and hereby is authorized to grant a utility line easement to Appalachian Power Company across the property being used for the Hunting Hills Booster Station; provided however, that the County of Roanoke shall incur no financial liability as a result of its execution of said deed of easement; and 2. That the County Administrator is hereby authorized and directed to execute the aforesaid deed of easement on behalf of Roanoke County upon a form approved by the County Attorney. I AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None IN RE: TINKER CREEK INTERCEPTOR John Hubbard submitted a status report on the Tinker Creek Inter- ceptor indicating this matter is at a standstill until a decision is made by EPA relating to a bid protest by a pipe manufacturer. IN RE: CLAIM James Buchholtz, County Attorney, reminded the Board of a claim I they had which was "filed with the Administrator too late to get on the agenda and the Board needs to take some action on the claim." On motion of Supervisor Johnson and the following recorded vote, the claim was denied. AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None IN RE: RESIGNATION OF ASSISTANT COUNTY ADMINISTRATOR Bruce Mayer, Assistant County Administrator, read a prepared letter of resignation effective January 4, 1982 to those present and expressed his appreciation for his personal and professional relationship with the Count' and its employees. On behalf of the Board, Chairman Myers expressed to Mr. Mayer that I he had handled a most difficult job with professionalism and concern and had performed his duties well, and that the County is losing a good employee. Administrator Don Flanders also expressed thanks and appreciation fot the help Bruce had been during this transition period and wished him success with his future endeavors. James Buchholtz, County Attorney, further stated that it had been a privilege and pleasure to work with Mr. Mayer and hated to lose him. IN RE: ANIMAL CLAIM John Chambliss, Director of Finance, informed the Board of an animal I claim filed by Robert E. Henderson, Jr. for a calf killed by dogs on November 17, 1981 and that the amount of this claim for $75.00 is within the County guidelines. IN RE: RESOLUTION NO. 3032 AUTHORIZING ON BEHALF OF THE COUNTY OF ROANOKE THE ACCEPTANCE OF A CERTAIN PROPOSAL TO PROVIDE TO THE COUNTY CERTAIN FINANCIAL ADVICE AND ASSISTANCE RELATING TO THE SALE OF CERTAIN PUBLIC IMPROVEMENT BONDS AND RELATED ITEMS. I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain proposal made to the County of Roanoke by Horner, Barksdale and Company of Lynchburg, Virginia, to serve as financial advisor to the County in and about the sale of certain public improvement bonds, to-wit: Courthouse improvement bonds in an amount not to exceed $7 million and sewer improvement bonds in an amount not to exceed $6.7 million , upon all and singular the terms, provisions and conditions set out in said proposal being dated November 24, 1981, a copy of which is and shall remain on file in the office of the Clerk to the Board of Supervisors of Roanoke County, be, and hereby is ACCEPTED; and I 2. That the County Administrator be, and hereby is authorized and directed to execute on behalf of the County of Roanoke a contract embodying among other provisions all and singular the terms, conditions and provisions set forth and contained in the aforesaid proposal of Horner, Barksdale and Company of Lynchburg, Virginia, bearing dated November 24, 1981 on file as aforesaid for said financial services, all of which shall otherwise be upon form approved by the County Attorney. AYES: Supervisors Hhite, Johnson, Park, Terry and Myers NAYS: None IN RE: STEERING COMMITTEE - APPALACHIAN POHER COMPANY RATES John Chambliss informed the Supervisors of a meeting with the I Steering Committee of VACo on Friday December 4 regarding the recent request of Appalachian Power Company to increase rates to local governments and he worked with the VACo attorney to insure that proposals offered to local governments in southwest Virginia are unified and in the best interest of the governments. Parks and Recreation submitted a report on the landfill project for the Mt. Pleasant Park which has cost an additional $2,200.00 not anticipated originally. Mr. Shell requested this amount be appropriated to the budget. The department is planning roller skating parties to raise the needed $1,000.00 for improvements but would like the County to appropriate these funds for the present and said funds will be reimbursed. AYES: Supervisors White, Johnson, Park, Terry and Myers I NAYS: None IN RE: MUSE DRIVE County Engineer Gene Robertson further submitted a request for Muse Drive southwest from its intersection with Finney Drive (Rt. 1043) be submitteG to the Highway Department for acceptance into the Secondary Highway System. On motion by Supervisor Park and the following recorded vote. AYES: Supervisors White, Johnson, Park, Terry and Myers NAYS: None IN RE: FIRE HYDRANT - HEDGELAWN - PETTY ACRES AREA Supervisor White directed John Hubbard to check into the possibility of a fire hydrant being placed in the vicinity of Hedgelawn Street in Petty I Acres since the citizens of that area have requested this to be done. Mr. White also stated that the Northside High School Booster Club has presented a proposal of a 50/50 split of $3,200.00 with the County to install a drainage near the concession stand and track to alleviate a muddy situation caused by poor drainage. Supervisor Johnson inquired of Gene Robertson if he had viewed a road owned by a Mr. Cumby off Colonial Avenue; Mr. Robertson informed Mrs. Johnson that a problem with the road does exist but feels the Highway Department I will need to look into the matter. Fred Altizer, Engineer, Department of Highways and Transportation, will check on this and report to Mr. Robertson. Mrs. Johnson asked to be kept informed. IN RE: ORGANIZATIONAL MEETING On motion of Supervisor Park and the following recorded vote, the Board will convene January 2, 1982 at 10:00 a.m. to organize for the year 1982. Jimmy Robertson attended for the Annual Pedestrian Protection in Richmond, Virginia, on December 9, and the County was awarded a Safe-Pedestrian award for absence of any pedestrian fatalities during the past year period.
