Members present: Acting Chairman Lawrence E. Terry, and Supervisors May W. Johnson, Edward C. Park, Jr., and T. M. White. Members Absent: Chairman Robert E. Myers IN RE: CALL TO ORDER Acting Chairman Terry called the meeting to order at 6:00 p.m. IN RE: ITEMS SUBMITTED FOR INFORMATION ONLY On motion of Supervisor vfuite and a unanimous voice vote, the following items were received and filed. (a) Jail Report - Oct. 1981 (b) Treasurer's Reports - Sept. and Oct. 1981 (c) Election Report - Abstract of Votes (d) Report - Solid Waste Disposal in the Future (e) Financial Statement - Oct. 31, 1981 IN RE: RAFFLE PERMITS On motion of Supervisor Park and a unanimous voice vote, the following raffle permits were approved with fees waived: (1) Roanoke County School Food Service Assoc. (2) Clearbrook Elementary School PTA (3) Fort Lewis Rescue Squad (4) Vinton Sandlot Booster Club County Administrator Flanders advised the Board that Wayne Compton, Commissioner of Revenue, desires to issue as well as audit all raffle and bingo permits. County Attorney James Buchholtz stated that legislature pro- vides for the governing body to issue such permits and that it would be illega for Board not to issue same. Tim Gubala, County Planner, reviewed the proposed Ordinance for all present and Supervisor Johnson stated she had wiated some time for this Ordinance, she then moved to adopt the following amendment. ORDINANCE NO. 3023 fu~ENDING SECTION 21-15 (17) (h) AND SECTION 21-21 (10) (h) OF THE ROANOKE COUNTY CODE RELATING TO THE RENEWAL PROCEDURES FOR MOBILE HOMES. I BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Chapter 21, Zoning, Article II. A-I Agricultural District, Section 21-15, Permitted uses, (17) (h) be, and hereby is amended to read and provide as follows: Section 21-15. Permitted uses. In agricultural district A-l, any building to be erected or land to be used shall be for one or more of the following or similar uses: ,;'c * * i't (17) Mobile homes, provided a special exception has been granted by the board of supervisors, upon the following conditions: * '/< ~'< * I (h) A filing fee of five dollars shall be paid to the county administrator upon filing the application for such special exception. These special exceptions shall be valid for a period of two years. The decal issued shall be affixed to the trailer so as to be visible from the outside. However, in seeking applications for renewal, the applicant shall meet all conditions and requirements. If there is a violation of such conditions or neighborhood opposition to such a renewal, the renewal application shall be referred to the board of supervisors for a public hearing to determine whether the renewal shall be granted. AYES: Supervisors Johnson, Park, White and Terry NAYS: None ABSENT: Chairman Myers IN RE: MENTAL HEALTH SERVICES OF ROANOKE VALLEY Mrs. Jo Wirth was present to represent Mental Health Services of Roanoke Valley and informed the Board of their financial status and an annual report of services performed. A film of the programs conducted by Mental Health was shown to those present. The Board expressed their thanks for a job well done. IN RE: COUNTY ADMINISTRATOR Administrator Flanders gave an update on his activities as Adminis- trator since his arrival November 9th and requested the Board to inform him of any duties or reports of which he is unaware in relation to his position. 196 IN RE: 11-24-81 DATA PROCESSING DIRECTOR Mr. Flanders reminded the Board that the data processing director for the School Administration has resigned that position and recommended Harry Franks be appointed Director for the County as well as for the School Administration if that meets the School Board's approval. On motion of Supervisor Park and the following recorded vote, the Board concurred with Mr. Flanders' recommendation that Harry Franks be appointed Director of Data Processing for the County and the School Adminis- tration, upon approval by the School Board. AYES: NAYS: ABSENT: I Supervisors Johnson, Park, White and Terry None Chairman Myers REQUEST TO PURCHASE COUNTY-OWNED PROPERTY Charles Knapp, citizen, submitted a proposal of purchase (filed with the minutes of the meeting) for County-owned property located in back of IN RE: I the Hollins Public Library off Barrens Road and Peters Creek Road. Administrator Flanders informed the Board that a study is being conducted of all County-owned property to determine the present and future potential usage of such property. After some discussion, Supervisor Johnson moved to continue this matter until such study is completed and a report is reviewed by the Board; adopted by the following recorded vote. AYES: NAYS: ABSENT: IN RE: Supervisors Johnson, Park, White and Terry None Chairman Myers CITIZENS COMMITTEE FOR THE COURTHOUSE CONSTRUCTION I Administrator Flanders inquired of the Board as to whether the Citizens Committee for the Courthouse construction has fulfilled their duties or the direction in which they now should follow. Supervisor White directed the administrator to write the Committee members to thank them for a job well-done and moved to dissolve this Committee since their duties have been fulfilled; adopted by the following recorded vote. Therefore, Mrs. Johnson moved to change the regular Board meeting date of Dec. 8th to Dec. 9, 1981 and directed the County Attorney to so advertise that change; adopted by the following recorded vote. RESOLUTION NO. 3024 CANCELING THE BOARD OF SUPERVISORS MEETING TO BE HELD ON DECEMBER 8, 1981 AND RESCHEDULING SAME FOR DECEMBER 9, 1981. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the regular meeting of the Board of Supervisors scheduled for December 8, 1981 is hereby canceled; and 2. That the date of December 9, 1981 is hereby established as the date of said meeting in the place and stead of December 8, 1981; and 3. That all public hearings heretofore scheduled and advertised for December 8, 1981 shall be held December 9, 1981 without further advertisement as if same had been duly advertised for December 9, 1981; and 4. AYES: NAYS: ABSENT: IN RE: Supervisors Johnson, Park, White and Terry None Chairman Myers I PARKING TICKETS Supervisor Park stated he would like to direct a public hearing to be held to amend Code Section 10-10-(h) to direct that payment of parking tickets be made to the Treasurer of Roanoke County instead of the Finance Director and that all proceeds relating to the payments and collection of such fines be the responsibility of the Treasurer. Mr. Park moved this to be his motion and directed Mr. Buchholtz to advertise same for December 22nd meeting; adopted by the following recorded vote. AYES: NAYS: ABSENT: IN RE: Supervisor Johnson, Park, White and Terry None Chairman Myers I ROANOKE COUNTY EMPLOYEES' HEALTH PLAN REPORT John Chambliss, Director of Finance, reported the status of funds on the County's Health Insurance plan and that the plan is working favorably for the employees. He further stated other localities have inquired about the plan and are considering this route for insurance. Supervisor Johnson expressed her gratitude for the good job Mr. Chambliss has done with the insurance plan and its acceptance by the employees. She further directed Mr. Chambliss to prepare a report of the procedure to institute this insurance plan and forward to the Virginia Association of Counties in order to allow other counties to work out their plans. I Mr. Chambliss informed the Board that the annual audit by Ernst and Whinny has not yet been completed but felt it would be ready to submit at the December 22nd meeting. IN RE: HEALTH DEPARTMENT Dr. Nancy Welch was present and submitted a report of activities from June 1980 through June 1981. Dr. Welch explained that when funds are I I I 1 11-24-81 1'99 collected by the Health Department above the amount they are required to secure. a refund check is forwarded. This year an excess amount of $29.094.29 was collected. and since a proposed legislature to charge a lesser amount for drugs will r~duce their available budget funds considerably. Dr. Welch requested the Board to allow the department to keep $14.000.00 of that money to replenish the budget. She further asked the Board's consideration to discuss the proposed legislation with Delegate Richard Cranwell to express their views concerning the matter of charging only $1.00 for any Health Department Services, unless patient can afford a greater amount. Supervisor White moved to allow the Health Department to retain $14.000.00 as requested; adopted by the following recorded vote. IN RE: RESOLUTION NO. 3027 ACCEPTING THE DONATION OF WATER AND SEWER LINES INSTALLED WITHIN THE WOODLANDS, SECTION 8, AND AUTHORIZING THE COUNTY ADMINISTRATOR TO DULY AUTHENTICATE SUCH ACCEPTANCE AS MADE AND PROVIDED BY LAW. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: I 1. That the offer of the developer of the subdivision known as The Woodlands, Section 8, to donate the water and sewer lines installed within the development of this subdivision to the Board of Supervisors of Roanoke County be, and hereby is ACCEPTED; and 2. That upon receipt of a duly executed deed conveying the herein- above mentioned water and sewer lines to the Board of Supervisors, the County Administrator is hereby authorized to authenticate the accpetance thereof on a form approved by the County Attorney. He informed that EPA is preparing a study of this site and will inform the County of its progress. No action was taken by the Board. IN RE: RESOLUTION NO. 3028 AUTHORIZING THE EXECUTION OF CERTAIN DOCUMENTS IN RELATION TO THE GLADE CREEK AND TINKER CREEK SEWER PROJECTS. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That certain documents required to be executed on behalf I of the County of Roanoke in relation to the Glade Creek and Tinker Creek sewer projects heretofore undertaken and directed by the Board of Supervisors are hereby authorized to be executed on behalf of the County of Roanoke; provided however, any documents authorizing addi- tional expenditure of public funds shall be specifically authorized ~ ~ 11-24-81 201 for execution by the Board of Supervisors; and 2. That the County Administrator is hereby authorized and directed to execute such documents as are herein authorized to be executed from time to time all of which shall be upon a form approved by the County Attorney. FOR A SPECIAL USE PERMIT Region Properties, Inc. applied for a Special Use permit in order to dump construction debris consisting of wood, paper and metal materials, on a 100' x 200' lot beyond Penguin Drive in the Penn Forest Subdivision. On motion of Supervisor Johnson and the following recorded vote, the request was approved for a two-year period. I AYES: NAYS: ABSENT: IN RE: Supervisors Johnson, Park, White and Terry None Chairman Myers READVERTISING FEE FOR REZONING AND PLANNING COMMISSION MATTERS Tim Gubala, County Planner, reminded the Board that previously they had discussed the possibility of charging a fee for notices sent to adjoining property owners when a rezoning request is continued by the Planning Commission. In the past, this expense has been borne by the County and Mr. Gubala suggested a fee be charged to cover this particular expense. On motion of Supervisor Park and the following recorded vote, a fee of $10.00 was approved for the readvertising of continued matters. AYES: Supervisors Johnson, Park, White and Terry NAYS: None ABSENT: Chairman Myers IN RE: REQUEST TO ADD BUCKINGHAM DRIVE AND BUCKINGHAM CIRCLE INTO THE STATE HIGHWAY SYSTEM On motion of Supervisor Johnson and the following recorded vote, the request to add Buckingham Drive from 0.16 miles west of its intersection with Rt. 1368 to its intersection with Wyndale Avenue (Rt. 925) and Buckingham Circle north of Buckingham Drive(Rt. 1366) .05 miles to end into the State Secondary Highway System, was approved for submission to the Highway Departmen AYES: Supervisors Johnson, Park, White and Terry I NAYS: None ABSENT: Chairman Myers IN RE: ORLANDO AND PALM VALLEY ROADS Supervisor White stated there is a problem with a curve where these two roads meet and a design of an intersection is under consideration to alleviate this problem. He moved to direct a public hearing be held to allow input from citizens and other interested parties regarding this matter. The Salem Resident Engineer and Traffic Engineer from the Virginia Department of Highways are to be invited to be present at the public hearing. County Attorney James Buchholtz was directed to advertise a public hearing for the meeting of December 22nd; adopted by the following recorded vote. AYES: Supervisors Johnson, Park, White and Terry I NAYS: None ABSENT: Chairman Myers IN RE: RAFFLE AND BINGO PERMIT PROCEDURE Wayne Compton, Commissioner of Revenue, informed the Board of his 11-24-81 20 ~{ I willingness to accept applications, audit and issue permits for bingo games and raffles conducted within the County. He stated his awareness of the procedure under current County code and asked consideration to amend the Code to allow his handling this matter. He felt with his handling of the entire process to secure these permits, he would have more control to "police" the offenders who do not get the permits. Mr. Compton will do a study and submit to the Board at a future meeting.
