5/25/1982 - Regular I I I l 5-25-82 4 a 4 4 'I 11 :1 I I I l ! 1 Roanoke County Board of Supervisors Salem-Roanoke County Civic Center Salem, Virginia May 25, 1982 The Board of Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the fourth Tuesday and the second regular meeting of the month of May, 1982. Members Present: Chairman Edward C. Park, Jr. and Supervisors Robert E. Myers, May W. Johnson and Gary James Minter. Members Absent: Vice Chairman Athena E. Burton IN RE: CALL TO ORDER The meeting was called to order by Chairman Park at 5:00 p.m. IN RE: EXECUTIVE SESSION Immediately after the meeting was called to order, Supervisor Johnson moved to go into executive session at the request of County Administrator Donald R. Flanders to consider personnel and real estate matters, pursuant to Section 2.1-344 (a) (1) and (2) of the Code of Virginia. Motion carried. IN RE: RECONVENEMENT On motion of Supervisors Myers, the Board returned to regular session at 6:40 p.m. Motion carried. IN RE: EXECUTIVE SESSION Supervisor Johnson moved immediately to return to executive session at the request of County Attorney James E. Buchholtz to consider a legal matter, pursuant to Section 2.1-344 (a) (6) of the Code of Virginia. Motion carried. IN RE: RECONVENID1ENT At 6:55 p.m., Supervisor Myers moved to return to regular session. Motion carried. ,....- , l.r:3 5 5-25-82 At 7:00 p.m., after the Supervisors had returned to Meeting Room 'A' Chairman Park advised those present that the meeting had been called to order at 5:00 p.m. and that the Supervisors had been in executive session since that time. IN RE: INVOCATION/PLEDGE OF ALLEGIANCE TO THE FLAG Since the minister scheduled to offer the invocation was not present, Director of Finance John M. Chambliss, Jr. was requested to do so. After the invocation, the pledge of allegiance to the flag was recited in unison by all present. IN RE: APPROVAL OF MINUTES Supervisor Johnson moved that the minutes of Board meetings held on April 27, May 3, and May 11, 1982, be approved. Her motion was adopted by a unanimous voice vote. IN RE: ITEMS SUBMITTED FOR INFORMATION Supervisor Minter moved that the memorandum from the Director of Utility Engineering and Administration, the list of accounts paid during April, 1982, the Summary of Appropriations from the General Operation Fund, and the statement of jail expenses be received and filed. His motion was adopted by a unanimous voice vote. IN RE: APPLICATION OF MR. AND MRS. WALTER BROMFIELD FOR A * SPECIAL EXCEPTION PERMIT TO PARK A MOBILE HOME ON * THE WEST SIDE OF STATE ROUTE 311, ABOUT 1/2 MILE ,,: APPROVED NORTH FROM ROUTE 785 IN CATAWBA MAGISTERIAL DISTRICT* 11r. Bromfield was present for this public hearing; there was no opposition. Supervisor Myers moved that the request be approved, subject to the provisions of the County Zoning Ordinance as it applies to mobile homes. His motion was adopted by a unanimous voice vote. BAILEY * REQUESTING REZONING FROM B-2 TO B-3 OF A 0.217- * ACRE TRACT LOCATED AT 7307 WILLIAMSON ROAD, N.W. * IN HOLLINS MAGISTERIAL DISTRICT. PETITIONERS * ALSO REQUEST A SPECIAL EXCEPTION TO PERMIT * APPROVED OPERATION OF A USED CAR LOT ON THOSE PREMISES. * Mr. William D. Bailey was present for this public hearing; there was no opposition to the rezoning or the special exception. Supervisor Minter moved that the rezoning be approved and that the special exception be granted. FINAL ORDER NOW, THEREFORE, BE IT ORDERED that the aforementioned tract of land, more particularly described below, be rezoned from Business District B-2 I to Business District B-3: BEGINNING at a iron pin in the south side of Williamson Road at its intersection with the centerline of Boxley Drive (now vacated) thence with the centerline of Boxley Drive S 18019' E. 79.49 feet to the true point of Beginning; thence S 18019' E 94.81 feet to an old iron pin in the North line of Lot #1, Block #1, Section #1, Map of Sunnybrook; thence with said line S 72000' W 97.40 feet to an old iron pipe in the east line of the property of Roanoke-Hollins Shopping Center Associates; thence with said line N 21033' W 94.14 feet to a point; thence with a new division line N 71031' 37" E 102.71 feet to a point in the centerline of Boxley Drive the True point of Beginning, and Containing 0.217 Acre. "- -.. . - --~ - ., 5-25-02 456 IN RE: PUBLIC BEARING ON ADOPTION OF THE ROANOKE COUNTY BUDGET FOR THE 1982-83 FISCAL YEAR Three persons from the audience signed up to speak before the Supervisors about next year's budget. Chairman Park set a five-minute I time limit for their remarks. Mr. David K. Byrd (3414 Locust Grove Lane, Salem) spoke first. He had attended the previous public hearing when the tax rates were set. He said one of the other persons at that public hearing, Mr. Bob Johnson from the Roanoke County Education Association, had told the media that the people who asked for tax relief were "grandstanding." Mr. Byrd said his position on taxes had not changed, that he and the other citizens in favor of lower tax rates were not grandstanding, and that he felt Mr. Johnson owed everyone an apology for his remark. Mr. John Hull (Route 1, Box 50, Salem) read a prepared statement urging that the school budget be cut and suggesting that the cuts come I from the administrative costs. He also singled out Supervisors Myers and Johnson and praised them for their concern and help. Mr. Bob Anderson (6010 Ponderosa Circle, S.W.) also read a prepared statement in which he compared the County's budget with Roanoke City's. He, too, felt that the County school administrative staff was overpaid and top heavy; he urged the Supervisors to hire an efficiency expert to do an independent survey and streamline the County government structure. Supervisor Minter aske!'Nr. Anderson if he had compared Roanoke City's school administrative salary/fringe benefits with the County school administrative staff's. he said he had, but when asked, he guessed the County School Superintendent's salary to be in the $60,000's. Mr. Minter advised him that the salary is actually in the $40,000's. He also I told Mr. Anderson that when making a public statement comparing salaries, taxes, or any other statistics, Mr. Anderson should be very careful that his information is correct. Mrs. Barbara C. Topper (339 Polly Circle, Salem) said she wanted I to speak about the budget, but instead she read a prepared statement about I I- I I .... 5-25~82 45'7~ future development and the necessary, associated facilities. She feared possible air and water pollution and traffic and road problems. She asked that when the Supervisors consider development of industrial sites, they look at the undesirable as well as the desirable features. Chairman Park then asked if anyone else wi.shed to conunent on the County budget. Supervisor Minter asked County Administrator Flanders if there was not a program of tax relief for the elderly in Roanoke County. Mr. Flanders replied that there was. Supervisor Johnson conunented that the County was the only Valley government that has given the maximum relief allowable to the elderly. Hs. Virginia Clingenpeel told the Supervisors she had failed to qualify for tax relief because of the interest paid on her savings account. An unidentified person from the audience said that tax relief is allowed on only a house and one acre of land; staff agreed that this is correct and these are State guidelines. 11r. Walter T. Beckner identified himself as a County citizen and a small businessman; he asked the Supervisors, "Where are you leading us?" As one of his reasons for asking that question he cited the fact that he owns a motorcycle which was assessed last year for around $140 and which was assessed this year for over $500. Mr. Beckner was encouraged to direct his inquiry to the office of the Conunissioner of the Revenue. He was also asked to leave his name and phone number with the Board Clerk, who is to relay the information to the Commissioner for reply. Supervisor Hyers then mentioned a situation which he says is developing and which he wanted to make public. He said one industry located in the County is paying less tax on their machinery and tools than other County industries. He suggested that the Commissioner of the Revenue look into the situation and get it straightened out because it is the responsibility of his office, not the Supervisors~ responsibility. IN RE: PROPOSED ADOPTION OF AN ORDINANCE TO EXTEND THE PENALTY DATE FOR TAXES ON HOBILE HOMES UNTIL JUNE 20, 1982 Chairman Park called upon Commissioner of the Revenue R. Wayne Compton and asked the purpose of this ordinance. He was advised that it . ,i? 5-25-82 458 took longer to prepare the mobile home assessments because the computers were tied up with personal property and real estate tax assessments. ORDINANCE NO. 3143 EXTENDING THE DATE FOR THE ASSESSMENT OF THE PENALTY UPON FAILURE TO PAY TAX ASSESSED AGAINST MOBILE HOMES. BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the penalty date for taxes on mobile homes having been set at May 31 is extended for a period of twenty days until June 20, 1982. The due date for the payment of these taxes remains May 31; however, no penalty will be imposed on the payment of taxes on mobile homes if said payment is made on or before June 20, 1982. 2. That a certified copy of this resolution be forthwith delivered to the Treasurer of Roanoke County and the Commissioner of the Revenue. IN RE: REPORT OF COUNTY AD~1INISTRATOR County Administrator gave an oral report to the Board which included the following: (1) For the present, instead of hiring a Planning Technician for the County Planner's office, Mr. Flanders asked for authorization from the Supervisors to secure the services of two I graduate students from VPI as summer interns. This would cost around $4,500 and the funds are available in the 1982-83 budget. (2) lie mentioned that the County Parks and Recreation Department is one of four finalists in the United States in Recreation programs for the handicapped. (3) Asked that the Supervisors delay appointment of people to serve on the County's Impoundment Safety Technical Advisory Committee until June 8. (4) Advised that during the previous week he had met with two industrial prospects. (5) Described a seminar being sponsored by the Virginia Division of Industrial Development on June 3, 1982, in Staunton. Asked if any Supervisors could attend. (6) Advised that a meeting has been set for June 8, 1982, with State Highway Commissioner Harold King and area Legislator Mr. Flanders recommended that the Supervisors meet with the Legislators I I prior to meeting with Mr. King. (7) When Supervisors Myers asked if Mr. Flanders had investigated his previous inquiry about stains on some of the bricks at the Roanoke County-Salem jail, Mr. Flanders replied he had referred the inquiry to the architects who designed the building and had received no reply as yet. Supervisor Park moved that Mrs. Frank Stone (P. O. Box 81, Vinton) be reappointed to another term on the Virginia Western Community College Board. Her current term expires June 30, 1982. IN RE: HEARING OF CITIZENS Mr. Daniel Shaw introduced himself as a County resident affiliated with the Association of Retarded Citizens in the Valley. He thanked the supervisors for including in the County's 1932-83 budget a contribution to I his organization. He also invited the Supervisors to come by their facility on Melrose Avenue at any time for an inspect:Lc.1 tour. He further stated that because of various cuts in their funding from federal and State governments, they were doubly grateful for the County's contribution. IN RE: REPORTS AND INQUIRIES OF BOARl! >tENDERS Supervisor Johnson advised those present that the application of the Muscular Dystrophy Association for a permit to conduct raffles had I> come in too late for inclusion on this agenda, but since they wanted to begin holding the raffles within the next few days, she asked that the Supervisors consider this application. She moved that the permit be issued. Her motion was adopted by a unanimous voice vote. Supervisor Minter asked County Attorney Buchholtz about dinner I meetings of bodies such as the Supervisors or the County Planning Commission. His questions was whether they are covered under the Freedom of Information Act. Mr. Buchholtz advised that a dinner meeting as a social gathering is I I I -I I i I I !. ~i not a m.eeting. If it is for the purpose of discessing or conducting 5-25-82 t41~ County business, it would be a meeting. The same thing would apply to the Planning Commission. I Supervisor Minter then publicly thanked Mr. George Harman, Secretary of Cats International, and Dawn Wells for helping the County by taking care of a complaint about an individual with 26 cats. Supervisor Myers had nothing to bring before the Board. Chairman Park stated he would like to go over the list of roads which are to get plant mix. John Peters from the County Engineering Department explained why the previously agreed upon list had been revised. Mr. Peters said that after the meeting between staff and the Supervisors to discuss putting together a list of priorities from each Supervisor's district, staff had tried to revise the list so the available money would I be divided evenly among the districts and the roads most in need of maintenance/repair would get it. He said that although the mileage on the revised list varies in each district, the money being spent will be the same in each district. Supervisor Minter moved for adoption of the priority list. His motion was adopted by a unanimous voice vote. I Supervisor Myers presented a list entitled "Major Ca.pital Ir1provements - 7/1/73-3/31/82." This list had been prepared at his request after the Supervisors' district meeting held at the Cave Spring high school in Harch, 1982 during vlhich a citizen had criticized the Supervisors' capital spending.
