MEMBERS PRESENT: Chairman Athena E. Burton, Supervisors May W. Johnson, Gary J. Minter, Robert E. Myers and Harry C. Nickens MEMBERS ABSENT: None IN RE: CALL TO ORDER I Chairman Burton called the meeting to order at 3:01 p.m. IN RE: EMPLOYEE HEALTH INSURANCE Chairman Burton recognized Mr. Lawrence C. Musgrove, Administrator of the self-funded employee Health Plan. Mr. Musgrove presented a report including the history of the County Health Plan, general information regarding individual claims, improvement in benefits and services to employees, pending matters, and his recommendations. The Supervisors had before them a copy of this report and a copy is filed with the agenda material of this meeting. I Hr. Musgrove recommended that the Board of Supervisors take the following action: (1) Appoint a person or committee to review present health coverage and to either (a) make recommendations to the Board for the coverage to be provided for the 1932-83 Plan Year or (b) authorize the I I I - person or committee to put the coverage into effect and report such action to the Board; (2) Authorize a person or committee to take action on matters that may arise during the Plan Year that the Administrator feels I~ "..- 9 r~ (), I f-..J '.# - 10-12-82 is beyond the scope of his authority; (3) Authorize the County Administrato or other official to sign the renewal for excess medical stop-loss insurance with Harbor Insurance Company; (4) Consider the Administrator's (5) Requested recommendations from the appropriate committee or officials I request for an increase in administration fees for the new plan year; and for contribution rates to the Plan for the new plan year. IN RE: EXECUTIVE SESSION At 3:52 p.m. on motion of Supervisor Johnson and a unanimous voice vote, the Board went into executive session to discuss legal matters pursuant to the Code of Virginia Section 2. 1-344(a), (6). IN RE: RETURN TO OPEN SESSION On motion of Supervisor Myers the Board returned to open session I at 4:29 p.m. The motion carried by a unanimous voice vote. Chairman Burton then advised the Board was back in open session for consideration of recommendations and that Mr. Musgrove wanted either the appointment of a committee or person to work on the establ ishment of or any changes or additions needed on the part of the Health Plan. Supervisor Myers moved that the Personnel Officer, when appointed, Mrs. Johnson and Mr. Flanders designated to serve on the proposed Health Insurance Committee, and that this committee report to the Board any recommendations in reference to the Health Plan. His motion was adopted by a unanimous voice vote. I After further discuss ion, Cha i rman Burton noted that all items on Mr. Musgrove's report had some critical need of consideration and that the Health Insurance Committee would address these items and report back to the Board. Kelley, Marvin R. Zirkle, Danny I E. Spangler, Paul E. Nester, W. River Bonhotel and Rebecca W. Stallard. Chairman Burton expressed appreciation to those participating and to those instructing and coordinating the program. IN RE: WORK SESSION - WATER AND SEWER RATES County Administrator Donald Flanders then called upon Mr. John Chambl iss, Jr., John R. Hubbard and Leonard G. Leask and Mrs. Diane D. Hyatt, who then presented a report concerning the proposed two-tier water and sewer rate structure as suggested by Weston & Associates, consultants on the project. No action was taken and this matter was continued to the October 26, 1982, regularly scheduled Board meeting. I IN RE: RECESS At 5:23 p.m. the Supervisors recessed for dinner. IN RE: RECONVENEMENT The meeting reconvened at 6:00 p.m. Supervisor Johnson immediately moved that the Board go into executive session to consider legal and personnel matters, pursuant to the Code of Virginia Section 2.10344(a), (1), and (6). Her motion was adopted by a unanimous voice vote. IIJ RE: HEARING OF CITIZENS Mr. Donald Gill ispie, Chief, Cave Spring Fire Department, I presented the Board with a check in the amount of $15,000.00 which represente the first annual payment of three payments to be made by the Volunteers to underwrite one half of the cost of the new tanker acquired for the Cave Spring Fire Department. ~ ~ '<f#/ -" "'J IV ~) i) 10-12-82 IN RE: PUBLIC HEARINGS IN RE: PETITION OF CHARLES H. BURTON REQUESTING REZONING * FROM R-l TO R-3 OF 9.12 ACRES ON THE NORTH SIDE * OF DENT ROAD (BETWEEN AIRPORT AND WilliAMSON RDS) * CONTINUED IN THE HOLLINS MAGISTERIAL DISTRICT. REZONING * IS REQUESTED TO PERMIT CONSTRUCTION OF CONDOMINIUMS. I Mr. John L. Apostolou, Attorney, was present to support this request and no one appeared in opposition. Mr. Apostolou reminded the Board this petition had been continued from September 28, 1982 and there was no opposition and denial of the petition by the Planning Commission was predicated on the matter of excess density. It was explained at that time that the density was based on erroneous computation of the survey not acreage and therefore, density should/be the issue. Mr. Apostolou said it was mentioned at the last meeting that a letter had been received by the Planning Commission from Roanoke City in opposition to the rezoning; contents of the letter unknown. Mr. Apostolou also stated he felt a consideration that was part of the denial was based on the fact that the tract of land was in proximity to the extended Airport runway and his case I was continued to allow the staff to gather more information. Chairman Burton recognized Mr. Timothy W. Gubala, Superintendent of the Department of Development, who responded to Chairman Burton concerning the letter from Roanoke City. He stated he had received a letter from the City of Roanoke dated August 11th, which said the minimum height for fl ights over the high point of the property would be 122.5 feet above ground level, and the average daily number of fl ights over the site is 80 and this is anticipated to increase with the extension of the runway and this would have some impact on the noise level. There was extensive discussion concerning the possible dangers I and noise factors and a lengthy review of an area map was made by the Board and Mr. Apostolou. Mr. Apostolou stated his petitioner may decide to build apartments or multi-family units rather than condominiums. Supervisor Minter moved for denial of the request because of possible safety factors and in 1 ight of the Planning Commission's opposition. - I ~ ~ ~2'~)d ~~ ~~ 10-12-82 '. Supervisor Nickens made a substitute motion to refer the petition back to the Planning Commission for appropriate corrections to include site plan and amended use of the property and that there be a publ ic hearing in 1 ight of the request that came before the Planning Commission requesting I zoning for condominiums which imp1 ied ownership, versus rental property in the form of apartments. Chairman Burton asked Dr. Nickens if he would include in his motion that the County Administrator contact the City of Roanoke requesting a representative be present to present the reasons for opposition when the petition comes before the Planning Commission again. Supervisor Nickens' motion was adopted by a unanimous voice vote. IN RE: PETITION OF MOD-U-KRAF HOMES, INC. REQUESTING REZONING* FROM RE TO B-2 OF 3 ACRES AT THE NORTHEAST CORNER OF * ROUTES 220 and 674 OPPOSITE CLEARBROOK SCHOOL IN THE * CAVE SPRING DISTRICT. I IN RE: PETITION OF BOBBY DONALD WALTERS REQUESTING * REZONING FROM A-I TO M-l OF 0.22 ACRES LOCATED ON * ROUTE 612, ABOUT 1-1/2 MILES NORTH OFF ROUTE 221 * AT BENT MOUNTAIN IN WINDSOR HILLS DISTRICT. * REZONING IS REQUESTED TO PERMIT OPERATION OF A * MOTOR VEHICLE BODY SHOP THEREON. APPROVED James M. Young, attorney, was spokesman on behalf of his cl ient, and there was no one in opposition. After a brief discussion conerning outdoor storage of equipment and the materials for business should be enclosed, Supervisor Myers moved the petition be granted with the proper conditions. His motion was adopted by the following: NOW, THEREFORE, BE IT ORDERED that the aforementioned tract of land, I more particularly described below, be rezoned from Agricultural District A-I to Industrial District M-l Conditional. If the title to the property becomes vested in a person, corporation or other entity other than Bobby Donald Walters or Will iam Walters, of if Bobby Donald Walters and/or Will iam Walters ceases to use the property over at least a six month period of time as an automobile body and fender shop, then the I zoning classification will revert back to Agricultural District A-1. IN RE: RAFFLE PERMITS On motion of Supervisor Minter and a unanimous voice vote a raffle permit for Northside, Jr. High PTA was approved with waiver of fi1 ing fee. On motion of Supervisor Myers and a unanimous voice vote a raffle I permit for G1envar Band Boosters was approved with waiver of fi1 ing fee. I I I i i -t ! ! I IN RE: SCHOOL BOARD RESOLUTION NO. 3274 AUTHORIZING AND CONCURRING IN THE REQUEST OF THE ROANOKE COUNTY SCHOOL BOARD TO LEASE CERTAIN REAL ESTATE ADJACENT TO THE WILLIAM BYRD HIGH SCHOOL PROPERTY BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain request of the Roanoke County School Board to lease 3.53 acres, more or less, adjacent to the Will iam Byrd High School property in Roanoke County, said real estate being needed for the purpose of future expansion of school facil ities in the eastern part of the County, be, and same hereby is, concurred in and is authorized to be consumated; and I 2. That the Chairman of this Board is hereby authorized and directed to execute the lease on behalf of Roanoke County upon a form approved by the County Attorney; and 3. That an attested copy of this resolution be forthwith del ivered to the Clerk of the Roanoke County School Board. NAYS: None Snpervisor Johnson moved to approve the request of the Roanoke County School Board for an appropriation of $9,000 to the Federal Programs I Fund from an ESEA - Title IV-C Adopter Grant. On motion of Supervisor Johnson and a unanimous voice vote this resolution from the School Board was approved. IN RE: PARKS AND RECREATION I RESOLUTION NO. 3276 APPROVlfJG THE SUBMISSION OF A CERTAIN GRANT APPLICATION BY THE ROANOKE COUNTY PARKS AND RECREATION DEPARTMENT AND AUTHORIZING TIlE COUNTY ADMINISTRATOR TO EXECUTE THE NECESSARY DOCUMENTS FOR THIS GRANT APPLICATION BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the grant appl ication for certain funds in the amount of $125,000 which are available through the Virginia Commission on Outdoor I Recreation on a 50% local matching funds basis for first phase develop- ment of the Stonebridge Park Addition be, and hereby is, approved in that Roanoke County is authorized to expend the 50% local share required; and 2. That the County Administrator be, and hereby is authorized and I directed to execute the necessary documents on behalf of Roanoke County. He also gave a brief report on the progress of the move to the new County Administration Center. IN RE: ORGANIZATION STRUCTURE FOR COUNTY OF ROANOKE ADMINISTRATION Supervisor Nickens moved that the following prepared resolution be approved: RESOLUTION NO. 3277 ESTABLISHING AN ORGANIZATIONAL STRUCTURE FOR THE COUNTY OF ROANOKE RELATING TO THE COUNTY ADMINISTRATOR'S OFFICE AND THOSE DEPARTMENTS MANAGED BY THE COUNTY ADMINISTRATOR AND RESPONSIBLE TO THE BOARD OF SUPERVISORS OF ROANOKE COUNTY THROUGH THE COUNTY ADMINISTRATOR BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That there be, and there hereby is, establ ished the following organizational structure of the County of Roanoke as follows, to-wit: a. The County Administrator, who shall, in addition to such other responsibilities vested in him as heretofore provided by the Board of Supervisors by Resolution No. 2475 adopted January 2, 1980, have the direct responsibil ity for managing the following several departments of Roanoke County as follows: (i) Office of Personnel Services which office shall be directly managed by a Personnel Officer and shall have such other employees as from time to time shall be authorized by the Board, which department shall have the responsibil ity of employee safety education, general employee training, employee insurance programs and benefits, and employee relations; and the Personnel Officer shall be placed in the current County pay plan at a grade 39 having a salary range of $20,532 to $26,040. (i ii) Department of Publ ic Facil ities which office shall be directly managed by the Superintendent of Publ ic Facil ities and shall have such other employees as from time to time may be authorized by the Board, and within such department shall be the following divisions, to- wit: Division of Engineering, managed by a Director of Engineering; Division of Parks and Recreation, managed by a Director of Parks and Recreation; Division of Communications, managed by a Director of Communicatic 1S who shall be placed in the current County pay plan at a grade 37 having a salary range of $18,696 to $23,664; Division of Facil ities, managed by a Director of Facil ities; and Division of Util ities, managed by a Director of Utilities; and the Superintendent of Publ ic Facil ities shall until I further order of the Board be an Unclassified position at a salary of $27,312.00; and that the job title of County Engineer be, and hereby is, abol ished and the responsibil ities enjoined by the Roanoke County Code upon the County Engineer shall be the responsibil ities of the Superintendent of Publ ic Facil ities with the advice and aid of the Director of Engineering. (iv) Department ~ Fiscal Management which office shall be directly managed by the Superintendent of Fiscal Management and shall have such other employees as from time to time may be authorized by the Board, and within such department shall be the following divisions, to- wit: Division of Del inquent Collections and Financial Planning; Procurement Division, managed by a Procurement Supervisor; Automated Services Division, managed by a Director of Automated Services; and Division of Real Estate I Assessment, managed by an Assessor who shall be appointed by the Board of Supervisors and shall be directly responsible only to the Board of Supervisors as made and provided by law, but for purposes of fiscal planning of the County shall make advisory reports to the Superintendent of Fiscal Management as may be required by the Superintendent of Fiscal -- Management; and the Superintendent of Fiscal Management shall until ~ I I I ~ 1 10-12-32 further order of the Board be an Unclassified position at a salary of $31,488.00. The following is a prepared resolution: RESOLUTION NO. 3279 ACCEPTING A BID MADE TO THE COUNTY OF ROANOKE TO FURNISH 2,160 EIGHTY POUND BAGS OF COARSE SOLAR SALT I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That a certain bid of Inland Products in the amount of $7,495.20 to furnish 2,160 eighty pound bags of coarse solar salt, upon all and singular the terms and conditions of the invitation to bid, the specifi- cations of the County of Roanoke, the bidder's proposal and the provisions of this resolution, be, and the same hereby is ACCEPTED; and 2. That the County Administrator is hereby authorized and directed to enter into a contract with Inland Products upon a form approved by the County Attorney for this purchase; and 3. Hubbard, Superintendent, Department of Publ ic Facil ities, read from a prepared report informing the Board that the Bid Committee recommended the low bid of $7,750.00 to Bildel Corporation for constructing the well house walls and roof. Supervisor Nickens expressed opposition to the cost as this represented approximately $50 per square foot to construct a cinder block building. After further discussion, with opposition from Board members concerning the cost, Mr. Hubbard stated he would look into alternative solutions for this construction. Supervisor Nickens moved to continue this matter to the next meeting. Motion carried. IN RE: REPORT OF COUNTY ENGINEER Mr. Gene Robertson, Director of Engineering, read from a prepared report concerning the proposal to close Route 605 and 654 in Botetourt County, a portion of 605 being in Roanoke County, to through truck traffic. The Botetourt County Board of Supervisors has designated Route 11 and Route 220 as the alternate routes for trucks to use and the Highway Department must now proceed with a publ ic hearing and traffic study to determine if closing these routes to through trucks is justified. Mr. Robertson said the Botetourt County Board wished concurrence from Roanoke County to request the same restrictions be applied to that portion of Route 605 lying in Roanoke County to provide better continuity I i i I 'I I, i ! I i I for the restriction. Supervisor Minter moved to concur with the recommendations of the Engineering Department to the State to close through truck traffic to the aforementioned portion of 605 in Roanoke County. His motion carried. Supervisor Minter then moved that the County request that the the trucks using the Highways 11 and 220 North as he felt it was a problem when the truckers evade the weighing station thereby, tearing up the roads ---- ~ ,... 266 ~ 10-12-32 in the secondary and residential areas. His motion carried. At this point, Mr. Robertson requested introduction of an item not on the agend that Chairman Burton had asked to be presented. Chairman I Burton responded and said the current budget had funds for carpeting the Sheriff's Department Communication Room and the possible renovation of two rooms in the old jail. She stated at this time, she would 1 ike to put aside discussion of renovation of the two rooms in the jail, but the carpetin was in critical need and the amount budgeted was approximately $200 short of the amount needed for the carpet. That the County of Roanoke be, and hereby is, authorized to enter into a certain contract by and between the County of Roanoke and Dr. H. J. Minarik to employ Dr. Minarik's services as Jail Physician for Roanoke County for a period of twelve (12) months from and after July 1, 1982 through June 30, 1983, as defined in said agreement, upon all and singular the terms, conditions and provisions to be more fully set out in said contract; and 2. That the County Administrator is hereby directed to execute said contract, upon a form approved by the County Attorney, on behalf of Roanoke County. Pence. Her motion was adopted by a unanimous voice vote. - ~ rm '268 10-12-82 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Johnson stated she had nothing further to present. Supervisor Minter stated he had three brief items to present. He I advised he had a report from Mr. Gene Robertson, County Engineer, regarding the Verndale Road situation and requested this be disussed at the next meeting. He also stated he had received complaints from citizens of the Will iamson Road area about citizens participating at the flea markets on Saturdays and Sundays and blocking the roads. He asked that the County Administrator check with the proper authorities as to any problems that may exist. He continued by saying he had also had complaints from merchants concerning out-of-town merchants bringing trucks of furniture into the County for sale. He asked that this be investigated, especially in regards to permits. He then stated he had received a complaint regarding property which apparently was to have a 50 foot buffer zone, the property being near the end of the airport runway under construction by the City of Roanoke, and that all trees had been cut down. He asked the County I Administrator to look into this matter as well. Mr. Wayn Compton, Commissioner of Revenue, then responded to Mr. Minter's question concerning the flea market parking problem. He advisee he felt the County 1 ine ran through the parking lot in question, and if it were possible to determine where the County 1 ine is, then flea market stands could be moved into the City, back from the road. Mr. Minter then stated that maybe the County Attorney and County Administrator could look into this matter. Supervisor Myers stated he had nothing to report. Supervisor Nickens questioned if the Board would discuss the I VACO legislative package. Chairman Burton then directed the County Administrator to schedule a work session concerning this matter prior to the next meeting. -., 2G9 10-12-82 Chairman Burton then directed the County Administrator to schedule a time at an upcoming meeting to discuss the shift pay differential for employees in the Sheriff's Department, and to reconsider the semi-annual I anniversary date as opposed to the annual date. She then stated that if there was no other business to come before the Board she would move for an executive session pursuant to the Code of Virginia Section 2. 1-344(a), (1) and (6) to discuss personnel and legal matters. IN RE: EXECUTIVE SESSION At 8:45 p.m. Supervisor Nickens moved that the Board go into executive session. His motion was adopted by a unanimous voice vote. IN RE: RETURN TO OPEN SESSION I At 9:15 p.m. Supervisor Nickens moved to return to open session. His motion carried.
