The Board of Supervisors of Roanoke County, Virginia, met this
day in open session at the Roanoke County Administration Center, Roanoke,
Virginia, this being the fourth Tuesday and the third regular meeting of

The Board met at 3:00 p.m. in open session to discuss the Roanoke
County Administration Center Dedication and items to be presented at a
Publ ic Hearing scheduled for December 14, 1982.

Chairman Burton called the meeting to order at 3:10 p.m.
The first item of business was presented to the Board by Timothy
W. Gubala, Superintendent, Department of Development, regarding a proposed
zoning ordinance amendment that would create a new zoning R-5 Residential
District, "Townhouses for Sale". After presenting the background of the
need for such a zoning district, a discussion ensued as to the specifics of
the buffering and screening provision proposed in the amendment. Supervisor

Johnson wanted to ensure that specific screening requirements were contained
in the district to separate R-5 from any adjacent R-l District.
The Board concurred that a separate R-o Residential Zoning

in condominiums was needed. It was noted that a "townhouseil and a
"condominium" should be defined.

asked to present this additional information at another work session prior
to a publ ic hearin~ on the matter.
The next matter considered was additional information on the

proposed chanqes in water and sewer rates which was presented to the Board
by John M. Chambl iss, Jr., Superintendent of Fiscal Management.
It was noted that previous bond issues of the County have been
used to acquire assets from the Roanoke County Publ ic Service Authority,
purchase private water companies, sewage treatment facil ities, and to providE
basic improvements to the existing physical plant.
The recent $3.0 mill ion bond issue for sewer improvements
contained approximately $1.8 mill ion for sewer interceptor projects. If
the entire $1.8 mill ion sewer improvements were financed from other sources,
the monthly base charge for sewer would become $5.86 per equivalent
connection or a reduction of $0.88 per month, (from proposed charges).
Should the interest payments on these improvements be financed from real
estate taxes ($180,000), the real estate tax rate must be increased 11 cents

to cover the cost.
Comparison of user charges for residential customers from
surrounding communities, and basis of rates indicating the proposed and
current water and sewer charges, was provided for the Board's information.
The Board of Supervisors agreed to advertise the following water
and sewer rates to become effective January 1, 1983, and to be presented
at the publ ic hearing scheduled for December 14, 1932:
Monthly base charge for water, $6.11, for sewer $6.74.
Monthly volume charge/1000 gallons for water, $0.68 and
for sewer, $0.74.
The next matter to be considered by the Board was proposed

revisions to the Business License Fees for the 1983 tax year which were
presented to the Board by Mrs. Sylvia Faw, Business License Inspector.
Categories and fees to be revised were discussed.
The Board agreed after reviewing proposed fees for Roanoke
County and comparison of business 1 icense rates in other local ities, to

direct the County Attorney to advertise for a publ ic hearing on the
revision of the Business License Ordinance to be held at the December 14,
1982 meeting. Fees are not to exceed the State ceil ing.

Donald R. Flanders, County Administrator, presented to the Board
members a "rough draft" of the program outl ining the events of the day of
the Roanoke County Administration Center Dedication, to be held December
4, 1982. A discussion was held regarding the progress being made for the
dedication and revisions were made to the program.

and duly carried by voice vote the Board of Supervisors met in executive

Section 2.1-344 (a), (1), (2), (4) and (6).

Supervisor Johnson moved that the following items be received and
filed; the motion was adopted by a unanimous voice vote.
1. Copy of letter to Mr. Bayes E. Wilson, Roanoke County School
Superintendent, from the Commonwealth of Virginia, State Department of
Education advising approval of app1 ication for 1982-83 Autism Project Fundin(
in the amount of $130,000.00
2. Letter from Plantation Pipe Line Company of Gastonia, North
Carol ina advising of their 1 iquid refined petroleum products pipe1 ine as
it affects Roanoke County.

3. Letter from Mr. Donald Haynes, State Librarian advising of
the Governor's decision to exempt state aid to pub1 ic 1 ibraries from his
mandated 5 percent reduction in state spending.
4. Transmittal from Electoral Board and certified copy of
election results in Roanoke County for the election held November 2, 1932.
A certificate of appreciation was accepted by Chairman Burton on
behalf of the County, from Mark Becker, Executive Coordinator of the
Clean Valley Committee on behalf of the Virginia Division of Litter Control
for County cooperation in the Valley wide 1 itter clean up program.

Mr. T. L. Plunckett was present representing Area Corporation to
request the Board to grant rezoning from M-l to B-2 of 7.584 acres located

on the south side of the N&W railroad tracks, west of Ogden Road and
northwest of Starkey Road in the Cave Spring district. Rezoning is
requested to permit construction and operation of a Chuck E. Cheese's
Pizza Time Theatre on the 7.584 acres and a contiguous 6.540 acre tract
already zoned for B-2 use. Because this restaurant operation includes
children1s rides and video games, Mr. Plunkett is also requesting the
necessary special exception permit as well as rezoning.

Mr. Plunkett presented a map and provided information as to the
drainage from the property and pointed out the entrances and exits to and frc
the property.
Supervisor Johnson moved to go along with the recommendation made

by the Planning Commission with proffered conditions to rezone this land
from M-l to B-2 and grant the special exception permit to Area Corporation.
FINAL ORDER
NOW, THEREFORE, BE IT ORDAINED that the aforementioned parcel of land
more particularly described below, be rezoned, subject to the proffered
conditions filed by the petitions which conditions are hereby incorporated
as a part of this ordinance, from Industrial District M-l to Business Distric
B-2.
BEGINNING at a point on the southerly 1 ine of the
property of the Norfolk & Western Railway Company,
which point is the northwesterly corner of the

636), and which point is also the northeasterly corner

the Zoning Ordinance of Roanoke County, the approval of the Board of
Supervisors of Roanoke County is granted for the use of an approximately
10,000 square foot portion of the building to be erected in part upon said

7.584 acres and in part upon an adjacent 5.640 acre tract already zoned
Business District B-2 as a restaurant with certain forms of publ ic
entertainment as an accessory use.
BE IT FURTHER ORDAINED that a copy of this order be transmitted to the
County Planner and that he be and hereby is directed to reflect that change
on the official zoning map of the County.

PROFFERED CONDITIONS
I. The only entrance from Ogden Road into the development will be
a single, right-in entrance only and there will be no exit into Ogden Road
from the property.
2. That Area Corporation will not seek a certificate of occupancy
for the improvements to be made on the property until such time as Area
Corporation has secured from the Norfolk & Western Railway Company
permission to instal I an 18-inch drainage pipe for storm water under the
tracks of the Winston-Salem Division of the Norfolk & Western Railway,
as shown on the plans of Tanglewood Square Shopping Center.
3. That Area Corporation will not seek a certificate of occupancy
for the improvements to be constructed on the property until the storm
drainage system as presently designed, which has been approved by the
Roanoke County Engineer, is constructed and in operation.

Chairman Burton suggested quarterly meetings of the Roanoke Valley
governments' chief elected officials to discuss valley-wide problems and

asked the County Administrator to request that consideration of this matter
be placed on the December 8th meeting agenda.

SCHOOL BOARD
Chairman Burton called on Mr. Homer Duff and Dr. Eddie Kolb to
present information to the Board regarding the resolutions that the School
Board had requested to be considered by the Board. Following the presentatic
the following resolutions were acted on.
RESOLUTION NO. 3306 AUTHORIZING AND APPROVING THE SUBMISSION
OF AN APPLICATION TO THE COMMONWEALTH OF VIRGINIA FOR A LITERARY

DEPARTMENT REPORTS
COUNTY ADMINISTRATOR:
Mr. Flanders reported to the Board that he had received a response
from Mr. Bern Ewert, Roanoke City Manager, regarding the complaint from
Mr. Samuel Crowder, who 1 ives in the vicinity of the Woodrum Airport, that
was forwarded to Mayor Taylor at the direction of the County Board at itls
last meeting. Supervisor Nickens suggested that this should be an agenda
item for the December 8th meeting in Vinton.
Mr. Flanders mentioned the dedication of the RCAC on December 4,
1982, and invited everyone to attend. He briefed the Board on the progress
I
that had been made thus far toward the dedication.
Mr. Flanders requested the Board to approve the appropriation of
funds not to exceed $500.00 for the purchase, installation and decorations
fur the live Community Christmas tree.
The tree is to be planted on the
RCAC grounds.
On motion by Supervisor Johnson and approved by a roll call vote,
the Board approved the appropriation of funds not to exceed $500 and asked
that the appropriation resolution be prepared and spread with the minutes.

Mr. Flanders mentioned his recent trip to New York with Mrs. Burton
Fred Anderson and Mr. Pettigrew. The trip was necessary to take care of
paper work involved in obtaining funds for the sale of bonds. A check in
the amount of $9,800,000 plus $33,571.11 in accrued interest from November
1 to November 17, 1982, was deposited in a New York bank and was immediately
transferred to a Roanoke County Bank allowing the earning of interest the
day of receipt of the funds.
Mr. Flanders requested the Board to approve the acquisition and
installation of 2 additional telephone cards at the RCAC.

Supervisor Myers moved for the adoption of the following prepared
resolution:
RESOLUTION NO. 3313 ACCEPTING THE DONATION OF A CERTAIN
TANK LOT AND EASEMENT IN CONNECTION WITH THE WATER SYSTEM
SERVING THE LA BELLEVUE SUBDIVISION
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That the offer of Wilclare Corporation to donate a certain tank
lot and easement in connection with the water system serving the La
Bel1evue Subdivision, be, and hereby is, accepted; and
2. That upon receipt of a duly executed deed upon a form approved
by the County Attorney from Wilc1are Corporation, the County Administrator
is hereby authorized to authenticiate the acceptance thereof as made and

provided by Section 15.1-286 of the 1950 Code of Virginia, as amended.

Mr. John R. Hubbard, Superintendent of Public Facilities, mentioned
the new Sewage Handl ing and Disposal Regulations as prepared by the State
Board of Health which became effective November 1, 1982.
The new regulations do not affect the County's sewerage system,
but apply to citizens install ing septic systems and those that pump and
haul sewage. He noted the staff was in support of these new regulations.
Mr. Hubbard presented a report to the Board regarding the South-

woods #2 well house walls and roof. He requested that the Board accept the
bid of, and award the contract to, Bildel Corporation in the amount of
$7,750.00
There was a discussion relative to the costs of this project. Mr.

Hubbard said that he had contacted the School Board, but they were too busy

to do this work. Also, our present bid requirements (bonding, licensing,
etc.) is a cause for higher prices.
Supervisor Nickens felt that the Board should reject the bid and
secure other proposals. A discussion fo11ed regarding the time and work
involved in rebidding this project and on motion by Supervisor Johnson the
Board approved the bid of Bi1de1 Corporation in the amount of $7,750.00.
RESOLUTION NO. 3314 ACCEPTING A CERTAIN BID MADE TO THE
COUNTY OF ROANOKE FOR CONSTRUCTION OF THE SOUTHWOODS #2 WELL
HOUSE WALLS AND ROOF
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That a certain bid of Bi1de1 Corporation in the amount of
$32.29 per square foot for a total bid of $7,750.00, being the lowest
conforming bid for construction of the Southwoods #2 Well House Walls
and Roof, upon all and singular the terms and conditions of the invitation
to bid, the specifications of the County of Roanoke, the bidder's proposal,
and the provisions of this resolution, be, and the same is hereby ACCEPTED;
and
2. That the County Administrator is hereby authorized and directed
to enter into a contract upon a form approved by the County Attorney for
this construction; and
3. That all other bids for this construction are hereby rejected
and the County Clerk is directed to so notify such bidders and express
the County's appreciation for the submission of their bids.

Mr. Hubbard presented a report to the Board regarding the waiver
of the sewer ordinance requested by Mr. C. H. Smoot in order that he might
install a septic tank on his property in the North Hills Subdivision.
The State Highway Department had required Mr. Smoot to bore under
the road for installation of a service lateral, the cost for this being
$2,300. The cost to open-cut the road would be $800.00.

After a discussion of this matter, the Board agreed to allow Mr.
Smoot a waiver for the septic tank if he could not obtain a permit to
open-cut the street in order to connect to the County's sewerage system.
On motion by Supervisor Minter and approved by the following roll

call vote, Mr. Hubbard was directed to contact the State Highway Department
to secure an open-cut permit for Mr. Smoot. If a permit is not received
from the State, then the County is to issue a permit to authorize Mr. Smoot
to install a septic system.

Mr. Hubbard provided the Board with information regarding the
Joint Legislative Audit and Review Commission Study on Highway Construction
Allocations in Virginia. He noted the staff would be making a presentation
at the public hearing on this matter in Richmond on December 13, 1982. The
Board concurred with this presentation and asked the Clerk of the Board to
notify the proper persons of this hearing and what intends to be considered.

Mr. Hubbard also informed the Board of a publ ic hearing to be
held on December 7, 1982, for the proposed location and design of Route 11 an
Route 115, Will iamson Road, Peters Creek Road and Plantation Road areas.
On motion by Supervisor Minter this information item was received
and filed with the minutes of this meeting and the County to be represented
at the Public Hearing at which the Board's position on the improvements is

relation to the construction of the Tinker Creek Sewer Interceptor
Project, in order to el iminate the North Ardmore Sewer Lagoon be, and it
hereby is, authorized to be accepted by the County Administrator on
behalf of Roanoke County; and
2. That the County is hereby authorized and directed to pay unto
Robert J. Miller and Jean Pugh Miller the sum of $27,111.00, the same
being certain rent due and owing for the use of the North Ardmore Sewer
Lagoon since July, 1980, upon proper execution of the aforesaid easement
agreement and a release of any additional rent claims by the Millers;
and
3. Upon completion of the reI ief sewer line the County shall
forthwith proceed to el iminate the North Ardmore Sewer Lagoon.

He reported no complaints have been received by the Sheriff's
Department, no accidents have occured, and people parking have not blocked
the entrances. Mr. Gubala suggested that the area be monitored for one year

and any and all complaints forwarded to County Zoning Administrator. If ther
are parking problems reported within this time, the County would ask the
Highway Department to erect Ino parking' signs.
The Board concurred with this suggestion.
Mr. Gubala reported to the Board on the assistance his department
had received from students from VPI. The work and information provided by
the students to the County at no cost will provide the "framework" for the
Comprehensive Plan update.
Supervisor Minter noted that other area school students would
probably be will ing to work for the County and help themselves at the same
time, when they had to prepare a thesis, for instance.

Mr. Gubala presented information regarding the need to hire a
Planner for the Development Department.
Since being promoted to the Department of Development, the work
load has become increasingly heavy, even with the assistance of the VPI
graduate planning students. There are projects now underway or scheduled,
that a planner is needed to work on, including the final ization of the
Subdivision Ordinance; a Capital Improvement Program; and the revision
of the Zoning Ordinance. For these reasons, Mr. Gubala requested that the
Board of Supervisors authorize the employment of an additional planner.

The staff had requested the Board's guidance regarding this matter.

SIGN REGULATIONS
Mr. James E. Buchholtz, County Attorney presented to the Board
a copy of the ordinance amending Article XVI I. Sign Regulations of Chapter
21. Zoning of the Roanoke County Code as amended by the Board at the
August 24th meeting for their review. After review of this amendment, the
Board wished to make any changes their recommendations can be made at the
next meeting. It was noted that the ordinance is being enforced.

Supervisor Myers requested the appointment of a representative to
the Industrial Development Authority from the Catawba Magisterial District
be continued to the next meeting to allow him time to consider the matter.

RESOLUTION NO. 3329 RATIFYING AND APPROVING THE PURCHASE OF
CERTAIN EXCESS INSURANCE RELATED TO THE ROANOKE COUNTY EMPLOYEE'S
HEALTH PLAN
BE IT RESOLVED by the Board of Supervisors of Roanoke County,
Virginia, as follows:
1. That that certain offer of the Harbour Insurance Company to
provide excess insurance coverage over and above the $25,000 per employee
1 imit establ ished by the Board, upon all and singular the terms and
conditions of said proposal, for the premium set out in such proposal
and heretofore bid by Harbour Insurance Company be, and said proposal
hereby is, approved, ratified, and confirmed in all respects; and
2. That the appropriate officials of the County and of the Roanoke
County Employee's Health Plan be, and they hereby are, authorized and
directed, and their actions relating to such excess insurance heretofore
taken are, fully approved, ratified, and confirmed, and all such actions,

SUPERVISORS' COMMENTS
Supervisor Nickens expressed concern regarding establishment of a
procurement policy which would secure for the County the best possible
procedure for use of the taxpayer's money. Mr. Buchholtz provided a draft
of a Procurement Pol icy for the Board to review. The pol icy is to be
considered at the December 7th Work Session.
Supervisor Myers asked Mr. Flanders to look into the possibil ity of
the State making improvements to a dirt road, State Route 620.
Supervisor Myers also asked Mr. Flanders to somehow get gasol ine
pumps monitored so as to control the flow of gasol ine into County cars instea
of "out of" County cars. With another year coming up, it was requested that
Mr. Flanders put some time into this and come back to the Board with a
recommenda t ion.
Supervisor Minter mentioned complaints of cancellation of karate
classes at a Southwest County location in order that other recreation
department programs could be conducted. Mr. Shell has been informed of
the complaints. Supervisor Johnson stated that certain seasonal sports,
such as basketball, has precedence over karate.
Supervisor Minter asked for a progress report concerning the
developments in workfare from the Department of Social Services.
Supervisor Minter stated he would 1 ike to see the County adopt
stricter conflict of interest laws.

Supervisor Johnson mentioned the sale of Christmas trees by the
Cave Spring Jaycees on the Mick-or-Mack parking lot.
Supervisor Johnson stated she felt the schedul ing of recreational
activities is the problem of Mr. Shell.
She requested an update on the installation of a street light at
the Bridlewood Subdivision entrance on to Highway 221.
Supervisor Johnson also requested that something besides a desk
be used as a divider in Mr. Fred Anderson's office.
Supervisor Johnson presented 2 large United States flags to
Chairman Burton for the County's use and stated she would like for them
to be flown at the dedication of the new Roanoke County Administration
Center on December 4th.
Chairman Burton wanted to know the status of the Energy Task Force
questionaire. It was noted that Mr. Leonard Leask had taken care of this
and any information will be presented to the Board.
Chairman Burton stated she did not 1 ike the format of the present
minutes of the meetings and asked that only the official actions taken by
the Board be recorded. She noted the School Board's minutes as being more
concise and suggested we follow this example. Mr. Buchholtz noted the
resolutions and appropriations should be set out and recorded as they are
now being done. Also, that some information in discussions should be
summarized, as in the case of someone voting no on a motion. On motion
by Supervisor Minter and carried by the following recorded vote, the
minutes should contain the official actions of the Board and the gist of
the conversations should be summarized. Also, the recorded tapes of the
minutes are to be kept on file for four (4) years and then destroyed.

WHEREAS, the North American Council on Adopted Children, in an
effort to draw attention to the joys and benefits of adoption by encouraging
adoption parents and agencies to publ icize adoption information, have
determined to establ ish the week of November 21-27, 1982, as Adoption
Week across the nation; and
WHEREAS, the Board of Supervisors and the citizens of Roanoke
County believe that family 1 ife in Roanoke County and across the nation
can be enhanced through utilization of the adoptive process for both
adults and children.
NOW, THEREFORE, I, Athena E. Burton, Chairman of the Board of
Supervisors of Roanoke County, Virginia, do hereby proclaim the week of
November 21-27, 1982, as
NATIONAL ADOPTION WEEK IN ROANOKE COUNTY
and do most sincerely and earnestly urge all citizens of Roanoke County
to participate in and promote the goals of National Adoption Week.
