2/24/1981 - Regular 2-24-81 ( 1, ,~) Board of County Supervisors Salem-Roanoke County Civic Center Salem, Virginia February 24, 1981 The Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the fourth Tuesday and the second regular meeting of the month of February. Members present: Vice Chairman Lawrence E. Terry, and Supervisors May W. Johnson, Edward C. Park, Jr. and T. M. White. Members absent: Chairman Robert E. Myers. IN RE: CALL TO ORDER: The meeting was called to order by Acting Chairman Lawrence E. Terry at 6:00 p.m. IN RE: TREASURER: Alfred C. Anderson, Treasurer, informed the Board that in addition to the two reports submitted (received in file further into the meeting) he would like to address the Board regarding repurchase agreements with Colonial American National Bank. Mr. Anderson. reminded the Board that we have these agreements with other area banks. RESOLUTION NO. 2798 DESIGNATING COLONIAL AMERICAN NATIONAL BANK AS A BANK WITH \JHICH CERTAIN AGREEMENTS BY AND BETWEEN SAID BANK AND THE COUNTY OF ROANOKE MAY BE EXECUTED. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Colonial American National Bank is hereby designated as a bank with which certain agreements by and between this bank and the County of Roanoke may be executed, it being recommended by the Finance Board of the County of Roanoke that it is in the best interests of the County of Roanoke to enter into deposits of funds of the County pursuant to appropriate repurchase agreements with the several banks doing business in the Roanoke Valley community; and 2. That upon receipt of appropriate bids for the deposit of such funds and repurchase agreements the Colonial American National Bank be, 2-24-81 () and it hereby is determined to be authorized to provide such repurchase agreements for execution by the County of Roanoke as made and provided by law. AYES: NAYS: ABSENT: Supervisors Johnson, White, Park and 'Terry None Chairman Myers IN RE: COLLECTION OF SEWER AND \vATER AND REFUSE BILLS Alfred Anderson reminded the Board that we previously set up a collection of sewer and water bills with Colonial American National Bank and First National Exchange Bank on a three-month trial basis. He stated that in his opinion, this method of collection is successful for the benefit of the County. John Chambliss, Director of Finance, has held meetings with the various area banks to come up with an equitable rate for collecting these bills. The banks are offering from IO~ to 25~ an item to handle these collections. Mr. Chambliss said he felt there should be a uniform amount among the banks for this service. After corresponding with the banks, Mr. Chambliss stated that Colonial American and First National Exchange Banks were not willing to negotiate on the amount of the collection fee~ but all other banks indicated their willingness to do so. After further discussion, Supervisor Park moved to have the County Treasurer offer Colonial American and First National Banks a 15~ per item fee for the collection and if they are unwilling to accept that offer, we will use other banks in the area who will find that amount acceptable~ motion adopted on the following recorded vote. (5) Correspondence from Roanoke City Council listing Council's appointments to the Roanoke Valley Industrial Fact Finding Commission and which specifies the Chairman and Vice-Chairman of toe Commission. (6) Progress reports from Roanoke Valley Cablevision, Inc. (7) Correspondence from Valley Metro regarding delay in providing bus service between downtown Roanoke and the Hollins area. (8) Correspondence from T. P. Parker & Son on behalf of Mr. W. J. Beason, Jr. advising that the site of his new home has been moved out of the flood plain along Mason's Creek and that a public hearing on amending the County Flood Plain Ordinance is no longer necessary. AYES: Supervisors Johnson, White, Park, and Terry NAYS: None ABSENT: Chairman Myers IN RE: EXECUTIVE SESSION On motion of Supervisor Johnson and a unanimous voice vote, the Board went into Executive session at 6:20 p.m. to discuss legal and real _ estate matters. IN RE: OPEN SESSION Acting Chairman Terry called the meeting to order at 7:05 p.m. I~ RE: INVOCATION Invocation was offered by the Rev. Fred A. Jordan, Trinity Church of the Brethren, 419 Adele Circle, Salem, Virginia; and the Pledge of Allegian e to the Flag was offered in unison. IN RE: APPROVAL OF MINUTES Acting Chairman Terry stated that the minutes for the last meeting will be approved at the next meeting. IN RE: STATEMENT REGARDING TAX RATE Supervisor White read a prepared statement and stated that in "the past weeks several statements have been made to the news media by the Administration and School Administration, some were true, others were erroneou . We've not seen a budget from the School Board or from the County Administrator to date. The Board of Supervisors' need to keep an open mind when setting 2-24-81 a tax rate ceiling on the proposed tax rate here tonight. There's been no letter writing campaign on behalf of our firemen, policemen, the folks who pick up our trash, or from any other County employee for that matter. We want to see that all our Company employees receive the best salaries and wages possible. In order to do this we need to tighten our financial belts as we do in our personal and business lives, and certainly in our local Govern- ~ent. I support the School system in Roanoke County and in the City of Salem but I also support our other County employees. It is not my intent to reduce any level of services but ~Je must see that each tax dollar collected is used to the fullest extent. In order to keep an open mind about our tax rate and to look at the entire budget objectively, I would like to make a motion that we set a ceiling on our tax rate of $1.25 per $100.00 valuation. That is only a ceiling. Acting Chairman Terry asked for a vote on Supervisor ~fuite's motion of $1.25 per $100.00 valuation for a ceiling tax rate. She further stated the Board is concerned with the School system and their programs and that this rate is the ceiling and that means no higher than that; and we will scrutinize the budget from every source from the County's side and work very diligently to make our tax dollar go just as far as it can. IN RE: CITIZENS ON THE TAX RATE Approximately 500 citizens attended this meeting and several in attendance represented the School system who favored their budget not being cut and recommended a tax increase in order to achieve their budget goals. Several citizens spoke in favor of the tax increase and others spoke in opposition to the increase, especially the elderly. IN RE: RECESS Acting Chairman Terry called for a recess at 7:45 p.m. IN RE: CALL TO ORDER The meeting was again called to order at 8:25 p.m. IN RE: ABANDONMENT OF OLD GARST MILL/CAVE SPRING ROAD LOCATED IN THE WINDSOR HILLS DISTRICT FINAL ORDER NO~v, THEREFORE, BE IT RESOLVED and ORDERED that at this meeting of the Board of Supervisors of Roanoke County, Virginia, held on the 24th day of February, 1981, the Board took action that a section of the Old Garst Mill- Cave Spring Road be, and the same is hereby permanently closed, discontinued and vacated, said portion of Old Garst Mill-Cave Spring Road being more fully described as follows: BEGINNING at a point at the northeasterly right of way of the existing Old Cave Spring Road and the northerly right of way of the Old Garst Mill-Cave Spring Road, also a corner of a tract of land the property of the Roanoke County Board of Supervisors; thence, with the northerly right of way of the said Garst Mill-Cave Spring Road and with the line of the tract of the Roanoke County Board of Supervisors S. 60 deg. 51' 41" W. 191.17 feet to a point, said point being on the northeasterly line of a new private access road to the tract of the Roanoke County Board of Supervisors; thence, leaving the northerly right of way line of the said Old Garst Mill-Cave Spring Road and with the northeasterly line of the said private road S. 61 deg. 24' 12" E. 17.42 feet to a point on the southerly right of way of the said Old Garst Mill-Cave Spring Road, said point further being on the line of a second tract belonging to the Board of Supervisors of Roanoke County; thence, with the southerly line of said Old Garst Mill-Cave Spring Road and with the tract of the Roanoke County Board of Supervisors N. 60 deg. 02' 45' E. 186.23 feet to a point where the said Old Garst Mill-Cave Spring Road intersects the westerly right of way of the Old Cave Spring Lane; thence, with the westerly right of way line of the Old Cave Spring Lane N. 48 deg. 52' IS" W. 12.83 feet to the point of beginning and containing .0583 acres. After some discussion regarding this amendment, Supervisor Johnson moved to continue the public hearing until the next meeting March 10th; adopted by unanimous voice vote. IN RE: REPORTS OF DEPARTMENTS, OFFICERS, AND COMMITTEES IN RE: RESOLUTION NO. 2800 AUTHORIZING THE EXECUTION OF AN EXTENSION OF AN AGREEMENT lHTH BONSACK RURITAN CLUB ALLOWING USE OF THEIR BUILDING BY THE PARKS AND RECREATION DEPARTMENT. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That a certain agreement executed on April 21, 1978 between the Board of Supervisors and the Bonsack Ruritan Club for a one year period and renewable for successive yearly periods, allowing the Parks and Recreation Department to use the Ruritan Club building for recreation programs, be and hereby is extended for a one year period; and 2. That the County Administrator is hereby authorized to enter into an extension of this agreement on a form approved by the County Attorney. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board hereby waives the requirements of the Roanoke County Water Ordinance contained in Section 20.1-5 of the Roanoke County Code as they pertain to only the right to provide service in regard to Belleview Gardens Subdivision, Section 4, said waiver being based upon a demonstration by the property owners that strict compliance with the provisions of the above section of the Water Ordinance would impose an undue hardship and burden upon the property owners, the construction standards set forth in said ordinance to, however, remain in full force and effect; and 2. He further requested the Board's authorization to publish a synopsis of Exhibit F as required by the Code of Virginia. That a certain contract having been executed March 1, 1977 between the County and Lucky's Hobile Communications for a one year period and successive yearly periods, if agreed to by the parties, for preventive maintenance and emergency service to the County's communication equipment, be and hereby is extended for a one year period; the monthly service charge on this contract to be $1,781,50; and 2. That the County Administrator is hereby authorized to enter into an extension of this contract on a form approved by the County Attorney. This Board consists of a nember appointed from each city and county in the Fifth Planning District of Virginia. IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Park inquired as to the status of securing data processin equipment for the County. Administrator Clark informed that he does now have draft specs for the equipment. Mr. Park further inquired of Andy Clingenpeel, Assessor, the status of tax relief for the elderly this year. Acting Chairman Terry read aloud the list of citizens who comprise the newly formed Roanoke Valley Industrial Fact Finding Co~~ission. IN RE: EXECUTIVE SESSION At 9:20 p.m. the Board went into Executive session on motion of Supervisor Johnson and a unanimous voice vote.
