4/30/1981 - Regular 4-30-81 411 Board of Supervisors Salem-Roanoke County Civic Cent Salem, Virginia April 30, 1981 The Board of Supervisor~ of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, to continue the meeting recessed on April 28, 1981. Members present: Chairman Robert E. Myers, Vice-Chairman Lawrence E. Terry, and Supervisors May W. Johnson, Edward C. Park, Jr. and T. M. White. IN RE: CALL TO ORDER Chairman Myers called the meeting to order at 7:00 p.m. and informed those present that this meeting is continued from April 28, 1981. Chairman Myers further welcomed Supervisor White to the meeting and expressed apprec- iation on behalf of the Board for his attendance due to his recent illness. IN RE: REQUEST OF RICHARD E. CLARK TO REZONE FROM BUSINESS DISTRICT B-2 TO BUSINESS DISTRICT B-3, A PARCEL OF LAND CONTAINING LESS THAN ONE ACRE AND BEING LOT 3, BLOCK 2, SECTION 1, OF NORTH HILLS IN THE HOLLINS MAGISTERIAL DISTRICT. * * CONTINUED * The purpose of this rezoning is so that an existing building may be used as an eat-in restaurant. Charles H. Osterhoudt, Attorney, was present to support this request and his client, Richard E. Clark was also in attendance. Since the public hearing of April 30, 1981, Mr. Clark stated they have withdrawn their app1icat n for an ABC license and have decided not to have a lounge and live music in the restaurant; a copy of letter for the withdrawal was submitted and filed with the petition for this request. Some citizens in opposition were also in attendance and stated their disapproval of the proposed rezoning. After some discussion Supervisor White moved to continue this public hearing in order that he could have a chance to view the site for said proposal; adopted by unanimous voice vote. I I I I I I 4-30-81 l 472 IN RE: REQUEST OF WHEELS, INC. FOR A SPECIAL EXCEPTION PERMIT * TO OPERATE A USED CAR DEALERSHIP IN BUSINESS DISTRICT * APPROVED B-3 AT 6626 WILLIAMSON ROAD IN THE HOLLINS MAGISTERIAL * DISTRICT. * Mr. Robert C. Puckett, President of Wheels, Inc. was in attendance and no one appeared in opposition. Supervisor White was informed by Mr. Puckett that he plans to carry around 40 cars on the lot and reviewed the hours of operation, 8:00 a.m. to 9:00 p.m. during daylight saving time and 8:00 a.m. to 8:30 p.m. during eastern standard time. Supervisor White moved to approve the permit on the condition that only 35 cars be carried on the lot for sale; adopted by the following recorded vote. AYES: Supervisors Park, Terry, White, Johnson and Myers NAYS: None IN RE: SCHOOL ADMINISTRATION BUDGET Supervisor White stated "I move to adopt a budget for fiscal year 1981-82 for the Roanoke County School Division in the total amount of $40,926,996.00, comprised in part from a sum derived from local revenues of Roanoke County in an amount not to exceed $17,204,000.00; provided however, and accepting the recommendation of Supervisor Edward Park, I further move, upon assurance from the Roanoke County School Board that funding of Roanoke County recreational program use of school facilities shall be continued and that a full day kindergarten program will be continued, that the sum of $91,000 and $190,000.00, respectively, shall be added to the basic Roanoke Cou y funding for schools making a total local budget amount for such purpose of $17,485,000.00 and likewise adjusting the total budget amount accordingly; al of which shall be hereafter appropriated by duly adopted appropriation reso- lution of the Roanoke County Board of Supervisors setting forth the appropr- iation to the Roanoke County School Division by major categories. Motion of Supervisor White was adopted by the following recorded vote. AYES: Supervisors Park, Terry, White, and Johnson NAYS: Supervisor Myers IN RE: REAL ESTATE TAX RATE FOR 1981 Supervisor Terry immediately moved to set the 1981 County real estate property tax rate at $.94 per $100 of assessed valuation. 4-30-81 473 "" Supervisor Myers stated "I don't think we have the amount of money some people are optimistic about and I'm afraid $.94 will not cover all the things being considered here tonight and I cannot support $.94 imposed on the people of Roanoke County, so I vote no ." Supervisor Johnson stated "I have been telling people we need a I $1.00 tax rate and tonight I'm voting for $.94 because the State sent us one-million dollars. RESOLUTION NO. 2852 SETTING THE TAX LEVY ON REAL ESTATE SITUATE IN ROANOKE COUNTY FOR THE CALENDAR YEAR 1981 BE IT RESOLVED that the levy for the twelve-month period beginning January 1, 1981 and ending December 31, 1981, be, and it hereby is set $.94 per ONE HUNDRED DOLLARS of assessed valuation for a tax rate of on all classes of taxable real estate and mobile homes as classified by Section 58-829.3 of the 1950 Code of Virginia, as amended, situate in Roanoke County. Adopted on motion of Supervisor Terry and the following recorded vote. I AYES: Supervisors Park, Terry, White and Johnson NAYS: None IN RE: RECESS Chairman Myers called for a recess at 7:25 p.m. IN RE: RECONVENEMENT Chairman Myers again called the meeting to order at 7:40 p.m. IN RE: REQUEST FOR PARTICIPATION CONTRACT RESOLUTION NO. 2853 AUTHORIZING THE COUNTY OF ROANOKE TO ENTER INTO A REIMBURSEMENT CONTRACT WITH PAUL BLACK IN REGARD TO HIS PROPERTY LOCATED ON CARVIN STREET UPON CERTAIN TERMS AND CONDITIONS. I BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County of Roanoke be, and it hereby is authorized to enter into a certain reimbursement contract which will provide for reimbursement to the developer from connection fees for his costs actually ~ I I I /JJ'~'uf ,,~ 4-30-81 474 expended in the construction of those sewer and water lines estimated to be 1,500 feet for off-site sewer and 700 feet for off-site water, upon all and singular the terms, conditions and provisions more fully set out in said contract; and 2. That the County Administrator is hereby authorized and directed to execute said contract on behalf of Roanoke County upon a form approved by the County Attorney. Adopted on motion of Supervisor Terry and the following recorded vote. AYES: Supervisor Park, Terry, White, Johnson and Myers NAYS: None IN RE: HEARING OF CITIZENS Wayne Compton, Commissioner of Revenue, stated that some people thought he had a financial interest in the property which is under consider- ation for rezoning at the request of Richard E. Clark. He further stated this is not the case and feels the County might consider the requirement of a sign on property indicating such property is being rezoned in order that citizens are more aware of the circumstances. Mrs. Shirley Black, President of the Roanoke County Council of PTA's, read aloud a statement commending the Supervisors and School Board for their efforts in setting a tax rate and school budget and expressed the feeling that not all residents were competely satisfied but since that is an impossible task, much had been done to keep the quality of education in Roanoke County at the present high level. IN RE: ADJOURNMENT On motion of Supervisor Park and a unanimous voice vote, the Board adjourned at 7:45 p.m.
