6/9/1981 - Regular 6-9-81 5'07 Board of Supervisors Salem-Roanoke County Civic Center Salem, Virginia The Board of Supervisors of Roanoke County, Virginia, met this day in I open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the second Tuesday and the first regular meeting of the month of June. Members present: Chairman Robert E. Myers, Vice Chairman Lawrence E. Terry, and Supervisors May W. Johnson, Edward C. Park, Jr. and T. M. White. IN RE: CALL TO ORDER Chairman Myers called the meeting to order at 6:00 p.m. IN RE: ITEMS SUBMITTED FOR INFORMATION ONLY On motion of Supervisor Johnson and a unanimous voice vote, the following items were received in file. (a) Accounts Paid for June from the Director of Finance I (b) Referrals to Planning Commission IN RE: SHERIFF'S DEPARTMENT Sheriff O. S. Foster informed the Board that the Department of Corrections will fund two-thirds of the salary for a Training Officer to be provided for the Sheriff's Department. He stated this is a much needed position and through normal turnover in the department, the remaining one- third of the salary would be withip the budget, therefore, no additional appropriation of funds is necessary. Sheriff Foster asked the Board's concurrence in hiring a Training Officer to train Sheriff's Department personnel. Sheriff Foster was informed by the Board this matter would be I taken into consideration at the final budget study. 6-9-81 508 IN RE: POLICE ACADEMY Capt. Mike Kavanaugh submitted a letter explaining that basic training for the Sheriff's Department has been by way of guests through I the Roanoke City Police Academy. Therefore, the County has not had input into the training session. Since the situation regarding funds is unknown for the City of Roanoke, the Department requests they be allowed to join the training at the Police Academy at New River Community College at an annual cost of $5,740.00. This joinder would enable the County to have input into the training sessions. The Board took this matter under advisement for the budget session. IN RE: EXECUTIVE SESSION On motion of Supervisor Johnson and a unanimous voice vote, the Board went into Executive Session at 6:20 p.m. to discuss personnel, real estate and legal matters. Adopted on motion of Supervisor Park and the following recorded vote: AYES: Supervisors Terry, White, Johnson, Park and Myers NAYS: None IN RE: PROPOSED AMENDMENT TO SECTION 8.2-6 OF THE ROANOKE COUNTY CODE WHICH REGULATES THE DESIGNATION OF FIRE LANES IN ROANOKE COUNTY. Supervisor Johnson stated this was brought about on behalf of the residents of Stonehinge because the developers felt it would be beneficial in that area and in Roanoke County. ORDINANCE NO. 2872 AMENDING SECTION 8.2-6 OF THE ROANOKE COUNTY CODE REGULATING FIRE LANES BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Section 8.2-6. Generally of Article II. Fire Lanes of Chapter 8.2. Fire Protection be repealed. 2. That there be, and there hereby is enacted a new section to be numbered 8.2-6 to read and provide as follows: Section 8.2-6. Generally. The fire marshall shall designate fire lanes on public streets, private roads or private property used for commercial purposes, apartment complexes, planned unit developments, nursing, retirement and convalescent homes, industrial or educational uses as follows: (a) Establishments; purpose. Fire lanes shall be established for the purpose of regulating parking in front of or adjacent to fire hydrants and for access by firefighting equipment and other emergency vehicles. ~ .... ... Markings and approved signs to designate such lanes shall be provided by the owner or agents of the property involved, under guidelines established by the fire marshal. I (c) Policy concerning fire hydrants. The following policy shall apply where fire hydrants are located: (1) Where hydrants are located at or close to the curb line or edge of the road and face on the public street, a public parking lot or a private road open to the public, parking within fifteen feet is prohibited. (2) A special curb, marking designated areas established pursuant to paragraph (1) of this subsection, shall be required and shall be yellow. (3) No person shall use, tamper with, damage or destroy any fire hydrant, valve or water distribution main; except, that any legally constituted fire department may use such hydrants for firefighting or training purposes. (4) No planting or erection or other obstruction shall be allowed within four feet of any hydrant. (5) All hydrants shall be painted in accordance with standards established by the fire marshal. (d) Policy concerning fire lanes. The following policy shall apply where fire lanes are established: I (1) A fire lane shall be designated where, in the oplnlon of the fire marshal, it is desirable that certain roads, areas and building access and egress facilities be kept clear for fire department and ambu- lance emergency equipment and other equipment provided for fire protection. Fire lanes shall be a minimum of ten feet in width from the curb where curbs are in existence; or from the pavement edge, where no curbs are in existence. (2) Signs, as required, shall be as follows: a. The design of the signs shall be as approved in the state manual on uniform traffic control devices and shall include the language "No Parking - Fire Lane." b. The signs shall be located so as to provide at least one sign for everyone hundred feet of fire lane space; however, should the fire marshal determine that additional signs are necessary, the owner shall locate such signs as the fire marshal determines are necessary to provide that the signs are in proper position and sufficiently legible to be seen by an ordinarily observant person. c. The signs shall be placed as follows: I Pavement edge to sign edge. . . Rural: Not less than 6'; nor more than la' Urban: Not less than 1'; nor more than 3' Curb face to sign edge. . . . . Rural: Not less than 1'; nor more than 3' Urban: Not less than 1'; nor more than 3' Pavement top to sign bottom. Rural: Urban: Rural: Urban: 5' 7' 5' 7' Curb top to sign bottom. d. Posts for signs, where required, shall be metal and 6-9-81 515 securely mounted. e. The curb or pavement edge of all fire lanes shall be painted yellow. Any existing marking in the area designated as a fire lane shall be obliterated or painted over in a manner approved by the fire marshal. IN RE: PROPOSED AMENDMENT OF SECTION 14-8 OF THE ROANOKE COUNTY CODE SETTING THE RATES FOR REFUSE COLLECTION IN ROANOKE COUNTY. Chairman Myers stated he felt these new rates should become effective January 1, 1982 since the citizens have an increase in real estate rates for this year. Supervisor Johnson informed those present that rates for this servic have not been increased since 1976. Supervisor Park stated that if this increase is delayed we will have connection with water and sewer. I problems because of some payments coming due to the City of Roanoke in ORDINANCE NO. 2873 AMENDING SECTION 14-8 OF THE ROANOKE COUNTY CODE SETTING THE RATES FOR REFUSE COLLECTION IN ROANOKE COUNTY BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That Section 14-8. Rates generally of Article II. Garbage Collection of Chapter 14. Refuse and Garbage be and the same hereby is repealed. 2. That there be, and there is hereby enacted a new section to be numbered 14-8 to read and provide as follows: Section 14-8. Rates generally. The following rates shall apply for the provision of garbage collection service: I Single-family residence $15.00 quarterly Apartments and trailer parks single location individual service $12.00 quarterly same as single family Commercial weekly pickup $25.00 quarterly 6-9-81 516 twice weekly $50.00 quarterly Disposition of materials deposited in disposal area by business, firm or corporation for refuse originating in county $ 2.50 per ton I Dumpster containers $12.50 per trip This amendment to take effect on July 1, 1981 Adopted on motion of Supervisor Terry and the following recorded vote. AYES: Supervisors Terry, Johnson and Park NAYS: Supervisors White and Myers IN RE: SALE OF PROPERTY OWNED BY THE COUNTY AND LOCATED ON COOK DRIVE James Buchholtz, County Attorney, stated an offer has been I received for the purchase of certain property with the provision of a one- year option for the amount of $10,000. If the option is not exercised, the County will retain the $10,000 but if option is exercised, then the $10,000 will become a portion of the total purchase price of $175,000. On motion of Supervisor Terry and the following recorded vote, it was approved to accept the offer with option included. RESOLUTION NO. 2874 ACCEPTING AN OFFER TO PURCHASE CERTAIN COUNTY PROPERTY AND GRANTING AN OPTION THEREFOR. BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That that certain offer to purchase approximately fourteen acres of land situate, lying and being in the City of Salem and owned by I the County of Roanoke for the full sum of $175,000.00, the same to be subject to a certain option for a period of one year from the date hereof for which the prospective purchaser shall pay the sum of $10,000.00 to be forfeited upon the failure of the prospective purchaser to exercise said option within the said period of one year, is accepted; and 2. That in order to consummate the sale and option agreement herein provided for the County Administrator be, and he hereby is r 6-9-81 ~17 authorized and directed to execute all documents needful and necessary to fully consummate the said option agreement and subsequent sale should said option hereafter be exercised as herein made and provided and to take such other actions as may be needful and necessary in the premises all of which actions and documents shall be in form approved by the County Attorney. I AYES: NAYS: Supervisors Terry, White, Johnson, Park and Myers None IN RE: COUNTY BUDGET FOR FISCAL YEAR 1981-82 Bruce Mayer, Interim County Administrator, stated the total amount of the 1981-82 budget is $73,606,400.00. No new capital equipment is included in the budget for this fiscal year and that 22 positions will be eliminated, 16 of which are vacant and will not be filled. Several organizations and citizens were present to discuss funds to be included in this budget: Matilda Bradshaw with TAP was present and outlined the programs presented through TAP this year and asked for the Board's continued support. Virla Jo Wirth, Mental Health Services, was present and recapped the programs offered to County citizens and also asked funds to be provided in this budget. Mr. Roy Crowe, Chairman of Roanoke County Fire Chief's Board, requested that the position of Fire Coordinator be reinstated in the budget in order to keep the fire services what it is today. Mr. Robert Blanchard from ITT, Inc. was present and stated they have an investment of $25 million dollars and 700 employees in that company and depend heavily on the firemen- in the event of an emergency. Mr. Blancha said he feels the Fire Coordintor's role is extremely important and should be continued. Mr. Tony Wirt was present to represent the rescue squads in the County. He stated that there are three emergency agencies in the County and that three Supervisors should not dictate the policies and requested the position of Fire Coordinator be reinstated and that Mr. Monroe be put in that position. I would like to propose a compromise and I cannot bring it up because I'm not eligible. The compromise is to re-establish the fire coordinator (position) and Mr. Monroe, until at least the first of the year so we can study the other options we have and get some input from the firemen and rescue men. We can't let the County people down. Give us a chance to work this out. If everything goes well, maybe we will keep it as it is." Chairman Myers said that during the past six years, since 1976-1980, the citizens have also supported the fire and rescue to the total amount of $6,537,001.29. We are trying as hard as you are but we have had a hard year as far as the budget is concerned. Supervisor White said he would like to echo what Mrs. Johnson said and he will work with Mrs. Johnson to put this position back and support the volunteers. Supervisor Terry stated that two-weeks ago he tried to offer some kind of a solution to get this matter settled. He further stated he had discussed this with Mrs. Johnson at 6:00 (before meeting) and "I will back Mrs. Johnson 100%." Roy Crowe, speaking for Fire Chief's Board informed the Supervisors they will work with them too for a solution and to keep the Fire Department going. Willis Buchanan, Hollins Fire Station #5, said it will be a pleasu;e to work with the Board in such a decision but "our backs are to the wall because at noon tomorrow, Roanoke County #5 intends to walk out. These are not threats, it is simply a way for us to pull ourselves together and reason together. We welcome the suggestion. I have heard at least three of you open to this suggestion and I would be highly pleased to hear two more say they will work with this suggestion. We hope that can be accomplished." County has requested and received two proposals (see report filed with the minutes of this meeting) and now would like to present this proposal to the Board for approval. On motion of Supervisor Johnson and a unanimous voice vote, the proposal was accepted. I Mrs. Mary Shelton, citizen of the area where project will be installed, stated those residents are unhappy about the proposed project and requests the County supply additional information to them regarding the project. Mr. Hubbard said he would send information to her. IN RE: CLARIFICATION OF RESPONSIBILITIES OF CERTAIN INDIVIDUALS IN THE UTILITY DEPARTMENT Bruce Mayer, Interim County Administrator, submitted a report to the Board which clarifies duties and responsibilities of the two department heads in the utility Department. AND THE SALEM RAIDERS HOCKEY TEAM. WHEREAS, Robert A. Payne, Sr. did establish the Salem Raiders Hockey Team in Salem for the 1980-81 season having moved said team from Utica, New York; and WHEREAS, the Salem Raiders Hockey Team has brought hours of entertainment to not only citizens of Salem, but the entire Valley, and has assisted with the expansion of youth hockey as well as helping with fund raising efforts for various organizations and has supported career days in local schools; and further, the Salem Raiders has assisted the general local economy in many ways. NOiv, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, that this Board is desirous of commending I Robert A. Payne, Sr. and the Salem Raiders for their ranking in the Eastern Hockey League and wishes to express appreciation for their many contributions to our community and the entire Valley. AYES: Supervisors Terry, White, Johnson, Park and Myers NAYS: None ~ 529 6-9-81 ~ IN RE: SPECIAL USE PERMIT REQUEST FROM SIDNEY LEE MUNCY Gene Robertson, County Engineer, stated he had inspected the pro- posed site for the dump to be constructed by Mr. Muncy and found it would block a natural drainage which drains 47.33 acres generating a ten-year storm equivalent. Mr. Robertson suggested that if the permit is approved, I Mr. Muncy should be required to install a 24 inch pipe for drainage. Supervisor Johnson instructed Mr. Robertson to write to Mr. Muncy, who was not present, and inform him of this pipe line. Mrs. Johnson further moved to continue this matter; adopted by unanimous voice vote. IN RE: HEARING OF CITIZENS Mr. Don Wharton expressed criticism of the Board's recent actions and said the change in government recently was to give us a good government but feels the Board is trying to oversee day to day operations and that this is an impossible job. Mr. Gary Minter addressed in particular "three members of the Board, I and said he feels there has been too much sneaky politics going on lately and cited some recent incidents which were questionable to him. He asked those members to "shape up or resign from the Board."
