Roanoke, V A 24015 Septem ber 27, 1983 The Board of Supervisors of Roanoke County, Virginia, met this day in open session at the Roanoke County Administration Center, Roanoke Virginia, this being the fourth Tuesday and the second regular meeting of the month of Septem ber, 1983. IN RE: CALL TO ORDER Chairman Johnson called the meeting to order at 3:17 p.m. The roll call was taken: MEM BERS PRESENT: Chairman, May W. Johnson; Vice Chairman, Harry C. Nickens; Supervisors Athena E. Burton, Gary J. Minter MEMBERS ABSENT: Supervisor Robert E. Myers IN RE: OPEN SESSION Work Session - Employee Health Insurance Chairman Johnson reiterated that the only vote the Board has made on the Plan to date was to extend the present coverage until June 30, 1984, and that effective January 1, 1984, the coverage would be put out for bids. Personnel Director Keith Cook outlined the language changes, rate structures, and excess insurance coverages that were made in the previous Work Session of September 14, 1983. After discussion the following motions were made and carried: Supervisor Burton moved to keep the $300 per participant out-patient diagnostic test reimbursement until coverage is bid, and the motion carried by a unanimous voice vote. Supervisor Nickens moved to adopt the language changes highlighted in yellow on the work sheets, and the motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Minter, Johnson NAYS: None ABSENT: Supervisor Myers 128 9-27-83 Supervisor Nickens moved to adopt the proposed rate structure with the County contribution to be $42 per month per employee effective November 1, 1983, and the motion carried by the following roll call vote. AYES: Supervisors Burton, Nickens, Minter, Johnson NAYS: None ABSENT: Supervisor Myers Supervisor Minter moved that the present contract with contribution C. Musgrove & Associates be continued through June 30, 1984; and that the health insurance coverage be rebid as soon as possible after January 1, 1984, to be effective July 1, 1984 - the date of the expiration of the present contract with contribution C. Musgrove & Associates. The motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Minter, Johnson NAYS: None ABSENT: Supervisor Myers Supervisor Nickens moved to increase the excess coverage from $25, 000 to $30,000, and the motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Minter, Johnson NAYS: None ABSENT: Supervisor Myers Work Session - User Fees - Superintendent of the Department of Fiscal Management requested that the fees recommended in his report be established for copies of maps and photocopies. Supervisor Burton moved the following fees be established for photocopies: no charge for the first five copies, the sixth copy charge is $1, and $.25 for each remaining copy. The copy fees for single-layered maps are $8 per sheet and $15 per sheet for composite maps. RESOLUTION NO. 83-181 ESTABLISHING FEES CHARGED FOR COPIES MADE ON THE COUNTY'S PHOTOCOPY MACHINES FOR PERSONAL USE AND/OR GENERAL PUBLIC USE BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, follows: 9-27-83 J') 9 . Superintendent of the Department of Public Facilities, Joh Hubbard, requested that the Board consider Secondary Highway needs and objectives i addition to the Six-Year Plan projects. John Peters presented an informational bookle published by the Highway Department in 1977 on the Six-Year Plan and a map outlinin traffic volume. Supervisor Burton requested accident and traffic count information Fred Altizer and Ron Stoots, of the Virginia Department of Highways and Transportation were present for this discussion of immediate and long-range needs. A public hearin will be scheduled for October 25, 1983. AYES: NAYS: ABSENT: IN RE: EXECUTIVE SESSION At 5:00 p.m. Supervisor Nickens moved to go into Executive Session pursuan to the Code of Virginia, Section 2.1-344(a) (1), (2), and (6) to discuss personnel, re estate, and legal matters. The motion carried by a unanimous voice vote. IN RE: OPEN SESSION At 5:32 Supervisor Minter moved to return to Open Session, and the motio carried by a unanimous voice vote. Work Session - Petitioned Water and Sewer Improvements John Hubbar requested comments from the Board regarding establishment of a policy for the I Q (\ t,) t.P 4 9-27-83 evaluation and financing of petitioned water and sewer improvements for those areas not served by public water and sewer. After discussing the lack of water supply, the health hazards, and the possibility of the petitioner and the County sharing the cost with the citizens who were present (Mr. William L. Brogran, Route 6, Box 188, Salem; Mr. & Mrs. Frank Taylor, 7903 Carvin Street, Hollins; and Mr. R. L. Bonn 7904 Carvin Street), the following suggestions were made: 1. Staff is to investigate the grant possibilities and work towards establishing a standard policy for the establishment of a petitioned improvements account. 2. Chairman Johnson requested a list of the health hazards involved. 3. Citizens were encouraged to contact their State and Federal legislative representatives. 4. County Administrator, Donald R. Flanders, will contact these citizens and advise them of their legislators' names and addresses in order that the citizens may contact their local representatives. That that certain bid of Cycle Systems, Inc. in the amount of $44,278.48, being the best bid submitted for a one year contract to place approximately fifty-five bulk containers at various locations throughout the County, upon all and singular the terms and conditions of the invitation to bid, the specifications of the County of Roanoke, the bidder's proposals, and the provisions of this resolution, be, and the same hereby is, ACCEPTED; and 2. That the County Administrator is hereby authorized and directed to enter into a contract upon a form approved by the County Attorney for this service; and 3. That the County of Roanoke be, and hereby is, authorized to enter int a contract with Appalachian Power Company to install underground electrical servic, to the Castle Rock Well No.2; and 2. IN RE: PUBLIC BEARINGS 9-27-83 1 ;i ~~~~ PETITION OF NELSON REPAIR SERVICES, INC. (WILLIAM M. NELSON) REQUESTING REZONING FROM R-3 TO B-2 OF A TRACT OF LAND CONTAINING 1.365 ACRES LOCATED AT 2222 ELECTRIC ROAD, S. W. IN THE WINDSOR HILLS MAGISTERIAL DISTRICT. REQUESTED TO BUILD RETAIL BUILDING FOR APPLICANT AND RENTAL CONDITIONS. APPROVED Mr. Richard Pattisall, attorney for the petitioner, reminded the Board th this public hearing was carried over from the September 13, 1983, meeting in order give the County Engineer and the staff a chance to view the drainage problems in t area and to allow the Highway Department an opportunity to look at the proposed plan. Supervisor Burton requested a report on the engineering study. Superintendent of t Department of Public Facilities, John Hubbard, reported that the plans were review with the Development Review Coordinator, Arnold Covey; and that additional informati is still required due to some complications on the ditch line, drainage complicatio , and also some computations to show the adequacy of down-stream channels. This w be required of any development that will locate on this site, and no building permit c be issued until all requirements are satisfied. Supervisor Burton verified that at t s point the rezoning is not relevant to the above problems and that the type of buildi plan is not part of a rezoning consideration unless it is part of the Proffered PIa Mr. Bob Plasters, 4958 Bower Road, S.W., Roanoke, spoke in oppositi to this request and indicated that the Board rejected rezoning of this property a f years ago for the operation of a floral shop. Supervisor Nickens moved that the petiti n be granted. FINAL ORDER NOW, THEREFORE BE IT ORDERED that the aforementioned tract of la , more particularly described below, be rezoned from R-3 to B-2, 1.365 acres, being t e northerly part of Lot #2, Section No.2, City View Heights, as shown on a surv y prepared by Jack G. Bowers, of St. Marks Lutheran Church, were present to inform the Board of the urgent need for a youth haven for girls in Roanoke County and to request support. Supervisor Nickens moved to support this concept, and the motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Minter, Johnson NA YS: None ABSENT: Supervisor Myers 9-27-83 I '~ 1',""', ' , t...I' 4 IN RE: REPORTS AND INQUIRIES OF BOARD MEMBERS Supervisor Myers - was absent. Supervisor Burton - no report. Supervisor Minter - no report. Supervisor Nickens - questioned the circumstances under which the Bealt Department is planning to relocate, and whether the County has had any input into thO decision. County Administrator, Donald R. Flanders, has contacted Dr. Welch, of th Health Department; and she is to forward the materials to him. Since the Board ha no input into this decision, Supervisor Minter moved that a formal written explanatio be requested from the Health Department, and the motion carried by a unanimous voic Supervisor Nickens read two letters concerning the joint operation of th Salem-Roanoke County Civic Center. Supervisors Nickens' communication with the Cit of Salem dated September 15, 1983, outlined five items in a proposal to turn ov operation of the Civic Center to the City of Salem. The five items were as follow (1) Roanoke County to pay Salem $150,000 immediately. (2) Roanoke County to pa Salem $100,000 on July 1, 1984. (3) Roanoke County to pay its share of the June 3 1983, deficit. (4) Roanoke County to pay its share of audited deficit August, 1983. (5) Roanoke County to pay its debt service as scheduled. E. Taliaferro's letter dated September 27, 1983, indicated that the proposal is acceptab with the exception of changing the audit and closing date from the end of August t the end of September, and that details will be worked out by respective Chairman Johnson requested Supervisor Nickens to point out the considerable savin that will result to Roanoke County because of this sale. Supervisor Nickens inform the citizens that Roanoke County does not own the land on which the Civic Center located. The actual County expenses for operation of the Civic Center are in exce of $150,000 per year. This does not include repairs and equipment replacement to 16-year old building, and that a conservative 10-year estimate of savings would be 0 excess of $2,000,000. 138 9-27-83 Supervisor Nickens then moved to accept the proposal from the City of Salem, and the motion carried by the following roll call vote: AYES: Supervisors Burton, Nickens, Minter, Johnson NAYS: None ABSENT: Supervisor Myers Chairman Johnson - reminded the Board of the Fire Chief's Dinner Meeting at Lakewood on October 27 at 7:30, the Fire & Emergency Services picnic on October 2 at the American Legion, and the October 4 Board Meeting at Bonsack at 6:30 p.m. A letter was read by the County Administrator from Susan Knight, Executive Director of the Easter Seal Society in Maryland proposing Halloween safety through a program of cooperation between the Easter Seal Foundation and WSLS-TV. The County Administrator and the Board Chairman both supported this program. The following proclamation was presented by Chairman Johnson separate from this Board Meeting designating October as United Way Month: PROCLAMATION PROCLAIMING UNITED WAY MONTH AND ESTABLISHING UNITED WAY FUND CAMPAIGN KICK-OFF DAY IN ROANOKE CO UNTY, VIRGINIA WHEREAS, for many years in Roanoke County, the Roanoke Valley, and the Commonwealth of Virginia, United Way and specifically, United Way of Roanoke Valley, Inc., has offered citizens the opportunity to express their community spirit through service to worthy causes, by raising funds to assist volunteer agencies to aid in the provision of social services to all of our citizens. NOW THEREFORE, by virtue of authority vested in me as made and provided by law, I, May W. Johnson, Chairman of the Board of Supervisors of Roanoke County, do hereby proclaim October, 1983, as, UNITED WAY MONTH in Roanoke County, Virginia; and DO FURTHER PROCLAIM September 19, 1983, as, UNITED WAY CAMPAIGN KICK-QFF DAY in Roanoke County and do respectfully request that each of the other local governments in the Roanoke Valley join with me in this most worthy endeavor. 9-27-83 139 IN RE: REPORTS OF OFFICERS, DEPARTMENTS AND COMMITTEES County Attorney - no report. County Administrator - presented the following ordinance relative t disclosure of holdings. Supervisor Nickens moved the ordinance deleting Roanoke Count Civic Center Commission: ORDINANCE NO. 83-174 REQUIRING DISCLOSURE OF PERSONAL AND FINANCIAL INTEREST OF CERTAIN COUNTY OFFICERS, OFFICIALS, AND EMPLOYEES PURSUANT TO ~2.1-613 OF THE 1950 CODE OF VIRGINIA BE IT ORDAINED by the Board of Supervisors of Roanoke County, Virginia, follows: 1. That in addition to the members of the Board of Supervisors of Roanok County the following persons occupying certain positions of trust appointed by the Boar of Supervisors be, and they hereby are, designated and directed to file as a conditio to assuming office or employment or continuing in such position to file a disclosur statement of their personal interests and such other information as is specified on th form set forth in ~2.1-614 of the 1950 Code of Virginia, as amended, and shall thereafte file such a statement annually on or before January 15, to-wit: County Administrator Superintendent of Fiscal Management Superintendent of Development Superintendent of Public Facilities Personnel Officer County Attorney County Assessor Members of the Roanoke County Industrial Development Authority Mem bers of the Roanoke County Library Board Members of the Roanoke County Planning Commission 2. Supervisor Minter moved the prepared resolution: RESOLUTION NO. 83-175 APPROVING THE OFFICIAL PARTICIPATION OF THE COUNTY OF ROANOKE IN A SINGLE COMMUNITY SERVICES BOARD FOR THE COUNTIES OF BOTETOURT AND ROANOKE AND THE CITIES OF ROANOKE AND SALEM, AS PROVIDED IN CHAPTER 10, TITLE 37.1 OF THE 1950 CODE OF VIRGINIA, AS AMENDED BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That there is presently established and operating a single community services board for the County of Roanoke and the Cities of Roanoke and Salem as provided for in Chapter 10, Title 37.1 of the 1950 Code of Virginia, as amended, which board, known as Mental Health Services of the Roanoke Valley, is composed of fifteen members made up of four members each from the County of Roanoke and the Cities of Roanoke and Salem and from three at-large members who were appointed by the Chairman of the Board of Supervisors of the County of Roanoke and the Councils of the Cities of Roanoke and Salem for the terms in accordance with the by-laws of Mental Health Services of the Roanoke Valley; and 2. That the County of Botetourt has had a limited participation with said community services board in its program and has had representation on said board through one County-appointed liaison and now desires, as required by law as of July 1, 1983, to fully participate in said program, to give full financial support to the same and to be officially represented on said board; and 3. That it is also the desire of the County of Roanoke and the Cities of Roanoke and Salem that the County of Botetourt be allowed full participation with them in said program and official representation on said board, upon giving full support thereto, with the understanding that the expansion of services to Botetourt County does not result in a reduction in the availability of services to the existing member governments; and 9-27-83 I ~t 1 4. That the County of Botetourt be allowed full participation in the program of Mental Health Services of the Roanoke Valley and official representation on its boar in accordance with the by-laws thereof, upon giving full financial support thereto. Adopted by the following roll call vote: A YES: Supervisors Burton, Nickens, Minter, Johnson NAYS: None ABSENT: Supervisor Myers The next resolution called for support in the development of the joint water source for the Roanoke Valley. Mr. Bob Anderson, 6010 Ponderosa Circle, Roanoke, Virginia, was present and questioned the Board on the planning and development of the West County Site for this proposed dam. Supervisor Nickens assured him that all the valley governments have investigated all possibilities thoroughly before making any conclusion. Superintendent of the Department of Fiscal Management, John Hubbard, then gave a complete background on the selection of this site. Supervisor Nickens moved the following prepared resolution: RESOLUTION NO. 83-176 ENDORSING THE DEVELOPMENT OF A SOURCE OF WATER IN THE WESTERN PART OF ROANOKE COUNTY AS A JOINT VENTURE WITH CERTAIN OTHER LOCAL GOVERNMENTS OF THE ROANOKE V ALLEY BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the Board of Supervisors does fully endorse, support, and agree to fund its share of the cost of development of a surface storage source of water for domestic distribution and use projected to supply water in the Roanoke Valley area to the year 2040, the same to be developed as a joint venture between Roanoke County, the City of Roanoke, the City of Salem, and the Town of Vinton, and located near the Roanoke River in the western part of Roanoke County; and 2. That the Board does most respectfully urge the City of Roanoke, the City of Salem, and the Town of Vinton to join with it in the aforesaid joint venture for the continued benefit and progress of the entire Roanoke Valley; and 3. That the Board does appoint the County Administrator as its representative to a committee comprised of representatives of the several local governments hereinabove set out to develop an equitable agreement by and between said governments for the development and utilization of said source of water; and 4. Donald R. Flanders requested that the Board look towards the need for assistance in the area of financial consultants. He recommended that a committee be instructed to interview firms with expertise in fiscal planning to set up a report for the Board at the first meeting in October. Supervisor Nickens moved to advertise for proposals and that the Bid Committee (County Administrator, Superintendent of the Department of Fiscal Management and Supervisor Nickens) and one other Board Member to be appointed by Chairman Johnson serve as the screening committee. The motion carried by a unanimous voice vote. The County Administrator then requested the Board create a committee for review of communications consulting firms for writing specs, reviewing proposals, and making recommendations for the communication system at the Courthouse. Supervisor Burton moved for the Bid Committee to locate these firms, set up an interview schedule, and to delay this report until the second regular meeting in October. The motion carried by a unanimous voice vote. Personnel Officer - Keith Cook requested that a Clerk Steno II be authorized to fill the vacancy of the Account Clerk I position in the Personnel Office. Supervisor Minter moved the following prepared esolution: RESOLUTION NO. 83-180 RECOMMENDING AND URGING THE INITIATION OF A PROJECT TO PROVIDE INDUSTRIAL ACCESS TO A CERTAIN POTENTIAL INDUSTRIAL SITE LOCATED IN ROANOKE COUNTY BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as 1. That said Board, having duly considered the potential industrial development f a certain eight (8) acres, more or less, parcel, respectfully urges and recommends to he Highway Commission of Virginia that consideration be given, that immediate study e made, and that a project be approved and initiated pursuant to the provisions of ection 33.1-221 of the 1950 Code of Virginia, as amended, and specifically sub-section a) thereof, to provide approximately .61 miles of needed industrial access improvements rom Old Hollins Road, route 601, into said eight (8) acre, more or less, parcel adjacent to the AM P, Incorporated property, all of which is situate in Roanoke County; and 9-27-83 ] ,1 ;~) 2. Regional Partnership of Roanoke Valley, Inc. - The Board discussed and commented on the Articles of Incorporation for this new organization. Supervisor Minter moved to change the agreement to include a paragraph that would require full financial disclosure for members of the Board of Directors. The motion was defeated by the following roll call vote: Supervisor Burton Supervisor Minter Supervisors Nickens, Johnson, Burton Supervisor Myers Supervisors Burton, Nickens, and Johnson were in favor of the idea but voted NAY because they did not want to jeopardize the actual formation of this new organization, and felt that this was not the proper method to institute this particular stipulation, and that it should be incorporated into the By-Laws.
