The Board of County Supervisors of Roanoke County, Virginia
met this day in open session at the Salem-Roanoke County Civic
Center in Salem, Virginia, this being the fourth Tuesday and
the second regular meeting of the month.
Members present: Chairman May W. Johnson, Vice Chairman
Robert E. Myers, Supervisors R. Wayne Compton, Edward C. Park,
Jr., and Lawrence E. Terry.
Chairman Johnson called the meeting to order at 7:00 p.m.
and recognized The Reverend Starke Cauthorne from the New
Hope Presbyterian Church, who offered the invocation. The
Pledge of Allegiance to the flag was given in unison.
IN RE: APPROVAL OF MINUTES

On motion of Supervisor Terry and a unanimous voice vote,
the minutes of the special meeting of April 4, 1979, and the
regular meeting of April 10, 1979, were approved as presented.
IN RE: PROCLAMATION-McVITTY HOUSE, INC.
As a matter of protocol and for the public record,
Chairman, Johnson advised the other Supervisors that on April
17, 1979, she issued a proclamation relating to McVitty House,
Inc. and the contribution of the residents in the recent "1979
ROCK IN ROLL JAMBOREE," which proclamation the Clerk to the
Board read aloud and which is filed with the minutes of this
meeting.

RESOLUTION NO. 2285 APPROVING FISCAL YEAR
1979-80 CONSTRUCTION FUND PRIORITIES FOR THE
SECONDARY SYSTEM OF STATE HIGHWAYS IN ROANOKE
COUNTY
A public hearing was held this date on adoption of the
.fiscal year 1979-80 Construction Fund priorities for the state
Secondary System'of Highways in 'Roanoke County. Mr. Larry
Garber; Assistant Resident "Engineer for the Highway DeDartment,
.was present at the hearing, Other Highway DeDartment represent-
atives were present and r~corded the proceedings. Mr Garber
reviewed the proposed schedule of priorities and then
proceeded to answer var.ious inquiries from interested citizens
and Board members:
Mr. DavidL.Simrnons raised questions on items 10 and 11
on the proposed priority list. Mr. Simmons then stated the
need for guardrails on Route 640 in the Catawba District.
Mr. John G. Hall also stated the need for guardrails for the
safety of children and the elderly traveling'the road. Catawba
District Supervisor Robert E. Hyers advised that he traveled
Route 640 with the Highway Department's Resident Engineer and

assured those present that the Highway Department is going to
make every effort to install these guardrails at the more
dangerous places along the road. Mr. Garber also noted that the
Highway Department is in the process of pursuing special safety
Federal funds for this purpose.
Mr. H, L. McPherson and other residents of Greenwood
Forest Subdivision appeared before the Board and submitted a
joint petition to the Board and Highway Department requesting
that hot plant-mixed asphalt be applied to Wedf,ewood,
Timberlane, Forester, and Sedgefield streets situate in said
Subdivision. A full copy of the petition, containing over 100
signatures from area residents, is filed with the minutes of
this meeting. After considerable discussion, the Supervisors
concurred in requesting the Highway Department to allocate any
additional funds to this Subdivision for road imnrovements at
the most needed areas. Mr. Ron Adkins, 3057 Timberlane, reiterate
the need for road improvements in this area.
Supervisor Park requested that Route 608 in the Bonsack
area of the Vinton District be surface treated until it can be
rebuilt,
WHEREAS, the Virginia Department of Highways and
Transportation has previously submitted its proposed schedule of
fiscal year 1979-80 Construction Fund priorities for the
secondary system of State highways in Foanoke County to the
Board of County Supervisors; and
WHEREAS, after two (2) successive weelrs of puhlication
of Notice of Intention to hold a public hearing on the aforesaid
study on April 2Lf, 1979, public inspection of said document and
receipt of public comments at this public hearing, all as
required by State law, the Board of County Sunervisors is of
opinion that the schedule as submitted to said Board should be
approved.
1'10\'1, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that the schedule of fiscal year
1979-80 construction fund priorities for the secondary system
of State highways in Roanoke County as submitted 'by the Virp;inia
Department of Highways and Transportation be, arid the same is
hereby, approved.
BE IT FURTHER RESOLVED that the Clerk to this Board
transmit a certified copy of this resolution to the Virfinia
Department of Highways and Transportation.

RESOLUTION NO. 2286 SETTING THE TAX LEVY ON ALL
CLASSES OF REAL ESTATE SITUATE IN ROANOKE COUNTY
FOR THE CALENDAR YEAR 1979
A public hearing was this date held on this date on the
setting of a tax levy on all classes of real estate situate in
Roanoke County for the calendar year 1979. John M. Chambliss, Jr.
Director of Finance, acted as spokesman and reminded those
present that the County Executive has submitted a balanced
budget with no recommended tax increase. There was no citizen
opposition.
BE IT RESOLVED by the Board of Supervisors of Roanoke
County that the levy for the twelve-month period beginning
January 1, 1979, and ending December 31, 1979, be, and it is
hereby set for a tax rate of $3.25 per ONE HUNDRED DOLLARS of
assessed valuation on all classes of taxable real estate situate

IN RE: RESOLUTION NO. 2287 SETTING THE TA~ LEVY ON ALL
CLASSES OF PERSONAL PROPERTY SITUATE IN ROANOKE
COUNTY FOR THE CALENDAR YEAR 1979
A public hearing was this date held on the setting of a tax
levy on all classes of personal property situate in Roanoke
County for the calendar year 1979. John M. Chambliss, Jr.,
Director of Finance, acted as spokesman and reminded those
present that the County Executive has submitted a balanced
budget with no recommended tax increase. There was no citizen
opposition.
BE IT RESOLVED that the levy for the twelve-month period
beginning January 1, 1979, and ending December 31, 1979, be,
and it hereby is, set for a tax rate of $3.25 per ONE HUNDRED
DOLLARS of assessed valuation on all taxable, tangible personal
property, excluding all those classes of household goods and
personal effects as are defined in Sections 58-829.1 and
58-829.1:1 of the Code of Virginia, as amended, but including
the property separately classified by Sections 58-829 , 58-829. ,
58-829.3, 59-831, 58-831.1 and 58~83l.2 in the Code of Virginia
of 1950, as amended, located in this County on January 1, 1979,
and tangible personal property including the property separately
classified by Sections 58-829, 58-829.2, 58-829.3, 58-831,
58-831.1 and 58-831.2 in the Code of Virginia of 1950, as
amended, of public service corporations based upon the
assessed value thereof fixed by the State Corporation Commissio

PETITION OF CHARLOTTE HESLEP AND DELL F. CRITCHER
FOR REZONING FROM R-l TO B-2 OF 1.84 ACRES LOCATED
AT 3505 BRAMBLETON AVENUE, S.W. (JUST WEST OF THE
INTERSECTION OF BRAMBLETON AND PINEVALE ROAD) IN
WINDSOR HILLS DISTRICT TO PERMIT OPERATION OF A
RETAIL BUSINESS FOR THE DISPLAY AND SALE OF
CUSTOM MADE HOME INTERIOR DECORATIONS, SUBJECT
TO THE FOLLOWING CONDITIONS CONSENTED TO BE THE
PETITIONERS:
WHEREAS, the Planning Commission recommended that the
petition for an unconditioned rezoning be denied; and
WHEREAS, in response to this recommendation, Petitioners
have proffered certain conditions to be placed on the rezoning,
in accordance with Section 21-11 of the Code of Roanoke County,
IN RE:
as follows;
(1) The intended use of the property shall be the retail
sale and display of home interior decorations and accessories.
Should the intended use not develop or begin operation, and
upon application for the occupancy of any other use, the zoning
classification of the property shall convert to Office and
Residential District B-1.
(2) In the event that the intended use as set out in
condition number (1) ceases to be operated, and upon application
for the occupancy of any other use, the zoning classification
of the property shall convert to Office and Residential District
B-l.
(3) That portion of the property being northwest of the
existing structure and extending to Pinevale Road shall remain
in the zoning classification Residential District R-l, and only
the following described portion of the property will be
conditionally zoned Business District B-2:
BEGINNING at a point where the southermost point of
Pinevale Road intersects with the northern right of
way of Brambleton Avenue; thence S. 58 deg. W. 181.6
feet to a point; thence N. 30 deg. 59' W. 175.02 feet
to a point; thence N. 58 deg. 00' W. 181.6 feet, more
or less, to a point on the western right of way line

WHEREAS, after due advertisement in the Roanoke Times and
World News, the Board of Supervisors held a public hearing on
said request at a meeting of the said Board held on A ril 24, 197
at 7:00 p.m., and at said public hearing gave all interested
parties an opportunity to be heard; and
~lliEREAS, following said public hearing, the Board of
County Supervisors of Roanoke County is of the opinion that the
request of the Petitioners, Charlotte Heslep and Dell F. Critcher
to rezone the parcel situate at 3505 Brambleton Avenue,
immediately west of the intersection of Pinevale Road and
Brambleton Avenue, should be granted, said request having been
conditioned by the Proffer of Conditions filed therewith.

NOW, THEREFORE, BE IT ORDERED by the Board of County
Supervisors of Roanoke County that the following described
parcel of land situate at 3505 Bramb1eton Avenue, immediately
west of the intersection of Pineva1e Road and Bramb1eton Avenue
be, and the same hereby is, rezoned from Residential District
R-1 to Business District B-2, upon the conditions set forth in
"Exhibit 1" attached hereto:
BEGINNING at a point where the southermost point of
Pineva1e Road intersects with the northern right of
way of Bramb1eton Avenue; thence S. 58 deg. 00' W.
181.6 feet to a point; thence N. 30 deg. 59' W. 175.02
feet to a point; thence N. 48 deg. 00' W. 181.6 feet,

BE IT FURTHER ORDERED, that the County Planner be, and
he hereby is directed to reflect this change in zoning on the
zoning maps of the County.
Stephen M. Yost, Attorney, appeared on behalf of the
petitioners. Robert H. Logan, Planning Technician, advised the
Supervisors that the Planning Commission recommended denial of
the rezoning but explained that the Commission opposed a straight,
unconditional B-2 zoning, not the actual request. Mr. Logan
noted that since the Commission's hearing, the petitioners
have proffered certain conditions which basically call for
conversion to B-1 should the intended use not develop or should
it cease to operate and upon the application for occupancy for
any other use; such B-1 zoning would be in keeping with the
County's long-range guide plan. Further, the petitioner has
amended the request to encompass only the area of the parcel
extending approximately 175 feet back from Bramb1eton. The
portion to the rear is to remain R-1; said conditions being
enumerated in the foregoing Final Order and outlined in a
Proffer Statement dated April 4, 1979.
No one appeared in opposition to the request although a
Mr. Henry F. Faery, 3516 Pineva1e Road, S. W., did state his
opposition to any further B-2 zoning along Bramb1eton Avenue.
This concluded the public hearing and Supervisor Terry
moved that the rezoning be approved, subject to the conditions
contained within the Final Order and outlined in the afore-
mentioned Proffer Statement, which motion was adopted by the
following recorded vote:

This request was presented to the Supervisors by
John H. Kennett, Jr., Attorney for the petitioners. No one
appeared in opposition.
NOW, THEREFORE, BE IT ORDAINED by the Board of Supervisors
of Roanoke County, Virginia, that the Zoning Ordinance of
Roanoke County be amended to reclassify on the Zoning map of
the County of Roanoke, Virginia, from a "Business District B-2"
to a "Business District B-3", as defined by said ordinance,
that certain parcel of land containing 1.07 acres and being the
northwest portion of a 3.445 acres tract running 200 feet on
Williamson Road and more particularly described as follows:
BEGINNING at an iron pin on the easterly side
of Williamson Road at the south line of the
property of Roanoke-Hollins Shopping Association
and being 599.50 feet northward along Williamson
Road from the intersection of Williamson Road
and Greenway Drive-Granville Street both

This concluded the public hearing-and Supervisor Compton
moved that the Board concur with the recommendation of the
Planning Commission and approve the rezoning, which motion

ROANOKE CITY RESOLUTION NO. 24584-WATER WITHDRAWAL
(BACK CREEK AND ROANOKE RIVER)
On motion of Supervisor Terry and a unanimous voice vote,
Roanoke City Resolution No. 24584 placing the Board of
Supervisors and various concerned governmental agencies on
notice of the City's objections to certain water withdrawal
structures proposed by Roanoke County on Back Dreek and the
Roanoke River was this date received and filed.

IN RE: RESOLUTION NO. 2288 HONORING THE SERVICE OF
JOSEPH YOUNG, FIRE CHIEF, CLEARBROOK VOLUNTEER
FIRE DEPARTHENT
WHEREAS, Joseph Young has served as a volunteer fireman
from 1967 through 1973, and as Fire Chief from 1973 through
1979 of the C1earbrook Volunteer Fire Department; and

WHEREAS, Mr. Young has performed his duties in both an
official and unofficial benefiting the citizens of the Clearbroo
area of Roanoke County; and
WHEREAS, the Board desires to recognize the services of
Mr. Young, who is retiring as Fire Chief, for devoting twelve
year of service to the County, serving six of those years as
Fire Chief, in a manner which went beyond that called for in
his capacity as a volunteer and as Fire Chief and would like
to wish him continued success in the Fire Department.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County that said Board does hereby
recognize Joseph Young for his outstanding dedication and
service to Roanoke County as a volunteer fireman for six years
and as Fire Chief for six years of the Clearbrook Volunteer
Fire Department.

COUNTY WATER SYSTEM
In a report to the Board, the County Executive advised
that he was in receipt of a memorandum dated April 9, 1979,
from W. L. Rossie, Jr., County Utility Director, concerning
the emergency purchase of certain 5,000-gallon pressure
tanks to be used in connection with development of wells at the
William Byrd High School site and at the Homewood Subdivision
in order not to delay completion of these water systems for
use by County citizens this summer.
Supervisor Park moved that the Board concur and approve
staff's action in the above-referenced subject matter, which
motion was adopted by the following recorded vote:

IN RE: SCHOOL BOARD APPOINTMENTS
In keeping with Resolution No. 1708 adopted by the
Supervisors on January 25, 1977, the County Executive advised
the Board that the terms of Joseph C. Thomas and John M.

Williams, representing the Catawba and Vinton Districts
respectively on the County School Board will expire on
June 30, 1979. A full copy of the report is filed with the
minutes of this meeting.
IN RE: RESIGNATION OF COUNTY ENGINEER
In a report to the Board, County Executive Clark formally
advised the Supervisors of the resignation of County Engineer
Arthur A. Guepe effective May 11, 1979, who has accepted a
position as City Engineer for the City of Louisvillp., Kentucky.

All Supervisors wished Mr. Guepe luck and commended him for a
job well done.
The County Attorney was directed to prepare a resolution
of appreciation for Mr. Guepe for the Board's next regular
meeting.
IN RE:
PERSONNEL-MANAGEMENT RELATIONS
I
In a report to the Board, the County Executive advised
that the County Attorney, in considering necessary amendments
to the County personnel rules and regulations for compliance
with State grievance procedures, has proposed a new chapter to
the County Code to be entitled "Personnel-Management Relations."
The County Executive also noted that since it is proposed that
this be adopted by ordinance, it will be necessary to publicly
advertise a summary of these proposals.
Supervisor Terry moved that the Board consider this matter
at its May 22, 1979 meeting, which motion was adopted unanimously
IN RE: ANNUAL AUDIT
The Supervisors generally concurred in the recommendation
of the Director of Finance to negotiate with the firm of Daniel
A. Robinson and Associates for both the turnover audit and the
annual audit. A full copy of the report regarding this subject
is filed with the minutes of this meeting.

On motion of Supervisor Park and the following recorded
vote, the Virginia Department of Highways and Transportation
was this date requested to accept the following streets in
La Bellevue Subdivision, Section 6, into the State Secondary
System of Highways in Roanoke County:
Summit Ridge Road from Coachman Circle to 0.24 mile east,
a distance of 0.24 mile.
Forest Oak Drive from Coachman Circle to end, a distance
of 0.23 mile.
Coachman Circle from 0.03 mile north of Greggin Drive to
Summitt Ridge Road, a distance of 0.16 mile.

CIRCUIT COURT CLERK-REQUEST TO PURCHASE OFFICE
EQUIPMENT
Mrs. Elizabeth W. Stokes, Circuit Court Clerk, appeared
before the Board regarding purchase of certain office equipment.
After some discussion as to the merits of the request,
Supervisor Park moved that consideration of the matter be
deferred until after budget study. The motion was adopted
unanimously.

IN RE: PARK FACILITIES
Mr. Bill Martin, resident of the Catawba District, appeared
before the Board regarding the need for more that the one
ballfield at the Masonts Cove School. Catawba District Superviso
Myers stated that the children in the area needed more facilitie
for their sports activities. Following some discussion,
C. Darrell Shell, Director of Parks and Recreation, was directed
to negotiate another agreement with the Moose Lodge for use
of its field. The County formerly entered into an agreement
with the Moose Club for the County and Mason Cove Recreation
Club to use the ballfields for the 1977 season, but this
agreement was not renewed.
Supervisor Myers also asked Mr. Shell the status of
installing lights for Walrond Park and was advised that the
County is awaiting final approval from Philadelphia at which
time the grant money for these lights will be released.
Mr. Melvin Divers, President of the North Roanoke Little
League, appeared before the Board regarding the need for
Walrond Park and installation of lights for said park.

Mr. David Simmons, Catawba District, also appeared before
the Board regarding an area behind the new Glenvar Library
called "Shamrock Square."
Considerable discussion took place on the development and
maintenance of parks in the County. County Engineer Guepe
reiterated the impact of the January ice storm on the Public
Works Department.
IN RE: RESOLUTION NO. 2290 SUPPORTING THE TOWN OF VINTON
IN ITS REQUEST TO THE STATE HIGHWAY COMMISSIONER,
DEPARTMENT OF HIGHWAYS AND TRANSPORTATION, FOR
THE FOUR LANING OF VINTON MILL ROAD

WHEREAS, Vinton Mill Road, a thoroughfare located in the
City of Roanoke, the Town of Vinton and the County of Roanoke,
is a heavily traveled and overcrowded two-lane road; and
WHEREAS, the Town of Vinton, over the past several years,
has repeatedly requested the State Highway Commission to proceed
to cause Vinton Mill Road to be four laned in order to alleviate
the overcrowded condition of said highway and to promote the
welfare and safety of the citizens using and living along
said highway.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Supervisors of Roanoke County as follows:
1. That the County of Roanoke does fully support the
Town of Vinton in its repeated request made to the State
Highway Commission to four lane Vinton Mill Road in order to
alleviate the overcrowded traffic conditions thereon and to
better promote the welfare and safety of citizens using and
living along Vinton Mill Road; and
2. That attested copies of this resolution be forthwith
forwarded to appropriate officials of the State Highway
Commission, Department of Highways and Transportation, of the
Commonwealth of Virginia by the Clerk of this Board.

RAFFLE PERMIT RENEWAL-NORTH CROSS SCHOOL

Supervisor Terry moved that the application of North
Cross School for renewal of their raffle permit be approved
effective this date through December 31, 1979, which motion was
adopted unanimously.
IN RE: RESOLUTION NO. 2291 REQUESTING THE VIRGINIA DEPARTMENT
OF HIGHWAYS AND TRANSPORTATION TO ACCEPT THE FOLLOWING
STREET OR PORTION THEREOF INTO THE STATE SECONDARY
SYSTEM FOR PURPOSES OF MAINTENANCE:

BE IT RESOLVED by the Board of County Supervisors of
Roanoke County as follows:
1. THAT the State Department of Highways and Transporta-
tion is hereby requested to accept into the State Secondary
System for purposes of maintenance the following street or
portion thereof located in the County of Roanoke, Virginia,
to-wi t:
Luckado Street from its intersection with Churchill
Avenue to its intersection with Overland Drive;and
2. THAT the County of Roanoke by reason of this request
does not undertake any obligation of maintenance of such
street; and
3. THAT attested copies of this resolution be forwarded
to the appropriate officials of the State Department of
Highways and Transportation.
On motion of Supervisor Terry and adopted by the following
recorded vote:
AYES: Mr. Compton, Mr. Myers, Mr. Park, Mr. Terry,
Mrs. Johnson
NAYS: None
This concluded the business before the Board at this
time and on the motion of Supervisor Terry and a unanimous
voice vote, the meeting was adjourned at 9:45 p.m.
