Members present: Chairman May W. Johnsont Vice Chairman Robert E. Myerst Supervisors R. Wayne Comptont Edward C. Parkt Jr.t and Lawrence E. Terry. Chairman Johnson called the meeting to order at 6:05 p.m. and announced that opening business will include only routine matters; public hearings and other public agenda items will not begin before 7:00 p.m. ~RE: INFORMATIONAL ITEMS The following itemst submitted by the Director of Financet were for informa- tion of the Supervisors and are filed with the minutes of this meeting: (a) Financial statement for October and (b) Accounts Paid for November. RE: SALE OF BOND ANTICIPATION NOTES I Director of Finance Chambliss advised the Supervisors that this item is for information of the Supervisors and will be coming back before the Board in January for action. A full copy of the report is filed with the minutes of this meeting. RE: EXECUTIVE SESSION At 6:12 p.m't on motion of Supervisor Terry and the followingt recorded votet the Board went into executive session to discuss real estate and legal matters. AYES: Supervisors Comptont Myerst Parkt TerrYt and Johnson. NAYS: None. At 7:01 p.m't on motion of Supervisor Terry and a unanimous voice votet the Supervisors reconvened in open session. 7 O'CLOCK SESSION I Chairman Johnson announced to those present that the meeting had already been called to order at the 6 o'clock session and recognized John M. Chamblisst Jr.t Director of Financet who offered the invocation. The Pledge of Allegiance to the Flag was recited in unison. RE: APPROVAL OF MINUTES On motion of Supervisor Compton and a unanimous voice votet the minutes of th regular meeting held November l3t 1979 t were approved as presented. 12-11-79 _:;,.~ . /If:,. 4, 381 RE: REQUEST OF BOARD OF COUNTY SUPERVISORS FOR A "USE NOT ) PROVIDED FOR" PERMIT TO ALLOW CONSTRUCTION AND OPERA- ) TION OF A GOVE~~MENTAL SERVICES CENTER ON A 27.199- ) ACRE TRACT PRESENTLY ZONED R-l AND LOCATED AT THE END ) OF NORTHRIDGE ROAD, BETWEEN NORTH LAKES SUBDIVISION ) AND NORTHSIDE HIGH SCHOOL IN TH~ CATAWBA DISTRICT ) DENIED Chairman Johnson advised those present that the Supervisors had agreed to I deviate from the prepared agenda and take under consideration Item F-3 (Unfinished Business) concerning the request of the Supervisors for a "Use Not Provided For" permit to allow construction of a governmental services center. Chairman Johnson them recognized Catawba District Supervisor Myers who advise~ that since the public hearing held by the Board on November 13, 1979, an agreement by and between the Board of Supervisors of Roanoke County and the five families who had a legal interest in a lOa-foot strip of land adjacent to the tract has been entered into and fully executed by all parties concerned. Mr. Myers further advised that the families have agreed to return the property to the County and that the County has agreed to buy back the land from the parties concerned at the original price and to pay additional costs involved such as surveying costs and recording fees. I Supervisor Myers then read the Agreement, which is herein spread as foMlows: THIS AGREEMENT made and entered into this lath day of December, 1979, by and between WILLIAM D. LAYMAN and WEDA S. LAYMAN, husband and wife, DAVID W. LONG and JEANNE M. LONG, husband and wife, HAROLD N. HOBACK and ELIZABETH T. HOBACK, husband and wife, and RICHARD V. BEARD and WANDA L. BEARD, husband and wife, parties of the first part; and JAMES L. CROSS, JR., and NANCY W. CROSS, husband and wife, parties of the second part; and THE BOARD OF SUPERVISORS OF ROANOKE COUNTY, VIRGINIA, party of the third part. : WIT N E SSE T H WHEREAS, the party of the third part has heretofore conveyed to the parties of the first part certain lots or parcels of land hereinafter more speci- fically described; and I WHEREAS, the party of the third part has heretofore agreed to convey to the party of the second part a certain lot or parcel of land hereinafter more specifically described; and WHEREAS, the parties hereto have agreed upon a disposition of said lots or parcels of land upon the occurrence of certain events. Cross I The original Agreement is on file in the Office of the Clerk to the Board of Supervisors. Mr. Myers moved that said Agreement be approved. Mr. Park requested that Mr. Myers include in his motion that the property be put up for sale, which Mr. Myers concurred with and so moved. The motion was adopted by the following recorded vote: I AYES: Mr. Compton, Mr. Myers, Mr. Park, Mr. Terry, Mrs. Johnson NAYS: None On motion of Supervisor Myers and the following recorded vote, the request of the Board of County Supervisors for a "Use Not Provided For" permit to allow construction and operation of a governmental services center on a 27.l99-acre tract presently zoned R-l and located at the end of Northridge Road between North Lakes Subdivision and Northside High School in the Catawba District was this date denied. AYES: Mr. Compton, Mr. Myers, Mr. Park, Mr. Terry, Mrs. Johnson NAYS: None After the action taken above, those present in the audience applauded I the Supervisors for their decision to deny permit. Supervisor Myers thanked Mr. Jerry McNulty (who acted as spokesman for the North Lakes Civic League who opposed the request) and Mr. Harold Hoback (one of the property owners who agreed to sell a parcel back to the County) for their hard work in the matter. Mr. McNulty was present and thanked the Supervisors for their decision 12-11-79 - 385 \ J to deny the request. IN RE: REQUEST OF STEVE A. BOYD FOR RENEWAL OF A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 2.25-ACRE TRACT LOC*TED 300 YARDS WEST OF STATE ROUTE 845 NORTH OF ITS INTERSECTION WITH STATE ROUTE 676 IN THE CAVE SPRING DISTRICT. I Chairman Johnson opened the floor for public comments and recognized Mr. Boyd. No one appeared in opposition. This concluded the public hearing and Supervisor Terry moved that the renewal be approved beginning November 15, 1979, subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. IN RE: REQUEST OF CLARENCE D. BRITT FOR RENEWAL OF A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A I-ACRE TRACT LOCATED ON THE NORTHWEST SIDE OF STATE ROUTE 622 (BRADSHAW ROAD), 10 MILES WEST OF ITS INTERSECTION WITH STATE ROUTE 864 IN THE CATAWBA DISTRICT. Chairman Johnson opened the floor for public comments. No spokesman for the petitioner was present nor was anyone present in opposition. This concluded the public hearing and Supervisor Myers moved that I the renewal be approved beginning November 15, 1979, subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. IN RE: REQUEST OF DEMATRICE B. JOURNIETTE FOR RENEWAL OF A SPECIAL EXCEPTION TO PARK A MOBILE HOME OCCUPIED BY WILLIAM M. JOURNIETTE ON A I-ACRE TRACT LOCATED ON THE EAST SIDE OF STATE ROUTE 605 (OLD MOUNTAIN ROAD), 0.2-MILE SOUTH OF CARLOS DRIVE IN THE HOLLINS DISTRICT. Chairman Johnson opened the floor for public comments and recognized Mr. Journiette. No one appeared in opposition. This concluded the public hearing and Supervisor Myers moved that the renewal be approved beginning November 25, 1979, subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion 1 was adopted unanimously. IN RE: REQUEST OF DAVID K. MUNCY FOR RENEWAL OF A SPECIAL TO PARK A MOBILE HOME ON A 0.75-ACRE TRACT LOCATED EAST SIDE OF STATE ROUTE 612, 2 MILES SOUTH OF ITS SECTION WITH ROUTE 460 IN THE CATAWBA DISTRICT. EXCEPTION OFF THE INTER- Chairman Johnson opened the floor for public comments. IN RE: REQUEST OF MICHAEL W. CONNER FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A I-ACRE TRACT LOCATED ON THE SOUTH SIDE OF U. S. ROUTE 221, 1300 FEET WEST OF ITS SOUTHERLY INTERSECTION WITH STATE ROUTE 696 IN THE WINDSOR HILLS DISTRICT. I Chairman Johnson opened the floor for public comments and recognized Mr. Conner. No one appeared in opposition. This concluded the public hearing and Supervisor Terry moved that the request be approved subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted unanimously. IN RE: PETITION OF FRANCES E. WEAVER FOR REZONING FROM R-l TO B-2 OF A PARCEL OF LAND CONTAINING 1.372-ACRES AND LOCATED ON THE NORTH SIDE OF STATE ROUTE 634 (HARDY ROAD), APPROXIMATELY 0.4 MILE SOUTHWEST OF THE VINTON TOWN LIMITS IN THE VINTON DISTRICT SO THAT AN INDOOR ARCHERY RANGE MAY BE CONSTRUCTED AND OPERATED THEREON. * * * * * APPROVED * * Chairman Johnson opened the floor for public comments and recognized I Michael Quinn, Attorney, who appeared on behalf of the petitioner and advised that the purpose of the rezoning is so that a building containing an indoor archery range may be constructed and operated thereon. Haeussler, Executive Director, Fifth Planning District Commission, advising that the Commission's Executive Committee approved the commencement of a Temporary Housing Site Study for the County of Roanoke, providing the Commission obtains the County's prior approval for such a study. Supervisor Park moved that the Board approve commencement of a I Temporary Housing Site Study for the County and that the Fifth Planning District be notified of such action, which motion was adopted by the following recorded vote. AYES: Mr. Myers, Mr. Park, Mr. Terry, Mrs. Johnson NAYS: None TEMP. ABSENT: Mr. Compton _fl>': 388 ' 12-11-79 IN RE: APPLICATION OF FORT LEWIS RESCUE SQUAD LADIES AUXILIARY FOR RENEWAL OF THEIR BINGO PERMIT Supervisor Myers moved that the application of Fort Lewis Rescue Squad Ladies Auxiliary for renewal of their bingo permit be approved for the perio January 1, 1980 through December 31, 1980, which motion was adopted by the following recorded vote: I AYES: Mr. Myers, Mr. Park, Mr. Terry, Mrs. Johnson NAYS: None TEMP. ABSENT: Mr. Compton IN RE: REQUEST OF ROANOKE MOOSE LODGE #284 FOR A BINGO PERMIT Supervisor Myers advised that he was in receipt of an application from Roanoke Moose Lodge #284 for a bingo permit. There being no opposition, Supervisor Myers moved that the request of Roanoke Moose Lodge #284 for a bingo permit be approved for the period January 1, 1980 through December 31, 1980, which motion was adopted by the following recorded vote: AYES: Mr. Myers, Mr. Park, Mr. Terry, Mrs. Johnson I NAYS: None TEMP. ABSENT: Mr. Compton IN RE: DISABILITY INSURANCE COVERAGE FOR VOLUNTEER FIRE AND RESCUE PERSONNEL The report of the County Executive stating the needs for dis- ability insurance coverage for volunteer fire and rescue personnel was before the Board for consideration. Following some discussion, Supervisor Myers, who serves as Chair- man of the County's Bid Committee, moved that specifications be prepared and proposals solicited from insurance companies for such insurance coverage, which motion was adopted by the following recorded vote: I AYES: Mr. Compton, Mr. Myers, Mr. Park, Mr. Terry, Mrs. Johnson NAYS: None A full copy of the report is filed with the minutes of this meeting. 12-11-79 ~. ~-'h 389 IN RE: HISTORIC SITES County Executive Clark presented presented to the Board a booklet entitled "Historic Sites in Roanoke County, Virginia" which is a survey of historic sites in the County. Mr. Clark advised that the booklet was prepared I by the Planning and Zoning staff and is for the Supervisors' information. A full copy of the booklet is filed with the minutes of this meeting. IN RE: RESOLUTION NO. 2457 AUTHORIZING THE CLOSING OF THE COUNTY'S FINANCE DEPARTMENT TO THE GENERAL PUBLIC IN ORDER THAT THE TURNOVER AUDIT MAY BE PERFORMED, AND DIRECTING THE DIRECTOR OF FINANCE TO ADVERTISE SUCH CLOSING. BE IT RESOLVED by the Board of County Supervisors of Roanoke County as follows: 1. That the County's Finance Department be, and it hereby is, authorized to be closed to the general public as of the close of business on Friday, December 28, 1979, and remain closed to the general public until 8:30 a.m. on Monday, January 7, 1980, so that the turnover audit may be performed by Daniel A. Robinson & Associates, P.C.; said office to reopen prior to I January 7, 1980, should the turnover audit be completed ahead of time; and 2. That the Director of Finance be, and he hereby is, directed to advertise said closing of the Finance Department as herein made and provided. I IN RE: LIVESTOCK CLAIM - ROBERT E. Welch, Director, County Health Department, appeared before the Board and made a presentation of the Health Department's activities for the 1978-79 fiscal year and presented a refund check in the amount of $6,741.26 to the County Executive, who immediately turned the check over to the County's I Director of Finance. A full copy of Dr. Welch's report is filed with the minutes of this meeting. Following Dr. Welch's presentation, Supervisor Myers moved that the County Executive be authorized and directed to correspond with the State Depart- ment of Health concerning the need for a sink in the Pharmacy in the building occupied by the Roanoke County-Salem Health Department and to report back to the Board, which motion was adopted unanimously. In relation to this proposed resolution, Supervisor Myers referred to the 11-13-79 I meeting whereby the Superviors authorized additional time off on Christmas Eve and New Year's Eve, whichever the employee wishes to take off as long as County offices remain open the entire day both days. Mr. Myers stated that he felt this action of the Board was sufficient time off since County employees are already entitled to eleven paid holidays; and therefore, urged the Supervisors to not consider any more time off.
