1/2/1980 - Special 1-2-80 -'i 405 Board of County Supervisors 430 East Clay Street Salem, Virginia Salem-Roanoke County Civic Ct January 2, 1980 at 9:00 a.m. I Pursuant to Resolution No. 2467 adopted December 11, 1979, which directed scheduling and advertising of the organizational meeting of the Board of Super- visors of Roanoke County for the calendar year 1980 to be held on Wednesday, January 2, 1980, the said Board of Supervisors met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia. Members present: Supervisors May W. Johnson, Robert E. Myers, Edward C. Park, Jr., and Lawrence E. Terry. Chairman Johnson called the meeting to order at 9:05 a.m.. County Administrator, William F. Clark, offered the invocation and the pledge of allegiance to the flag was given in unison. IN RE: ELECTION OF HOLLINS DISTRICT SUPERVISOR I Supervisor Park moved that this item be continued to the next meeting of the Board of Supervisors and the motion was adopted by a unanimous roll call vote. Supervisor Myers then moved that the County Attorney notify the Judges of the Circuit Court that a vacancy exists on the Board from the Hollins Magisterial District and request an election at the next qeneral election in Roanoke County, which motion was carried unanimously. IN RE: TERMS OF OFFICE FOR CHAIRMAN AND VICE CHAIRMAN Supervisor Myers moved that the term of office for Chairman and Vice Chairman be for a one-year period, which motion was approved unanimously by a ro 11 ca 11 vote. IN RE: ELECTION OF OFFICERS I Supervisor Park moved to elect Supervisor Terry Chairman and the motion was unanimously adopted. Supervisor Myers moved to elect Supervisor Park Vice Chairman, which motion was also adopted unanimously. At this point in the meeting, Chairman Terry assumed the Chair and invited the other Board members to make remarks concerning the previous service -.-... .".' ,,~ ~" ~ ;4- 0 6 as Chairman by Supervisor Johnson. Following such remarks, Chairman Terry pre- sented to Supervisor Johnson a seal of the County which had been framed for her in recognition of her service as Chairman to the Board during 1979. IN RE: RULES OF PROCEDURE Supervisor Johnson moved that the Board adopt "Roberts Rules of Order" I without the requirement for a second of motions as the Rules of Procedure. The motion was adopted unanimously. IN RE: SCHEDULING OF BOARD MEETINGS Supervisor Myers moved that the regular Board meetings for 1980 be the second and fourth Tuesdays of the month. beginning at 6:00 p.m. at the Salem- Roanoke County Civic Center which motion was adopted unanimously. IN RE: RESOLUTION NO. 2474 ESTABLISHING A PLAN OF GOVERNMENT FOR THE COUNTY OF ROANOKE FROM AND AFTER JANUARY 1, 1980. Supervisor Johnson moved the adoption of a prepared resolution establish- ing a plan of government for Roanoke County. Prior to voting on the resolution. the County Attorney was asked to explain the substance of the proposal. after which the resolution was adopted by unanimous roll call vote; the text of Resolution No. 2474 is as follows: I BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. That from and after January 1, 1980, there shall exist in the County of Roanoke all such courts, constitutional officers, departments. boards, commissions and committees as made and provided by law; and 2. That pursuant to the Constitution of Virginia, Title 15.1 of the Code of Virginia of 1950, as amended. and the general law of the Commonwealth of Virginia. the Board of Supervisors of Roanoke County shall be. and hereby is. the sole governing and policy making body for the County of Roanoke; and 3. That the Board of Supervisors of Roanoke County does hereby establish as the administrative plan of government of Roanoke County those departments, boards. commissions and committees as follows: I a. a welfare board b. a library board c. an office of the county assessor d. an office of the county attorney e. a planning commission 1-2-80 ..:,~ " ~: ; '. That the Office of the County Administrator shall be responsible for the operational departments and offices of the County of Roanoke as follows: I a. Office of Purchasingt b. Department of Utilities c. Depa rtment of Financet d. Department of Parks and Recrea ti on e. County Engineer f. Office of Animal Control I g. Department of Fire and Emergency Services h. Department of Planning and Zoning. Each of the aforesaid departments and offices hereby established shall have and perform all such responsibilities and duties assigned to them by the County Administrator pursuant to authority vested in the County Administrator by the Board of Supervisors of Roanoke County as made and provided by Section 15.1-117 of the Code of Virginia of 1950, as amended; and 5. That all policies, ordinances, resolutions and codes heretofore adopted by any successor board of supervisors of Roanoke County not inconsistent with the powers, duties, authority and responsibility vested in the Board of Supervisors of a county operating pursuant to the traditional or "old" form of government for counties in the Commonwealth of Virginia is hereby specifically re-enacted and continued in full force and effect to be administered pursuant to the plan of government herein established and set forth. QJ8. 1-2-80 IN RE: RESOLUTION NO. 2475 ESTABLISHING THE AUTHORITY VESTED IN THE OFFICE OF THE COUNTY ADMINISTRATOR OF ROANOKE COUNTY. Supervisor Park moved to approve the prepared resolution vesting the authority to be exercised in the office of the County Administrator. Prior to voting on the resolution, the County Attorney explained the substance of this proposal. It was then adopted by unanimous roll call vote; the text of Resolution I No. 2475 is as follows: BE IT RESOLVED by the Board of Supervisors of Roanoke County that the authority vested in the Office of the County Administrator of the County of Roanoke, Virginia, shall be as follows: 1. To serve as Clerk to the Board of Supervisors. 2. To record in a book to be provided for that purpose all of the pro- ceedings of the governing body. 3. To make regular entries of all the governing bOdy's resolutions and decisions on all questions concerning the raising of money; and within five days after any order for a levy is made, to deliver a copy thereof to the commissioner of the revenue of the county. 4. To record the vote of each supervisor on any question submitted to the I governing body, if required by any member present. 5. To sign all warrants issued by the governing body for the payment of money, and to record, in a book provided for that purpose, the reports of the county treasurer of his receipts and disbursements. 6. To preserve and file all accounts and papers acted upon by the governing body with it's action thereon. 7. To make recommendations to the governing body concerning any officer or department of the county government or employee under the control and super- vision of the governing body. 8. To attend to the execution of and enforce all lawful resolutions and orders of the governing body concerning any department, office or employee in the county government, and shall see that all laws of the State required to be I enforeced through the governing body are faithfully executed, and to make report to the governing body how such orders, resolutions and laws have been executed. 9. To confer with any person concerning the affairs of the county government and to make report to the governing body of all such matters whereon it should take action. 1-2-80 ...'~~ ;'f' 409 10. To make monthly reports to the governing body in regard to matters of administration, and keep it fully advised as to the financial condition of the county. I 11. TO,for informative and fiscal planning purposes only, prepare and submit to the governing body, in accordance with general law, an annual budget. 12. To audit all claims of every character or nature against the county, except those required to be received and audited by the county school board, to ascertain that such claims are in accordance with purchase orders or contracts of employment or in accordance with the law from which same arise; to issue all warrants in settlement of all such claims when such expenditures are authorized and approved by the officer and/or employee authorized to procure the services, supplies, materials or equipment accountable for such claims. Every warrant issued pursuant to the provisions of this section shall bear the date on which the County Administrator orders it to be issued and shall be made payable on I demand, signed by the County Administrator, or by his designated assistant when authorized by the board of supervisors, and recorded in the form and manner prescribed by the Auditor of Public Accounts; and the warrant shall be converted to a negotiable check by the treasurer, or appropriately designated deputy treasurer, by affixing his signature thereto in conformity with the provisions of Section 58-951 and by designating thereon the bank by which it is to be paid. The County Administrator shall not approve expenditures in any year for any purpose in an amount greater than the amount available for such purpose during the year nor shall he order issued against any funds at any time any warrant or warrants in excess of the amount available in such fund and in the treasurer's possession at the time such warrant is issued, taking into account all previously issued and outstandinq warrants payable from such funds; nor shall he approve, draw or permit to be paid any warrant drawn for any purpose unless there has been an appropriation of funds by the board of supervisors for that purpose, I any other provisions of this article to the contrary notwithstanding. 13. To act as purchasing agent for the county; to make all purchases for the county subject to such exception as may be allowed by the governing body. He shall have authority to make transfer of supplies, materials and equipment between departments and officers, and employees; to sell any surplus supplies, materials and equipment and to make such other sales as may be authorized by the governing body. He shall have power, with consent of the governing body, to establish suitable specifications or standards for all supplies, materials --- 410 1-2-80 and equipment to be purchased for the county, and to inspect all deliveries to determine their compliance with such specifications and standards, and if such deliveries are not in accordance with such specifications and standards it shall be his duty and he is empowered to reject the same. He shall have charge of such storerooms and warehouses of the county as the governing body may provide. He shall have the care and charge of all public buildings and the furnishings and fixtures therein under the control of the governing body. All purchases and sales shall be made under such rules and regulations as the governing body may by ordinance or resolution establish. Subject to such exception as the governing body may provide, he shall before making any purchase or sale invite competitive bidding under such rules and regulations as the governing body may by ordinance or resolution establish. He shall not furnish any supplies, materials, equipment or contractual services to any department or office or employee, except upon receipt of a proper1y approved requisition and unless there be an unencumbered balance sufficient to pay the same. 14. To keep a record of the revenues and expenditures of the county; to keep such accounts and records of the affairs of the county as shall be pre- scribed by the governing body; and monthly to prepare and submit to the governing body statements showing the progress and status of the affairs of the county in such form as shall be specified by the governing body. 15. To perform such other duties as may be imposed upon him by the governing body. 16. To perform all duties imposed by law upon the county clerk as clerk of the governing body; all duties imposed upon the county purchasing agent, and all duties imposed upon the "local delinquent tax collector" provided for in Sections 58-990 and 58-991 of the Code, and to have all the powers and duties imposed by those sections. 17. To maintain a centralized system of accounting for the county, including the county school board and the local board of public welfare or social services pursuant to the provisions of Section 2-138 [Section 2.1-167J of the Code; provided that when such centralized system of accounting is installed pursuant to the provisions of Section 2-138 [Section 2.1-167J of the Code, the authorization and approval of expenditures, audit of claims and the issuance of warrants in settlement thereof for all agencies of the County, including the county school board and the board of public welfare or social services, shall be in conformity with the procedure set forth in subsection [12J of this section whe such procedures are directed by resolution of the Board of Supervisors; other I I I 1-2-80 - 411 provisions of any section of the Code to the contrary notwithstanding. On motion of Supervisor Park and adopted by the following recorded vote: AYES: NAYS: Supervisors Johnson, Myers, Park, and Terry. None. I IN RE: APPOINTMENT OF COUNTY ADMINISTRATOR Supervisor Johnson moved that William F. Clark be appointed County Administrator and the motion was approved by unanimous roll call vote. IN RE: APPOINTMENT OF DEPUTY CLERK TO THE BOARD OF SUPERVISORS County Administrator Clark indicated to the Board that he was not ready to make a recommendation on the appointment of a Deputy Clerk for the Board, and this agenda item was passed over. IN RE: APPOINTMENT OF COUNTY ATTORNEY Vice Chairman Park moved that James E. Buchholtz be appointed County Attorney and the motion was approved by unanimous roll call vote. I IN RE: APPOINTMENT OF DIRECTOR OF FINANCE County Administrator Clark recommended that the Board appoint John M. Chambliss, Jr. as Director of Finance and that he also be designated as Assistant County Administrator. Supervisor Myers so moved and the motion was adopted by unanimous roll call vote. IN RE: APPOINTMENT OF COUNTY ASSESSOR Supervisor Johnson moved that Andrew E. Clingenpeel be appointed County Assessor and the motion was approved by unanimous roll call vote. I IN RE: APPOINTMENT OF COUNTY ENGINEER County Administrator Clark recommended that Raymond Eugene Robertson be appointed County Engineer. Supervisor Myers so moved and the motion was adopted by unanimous roll call vote. IN RE: APPOINTMENT OF DIRECTOR OF PARKS AND RECREATION County Administrator Clark recommended that C. Darrell Shell be appointe Director of Parks and Recreation. Vice Chairman Park so moved and the motion was adopted by unanimous roll call vote. ~. 1-2-80 IN RE: APPOINTMENT OF COUNTY PLANNER County Administrator Clark recommended that Timothy W. Gubala be appointe County Planner. Vice Chairman Park so moved and the motion was approved by unanimous roll call vote. County Administrator Clark recommended that County Planner Timothy W. I IN RE: APPOINTMENT OF ZONING ADMINISTRATOR Gubala be appointed Zoning Administrator. Supervisor Johnson so moved and the motion was approved by unanimous roll call vote. IN RE: APPOINTMENT OF COORDINATOR OF FIRE AND EMERGENCY SERVICES County Administrator Clark recommended that Robert N. Monroe be appointed Coordinator of Fire and Emergency Services; Supervisor Myers so moved and the motion was approved by unanimous roll call vote. IN RE: ORDINANCE NO. 2476 ABOLISHING THE FINANCE BOARD AND VESTING THE BOARD OF SUPERVISORS WITH ALL AUTHORITY, POWERS, AND DUTIES OF THE FINANCE BOARD AND PROVIDING FOR AN EMERGENCY. BE IT ORDAINED by the Board of Supervisors of Roanoke County as follows: 1. That pursuant to Section 58-940 of the Code of Virginia of 1950, I as amended, the Finance Board directed to be created for the County of Roanoke is hereby abolished; and 2. That the Board of Supervisors, the governing body of Roanoke County, is hereby vested with all the authority, powers and duties formerly vested in the Finance Board as made and provided by law; and 3. That in order to appropriately organize a new government for the County of Roanoke, an emergency is declared to exist in order that this ordinanc shall be immediately effective upon its passage; and 4. That an attested copy of this ordinance be forthwith transmitted to the Circuit Court of Roanoke County, Virginia. On motion of Supervisor Johnson and adopted by the following recorded vote: NAYS: None. I AYES: Supervisors Johnson, Myers, Park, and Terry. IN RE: APPOINTMENT OF BOARD OF PUBLIC WELFARE Supervisor Myers moved that the existing members of the Board of Public Welfare be reappointed to serve the balance of their present terms; the motion was approved unanimously. '.A"-'r~:-........ 1-2-80 - 413 IN RE: APPOINTMENT OF PUBLIC SERVICE AUTHORITY Vice Chairman Park moved that the Board of Supervisors be appointed individually as the members of the Public Service Authority for Roanoke County, which motion was approved unanimously. I IN RE: APPOINTMENT OF PLANNING COMMISSION Supervisor Johnson moved that the present members of the County Planning Commission be reappointed to serve the balance of their present terms and further moved that Robert E. Stegall from the Cave Spring Magisterial District be reappointed to a four-year term at the conclusion of his present term, which will expire January 26, 1980. This motion was approved unanimously. IN RE: APPOINTMENT OF AIR POLLUTION ADVISORY AND APPEALS BOARD Supervisor Johnson moved that the present members of the Air Pollution Advisory and Appeals Board be appointed to serve the balance of their present terms, which motion was approved unanimously. IN RE: APPOINTMENT OF BUILDING CODE BOARD OF ADJUSTMENTS AND APPEALS I Supervisor Myers moved that the present members of the Building Code Board of Adjustments and Appeals be reappointed to serve the balance of their present terms, which motion was approved unanimously. IN RE: APPOINTMENT OF INDUSTRIAL DEVELOPMENT AUTHORITY Vice Chairman Park moved that the present members of the Roanoke County Industrial Development Authority be reappointed to serve the balance of their present terms, which motion was approved unanimously. IN RE: APPOINTMENT OF COUNTY REPRESENTATIVES, SALEM-ROANOKE COUNTY CIVIC CENTER COMMISSION Supervisor Johnson moved that the present County representatives on the Salem-Roanoke County Civic Center Commission be reappointed to serve the balance of their present terms, which motion was approved unanimously. I IN RE: APPOINTMENT OF LIBRARY BOARD In the matter of appointing a Library Board (which has not existed since December, 1975) Supervisor Johnson recommended the appointment of Mrs. Patty Smith, 3526 Timberline Trail, Roanoke, Virginia; Supervisor Myers recommended Mrs. Bobbie Brightbill, 356 Inga1 Boulevard, Salem; Vice Chairman Park recommended Charles Jennings, 1112 Jeanette Avenue, Vinton; Chairman Terry 11III ~: 1-2-80 414 I recommended Ms. Sarah B. Hodges, 2224 Pelham Drive, Roanoke. ~ 1". After these nomi- nations, Supervisor Johnson moved appointment of the individuals, which motion was adopted unanimously. Note: Mr. Charles Jennings subsequently declined appointment. IN RE: RESOLUTION NO. 2477 REQUESTING THE CIRCUIT COURT OF ROANOKE COUNTY TO ESTABLISH A SCHOOL TRUSTEE ELECTORAL BOARD CONSISTING OF A MEMBER FROM EACH OF THE FIVE MAGISTERIAL DISTRICTS OF ROANOKE COUNTY. I BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. That pursuant to Section 22-60 of the Code of Virginia of 1950, as amended, the Circuit Court of Roanoke County, Virginia, is hereby requested to appoint a school trustee electoral board consisting of a member from each of the five magisterial districts of Roanoke County, Virginia; and 2. That an attested copy of this resolution be forthwith transmitted to the Circuit Court of Roanoke County, Virginia. On motion of Supervisor Johnson and adopted by the following recorded vote: AYES: Supervisors Johnson, Myers, Park, and Terry. NAYS: None. I At this point in the meeting, Chairman Terry invited any citizens in the audience who wished to speak to do so. Mr. Rich Harvey read a prepared statement in regard to the need for a Hollins District representative on the Boar of Supervisors to succeed Mr. R. Wayne Compton. IN RE: RESOLUTION NO. 2478 EXPRESSING THE BOARD OF SUPERVISORS. APPRECIATION TO R. WAYNE COMPTON FOR HIS SERVICE TO THE COUNTY OF ROANOKE AS A MEMBER OF THE BOARD OF SUPERVISORS OF ROANOKE COUNTY. County Attorney Buchholtz read this prepared resolution commending Mr. Compton for his service to the citizens of Roanoke County. Supervisor Johnson moved approval of the resolution; it was approved by a unanimous roll call vote and the text of Resolution No. 2478 is as follows: WHEREAS, R. Wayne Compton, the former supervisor from Hollins Magisterial District, was first elected to the Board approximately seven (7) years ago, and I has since been re-elected to that position by his constituents; and WHEREAS, during his tenure as a member of the Board of Supervisors of Roanoke County, R. Wayne Compton has served as both Chairman and Vice-Chairman 1-2-80 - 41 fi:':' I I I LD~'~ ." Of the Board and has further served the County and it's citizens tirelessly on various committees and commissions including the Fiftn-Uistrict Planning - Commission and the Board of the Roanoke County Public Service Authority; and WHEREAS, the citizens of Roanoke County, recognizing the many past contributions of R. Wayne Compton to the County of Roanoke, elected him to the post of Commissioner of the Revenue of Roanoke County, thereby necessitating his resignation from the Board of Supervisors of Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia as follows: r 1. That the Board does hereby express to R. Wayne Compton it's very deep and heartfelt appreciation for his long and dedicated service to the County of Roanoke and all it's citizens as the Hollins Magisterial District member of the Roanoke County Board of Supervisors and do further offer to him the Board's sincerest congratulations on his recent election as Commissioner of the Revenue of Roanoke County; 2. That an attested copy of this resolution, duly authenticated, be forth- with presented to R. Wayne Compton, Commissioner of the Revenue of Roanoke County, Virginia. sl Lawrence E.
