2/26/1980 - Regular 2-26-80 -- 46 Board of County Supervisors Salem-Roanoke County Civic Center Salem, Virginia February 26, 1980 The Board of County Supervisors of Roanoke County, Virginia, met this day I in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the second Tuesday and the first regular meeting of the month of February. Members present: Chairman Lawrence E. Terry, Supervisors May W. Johnson and Paul B. Matthews. Members Absent: Supervisors Edward C. Park Jr., and Robert E. Myers. Chairman Terry called the meeting to order at 6:20 P. M. and announced that opening business will include only routine matters; public hearings and other agenda items will not begin until 7:00 P. M. Supervisor Johnson immediately made a motion for the Board to go into Executive Session to discuss legal matters and the motion was adopted by a unanimous voice vote. I At 6:40 P. M. the Board adjourned from the Executive session and the meeting was reconvened on motion of Supervisor Johnson. Chairman Terry recognized County Administrator, William F. Clark, who then submitted to the Bord a report of the Agreement between Roanoke County and the Fifth Planning District Commission for 1979 Data Maintenance. RESOLUTION NO. 2508 AUTHORIZING AND DIRECTING THE COUNTY ADMINISTRATOR TO EXECUTE A CERTAIN AGREEMENT WITH THE FIFTH PLANNING DISTRICT COMMISSION ON BEHALF OF ROANOKE COUNTY UPON CERTAIN TERMS AND CONDITIONS BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. That the County Administrator be, and he hereby is authorized and directed to execute on behalf of Roanoke County a certain 1979 Data Maintenance Report agreement with the Fifth Planning District Commission, which agreement I shall contain provision for payment by the Fifth Planning District Commission to Roanoke County of the sum of $4,091.00, such payment to be for the County's sh~re of the report for work completed in 1979 by the County, such payment, however, to be made by the Fifth Planning District Commission in 1980. _ ....'~:-...x. .' /-,. ,. 466 t 2-26-80 2. That the form of such agreement shall be approved by the County Attorney prior to execution thereof by the County Administrator. On motion of Supervisor Johnson and adopted by the following recorded vote. AYES: Supervisors Matthews, Terry and Johnson ABSENT: Supervisors Park and Myers I NAYS: None Administrator Clark then submitted a Departmental Activities Report for the month of January, 1980, containing activities of the various departments of the County. The 1979 annual Report of the Planning Commission and Board of Zoning Appeals was submitted by Mr. Clark and filed with the minutes of this meeting. All reports were received by the Board on motion of Supervisor Johnson and adopted by a unanimous voice vote. Recess at 6:50 P.M. REGULAR MEETING 7:00 P. M. I Chairman Terry called the meeting to order at 7:00 P. M. and introduced Rev. Wayne O. Wingfield from the First Wesleyan Church, Salem, Virginia, who offered the invocation; Pledge of Allegiance to the flag was recited in unison. Chairman Terry explained to the public that Supervisors Park and Myers were out of town and would not be in attendance. IN RE: PUBLIC HEARINGS REQUEST OF CURTIS W. SWEENEY FOR A PERMIT TO PLACE A MOBILE HOY~ ON A 30.71 ACRE TRACT LOCATED ON THE SOUTH SIDE OF STATE ROUTE 785 (BLACKSBURG ROAD) APPROXIMATELY 1600 FEET WEST OF IT'S INTERSECTION WITH STATE ROUTE 311 IN THE CATAWBA DISTRICT. Chairman Terry asked if anyone was present to support or object to the I request. Mr. Sweeney was recognized and Tim Gubala, County Planner, was asked if he had anything to say about this request. He stated that Mr. Sweeney was planning to build a house on this site in two years and he suggested the permit be issued and inspection of the site be made at the end of that period. 2-26-80 -." 467 t A nearby property owner spoke in support of a two-year permit. MARTIN TO RENEW A PERMIT TO PLACE A MOBILE HOME ON A 4.5 ACRE TRACT LOCATED OFF THE WEST SIDE OF STATE ROUTE 690 APPROXIMATELY 0.8 MILE SOUTH OF IT'S INTERSECTION WITH U. S. ROUTE 221 IN THE WINDSOR HILLS MAGISTERIAL DISTRICT. Chairman Terry asked if anyone was present to support or object to the request; no one responded. Supervisor Johnson made a motion that due to this being a renewal, that it be approved and which was adopted by the following recorded vote: AYES: Supervisors Matthews, Terry and Johnson NAYS: None I REQUEST OF EVELYN J. DEHART TO RENEW A PERMIT TO PLACE A MOBILE HOME ON A 1.0 ACRE TRACT LOCATED ON THE NORTH SIDE OF STATE ROUTE 777, 0.2 MILE WEST OF IT'S INTERSECTION WITH STATE ROUTE 680 IN THE CATAWBA MAGISTERIAL DISTRICT. Chairman Terry asked if anyone was present to support or object to this request; no one responded. Supervisor M2tthews made a motion that this request be approved and which was adopted by the following recorded vote. AYES: Supervisors Matthews, Terry and Johnson NAYS: None REQUEST OF THOMAS O. SLONE TO RENEW A PERMIT TO PLACE A MOBILE HOME TO BE OCCUPIED BY VINNIE M. SLONE ON A 2.17 ACRE TRACT WITH AN EXISTING HOUSE LOCATED ON A PRIVATE DRIVEWAY RUNNING APPROXIMATELY 400 FEET NORTHWEST OFF STATE ROUTE 777 ACROSS FROM IT'S INTERSECTION WITH STATE ROUTE 807 IN THE CATAWBA MAGISTERIAL DISTRICT. Chairman Terry asked if anyone was present to support or object to this request; no one responded. FOR A "SPECIAL USE PERMIT" TO OPERATE A LANDFILL AT DUKE & EARL'S PRO- PERTY ON THIRLANE ROAD IN CATAWBA DISTRICT. Chairman Terry asked if anyone was present concerning this request; no one responded and Supervisor Johnson made a motion that this item be passed I over until later in the meeting, which motion was adopted by a unanimous voice vote. IN RE: COUNTY ATTORNEY Chairman Terry recognized James E. Bucnholtz, County Attorney, who stated that he had a resolution prepared to authorize the County to acquire a parcel of land for a well site. RESOLUTION NO. 2509 AUTHORIZING ROANOKE COUNTY TO ACQUIRE A CERTAIN WELL SITE LOCATED ON THE WILLIAM BYRD HIGH SCHOOL ~~ PROPERTY FROM THE ROANOKE COUNTY SCHOOL BOARD BE IT RESOLVED by the Board of Supervisors of Roanoke County, Virginia, as follows: 1. That the County be and it h-reby is authorized to acquire from the Roanoke County School Board a certain piece or parcel of land situate, I lying and being in the County of Roanoke, Virginia, on the William Byrd High School property, the same being a rectangular lot 100 feet by 100 feet, to be more particularly described in the deed of conveyance to Roanoke County. 2. That the County Administrator be, and he is hereby authorized and directed to accept such deed of conveyance on behalf of the County of Roanoke as made and provided by law, the same to be upon form approved by the County Attorney. On motion of Supervisor Matthews and adopted by the following recorded vote: AYES: Supervisors Matthews, Terry and Johnson NAYS: None Mr. Buchholtz then stated he had prepared resolution to authorize I the County to enter into an agreement for redemption of bonds of the Public Service Authority; resolution was read aloud by Mr. Buchholtz on the request of Chairman Terry. 2-26-80 ~r'_ 469, RESOLUTION NO. 2510 AUTHORIZING THE CHAIRMfN OF ., THE BOARD OF SUPERVISORS OF ROANOKE COUNTY TO ENTER INTO A CERTAIN AGREEMENT RELATING TO THE REDEMPTION OF CERTAIN BONDS OF THE ROANOKE COUNTY PUBLIC SERVICE AUTHORITY BE IT RESOLVED by the Board of Supervisors of Roanoke County as I follows: 1. That the Chairman of the Board of Supervisors be, and he hereby is authorized to execute on behalf of Roanoke County a certain agreement dated February 18, 1980, by and between the Roanoke County Public Service Authority, the County of Roanoke, the Colonial-American National Bank of Roanoke, IDS Life Insurance Company, Investors Syndicate Title & Guaranty Company, and Investors Syndicate of America, Inc. relating to the redemption of certain revenue bonds of the Roanoke County Public Service Authority; and 2. That the Clerk of the Board be, and he hereby is authorized and directed to attest the execution of the afore~aid agreement on behalf of the County of Roanoke; and I 3. That such agreement shall be executed and attested as aforesaid only upon form approved by the County Attorney. On motion of Supervisor Matthews and adopted by the following recorded vote: AYES: Supervisors Matthews, Terry, and Johnson NAYS: None County Attorney, James Buchholtz, then reminded the Board that they had before them a resolution dealing with the request for a referendum for $3.5 million dollars worth of bonds and this resolution is one which will provide for a referendum to be held May 6 to approve borrowing for renovation of the Courthouse. In addition thereto is a resolution requesting a referendum for $2,000,000.00 worth of bonds. This resolution is to provide for a referendum I to be held on M~y 6 to approve construction of certain new fire houses for the County. Chairman Terry asked if there was any comments from the public. No one responded. Supervisor Johnson reminded the public that a cowmittee had examined the present courthouse and stated that renovation was needed. RESOLUTION NO. 2511 AUTHORIZING THE ISSUANCE OF $3,500,000.00 OF GENERAL OBLIGATION BONDS OF ROANOKE COUNTY, VIRGINIA, AND PROVIDING FOR THE SUBMISSION OF THE QUESTION OF THE ISSUANCE THEREOF TO THE VOTERS OF ROANOKE COUNTY I WHEREAS, the Board of Supervisors of Roanoke County has heretofore recognized the need for the renovation and reconstruction of the Roanoke County Courthouse in order to provide adequate Court facilities for Roanoke County; and WHEREAS, the Board of Supervisors determines that it is advisable to contract a debt and issue bonds of Roanoke County in the aggregate amount and for the purpose hereinafter set forth and to request the Circuit Court of the County to make an Order as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of Roanoke County that said Board hereby determines that it is advisable to contract a debt in an amount not to exceed $3,500,000.00 and to issue general obligation bonds of Roanoke County of the maximum amount of $3,500,000.00, pursuant to the Public Finance Act to finance the cost of I renovation and reconstruction of Court facilities for Roanoke County, including the acquisition of real estate, if any. BE IT FURTHER RESOLVED that said Board respectfully requests the Circuit Court of Roanoke County to make an Order requiring the Judges of Election on the day fixed by the Order to open a poll and take the sense of the qualified voters of the County on the question of contracting such debt and issuing such bonds. BE IT FURTHER RESOLVED that the Clerk of the Board is hereby directed to certify a copy of this Resolution and to present it to the Judge of the Circuit Court for the County of Roanoke. BE IT FINALLY RESOLVED that the Clerk of this Board is hereby the Circuit Court for the County of Roanoke. On motion of Supervisor Johnson for a public hearing and adopted by the following recorded vote: AYES: Supervisors Matthews, Terry, and Johnson I NAYS: None IN RE: DIRECTOR OF FINANCE Report--Livestock Claims of Bobby E. Lambert John Chambliss, Director of Finance, stated that the reports, (filed with the minutes of this meeting), indicated Mr. Lambert is due $5.00 for a chicken killed by a dog,but the Animal Control Officer advised that it appears the other chickens in question froze to death rather than being killed by dogs. Chairman Terry then recognized Mr. Lambert who stated that the chickens were killed by dogs and that he had a witness, Blanche B. Pedneau, not present, who would verify his claim. Supervisor lfutthews then stated that he knows the witness, Blanche Pedneau, whereupon Chairman Terry suggested that this item should be carried over to the next meeting and he then asked Mr. Matthews I if he would be willing to talk with the witness; he replied that he would be willing to do that. On motion of Supervisor Johnson to carryover this item to the next meeting and adopted by the following recorded vote. AYES: Supervisors Matthews, Terry, and Johnson. NAYS: None Mr. Chambliss stated that he had prepared a resolution, on the request of Elizabeth Stokes, appropriating funds for the employees of the Clerk of the Circuit Court. The funds appropriated will be reimbursed by the Circuit Court for the payroll of said Court since employees would not be under the County's pay and classification plan. Foster who informed the Board of his actions on behalf of the possible employment of additional personnel I to the staff of the new jail. He stated his request for a prepared resolution to be adopted authorizing the employment of said personnel. Mr. Foster submitted a full report to the Board. RESOLUTION NO. 2514 AUTHORIZING AND APPROVING THE EMPLOYMENT OF FORTY-THREE ADDITIONAL PERSONS FOR THE SHERIFF'S DEPARTMENT OF THE COUNTY OF ROANOKE BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: 1. That, in view of the impending opening of the new Roanoke County jail, the Board does hereby approve and authorize the employment of forty-three additional persons for the Sheriff's Department of Roanoke County; to-wit, forty corrections officers, two cooks and one clerk- typist; and I 2. That the Clerk of the Board be, and he is hereby authori~ed and directed to forthwith transmit a copy of this resolution to the State Department of Corrections and the State Compensation Board. Rossie Jr., Director, Public Service Authority, who reminded the Board that the County has an option to purchase before February 28, 1980, the well designated as William Byrd Well #3, for the amount of $1.00 and requests that the Board exercise. this option. He stated the Public Service Authority had recommended purchase of this well. RESOLUTION NO. 251~ AUTHORIZING AND DIRECTING THE COUNTY ADMINISTRATOR TO EXERCISE A CERTAIN OPTION TO PURCHASE A CERTAIN WELL LOT FROM TEMPO HOMES, INC. BE IT RESOLVED by the Board of Supervisors of Roanoke County as I follows: 1. That the County of Roanoke having entered into a certain option agreement with Tempo Homes, Inc. to purchase a certain well lot designated as William Byrd Well #3, and it having been determined that it would be in the best interests of the County to exercise such option, the County does hereby exercise its option dated March 28, 1979, to purchase a certain well lot from Tempo Homes, Inc. for the sum of One Dollar; and 2. That the County Administrator be, and he hereby is directed to notify Tempo Homes, Inc. of the County's decision to exercise such option in writing on or before March 28, 1980; and 3. That an attested copy of this resolution be forthwith delivered On motion of Supervisor Johnson and adopted by the following recorded vote. IN RE: RESOLUTION NO. 2516 WAIVING THE TERMS AND PROVISIONS OF CHAPTER 20.1 OF THE ROANOKE COUNTY CODE AS SAME APPLIES TO A CERTAIN LOT SITUATE, LYING AND BEING ON OLD CAVE SPRING ROAD BE IT RESOLVED by the Board of Supervisors of Roanoke County as follows: I 1. That the terms and provisions of Chapter 20.1 of the Roanoke County Code be, and the same hereby are waived as same apply to a certain lot situate, lying and being on Old Cave Spring Road in Roanoke County to the extent that the connection charge in the amount of $864.00 shall not be required to be paid by Allen R. Moran in order to connect to the County's water system; provided however, an extension of the County water system shall be made by Allen R. Moran at a cost of $2925.00 and the County shall participate in such extension to the extent of $563.00, the same being comprised of $288.00 representing an equivalent to the County's capacity charge and an amount of $275.00 being the difference in materials cost between eight inch and six inch water line; and I 2. That the County Administrator be, and he hereby is authorized and directed to enter into agreement with Allen R. Moran embodying the above terms and condtiions, the same to be upon form approved by the County Attorney; and 3. That an attested copy of this resolution be forthwith delivered to the Roanoke County Public Service Authority and to Allen R. Moran. AYES: Supervisors Matthews, Terry and Johnson NAYS: None At this point, Chairman Terry asked if anyone had arrived to represent the request for a "Special Use Permit" for Joe Bandy & Son, Inc., Mr. Bandy I was recognized. Mr. Terry explained to Mr. Bandy that since Supervisor Myers was out of town he would suggest that this item be held over until the next meeting, March 11, if this was agreeable; he did so agree. On motion of Supervisor Johnson and adopted by a unanimous voice vote. - "416 2-26-80 IN RE: HEARING OF CITIZENS ON PUBLIC MATTERS Chairman Terry recognized Julia Reynolds representing the County Council of PTA's, who stated her desire on behalf of the PTA's, to thank the Board for the public hearing and proposed referendum regarding the appointment of the School Board. Mr. Terry thanked her for appearing. I Supervisor Johnson expressed her thanks and appreciation to the U. S. Hockey team and Eric Heinden for his medals at the Olympic games in New York. At 7:30 p.m. the Board concluded it's regular agenda and recessed. At 9:15 p.m. on motion of Mr. Matthews and a unanimous voice vote, the Board went into Executive Session. At 10:35 p.m. on motion of Mrs. Johnson and a unanimous voice vote, the Board reconvened.
