I The Board of County Supervisors of Roanoke County, Virginia, met this day in open session at the Salem-Roanoke County Civic Center in Salem, Virginia, this being the fourth Tuesday and the second regular meeting of the month. Members Present: Chairman R. Wayne Compton, Vice-Chairman Robert E. Myers, Supervisors May W. Johnson, Edward C. Park, Jr., and Lawrence E. Terry. Chairman Compton called the meeting to order at 7:04 p.m. and recognized Reverend W. F. McMahan, Locust Grove Methodist Church, who offered the invocation. The Pledge of Allegiance to the flag was given in unison. IN RE: APPROVAL OF MINUTES On motion of Supervisor Johnson and the unanimous voice vote of the Board, the minutes of the regular meeting held December 27, 1977 and the organizational meeting held January 2, 1978, were approved as spread. IN RE: APPLICATION OF GAY G. MARTIN FOR A SPECIAL EXCEPTION TO PARK A MOBILE HOME ON A 15.28-ACRE TRACT LOCATED ON THE WEST SIDE OF STATE ROUTE 690, 0.8 MILE SOUTH OF ITS INTERSECTION WITH ROUTE 211 IN THE VICINITY OF POAGES MILL I The public hearing on the application of Ms. Martin had been continued from the January 10, 1978 meeting due to certain area opposition and the fact that the applicant, or someone representing the appl icant, was not present. At this point, Chairman Compton opened the floor for publ ic comments. Ms. Lorraine Brown, daughte of the appl icant, was present on behalf of Ms. Martin. No one appeared in opposi- tion to the request. Supervisor Terry moved that the appl ication of Gay G. Martin be approved subject to the provisions of the County Zoning Ordinance as it pertains to mobile homes, which motion was adopted by the fol lowing recorded vote: AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None IN RE: PETITION OF EDWARD R. AND DORIS B. GRAHAM FOR THE * I SSUANCE OF A "USE NOT PROV I DED FORII PERM I T TO ALLOW", THE REPAIR AND SALE OF FARM IMPLEMENTS FOR A TRACT OF * LAND CONTAINING LESS THAN ONE ACRE AND LOCATED ON THE * SOUTH SIDE OF U.S. ROUTE 11-460, 1,250 FEET EAST OF * THE ROANOKE/MONTGOMERY COUNTY LINE * NOW, THEREFORE, BE IT RESOLVED AND ORDERED that in this meeting of the FINAL ORDER I Board of Supervisors of Roanoke County, Virginia, held on the 24th day of January, 1978, the said Petitioner is hereby granted a use not provided for permit for the sale and repair of farm implements for a period of three years, in order that said propoerty might be more fully and reasonably used, the said property being more particularly described as follows: Less than one acre, to-wit: BEGINNI~IG at a point on the Southerly side of U.S. Route 11, where it intersects with the northwestern most parcel of land heretofor conveyed to Edward Roll in Graham and Doris B. Graham, said property being shown on a plat of survey prepared by T. P. Parker, S.C.E., dated August 29, 1-24-78 ,~ fl 9 1956; thence with the southerly line of U.S. Route 11, S 580 30' N 150 feet to a point; thence leavinq the south side of U.S. Route 11, 0-0 S 15 181 W 225 feet to a point; thence N 92 30' E 150 feet to a point on the western most boundary of the property of Edward Rollin Graham and Doris B. Graham; thence N 150 181 W 225 feet to the place of BEGINNING; and Be it further resolved and ordered, that the Clerk of the Board shall forth with certify a copy of this resolution and order to the Secretary of the Planning Commission of Roanoke County, Virginia, and a copy to Robert P. Doherty, Jr., Attorney for Petitioner. In relation to the above request, Mr. Robert P. Doherty, Jr.,'Attorney, appeared on behalf of the petitioners. Mr. and Mrs. Graham were also present. At this point, Chairman Compton opened the floor for publ ic comments. By a show of hands, three persons appeared in opposition. Mr. Doherty advised that the petitionE rs wished to withdraw their original request for rezoning to M-l to allow for the repair of trucks and request the issuance of a "Use Not Provided For" permit for thE repair and sale of farm implements. Mr. Doherty further noted that the "Use Not Provided For" permit is in accordance with the Planning Commission recommendation. Persons opposing the request were opposed to the rezoning only, and no one expresse( opposition to Mr. Graham continuing his present operation. This concluded the publ ic hearing, and Supervisor Myers moved that the Boar( concur with the Planning Commission recommendation and approve the issuance of a "Use Not Provided For'l permit for the sale and repair of farm implements for a period of three years. The motion was adopted by the following recorded vote: I AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None I IN RE: APPOINTMENT - FIFTH PLANNING DISTRICT COMMISSION Pursuant to a communication received from the Fifth Planning District Commi - sion advising that Roanoke County is entitled to three (3) elected officials in addi~ion to the two (2) citizen representatives on said Commission, Supervisor Johnson moved that Supervisor Park be appointed to fill the unexpired term of former Supervisor Tompkins on the Commission, which term ends July I, 1979. The motion was adopted by the unanimous voice vote of the Board. IN RE: RESIGNATION OF MRS. JUANITA KESLER ON FIFTH PLANNING DISTRICT COMMISSION The Fifth Planning District Commission advised that Mrs. Juanita Kesler, Roanoke County's citizen representative on the Commission, has missed six consecu- tive regular Commission meetings. Mr. Myers advised the Board that Mrs. Kesler had contacted him and submitted her resignation from the Commission. Supervisor Myers moved that the Board accept the resignation of Mrs. Juanitc Kesler on the Fifth Planning District Commission, which motion was adopted unani- mously. I IN RE: ROANOKE COUNTY RESCUE SQUADS - REQUEST FOR FUNDS In relation to the request of Roanoke County rescue squads for assistance in purchasing two-way radios, Mr. Barry Tayloe, member of the Cave Spring Rescue Squad, was spokesman. Mr. Tayloe briefly explained the nature and reason for re- questing the funds. He advised that approximately one-quarter mill ion dollars had 1-24-78 270 been raised, but some of the squads are experiencing difficulty in allocating funds towards the purchase of the radios. Other rescue squad representatives were presen~ and spoke in regard to this request. Supervisor Johnson directed that an appropriation resolution be prepared for the next regular meeting for the Board1s consideration. I IN RE: GLIDDEN PAINT STORE - DENIAL OF WAIVER OF WAtER ORDINANCE I Mr. G. Franklin Flippin, Attorney, appeared before the Board and requested the Supervisors to reconsider their denial of a waiver of the County's water ordi- nance for Glidden Paint Store, which matter was considered by the Supervisors on December 27, 1977. Mr. Fl ippin advised that his clients had connected with Craighead Water Company, a private water company, before the matter had been formally acted upon by the County. Mr. Myers, the Supervisors' liaison representative on the Publ ic Service Authority, advised that the matter had been considered by the PSA on December 19, at which time it was recommended that the request for waiver be denied. Mr. Myers also reaffirmed the action taken by the Supervisors on December 27 to deny said request. Mr. Victor Ludwig, representing Craighead Water Company, was also present and advised that the Paint Store is within the franchise area granted Craighead by the State Corporation Commission. County Attorney Dean Foster advised that the State Corporation Commission does not have any jurisdiction over a local governing body. Mr. T. A. Carter, one of the owners of Craighead Water Company, was present and also questioned the County's action to deny the request for waiver. There being no further comments, Supervisor Myers moved that the Board reaffirm its previous action and enforce the County1s water ordinance, which motior was adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Compton NAYS: None ABSTAINING: Mr. Terry I IN RE: RESOLUTION NO. 1976 APPROVING THE TEXT OF A LOCAL HISTORICAL MARKER WHEREAS, the Board of County Supervisors of Roanoke County have been re- quested by representatives of Hollins College, pursuant to the laws of the Common- wealth of Virginia, to approve the accuracy of bhe text of a historical marker to be erected upon the right of way of a public highway commemorating a local aspect of history; and WHEREAS, after due consideration of documented research, the Board is of opinion that the text as hereinafter cited is a true and correct statement of a local aspect of history. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roano e County that the following text be, and the same is hereby, approved as a true and correct statement of a local aspect of history: HOLLINS COLLEGE First chartered college for women in Virginia, established 1842. Led for 87 years by Charles L. Cocke and his daughter Matty L. Cocke, first woman president of a Virginia college. 1-24-78 27] BE IT FURTHER RESOLVED that, as required by the laws of the Commonwealth of Virginia, said historical marker shal I display the hereinabove-cited text and shall display on the face of said marker prominent notice of the Board of Supervisors of Roanoke County. BE IT FINALLY RESOLVED that the County of Roanoke shall bear no expense in the design, manufacture or erection of said historical marker. On motion of Supervisor Myers and adopted by the following recorded vote: AYES: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton I NAYS: None IN RE: RESOLUTION NO. 1977 AUTHORIZING AN AMENDMENT TO A CONSULTANT CONTRACT AND A LOAN FROM THE GENERAL FUND TO THE GRANTS PROJECT FUND WHEREAS, the Board of County Supervisors has heretofore entered into a consultant contract with Daniel A. Robinson and Associates for the County Capital Improvements Program; and WHEREAS, the County Planner, in a report to the Board dated January 24, 1978, has recommended that said consultant contract be amended to include additiona tasks to be performed by the consultant at an additional fee to the County; and WHEREAS, the Board is of opinion that the consultant contract amendment at the fee recommended in said report is in the best interest of Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that the Task Order attached hereto as Exhibit "A" be, and the same is hereb , approved as an amendment to the consultant contract of date October 3, 1977, with Daniel A. Robinson and Associates. BE IT FURTHER RESOLVED that the County Executive be, and the same is hereby authorized to execute said amendment to the consultant contract on behalf of the County. I BE IT FURTHER RESOLVED that said Task Order be, and the same is hereby, approved for a fee not to exceed $4,000.00. BE IT FINALLY RESOLVED that a loan of $8,000.00 from the General Fund to the Grants Project Fund be, and the same is hereby, authorized to provide operating funds for the Capital Improvements Program Study; the General Fund to be reimbursed when State and Federal funds are received. IN RE: RESOLUTION NO. 1979 REQUESTING THE SOIL CONSERVATION SERVICE, USDA, TO REACTIVATE AND UPDATE THE SOUTH FORK ROANOKE RIVER WATERSHED WORK PLAN I WHEREAS, a P.L. 566 work plan for the South Fork Roanoke River Watershed, Floyd, Montgomery and Roanoke Counties, State of Virginia, was prepared November 26 1965, by some of the undersigned sponsors (and others) with assistance of the Soil Conservation Service, USDA: such plan proposed the construction of four sing1e- purpose floodwater protection dams and approximately seven miles of channel modifi- cation for flood protection, and various land treatment measures for watershed protection; and WHEREAS, the plan was authorized for construction by the Congress of the United States on August 31, 1966; and WHEREAS, an attempt was made in June 1970 to add municipal water supply in two dams through a supplemental watershed work plan agreement; such agreement never being executed; and WHEREAS, the South Fork Roanoke River Watershed Project was placed on the inactive list by the Soil Conservation Service, USDA, as of June 30, 1974, because of lack of tangible progress made toward implementing the plan by local sponsoring organizations; and WHEREAS, the local sponsoring organizations, including the jurisdictions of Montgomery County, Floyd County, Roanoke County and the City of Salem have renewed interest in solving the problems of flooding on the Roanoke River, municipal and industrial water supply needs, water-based recreational needs, and the promotion of good watershed protection and land conservation practices. NOW, THEREFORE, THE fOLLOWING BE AND HEREBY IS RESOLVED by the Board of County Supervisors of Roanoke County: 1. This body petitions the Soil Conservation Service, USDA, to undertake a revision of the South Fork Roanoke River Watershed Work Plan, to begin as soon as practical and possible. 2. This body requests cooperation in this venture from the other sponsoring municipal ities involved and from the various boards, commissions, agencies of federal and state government, and authorities who might contribute to the watershed plan revision and its implementation. 3. This body indicates its sincere interest in solving the problems cited and intends that if a mutually agreeable and financially feasible plan be developed, this governing body will support the implementation of such plan with the resources of its command. This body represents that it, or agency of it, is vested with authority to raise tax revenue to support the construction of water impoundments; to issue bonds as provided in the Code of Virginia for the financing of certain portion of the project; to operate and maintain structural measures; and to secure land easements and rights necessary to provide such improvements. On motion of Supervisor Myers and adopted by the following recorded vote: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None I IN RE: FINANCIAL STATEMENT The Financial Statement for the six-month period July 1, 1977 through December 31, 1977 was for information of the Supervisors and is filed with the minutes of this meeting. IN RE: RESOLUTION NO. 1980 DESIGNATING THE NAME OF A PUBLIC STREET AS COLUMBINE LANE WHEREAS, there exists an unnamed public road duly accepted by the Board of County Supervisors on December 28, 1976 located on the north side of Stonington Road (Route 1892) approximately 190 feet east of Goodland Avenue (Route 1893) and extending in a northerly direction for a distance of 0.15 mile and, WHEREAS, the property owners and residents along this road are desirous to name said road Columbine Lane and, WHEREAS, pursuant to Section 15,1-379 of the Code of Virginia, as amended, the governing body of any County authorized by resolution duly adopted may name streets, roads, and alleys therein outside the corporate limits of towns except those primary highways conforming to Section 33.1-12 of the Code of Virginia, as amended. I NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that the above-mentioned public road extending from Stonington Road (Route 1892) approximately 190 feet east of Goodland Avenue (Route 1893) for a distance of 0.15 mile be and hereby is officially named and designated as Columbine Lane. BE IT FINALLY RESOLVED that the sum of $39.00 be, and the same is hereby, approved toward the erection and cost of said street sign, such funds being include in the 1977-78 Roanoke County budget. On motion of Supervisor Johnson and adopted by the unanimous voice vote of the Board. IN RE: RESOLUTION NO. 1981 DESIGNATING AN UNNAMED PUBLIC ROAD AS SHEILA LANE WHEREAS, an unnamed public road located between Farmington Drive and Luwana Drive in the Nottingham Hil Is Subdivision area is presently unnamed and, WHEREAS, the residents along this road are desirous of a name so that they may receive postal deliveries and, WHEREAS, pursuant to Section 15.1-379 of the Code of Virginia, as amended, the governing body of any County authorized by resolution duly adopted may name streets, roads, and alleys therein outside the corporate limits of towns except those primary highways conforming to Section 33.1-12 of the Code of Virginia, as amended. I NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County, Virginia that an unnamed public road extending from Farmington Drive to Luwana Drive, a distance of 0.14 mile, be and hereby is officially named and desig- nated as Sheila Lane 1-24-78 2'14 On motion of Supervisor Terry and adopted by the unanimous voice vote of the Board. I IN RE: RESOLUTION NO. 1982 APPROVING SALARIES OF EMPLOYEES OF THE OFFICE OF THE CLERK OF THE ROANOKE COUNTY CIRCUIT COURT WHEREAS, the budget for the Office of the Clerk of the Circuit Court (a Constitutional Office), is approved by the State Compensation Board on a calendar year basis; and WHEREAS, a portion of the salaries and office expenses of this office are returned to the County based on this budget approved by the Compensation Board; and WHEREAS,"as the individual salaries approved by the Compensation Board do not directly correspond to the Grade/step increments of Pay Plan of Roanoke County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that the salaries of G. I. Buckland, L. M. Burris, P. A. James. C. E. Lester V. L. Leonard, S. W. Nevergold, C. W. Webber, and N. T. Wright, employees of the Office of the Clerk of the Circuit Court, be approved at the rate establ ished by the Compensation Board, retroactive to January 1, 1978, with all replacements begin ning employment at the proper beginning Grade/step of the County Pay Plan. On motion of Supervisor Myers and adopted by the following recorded vote: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None AYES: NAYS: IN RE: MEETING WITH SHERIFF DEPARTMENT PERSONNEL I Chairman Compton advised that he was in receipt of a communication from Sheriff O. S. Foster requesting a meeting with the Supervisors for some of his supervisory personnel to discuss personnel matters and matters in relation to their employment with Roanoke County. The Supervisors agreed to meet with said personnel on Tuesday, February 14, 1978 at 6:00 p.m. in Section of the Community Room at the Salem-Roanoke County Civic Center in Salem. IN RE: MEETING WITH JOHN NEWSON Mr. Myers advised that he was in receipt of a communication from Mr. John Newson requesting an opportunity to meet with the Supervisors and the Director of Parks and Recreation to answer and clarify certain questions Mr. Newson has raised in regard to the Parks and Recreation Department. Mr. Myers then moved that the County Executive be directed to correspond with Mr. Newson and set a date for a meetIng with Mr. Newson and advise the Board members. I IN RE: REFUSE COLLECTION On motion of Supervisor Johnson and the unanimous voice vote of the Board, the County Executive and staff was this date directed to study and report back to the Board the feasibility of including residential refuse collection in the budget as a tax-supported service, including the designation of service districts wherein door-to-door collection would be provided. 1-24-78 IN RE: RESOLUTION NO. 1983 AUTHORIZING THE RENEWAL OF THE COUNTY'S CONTRACT WITH BLUE CORSS/BLUE SHIELD OF SOUTHWESTERN VIRGINIA WHEREAS, the Board of County Supervisors has heretofore enetered into a contract with Blue Cross/Blue Shield of Southwestern Virginia to provide for group hospital ization and medical insurance for County employees; and WHEREAS, said contract contains a renewal provision, which renewal provisio must be executed prior to March 1, 1978; and WHEREAS, the County Assistant Director of Finance has, with the concurrance of the County Executive, recommended in a report dated January 24, 1978, that said contract be renewed for a period of one year. I AYES: NAYS: NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that said Board hereby approves the renewal for a period of one year of the County's contract with Blue Cross/Blue Shield of southwestern Virginia, which contr ct provides for group hospital ization and medical insurance for County Employees. BE IT FURTHER RESOLVED that the County Executive be, and he is hereby, authorized and directed to execute the necessary documents renewing said contract for a period of one year. On motion of Supervisor Park and adopted by the following recorded vote: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None At 9:00 p.m., Supervisor Johnson moved that the Board go into Executive Session to discuss legal matters, which motion was adopted by the following recorde vote: AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Park, Mr. Terry, Mr. Compton None I At 10:40 p.m., the Supervisors returned to the meeting room and on the motion of Supervisor Myers and the unanimous voice vote of the members, the Board reconvened in open session. IN RE: APPOINTMENT - FIFTH PLANNING DISTRICT COMMISSION Supervisor Johnson moved that Mr. James R. Jones of the Vinton area be appointed to serve as one of the County's two citizen representatives on the Fifth Planning District Commission for a three-year term beginning February 1, 1978, and ending February 1, 1981. The motion was adopted unanimously. IN RE: RESOLUTION NO. 1984 AUTHORIZING THE EXECUTION OF AN ADDENDUM TO THE WATER AND SEWER CONTRACT WITH ROANOKE CITY WHEREAS, by Resolution No. 1961 adopted by the Board of County Supervisors of Roanoke County on December 27, 1977, said Board did authorize its Chairman to execute a contract with the City of Roanoke providing for the sale, conveyance and exchange of certain water and sewer 1 ines and further providing for the purchase of bulk water from the City of Roanoke upon certain terms and conditions; and WHEREAS, by letter dated January 19, 1978, the Board of Directors of the Roanoke County Public Service Authority has recommended to the Board of County Supervisors that an addendum be attached to said contract to provide terms under which the County would be authorized to purchase and intergrade the Hunting Hills- Craighead water systems into the Roanoke County water system; and I 1-24-78 2'16 I WHEREAS, the Board is of opinion that said action should be taken. NOW, THEREFORE, BE IT RESOLVED by the Board of County Supervisors of Roanok County that the following terms be included in an addendum to be attached to the contract of date December 27, 1977, previously authorized for execution by Resolu- tion No. 1961, said addendum to be in a form approved by the County Attorney: 1. The County shall have authority to purchase the Hunting Hil Is-Craighead water systems in southwest Roanoke County and to continuously utilize the wells presently in existence in said system to serve existing and new customers within the present service area of said systems. 2. The service area of said systems may be expanded should the City not have a water line capable of serving said new area within 2,000 feet of said area as set out in Paragraph 2.8. of the December 27, 1977, contract between the City of Raonoke and the County of Roanoke. BE IT FURTHER RESOLVED that the Chairman and the Clerk be, and the same are hereby, authorized and directed to execute said addendum on behalf of Roanoke Count On motion of Supervisor Myers and adopted by the following recorded vote: AYES: NAYS: Mrs. Johnson, Mr. Myers, Mr. Compton Mr. Park, Mr. Terry This concluded the business before the Board at this time and on the motion of Supervisor Myers and the unanimous voice vote of the members, the meeting was adjourned at 10:50 p.m. I CHAIRMAN I
